His mental instability was at least somewhat clear, and should have been brought to the judges attention. There might not have been much that could have been done to prevent this, but he should have at least been put on a terrorist watch list if he wasn't already.

EDIT: I will add since some people didnt want to watch an uncut video of the trial or all the videos related to the shooting, but it was confirmed one of the men he shot (Rosenbaum) said very racist slurs during that riot and that Kyle went to the protest after he was paid to protect a store.
