I got hit nov.5, still hasnt been settled since then, i fear its more due to the holidays and bad timing but it has been stretched out, is it time to get a lawyer or should i try to fight it out more?
I had run over a boulder along side of driveway. I filed claim. Got 3 estimates. I pay deductible because broad collection & my fault. But had to wait 3 months to get appt at backed up collision shop. Allstate CLOSED MY CLAIM MONTHS BEFORE I EVEN TOOK MY TRUCK IN FOR REPAIRS. They gave me a check for around $1000. All 3 estimates are for around $5000. I not have collision claim since 2019. I not have these horrid problems in past claims.
My mom got rear ending By a girl who had all state insurance. The girl had no idea where she was or what happened. Ultimately, she was taken away in handcuffs for DWI. It's been 2 weeks in all States since they can't get ahold of her, gotta wait for this and that. Exactly what you're describing. She had to have a cat scan and, at minimum, had a concussion and has been having dizzy spells (i know she's actually hurt bc she is by far the most honest person i know). My mom's insurance company (progressive) is starting to handle the claim. Meanwhile, my mom will have to pay a deductible, rental car, and the possibility of rates going up as a consequence. I've told my mom to pump the breaks and hold up. There's no hurry bc we have an extra vehicle she can use. For me, it's the principle of them being able to cause her all this pain, and they will get away without having any responsibility. I was going to foia the bodycam footage of the girl getting arrested. Do you think that would be helpful? Thank God for good people like yourself, who put out videos like this, making people aware of their tricks (imo it's fraudulent and borderline criminal). I'm only gotten to the 1st couple minutes of your video. I had to stop and send it over to my mom bc what you're describing is exactly what their doing. I feel like it's even more important to hold them accountable because it wasn't just that their insured driver was at fault, they were criminally negligent imo. I'm going to go ahead and finish the video, but are there any other tips or advice you'd be willing to share? I know she's not latigious, but I feel like she should speak with a lawyer? Of course, you can always use something called subrogation. That is, you turn the matter over to your insurance company and you get the benefits of your policy -- rental car, repairs, medical, etc. -- paid by your insurance company. And then your insurance company goes after the insurance company representing the at-fault person (who caused the accident) to get reimbursed.
This is true. Unfortunately, not everyone knows about things like rental insurance or medpay so they don't always have enough from their insurance policy to help them until the at fault party's insurance pays up.
We do not provide a rental or estimate to non allstate customers until we talk to our customer to do due diligence in investigating. Can you imagine your insurance company paying out of your policy without talking to you first? We give that courtesy to our customers. They have 14 days to respond. 99.999% the customer is able to be reached in three days. We also investigate to AVOID RAMPANT FRAUD. I only depend on a police report if a party is not responding in the investigation or the situation is word versus word and can't be determined with the statements or photos. If you need a rental and estimate immediately go through your own insurance company and they can subrogate (bill them) the other insurance company. If you're injured, TELL YOUR ADJUSTER. Communication is a two way street. Follow up with us too! We have VERY HIGH workloads. If your adjuster I'd unavailable, press '0' to get assistance from a team member. If you are THAT injured. Get treatment. I can only provide you with a bigger settlement if you have records PROVING your injuries and PROVING your limited life functions. Just "taking your word" for it and asking for 30k for a soft tissue injury is not going to work and you're out of your mind. This is not a "trust me bro" situation. Document, document, document. Also, don't record people. Unprofessional and stupid idea. Ask the adjuster to send a email to you recapping your discussion. Get everything in writing. This guy is not being honest at all. It's like accusing someone of breathing as stealing oxygen produced by trees. Completely spins every little thing to sound as dramatic as possible to get your business. Do your homework people.
