$16,000 Annual Gift Tax Exclusion: Here's What You Need to Know | Rob.CPA

  • In this video, I walk through the basic rules around gift tax rules.
    For the 2022 tax year, the annual exclusion limit for recipients is $16,000. So if you give someone $16,000 or less, the amount received by the recipient is not taxable, but you as the giver, cannot deduct this amount on your tax return.
    If you’re married, the annual exclusion in 2022 is $32,000.

    If you gift over the annual exclusion of $16,000, then you will need to file a Gift Tax return, FORM 709. You may not have to pay tax, but you will need to file the form. The form is used to notify the IRS of amounts gift over the annual exclusion.
    For married couples, that amount of annual exclusion is $32,000.
    For the 2023 tax year, the annual exclusion is $17,000 per recipient.
    We see a lot of our clients use this gift tax rule to provide gifts to their children. For example, contributing to their children’s 529 plan or contributing to their grandchild’s 529 plan.
    Remember, the annual exclusion in 2022 of $16,000 is per recipient. So, I could gift $15,000 to one person, then $15,000 to another person, then $15,000 to another person, all in 2022 and still follow the rules.
    In 2023, everyone’s lifetime exclusion is $11,920,000. BEWARE, this amount may decrease in 2026 as some tax laws plan to expire that year, this being one of them.
    Knowing how the gift tax rules work, you can think about future planning strategies.

    Basically, in 2023 if you gift over the annual exclusion limit you have to report it, but you will not owe any taxes on gifts unless you exceed the lifetime gift allowance. Which, is a moving target set by Congress.

      Yes, that is correct. Gifts over the annual exclusion need to be reported on a gift tax return and counted toward your lifetime estate

    Please make sure that people know this monetary gift has to come from the donor/giver's After Tax Funds.

    I have a question, maybe you can put it into a video. You gift them under the 16000 value of gift so you don't have to report it to the irs. BUT
    1. do you have to have proof of the transaction ?
    2. do you use it as a expense into your business? / Or is it that you just ignore it completely?
    3. And if you use your business checking to pay your children a gift tax will that cause you a audit? Or its best to pay through personal account?

    Thank you Rob for the video. I was wondering, if a non US citizen and nonresident of US gifts say (as an example) US $70K to her child (money being transferred from outside of US to a bank in US of the child) who is an adult US citizen, will the donor still need to file form 709, and if she has to file it, then does she get the annual exclusion and life time credit?

    Hi, For spouse, do we still report it and file schedule A and 709 for 50% of the value of each property?
    We have some properties bought after marrying, in one person's name, and in a common law state. We are going to file a new deed with both names. It sounds like both because we are in a common law state and the spouse exclusion that no tax will be due. We realize that in a common law state, there is a case for not doing it, but we are preparing for a 1031 future transaction and need to align names across property deeds.

    What if you are the recipient of a gift well over the annual limit? What IRS form do I have to fill out disclosing that I received a gift?

      Good question. The person that gave the gift in excess of the annual limit files form 709

      Yes, you can gift the same person each year. If its under the annual limit, then the receiver of the cash doesn't pay tax and you don't have to claim it.

    If a husband and wife gift $100k to a child, do both husband and wife need to file form 709 or can one parent file the return if not concerned about the lifetime exclusion? If both need to file, is each return showing 50% ($50k) of the total gift? Or do both file with the full gift amount of $100k? Thank you

      If they are filing a married joint return, then one form can be filed, but both need to sign it. Did the money come from the joint account or from the husband or wifes account?

      Assuming the house is over $16,000 in value, you would have to complete the gift tax return.

    How about if I gift my 20 year old daughter $20k cash and she wants to deposit it into her checking account. Can I get away with not filing a form 709?

      are you married...if so, you can gift her $20K and say its from you and your spouse.

    If I add my best friend in my second hand car title along with my name, as joint tenants with right of survivorship, is this considered a gift? If so If fair market value of car is 17000$, then 17000$ is gift amount? Or 17000$/2 is gift amount?

      It sounds like you are creating a "will" / surviorship if something were to happen to you. You own your car, but if I understand you, if something happens to you, then the car goes to your friend...that wouldn't be considered a gift.

      You can directly "gift" an IRA. You would have to withdraw the funds, which could be taxable to you.
      It also depends on your situation - your age and if the funds are in a IRA vs. Roth IRA, etc.

    My Grand Niece has 5 kids, all under 18 years old, can I give $16,000 to her and each of her kids and the total money be used by her for living expense for her and her kids without reporting these five gifts to the IRS

      Yes, that is correct. if you gift $16,000 each to your grandchildren, there is no tax that you have to pay...just make sure there is a paper trail and the grandkids should have bank accounts set-up too.

      Yes, your mom can gift you $16K a year and you can use that to pay for what you want.
