    not-so-fun-fact: Harry Roque, who was one of Laude's family's attorneys, later became the press secretary for the Duterte Administration and defended the choice to pardon Pemberton. He later ran for senate this year and very deservedly lost.

    As an American, this sh*t is straight up embarrassing. I'm fully aware of what US soldiers get away with (actually, apparently just the surface bc those numbers were alarming).
    "Panic" should not be an excuse. Imagine being like "your honor, this person was gay, and I'm not, so I had to k*ll them. You get it, right?" Is that not a hate crime by definition?
    At no point is someone's orientation or gender justification for murder, and how dare both governments agree that it is.
    He got off free bc she was trans. There's nothing else to it.
    Imagine if a Phillipines soldier murdered an American woman on our soil. Imagine the outrage and the manhunt. This should be no different.

      To be fair, you can acknowledge the intent of the perpetrator and argue for mitigating circumstances without claiming that it's okay. Regardless, it doesn't excuse the cruel murder of an innocent woman and his defense falls dead in the water since he went out of his way to murder Laude.

    Jennifer was only 26 when she died. She had a lot of life left to live. It's sad to see someone's life cut so short. I hope one day her family can find justice and peace.

      She kinda sounded like a badass. Paying to repair her family’s home, even helping her neighbors financially. What a sweet soul she sounded like. It’s so sad what happened, and so sickening how her case was handled.
      Her mom was a badass too. “Just because we are poor doesn’t mean we can’t fight” Jennifer was definitely her daughter!

    The fact that Jennifer was so close to living the life of her dreams with her soulmate made this even more crushing…. If only she’d been able to leave just a little sooner. I’m so sorry for that sweet lady. And I am so sorry for her family and her fiance.

      1: She, not they. (you clearly aren't talking about both her and her fiance since he wasn't involved in any "sexual activities.") Using "they" for transwomen isn't some neutral stance, is still misgendering, and is, to be concise, a dick move.
      2: She was supporting herself and others with her sex work, and until she could actually leave and start making money in Germany, she has to work still. While we can't know how her fiance felt about this, this isn't any sort of mitigating factor to her murder. Even if we assume he was unaware and not okay with it, infidelity doesn't warrant a death sentence.

      So, are you claiming that her murderer deserves a lighter sentence because he murdered a sex worker? Or that infidelity warrants a death sentence? Or, we can look behind the implied door 3 and ask if you're saying that her life didn't matter due to her being trans. Because I struggle to imagine you'd be trying to make these points if a cis person was the subject of this video.

      @K.M.V S norways prison systems are based on rehabilitation rather than punishment, unlike the United States. Recidivism is incredibly low in norway because of this. Prison systems based on true rehabilitation rather than punishment often have very little issues with reoffenders.

    As a Filipino, I'm thankful that you covered this story, but there's something that people should know. Though the country is very conservative, but it has the highest level of tolerance in Asia. Now the keyword here is TOLERANCE, not acceptance. The Philippines is the most lgbtq+ friendly country in asia, but that does not mean that the majority of Filipino's accept them. Homophobia and transphobia is still very much a thing in the country, so LGBTQ+ individuals are very rarely treated the same way a cis person is treated. Though there are progress being made, it will take some time, but the most important step has already been established, as tolerance comes first before acceptance.

    Absolutely no relation to this guy. But I remember when this case happened very well. When this all happened I used to be very active in Facebook and had a lot of Filipina friends online that I used to chat daily. I probably received 100 different messages from my foreign friends asking me if I knew this guy or if I was related lol it was wild. It's sad Laude received no justice in this case. Pemberton should've been prosecuted to the fullest.

    I feel so sad for Jennifer. She was beautiful inside and out and truly valued her relationships with the people around her. The generous nature of her despite being poverty stricken gives me so much added anguish since people like her are few and far between these days. The Philippines lost a truly beautiful treasure who demonstrated kindness and support to her community and acceptance to the others struggling with their own sexuality. I sincerely hope one day Jennifer gets justice and in the meantime I pray she's in a place where she's free of pain and any other negative feelings and she's flourishing in the place we all go once we leave this earth❤️😭

There's a lot of different opinions on how "love" and sex work affect each other, but if they were both okay with it I don't think it really matters. I think making assumptions on if she was really "in love" with him or not, just because she was a sex worker, is a little strange. Mark could also have just been okay with it, though to be fair filipino mail order brides are really common and there was most likely some level of that in their relationship. I just don't really think it's fair to assume a dead lady wasn't "in love" because of that. Like she's already dead man, give her a break. Lmao.     Oh my god. I am from the area where the killer is from. A classmate of mine, whom I immediately got bad vibes from, told me a story about his cousin. It went something like this, "Yeah, my cousin joined the marines. He got stationed in the Philippines a few years ago and told me about this tr***y that tricked him so he snapped his fucking neck." Saying all of this while laughing and continuing on to make more horrifically violent transphobic remarks. I was horrified but did not know what to say. I was 17 at the time and being given a hard time by this boy and his group of friends anyway. I didn't want to get jumped (which they threatened to do on multiple occasions) so I just ignored it. Even had I said something to someone, I'm not sure what could have or would have been done. The administration of this school did not discipline students in the slightest for this kind of thing. I didn't know if he was telling the truth at the time but this story has so many similar details that I'm thoroughly convinced that Jennifer Laude is the victim of this kid's cousin. And he bragged about it. It sickens me to this day to think about it.

    at least once a year, local Philippine media outlets and LGBTQIA+ communities would remember Jennifer Laude and it's really heartbreaking to see that the majority of the Filipino commenters would laugh and make a joke out of her case saying Pemberton was shocked he saw a penis as if a person's life is a laughing matter and that the situation would warrant a violent death.

      It obviously doesn't deserve a violent death but the situation does raise questions around the issue of informed consent. If someone doesn't want to engage in sexual contact with a trans person that's their prerogative. You can argue that such a belief is bigoted but if they don't want to have sexual contact with another person for any reason I'm not sure we can tell them they're wrong. On the other hand I can totally understand why trans people wouldn't want to tell someone else they're trans because of the risk of being met with violence in response as illustrated by the murder of Jennifer Laude. It's a conundrum I'm not sure how to deal with.

    When I took criminal law in law school (in the US) we talked about “gay panic” defense to homicide crimes. It’s as you say - basically an excuse not for murder but for supposed “provocation” that legally mitigates/justifies the use of deadly force. It generally reduces non-premeditated murder charges to a lesser crime like voluntary manslaughter.
    It absolutely sends a message that somehow a “straight” man suddenly seeing a penis entitles the man to lash out and kill another person. Imagine if all the people who get unsolicited dick pics went and slayed the person who sent them… or if a lesbian were justified in killing a man who tried to kiss her. That would never fly, obviously. But, while on the way out in the US, mostly, the gay panic legal defense defense is still a phenomenon that attorneys need to be aware of - so that prosecutors can know how to shut it down if a defendant attempts to claim it as a defense in a case.
    Edit: I graduated in May 2022 - so it was very recent that I took that class.

      To me the gay panic defense is as pointless as a crime of passion defense. (Example being finding out your partner cheated on you and then you just decide to murder/assault them soon after). The law imo shouldn't be so lenient towards this and see it for what it is, murder/assault/abuse depending on the situation.

    im trans and ive known about Jennifer Laude's story for years, thank you for shedding more light on it. She was such a giving soul and I am so angry at her killer being pardoned in her own home country. I hate that these men take their insecurities out on trans women so violently. It's so sad seeing pictures of her happy with Mark, who didn't seem to be afraid to show off his beautiful and kind trans girlfriend. I've heard from another trans woman that every partner of someone who is trans is just as special as the trans person they're with, and I can attest to this from my own boyfriend. I can't imagine what Jennifer's family and Mark must have felt and continue to feel... Cases with LGBT victims and survivors don't get covered much in true-crime videos on RUclips so again thank you

    I remember overhearing a woman in Flagstaff, Arizona telling a story about an ex of hers with an facescious tone as if complaining about whacky things an ex did, except as I accidentally tuned in as she described this ex calling her frantically telling her that he had just killed somebody she had described as "a transvestite prostitute" that he thinks he'd just killed, that he had just drowned her in the toilet after discovering that she was a "man," that the guy had begged her not to leave him after saying that and she told him she wouldn't, that Fillipinos were protesting again him. I pieced together that this whacky-toned story she was telling was actually the murder of Jennifer Laude, and was just so disgusted at how casually she could tell somebody that story at a bar, also in a way that was putting blame on Jennifer, and just. It's so disgusting, all the levels of dehumanization that happen to make a conversation like that possible, same shit that makes it possible for her to blame Jennifer is the same shit that made it possible for him to kill her in the first place. It's so sick that that mentality is so normal! The dehumanization of trans women, sex workers, and people in occupied countries is so intense, it's freaking psychopathic, yet its also such a big chunk of the public that participates in it, like it's the ordinary fucking American way to think or something

Yes, men have egos that get hurt quickly and easily, and violence often is the way many react. At the same time there are a lot of strange expectations of men as well which contribute to that - there sure is a hell of a lot to win in that area.
      I could see why it could surprise them initially - but to just start beating someone, that is seriously fucked up. Probably more going on than him being some "random dude", one would hope.

    Jennifer and her husband were supposed to get married. They were supposed to live together in her husband's home country after that. Had you seen the footage of him by the gate of the camp where they kept Pemberton, you could see how angry he way to the point he pushed the military away just to get in.     Speaking on the “Gay/Trans Panic Defense” - it’s still a recognized legal defense in 35 states in the US.
    In May of 2022, an ex football player of Virginia Tech, named Isimemen Etute was _found NOT GUILTY of 2nd degree murder of Jerry Smith, a gay man who Etute stupidly mistaken for a woman on Jerry’s Tinder profile._
    I swear, as a transgender person myself, EVERY TIME I bring up the fact that the gay/trans panic defense is legal in an overwhelming majority of states throughout the country I live in, I hear nothing but silence. There are too many people who don’t realize you can literally get away with murdering us. It’s absolutely terrifying.

    As a transmasc person, it means a lot to me that you and your team treat Jennifer and her case with the respect and dignity she deserved. Trans women of color often fail to get even that kind of media attention here in the U.S., and similarly often don't get justice. It's an extremely painful reality, and the fact that you seem just as upset about what was done to Jennifer as you might for any other victim helps any trans viewer, like me, feel like someone out there cares. I don't know if anyone on the team is trans, and frankly, it doesn't really matter to me, because your work on this story speaks for itself.

It's a sort of umbrella term; I prefer to use it instead of calling myself a trans man because my experience of my gender is more complicated than just being a guy, so transmasc is usually my default when I want to be specific re: the direction of my transition. I thought it would be appropriate here because as someone who isn't a trans woman, my relationship to Jennifer's case is different than a trans woman's would be, and I wanted my perspective to be clearly communicated.
      Does that help? Genuinely not trying to talk down or be pretentious, I'm just autistic and very concerned with accurately communicating what I mean, so I get really granular sometimes.

      Intersex people are as rare as ginger people are. The exceptions are vital to reflect on your definitions. If you don't take them into consideration, your definition is flawed.
      Nobody is claiming transwomen to be ciswomen. We call them transwomen for a reason. Because they are not genetically women. Transwomen can also have functional vaginas, so I'd probably drop "needs female genitalia" from the definition in your position.

    TBH, if I found out my fiancé wasn’t born a man, but was trans, it would change nothing in my eyes as I fell in love with him as a person, but I can understand how it may break a lot of trust or upset someone else if their relationship becomes serious and their partner isn’t honest with them before they become intimate. I don’t know as it is such a touchy subject now a days and again, I don’t see why the sexual organs a person has should make any difference as to your love for them as a human being, but I can at least kind of understand that others may feel differently then I do.

      My friend has a similar experience with a trans person. They told me that they met together at a gaming community after their now partner and very close friend messaged them by accident. They had long talks with one another but he had a sneaking suspicion that the person they were talking to wasn't all that they seem to be judging from the tone of their voice when she spoke up in a voice chat they had. Months after that and they became boyfriend and girlfriend, he popped the question to her about his suspicions and she reluctantly confirmed that she is trans. He told me that he wasn't surprised and not at all disappointed with that knowledge as he had his suspicions before. Adding that nobody else has made him feel the way he felt being with her even compared to his past relationships with actual women. I find that really sweet. They're still going strong to this day.

    It seems to me that people will always see a man who murders a sex worker as a monster. Unless the sex worker was trans. Then people seem perfectly justified saying "I'm not excusing murder but..." and expect to come off completely reasonable, non-problematic and not a psychopath at all. They get called out and can blame it on "political correctness," completely oblivious to what they're actually saying about themselves and the world that shaped them. I don't care what information you feel entitled to before getting a room with someone. I actually don't. Your views on this are completely irrelevant. There was nothing in this murder to sympathize with and nothing good will come from mansplaining a monster.

      It always falls on the person they killed.
      Think about your priorities here.
