Busted for photography! Avoiding being illegally detained from a corrupt maintenance guy

  • I had two busts in two places I filmed at for elevators in one week. Quite a journey isn't it! Sometimes that's what happens with elevator photography. Unlike Westfarms Mall, this bust does not have a happy ending. Unlike Westfarms Mall, this confrontation came from the building maintenance guy who was very unprofessional, incredibly rude, and attempts to illegally detain me for taking videos of the elevator in the building and complained to his manager that I wasn't showing ID. He probably did it in fear, but he still handled everything wrong so there is no excuse for anything this man did here. The Maintaince guy NEVER has a right to ask for someone to show ID in this context! Maybe not even ever!! This video tells the whole story of what happened. The maintenance guy is actually at fault for not keeping his building safe. You will see what I mean in the video. Remember everybody, when confronted by employees who work FOR THE BUILDING (NOT AN EMPLOYEE OF A TENANT OF THE BUILDING. Though probably a good idea to consider turning off cameras for tenant employees or if they bring up official building policy) or a property manager or owner, you have to stop recording your video if asked and leave the property if asked (If you can't confirm this, probably still a good idea to stop recording anyway unless your on public taxpayer funded property). You DO NOT have to present them with identification or delete your video. Both are ILLEGAL for these people to do and you can easily give up your constitutional rights if you fall for this! When this happens, you calmly LEAVE THE PREMISES IMMEDIATELY the moment you hear the word ID come the person stopping you. They also DO NOT have the right to detain you in their building illegally. Again, they DO NOT have the right to make your ID present to them! You also DO NOT have to delete the footage you acquired if the person stopping you attempts to forcefully remove your footage. All you have to do is stop recording. If any of these scenarios occur, LEAVE IMMEDIATELY! Remember everybody, PHOTOGRAPHY IS NOT A CRIME!! Weather this guy reacted out of fear or not, or weather he knew his rights or not, he handled the situation very unprofessionally and attempted to exceed his authority. Obviously if you know where this video was recorded, please avoid this building to check out the elevator to prevent this same situation from happening to you since you all see how this building is run by incompetent people. The location of this building will not be mentioned.
    Fall 2024 update: Between this nearly unlawful detainment, and a record breaking of FOUR other busted incidents in under one year, I will be ending my elevator videography hobby (minus exceptions of occasional videos from time to time. A 90% decrease in elevator filming). It is no longer fun to go elevator adventuring and the last thing I need is someone who will successfully destroy my life in another one of these incidents. Property employees and owners will never be understanding of conventional elevator enthusiasts and that is something that is never going to change. Because of the alarming rate of these incidents occurring, I am retiring the elevator filming hobby and elevator videos will only go live periodically beginning in 2025. A channel update video or community post will follow at the beginning of the new year.

    Jeez man, this sucks. Was this a typical multi-tenant office building assuming?
    I still remember when I was harassed by Allied Universal (not in full uniform, but a gray polo) at an office building, it's a long story but the building signage indicated that the building was multi-tenant medical, while it was actually something else completely different. He accused me of trespassing then threatened to call the cops on me. I told him "I am leaving the premises" then walked to my car. He did not ask for ID. This was a couple weeks ago and have not heard back since.

      @@VernonElevator Yes it is a typical multi-tenant office building to say the least.
      That's the best thing you could have done. In my opinion, unless it's blatantly clear (No trespassing signs, security desks and/or keycard readers) you're allowed to be there until you are told otherwise. This is just an opinion. Again, I don't endorse trespassing on this channel. Again, private property employees are unfamiliar with us so they think the private property logo means everything is hunky dory. Since it's not a perfect world, we just need to know what to do if they want us out, but know how to respond if they attempt to exceed authority. Many property employees and owners either don't understand people's rights, or don't care entirely.

      @@TechNerdNolan It's definitely possible that happened and he took it out on me. Still, no excuse for how he handled this confrontation. At the end of the day, the machine room being open still falls on him. I didn't plan on ratting him out, but it still falls on him.

      @@GTboy2128 Thanks. This Maintenance guy is a power starving tyrant who needs to be in control of everything. Trying to make me show ID is illegal. If I showed my ID, my rights are toast. These power starving people don't understand their rights as well as our rights. Many of these Private Property employees don't seem to understand that all the can do is tell us to stop recording and leave. If it means that much to them, they should be heightening up security in their buildings. They could at least put up a no trespassing sign if it's that much of an issue to them. Again, I do not endorse trespassing on this channel. I always avoid trespassing and I also avoid buildings that have clear indication. We must comply when told to stop and leave if we are told to leave. But that's supposed to be the end of that once either or both of those declarations are made. Many of these open multi-tenant office buildings do not have such indication and have public services in their buildings. If you have public services in your building and you do not have clear indication of who you don't want in your building, everyone should expect professionalism from you even if it involves being told to stop recording and leave. I'm just glad It didn't get any worse than this. If he had successfully detained me, I would have had to call the police. PHOTOGRAPHY IS NOT A CRIME! I will never be returning to this building. I will even avoid doing business with the tenants of this building if I ever need a service. I will find somewhere else to conduct business at knowing how incompetent the building employees of this building are.

    Man, that maintenance guy is one rude of a person. Sorry that you had to go thru this bud. Lost so much respect for him and just can’t believe that he failed to make sure that the door to the machine room was closed at all times.

      @@metroelevators4619 Sometimes these things happen in life. Again, everyone in the elevator world eventually comes across someone like this. We just have to know how to handle it the right way when it happens.

      @@SidJames-my1xx I hear you on that. Unfortunately there are plenty of people who will never learn and never pay consequences in their lives. We live in a fallen world for a reason. I could of contacted the property manager through research. However, since he called his manager multiple times during this nasty encounter, I couldn't have trusted the property manager to do the right thing. So I decided it was best not to do it this time. Yes it's not fair at all, but for this situation it isn't worth it.
      And I totally understand why you would think this man should lose his job over something like this. Yes, he ended up being one of the bad guys out there whether he had intention or not to illegally detain me. He may never learn from this. But for this situation, I believed contacting the property manager was only going to continue escalating the situation. Especially since he called his manager multiple times so I couldn't have trusted the manager to do the right thing. Sure it's possible the manager is a completely different person, but it was a pretty high gamble to take and I was not willing to take it in case my rights were given up. We always want to avoid these situations from escalating whenever possible. However, if he attempted to physically restrain me, then I would have had to call the cops since that would have been official illegal detainment. At that point, I would have to get the property manager involved no matter what. But thankfully this didn't happen.
      Remember, many people will not be good leaders and will not experience consequences from their actions. We are the lights of the world and it's up to us to do the right things in our community.

      @@armandlembo1995 I'm never returning to this building again knowing how rude and unprofessional the property employees are here. Particularly the maintenance guy. Especially after the maintenance guy attempted to illegally maintain me here. He probably didn't know his rights and didn't realize what he was trying to do is something illegal. However, that is still not an excuse to not be professional about it. I do not want anyone else coming here to ride the elevator knowing how unprofessional the employees of this building are. But since I am never returning to this building and even this town, I will not have to worry about this unprofessional maintenance guy.

      Sadly everyone in the elevator community WILL encounter some type of property employee who is rude, unprofessional and may even attempt to do something inappropriate such as follow you, take a picture of your license plate, try to get your ID and maybe even illegally detain you. I'm not trying to scare anyone, but it usually happens to everyone eventually sadly.
      Giving these people your ID allows these people to hold your legal documentation to gain power which is Illegal. Same with detaining you in the building. While these types of busts are often painful to watch, it's important to learn from these videos so you know what to expect from these unprofessional employees and protect yourself from harm and preventing these people from conducting illegal activity on you. Without the knowledge, you can easily give up your rights and at that point, your in trouble. Generally saying, the moment you see one of these unprofessional employees or owners attempting to do something they shouldn't weather they realize it or not, you need to leave immediately. All you have to do is stop recording and leave if they ask you too.
      NEVER give them your ID, allow them to force you to delete your footage or detain you in their property. If you are being illegally detained, then you get law enforcement involved. Again, everyone WILL encounter someone like this in the elevator community. You just have to be prepared to handle people that attempt to exceed their authority weather it's intentional or not. Be respectful, be honest, and know the rights of the location you are at! For office buildings, it's stop recording if asked and leave if asked and that's it.
      For this situation, I could have contacted the property manager. However, since the panicking maintenance guy already called the manager twice during the confrontation, I couldn't have trusted the manager to do the right thing. So I felt it would only lead to more trouble if I contacted the manager on my own.
      I know I am repeating myself a lot here. However, I can never stress enough how important it is to know your rights! Especially with a lot of our rights have been under attack for many years at this point. If we don't practice our rights and know our rights, we lose them and fail to provide our civic duty in the United States of America.

    Good story Fantech0104, Remember on Private property, when you see a sign that says no trespassing, you can’t trespass. But for Public, you have every right to film in public.

    Yeah, I would be VERY CAUTIOUS when parking your personal vehicle nearby or right outside the property you’re tending to do an “In & out FAST” tour of an elevator!
    What they can potentially do is capture your license plate number which is THE LAST THING we want happening!
    Here are some facts that me & a friend of mine has noticed!
    When heading to big hotel resorts, they clearly don’t mind at all when there’s people that aren’t guests walking around & exploring the place since there are public shops & restaurants we can go to, plus public parking!
    I can agree with how we shouldn’t risk going into buildings that has a “Private Property, No Trespassing” sign since it’s definitely NOT promising, however, when it’s towards shopping malls that have that sign, it’s to also say that homeless people shouldn’t be there to sleep the night as an example in my opinion.

      @@hawaiiskylineandelevators4115 That can get pretty tough since many of these places you have to drive too. Sometimes people are going to do shady things no matter what. Unfortunately someone is always out to get you in the world. We just have to know how to handle it. Unfortunately license plates are a common issue. However, if you are in a town where you can walk to many of these places by foot, by all means do so.

    I am so sorry for your luck. I always tried to look up location which it is a head of time asap when it comes to privately owned propertys sometimes there are times what I like to do is call ahead of time.

      @@AlexElevatorFan This is a great way to lower the chance of something like this from happening! I actually do the same thing too where I research properties ahead of time. Obviously once in a while, a bust still happens. However, doing research ahead of time is a great way to greatly reduce your chances of getting busted. You can also get an idea of what places not to go into as well.

    As someone who’s been a maintenance guy in a building I personally wouldn’t have a problem although of course, I would have to check with my boss first to make sure it’s not too much of a liability. In fact if I were working in that building, I probably would’ve had a good run-in with you since I’ve been a fan of your channel. I mean, of course I would immediately recognize you.

    I mean... Come on! This has gone WAY too far! If I was in a place where he asked for my ID, I would call the manager or the police as soon as I leave. Photography is not a crime! All we're doing as photographers is demonstrating how they work for educational purposes! That's all!

Unfortunately since we are such a small community, many of these people see what we do as unusual so they automatically think it's wrong. So they don't understand how different people think. It's just a common issue we have to work around.

      @@thejayson3748 Absolutely not! Anyone could have walked in there. The machine room door being wide open absolutely falls on the maintenance guy. If the wrong people went in there and something happened, it could be a lawsuit waiting to happen. It's probably part of why the maintenance guy freaked out cause he probably knew that the machine room door being open was his fault and didn't want to admit it and probably wanted to blame it on me. I would hope this experience taught him that the machine door needs to be locked at all times when it's not being used.

    Honestly, this is quite a huge drawback from what I'm hearing. Even if some places don't have a "no trespassing" sign, it's still very deceiving because they will still have security/staff who will always look for such. Okay, this may sound theoretical, but based on my experiences (off-channel), being asked for ID and shit is very likely because again, trespassing is a crime, and the fullest consequence is prosecution. In my country, when no trespassing signs are found on private properties, they show an additional note saying, "Any trespassers will be prosecuted". So unfortunately, this is something that is always beyond our control and that will change anytime soon.
    Whatever I explained above may not be right, but this is based on all the earfuls I received from my parents whenever they found out about me being confronted for filming an elevator. Never said this would always happen in every case. Yes, I'm aware of worse scenarios of such among the rest of you guys, but the people in this world are not what we think.

      In the United States, everyone has a certain amount of rights in different situations that apply. In this case, the maintenance guy at the most should have just had me stop recording and leave. If you were to give these people ID, your giving up your rights as you basically consented to doing so which is a common trick people tend to do in the United States.
      I do not endorse trespassing on this channel. There are many office buildings in the United States that have the open multi-tenant setup without a security desk. Theoretically, they are open to the public since they service customers from many different places, but they can tell you to leave for whatever reason. Some of them have no trespassing signs to make clear of who they want and don't want in their building. But if this were to go into a court situation, I could argue that there was no sign saying I couldn't be there. Sure I would of course honor the wishes of building staff and owners, but it's something I could utilize. The problem in the U.S is that a lot of these private property owners embrace the private property logo and think everything is hunky dory. Since we are a small community, they don't see how different people could be. In a perfect world, all of the people who don't want this would have signs or security desks at their buildings. In my opinion, if you don't make it blatantly clear ahead of time (By having signs, and/or security desks) we should expect from some professionalism from you even if it involves being kicked out. It's just another issue at the end of the day since it's not a perfect world. This is why we know our rights here in America so we can be respectful and do the right things if we are stopped and asked to leave, but we can also protect ourselves from the building personnel who attempt to exceed authority.

      @@Fantech0104 Well explained Wes, you are right, you show your ID, you're done for, and yes, you clearly stated that you lose your rights permanently in such cases. Luckily, the times I got busted, I was never asked for ID, but the maximum I got? Delete the video, because they don't want to see it uploaded or visible on my device for a lot of reasons, even if mine are non-commercial. Period.

Too much of this harassment is going on at such an alarming rate where it's no longer fun to maintain the filming hobby. This maintenance guy is certainly unprofessional and handled everything wrong. He is absolutely 100% responsible for leaving the machine room open and anyone could have gone in there. It's a liability on him and this man is a nasty dude. And he attempted to unlawfully detain me whether it was intentional or not. However, the amount of unprofessionalism throughout all of these places with people like us is only continuing to grow. People are not understanding of us and we will not be recognized. This is why I am leaving the hobby and occasionally filming elevators. I've had it. The change will take place for uploads beginning in 2025. I'm tired of these property employees saying the same old trespassing line every single place we go to even though that is never the intention. But if nothing is ever going to change, no point in continuing. Especially if you are no longer enjoying it. Everything for the remainder of the 2024 year is just backlog content. I will make a more formal announcement about it when the new year begins. As unprofessional as this man is, I hope he learns how to be more professional and actually take care of his buildings. I certainly wish would learn to be a professional in the job market.

    Rude person. I believe the only elevator filmer that hasn't been busted and/or harassed is Elevation321. I believe everyone else has. So he is apparently smart.
