    About Me/Kirby:
    Kirby Pábalan-Táyag Aráullo is a renowned Filipino Culture Bearer and currently the National Coordinator for Culture and Heritage for NAFCON (National Alliance for Filipino Concerns). He is a Dátû and Lakan by blood, and an Activist at heart. Kirby is a direct descendant of the last Paramount Kings of Luzon (of both Lakandúlâ of Tondo and Rája Matandá of Maynílâ), and of the anti-colonial revolutionary Katipuneros and World War II Guerilyeras who fought for the liberation of the Philippines from colonialism. His upbringing exposed him to the contradicting worlds of traditional politics and grassroots activism.
    With a keen interest in varying fields (such as history, government, and human rights) and a strong commitment to serve the community, Kirby studied in some of the world’s most prestigious institutions, such as the University of California, Davis, Harvard University, and Université catholique de Louvain. Kirby is also the Co-Founder of the Bulosan Center for Filipino Studies at UC Davis and author of the groundbreaking book “Black Lives & Brown Freedom: Untold Histories of War, Solidarity, & Genocide.” He is a visiting professor at various colleges in the Philippines and a research fellow with Ágúman Sínúpan Singsing, an institute for indigenous advocacy and the study of Kapampángan language, history, and culture. Kirby is also well-known for his educationally engaging RUclips channel where you can find videos about history, culture, and everything in between!

      The western and Europe are mastermind in.this dispute. Thus, we should avoid any conflict but if this conflict continue the western and Europe will deploy its jet fighter in sabah and no one will gain benefits from it

    For ultranationalist Filipinos simply claiming Sabah should be a part of the Philippines because of this issue, this is a very useful question: "List down at least three major ethnic groups in Sabah." 9 out of 10 they will have no idea lmao

    Thank you for this video! I am not Filipino, but my wife is from Sulu, and her parents and many other relatives live in Sabah. This clears up a lot of why there is such a strong Filipino influence in an area that maps always show as being Malaysia. I had no idea the complexity of the underlying claims between the two countries.

      The british had two contracts that are highly suspicious and very different in translation one says lease while the other days "rent to own".so many times the sultanate of sulu was backstabbed,same thing with the " treaty of bates " from the U.S. which they utterly destroyed and conquered the sulu sultanate anyway..

      It has nothing to do with the Filipinos.

      @@normahabusamah5127 but sulu sultanate ceded their rights of sulu to Republic of the Philippines 1962 to seek help from Ph government then coz Malaysia greedily made Sabah part of Malaysia federal state. Philippines now has the rights to Sabah, Philippines

    Rajah (Or King) Baguinda Ali the "predecessor" of Sultan Sharif Ul-Hashim (1st Sultan of Sulu) was a prince from Pagaruyung of Minagkabau Kingdom which is now part of INDONESIA.
    Sayyid Abubakar bin Abirin or Sharif Ul-Hashim or Paduka Mahasari Maulana al Sultan Sharif ul-Hashim a Johor born Arab explorer founded the Sultanate of Sulu on November 17, 1405. Johor is one of today's MALAYSIAN state located in Malay Peninsula. He was married to Dayang-dayang Paramisuli, the daughter of Rajah Baguinda Ali.
    Present time mainland of the former Sultanate of Sulu is part of the Republic of PHILIPPINES.
    The TRUTH:
    South East Asia was a different, and could have been a lot different scenery without the Western Occupations (Spanish, British, Portuguese, Americans etc.) The westerners sets our boundaries very much differently from what it was used to be, according to their respective sovereignty.
    The once INDEPENDENT & DIVERSE insular Southeast Asian Kingdoms/Sultanates which contains mostly a mixture of descendants of Proto-Malay (Nesiot) and Pareoean peoples who were influenced by Malayo-Polynesian and other groups, were made divided by geo-political divisions set by western colonizers.

      True but in reality i could probably say that if without western influence we could still be having infighting between nations as to what western influence blended with rennaisance and humanism in the end of the dark ages in europe.we would mostly likely be having warring states right about now.

    So basically, after WW2, the British Empire gave the lease of Sabah to Malaysia and after Malaysia was established, Malaysia had to pay the Sultanate of Sulu because the British Empire gave them the lease so that means Malaysia have no rights over "a part of sabah(north borneo)" and the Sultanate of Sulu is the rightful owner of the said land. am i right?

      Not so...the lease was never being paid again after Sabah or north borneo was independent and united wiht Sarawak dan Malaya to make Malaysia Federation...and the cause why the lease never being pay because Philippines never give and recognize the sulu sultanete was a sovereign and its the reason why it beings knows and recognize as the sulu sultanete have been abolished...same goes to most of Indonesian sultanete...they exist but not have any power of their sovereign and it was recognized as abolished too...that what happen to every kingdom and sovereignty in every republic nation especially in this Southeast Asia

      @@deranjang9935 it should be "too scared to make two enemies at once" well you have a point, but also kind a narrow-minded to regard neighboring countries as "enemies" be mindful of your word selection I suggest.
      Regarding to the Philippine sabbah part occupied by Indonesia, honestly I can't answer to that but I know that Indonesia is far more sensible when it comes to territorial disputes (take the Celebes sea talks for example) unlike Malaysia who disregarded the whole issue as if it's nothing until the seize of Petronas asset. It might also be that a territorial talks between the two nations are taking place without our knowledge or overshadowed by Malaysia-Philippine issue which obviously lots of people are focusing more.

    Philippines is not like China who wants to own Asia. As a Filipino, we should just let Sabah be Sabah which is part of Malaysia for many years. What could be the reason or purpose of re-claiming Sabah when the Philippine government can't even handle well the Sulu region which today is still a poor region in the Philippines. Hope this issue will he resolved. Let's respect Malaysia and Sabah

      That's why Sulu became poor bcuz malaysia stole North Borneo from the Sultanate of Sulu. Malaysia becomes prosperous bcuz of the rich natural resources and the fats of the land of North Borneo, w/c would prosper Sulu and the Sultanate of Sulu, the rightful owner of North Borneo.

      Sabah belongs to the people who live there. We are not living in the middle ages. Brunei not withstanding, one guy does not own entire countries. Why doesn't the sultan sue the government of the Philippines for half of Mindanao?

    Mr Kirby Araulio, until today you haven't response to my questions concerning the 1878 Sulu-BNBC agreement (video minute:8.34 regarding agreement on the right - Tausug version). Who is keeping the original copy of the Tausug version of that document? How do you verify it is genuine if the original copy been reported missing during his majesty trip to Singapore? Why Sulu/PH NEVER make used of the 1878 Tausug version in any of their court case?

    Yes, we all know there are also Filipinos in Sabah. But will the people of Sabah want to accept the new government? If the people of Sabah have already chosen Malaysia, let it be, why do you want to be busy. Although Brunei colonized Sabah in the past, during the formation of Malaysia in 1963, the people of Sabah chose Malaysia to be independent together, but Brunei did not claim Sabah because of respect for the choice of the people of Sabah to choose Malaysia, even though some Bruneians feel sad at the loss of Sabah. So what lessons do we get?🤔 🧠🙌🏻

      Ughh correction brunei has always owned sabah in the past,so as with kalimantan(south borneo which is now indonesia) sarawak, these lands were once owned by the sultanate of brunei, now the sultanate of brunei's land is so small its almost invisible and is surrounded by malaysia just like singapore

      @@agronomist98 cobbold had no rigthts to include North Borneo to be a state of MalAysia bcuz it's not his land. The british only rented North Borneo from the Sultanate of Sulu.

      1. June 6th - Paris Court of Appeal had set aside and annulled the previous Paris Court (lower court) ruling awarding the heirs of the defunct Sulu Sultanate.
      2. June 27th - Dutch Court of Appeal had dismissed a bid by eight descendants of former Sultan of Sulu to enforce the arbitration award by Paris Court (lower court) ruling and dismissed attempt to seize Malaysian Petronas assets following the Paris Court of Appeal decision.
      3. Paris Court of Appeal also imposed on Sulu €100,000.00 (Euro currency) to be paid to Malaysia as legal cost.
      4. Mean while in Luxembourg, a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision.
      Malaysia had spent around RM32m, equivalent to about US$6.6m to deal with this Sulu claim cases in various European courts, in Madrid, Paris, Luxembourg, and Netherlands. Apart from the €100,000.00 Sulu has to pay Malaysia as legal cost, Malaysia is planning to sue Sulu for compensation for the loss of RM32m spent.

    Philippines claims Sabah on the basis that Sabah was once under Sulu. Descendants of former Sultan of Sulu claim that Sabah belonged to Sulu because Brunei gave Sabah to Sulu as a gift. But Brunei refuted this claim and denied ever having given Sabah to Sulu. There was no document regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans.
    In fact on 29 December 1877, Brunei ceded Sabah to BNBC and concurrently Sultan of Brunei appointed Baron Von Overback the co-owner of BNBC as Maharajah of Sabah and Rajah of Sandakan and Gaya. When BNBC went to Sabah to start their business, Sulu claimed that Sabah belonged to Sulu.
    BNBC agreed to enter a "pajak" agreement with Sulu after they were advised by their fellow businessmen in Hong Kong who advised that Sulu would attack them if they didn't have a deal with Sulu. BNBC understood that this "pajak" agreement was "cession agreement". So did early generation of Sulu, they too understood and accepted it as "cession". Only later generation of Sulu claimed that it was "rent" or "lease". This agreement was signed on 22 January 1878. The two events above led to an overlapping issue on Sabah.
    However on 22 July 1878, the then Sultan of Sulu had relinquished all his possession and sovereignty of Sulu and it's territories including Sabah to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory.
    Then in 1885, to resolve overlapping issue on Sabah and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered Sabah to Britain. As new owner Britain had full control of Sabah. Sulu could not claim anything because they had already relinquished the sovereignty of Sabah to Spain and Spain surrendered Sabah to Britain.
    Even though Britain had full control and sovereignty of Sabah, they still honoured the annual cession money payment stipulated in the "pajak'' agreement as consolation for the Sulu Sultan. So did Malaysia when formed, still honoured the annual cession money payment as consolation for the Sulu Sultan, the practice inherited from the British.
    Britain gave independence (self government) to Sarawak on 22 July 1963, and to Sabah on 31 August 1963. The people of Sabah and Sarawak had exercised self determination to form Malaysia together with Malaya and Singapore. The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. Malaysia was formed on 16 September 1963.

    "I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia".

      Actually in January 17, 1962, the Cobbold Commission headed by former Bank of England Governor, Lord Cobbold, was set up to determine whether the people of Sabah & Sarawak favoured the proposed union of Malaysia; the commission found that the union was generally favored by the people.     Quiet simple really. It used to belong to the Sultan of Brunei.Back then people of Borneo ARE NOT sulu. SULU are PIRATES.and why are the Philippines desires to claim sabah? Because sulu are filipinos? Or really because they just want to FORGET all of the lower part of Philippines used to belong to the Pirate sultanate of JOLO.
    The claim over Sabah from the Sulu Sultanate originates from the Pulau Chermin Civil War and Kinarut Wars which was an internal civil war within the Brunei Sultanate that lasted for 12 years from 1661 to 1673 between two opposing members of the royal household who claimed the throne; Sultan Abdul Hakkul Mubin and Sultan Muhyiddin.
    The claim over Sabah from the Sulu Sultanate is that either all of Sabah (or some territories within Sabah) was promised to them for aiding Sultan Muhiyiddin in the war.
    During the final battle in 1673 at Pulau Chermin, Sultan Mubin was defeated but there are conflicting versions as to if the Sulu warriors did indeed fight in the battle or if they merely waited for the battle to be over before ransacking the royal palace at the end of the battle.
    Prisoners were taken by the Sulu including a son from Sultan Mubin before they departed back for Jolo Island. No demands were made until 15 years later in 1688 when the very same son, named Datu Dakula was sent back to Brunei to claim what was promised to the Sulu Sultanate.
    There is also a suggestion that the Sulu claim over Sabah comes from Datu Dakula’s heritage as being a surviving son of Sultan Mubin, who therefore inherited all of Sabah as including six territorial dependencies since his father had died and Sabah was presented as a gift to Sultan Mubin’s parents during his wedding by the previous Brunei Sultan, Sultan Saiful Rijal.
    Sadly, there exists no historical evidence or agreements to support these claims by the Sulu Sultanate that Sabah was given to them by Brunei or if promises were indeed made by the Sultan of Brunei. And so, the Sulu claims appears to have no merit historically in this respect.
    The Sulu Sultanate were responsible for encouraging bands of pirates under the leadership of various datu’s loyal to the throne to commit acts of piracy, kidnapping and the capturing natives from coastal villages along the shores of Sabah from the mid-1700s till the late 1800s to be sold as slaves at slave trading markets in the Sulu archipelago.
    Kidnapping of natives and selling them as slaves was part of a greater economic trade that was incredibly profitable and a lucrative business; slaves provided manpower for plantations, manpower as rowers on war ships, house maids as well as skilled craftsmen for many traders in the Sulu Archipelago as well in foreign lands. And slaves could be used to settle personal debts between various datu’s and businessmen in the Sulu region.
    The British avoided conflict with the Spanish in the Borneo and Philippine region but did attack and capture Manila for a short period of time in 1763. They were happy to trade with the Sulu by selling them guns and ammunition which helped them sustain their war with the Spanish until their defeat in July 1878.
    Balambangan and Labuan islands served as important trading posts for the British to sell guns, ammunition and to barter trade with the Sulu for jungle products and opium.
    The Spanish, who had ruled much of the Philippines since 1570 had struggled to end the Sulu insurgency in the south for 300 years. They had previously signed many peace treaties after defeating the Sulu Sultanate in battles between the 1600s till the late 1700s but in every instance, once the Spanish had left, the treaties were torn up and completely ignored.
    The Sulu Sultanate then went back to committing acts of piracy, kidnapping and slavery against not only native villages in Sabah under Brunei rule as well as against Filipino villages in the Philippines under Spanish rule.
    All this changed by 1875 as the Spanish navy decimated villages loyal to the Sulu Sultan on islands surrounding Jolo Island and then introduced a naval blockade which prevented trade access to the Sulu Kingdom. The Sulu Sultanate were no longer the naval power they once were as the Spanish defeated them comprehensively in many battles and they suffered heavy losses in men and ships.
    The Sulu were not able to commit acts of piracy, kidnapping and slave trading as the British Navy were directed to stop these pirate attacks in Sabah and to destroy the pirate bases at Marudu Bay and on the east coast of Sabah in the mid-1800s. This too contributed significantly to the decline of the Sulu economy which in turn saw reduced wealth in the royal treasury.
    For the Sultan of Sulu, he only had two options in January 1878; surrender to the Spanish as he was on the verge of total defeat or surrender Sabah to Dent and Overbeck and negotiate a deal to re-arm and to be able to continue fighting the Spanish.
    By establishing a relationship with Dent and Overbeck, he also hoped to have a territory to escape to in the event of defeat that was a British safe and a yearly payment of 5000 pesos to sustain himself and his family for the rest of their lives.
    By signing the agreement of cession in January 1878, it meant the sultan was willing to sacrifice any claims he may have had on Sabah at a time when the Sultanate was desperate for money and weapons to continue the war against the Spanish as the terms offered by Dent and Overbeck were for a total cession and not for a lease on the territory.
    It is for these reasons we now understand the pressures the Sulu Sultan faced in 1878 and why he agreed to give up all claims of ownership over territories he claimed in Sabah.
    Baron Von Overbeck and Alfred Dent saw a business opportunity and signed the agreement to purchase of Sabah from the Sultan of Brunei. They then negotiated a similar agreement with the Sultan of Sulu who had overlapping claims over Sabah for 5000 pesos including three shiploads of guns and ammunitions which included a modern American weapon called the gatling gun that could fire 1000 rounds per minute.
    These historical facts are well documented by Don Carlos Cuarteron, the prefect of Borneo who documented these historical events in his personal diaries which can be viewed today in a book published by Mike Gibby titled “Crowned with the Stars.”
    It is because of his diaries that have been translated by Mike Gibby that we are now able to establish the real intentions of the Sultan of Sulu with regards as to why he agreed to the terms proposed by Dent and Overbeck and signed the agreement in 1878.
    The Sultanate of Sulu was forced to surrender to the Spanish in July 1878 after 300 years of bloody war and bloodshed. This final surrender brought about an end to any influence the Sulu would ever have again in the region.
    So, on what basis did the Sulu Sultanate ever have any claim to Sabah as the royal household were neither originally from Sabah, never lived in Sabah nor had any ancestorial claims to the territory in any capacity going back in time.
    There were no palaces, no cities and no centres of administration of the Sulu Sultanate in Sabah unlike the Brunei Sultanate who were based in Borneo and historically ruled most of Borneo for almost 6 centuries and had vassals and administrators and Bajau Samah armies based in Mengkabong, Putatan, Abai, Kinarut and even in Marudu. Until the cessation of Sabah in 1877, the entire west coast of Sabah was controlled by the Brunei Pangerans and their Bajau Samah warriors.
    In the 18th century, any Sulu claims over the east coast of Sabah was simply by the force of arms after the decline of Brunei hegemony with no proper transfer of sovereignty.
    Much of the controversy of “was it a lease or cessation” begins with Jamalul-Kiram II, the son of Sultan Jamal ul-Azam who had signed the agreement on 22nd January 1878. He replaced his elder brother as Sultan after the passing of Sultan Jamal and began to challenge the British by stating the agreement was a lease agreement and so this confusing narrative that the agreement of cessation was a lease begins, especially within the Philippines.
    But in the eyes of the Chartered Company and the British Government, there was never any question of the validity of the cessation: Sabah was not the property of the Sulu Sultanate any longer and there was nothing more to discuss on the matter.
    One aspect of history that further erodes arguments that the Sulu had some form of ownership over Sabah is that is the question of kidnapping and slavery; why would any royal household who claimed to rule over a people subject the very same people to a life of misery and slavery for the rest of their lives?
    The other historical issue we have found with claims made by the alleged claimants of the Sulu Sultanate today is that the identities of these Sulu claimants are also considered to be very doubtful as they do not allegedly come from a lineage that is linked directly to the Sulu Sultan from the 1800s.

      The International Arbitration Court has decided. Malaysia must pay $14.9B in compensation for the injustice malaysia had done to the Sultanate of Sulu. Malaysia must return North Borneo to its rightful owner, the Sultanate of Sulu. Your assets was sequestered in Europe, like Petronas in order that Malaysia will pay the Sultanate of Sulu.     You did not elaborate 22th July , 1878 Sulu agreement with Spain, Sulu Sultan had relinquished the control of Sulu to Spain. You mentioned the Madrid Protocol within Spain and British, but not mentioned Spain agreed to let British to control North Borneo.
    You also not touched on 1903 Confirmation of Cession signed within Sulu and British. Maybe you should also touched on 1915 Carpenters Agreement with US.
    How about the rightful heir of Sulu Sultanate. US defunct Sulu Sultanate after the death of Jamalul Kiram II in 1936 due to no rightful heir. So after all the cession and relinquishing, what was the land that Kiram II family remain.

      It was stated on the contract that the lessor will pay the family of the sultan of sulu and his decendants an amount of 5000 mexican peso/gold FOREVER. Malaysia, changed the currency to Ringgit and decided to stop paying in 2013..so the contract was terminated.. So since the contract was terminated, what do you think will happen next? Philippine government is not even directly involved with the case so no one can accuse us of greed. This is between Malaysia and the Family of the Sultan of Sulu.

    This "arbitration" is crazy. It isn't how arbitrations work. Normally both sides agree to an arbitrator, and to be bound by his decision.
    But here, one side just goes and get an arbitrator from a country so far away it is 1/3rd of the way around the planet, while the other doesn't agree. They want it to be decided in court. Nevertheless, the arbitrator carries on anyway, and eventually decides the side that got him appointed wins, and gives them $16 billion.

    Stampa's insistence that Spain and France are neutral grounds is idiotic. They also don't have jurisdiction. When the Spanish court told him to stop, he just ignores the court order and moves to France. France tells him to stop, he ignores it and just ploughs on ahead.

    Definitely a difficult issue. Even if the UN intervened, it's gonna end up with a vote and I doubt any Sabahan wanna join the Philippines. Plus this whole issue is somewhat weird because Sabah joined Malaysia after they got approval from the UN so technically it has always been legal and recognised by them. I do feel bad for the sultan of sulu and Philippines, but it is what it is.

      Sulu/PH need to resolve 2 legal aspects before making any claim on Sabah from Malaysia.
      Firstly, Sulu need to show undisputable proof that earlier, Brunei Sultanate (original owner) give North Borneo (Sabah) to Sulu as a gift for assisting in the Brunei’s civil war. This is to rebuke the existence of 29/12/1877 agreement (consist of 4 agreements) signed by Brunei Sultanate that grant the whole of North Borneo to British North Borneo Company (BNBC). These agreements exist and keep at the National Archives in London. The word “grant” been used, and it has never been challenged or protest by Brunei, even when the British turned North Borneo into British Charter (1881), Protectorate (1888), Colony (1946) and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia.
      Secondly, let assume North Borneo belongs to Sulu. Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and Carpenter Agreement on 22/3/1915 with the US. Later Spain and US relinquish North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. At the end, Sulu has nothing.
      Thirdly, subsequent to the second point above, PH claims on North Borneo (Sabah) is null and void. Any colonized colony that seek independence, the territory (sovereignty) is based on what been given by their colonizer. In this regard, the principle of uti posseditis juris is applicable, acceptable and recognize internationally. PH got their independence from US in 1946 and under this principle, there is NO North Borneo.

    Hi, I've an Idea. Since I'm a Sabahan myself, is it possible to born a state in which Malaysia and Philippines are together?
    Well to be specific, is it possible to let Sabah to be owned by Malaysia and Philippines? Since Sabah was declared part of Malaysia on 1963 by the British empire but the Sulu still not happy with agreement lease by their old Sultan which stated "pay rm5000 yearly until the end of time" in the same context it is still owned by the Sulu.
    The state of Sabah will be the most special place in which Malaysian and Philippines can go in without passport.
    The citizens of Sabah will have special case of nationality, in which they could have 2 nationality mentioned as Malaysia & Philippines in their IC ( identification card ).
    I know that Malaysia could only have 1 IC, but this is a special case now.
    If the government wanted to take the tax from the citizens of Sabah, it should be like:
    Goods price - rm100
    Gov tax - 10% ( 5% Malaysia & 5% Philippines )
    So it will be like rm5 for Malaysian gov and rm5 for the Philippines.
    All of the natural resources and goods at Sabah will be taken (50% Malaysia 50% Philippines).
    In the same time, Malaysia and Philippines have to take care of the people of Sabahan by means of employment, financial, housing, roadworks and etc.
    Well, it was just my way of thinking to let both parties in a win2 situation though.

      And I just even came up with the unique trait of being a native born Sabahan to be both technically Malaysian Pilipino, meaning people who are both considered citizen of both countries.

      The original lease payment was 5300 gold mexican dollar which Malaysia converted to MYR. I just checked the value of the mexican coins around 1850's it ranged from USD850-3000 each. I used the USD1095 value as an average, the current value of the lease shld be USD5,803,500.00 and the land was leased for farming rubber trees, not extracting/mining oil from the land. My 2 cents worth.

    North Borneo from its name already known as part of sultanate of Brunei. If there any country want to claim, its only Brunei may have substances. Even it didn't clear how part of North Borneo under Sulu Sultanate if any. During Spain colonial until American came in, North Borneo never under their jurisdictions. The only we can see overwhelmed of refugees, so called warriors from south Philippines. After too long war between them, the numbers of refugees keep increasing.     On 12 July 2022 Malaysia obtained Suspension (Stay) Order from the Paris Court of Appeal to suspend Exequatur Order issued by Paris Court. A Stay Order obtained in the French Court of Appeal pending application to set aside an arbitration award in an arbitration proceeding also to be filed in the French Court has a high probability to be allowed since the arbitration proceedings itself was held ex-parte (one sided) which is deemed deficient and defective. Also, this court has no jurisdiction on a sovereign state. Soon it will just be like Spain that rejected the claim.
    Earlier, on 29 June 2021, upon application by the Government of Malaysia, the Spanish High Court of Justice of Madrid decided that the service of notice of the proceedings for appointment of arbitrator for purposes of the Claim was not properly served to Malaysia in accordance with peremptory international rules and Spanish law (the “Nullification Decision”). It is also not consistent with the High Court of Justice of Madrid’s case laws on service of process on sovereign States. Because of the Nullification Decision, Dr. Stampa is not an arbitrator in the purported arbitration proceedings and, therefore, all his decisions, including the Final Award (issued on 28/2/2022), are null and void.

      @@paoloangelopenas5073 Ha ha ha ha. How on earth a junior court, the Paris court is superior than the higher rank court namely Paris Court of Appeal? Who told you that Stay Order is effective in France only? Do you know in order to involve a sovereign state in a court process you need sanction from New York Convention 1958. You just can't go to any court to do it. Read Article 1, 2 and 5 which are prerequisites to the convention. There is no application by Sulu as the prerequisites are not to their favour. That is why nothing happened and Sulu been hopping from one court to another.

      there are two types of “stay”:
      1) stay of proceedings: the proceedings is halted. The case cannot move on.
      2)stay on execution: the implementation of the ruling is halted (the seizure of Malaysian assets and the turnover of Sabah back to the heirs of the Sultan).
      The Malaysian government got a STAY ON EXECUTION. The award was halted. It did not, however, invalidate the ruling. 🤡🤡🤡
      Read your comment again and it may finally occur to you that you have shot yourself on the foot (multiple times now).

    Brunei actually owns Sabah first in 14th Centuries. THEN in 1658 , Sultan Muhyiddin the 14th Sultan Of Brunei gave Eastern Sabah to the Sultanate Of Sulu after the Brunei Civil War ended. Because The Sulu help Sultan Muhyiddin In A Brunei Civil War Against Sultan Abdul Hakul Mubin (13th Sultan Of Brunei). end

      The territory and sovereignty of the Sultanate and Sulu & North Borneo was transfered to the Philippines before malaysia was created in 1963. But the proprietary of the Sultanate of Sulu and North Borneo belongs to them. Pay your commercial obligation to the Sultanate.       Firstly, Sulu need to show undisputable proof that earlier, Brunei Sultanate (original owner) give North Borneo (Sabah) to Sulu as a gift for assisting in the Brunei’s civil war. This is to rebuke the existence of 29/12/1877 agreement (consist of 4 agreements) signed by Brunei Sultanate that grant the whole of North Borneo to British North Borneo Company (BNBC). These agreements exist and keep in the National Archives in London. The word “grant” been used, and it has never been challenged or protest by Brunei, even when the British turned North Borneo into British Charter (1881), Protectorate (1888), Colony (1946) and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia.
      Secondly, let assume North Borneo belongs to Sulu. Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and Carpenter Agreement on 22/3/1915 with the US. Later Spain and US relinquish North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. At the end, Sulu has nothing.

    Secondly sulu sultanete or even Philippines doesn't have any rights to reclaim Sabah because sulu sultanete have already abolished very long time ago...
    Third and finally Philippines never ever recognized sultanete of sulu was a sovereign anymore...
    So In conclusion Philippines or even Indonesia doesn't have any rights to disturb the sovereignty of Malaysia Federation...

    In History was owned the Sultan of Sulu before 1963.North Borneo has been leased to Chartered Company by unwise Sultan who wants payment for 500 hundred dollars only per year.He made agreement without expired date.The group claimants of Sabah their award from Tribunal ruling of International Court has been canceled and rejected from having right as the ownership over Sabah due of long years had passed makes such agreement is void and Sabah/Malaysia is recognising new Ownership has the right in contrast with

      How do you explain the existence of two agreements related to the ownership of North Borneo (Sabah) namely between Brunei Sultanate & BNBC (29/12/1877) and Sulu & BNBC (22/17/1878)?
      The only existing agreement involving the Sultanate of Brunei (original owner) is that agreement that Brunei grant and cede North Borneo to BNBC on 29/12/1877.
      If Brunei Sultanate had given North Borneo to Sulu much earlier, his majesty would not have signed that 1877 agreement. The signing confirm North Borneo still belongs to Brunei.
      Why there is no protest from Sulu to Brunei for signing the 1877 agreement?
      Why Sulu & BNBC agreement not signed earlier in 1877 but 3 weeks later (1878) after the signing of the 1877 agreement between Brunei Sultanate & BNBC?
      Regarding the 1878 Sulu & BNBC agreement (the original agreement in Tausug is missing during his majesty trip to Singapore), the validity of Sulu ownership of North Borneo is doubtful. How on earth Sulu can own North Borneo if no undisputable proof that Brunei gives it to them earlier? Unless there is a possibility the British been scammed, deceived, or intimidated by Sulu into signing that 1878 agreement?
      For sure the first agreement (1877) and with the original owner himself is more valid in court.

      There is a court case recorded by ICJ (International Court of Justice, The Hague) pertaining to the Philippines claims on North Borneo. It is a special 37-page report by ICJ that was published in 2001 and easily accessible from the ICJ official website. It was a trial within a trial in the main court case between Malaysia and Indonesia over the ownership of the islands of Sipadan and Ligitan in Sabah.
      Philippines which is not a party to the trial requested permission to intervene. To comply to Article 62 of the Statute of Court, Philippines stated the objectives for the intervention (Section 7 & 84) namely, to safeguard and preserve Philippines historical and legal rights over North Borneo and to inform the court the affect or effect of the court outcomes on its claim to the territories.
      In the trial within a trial, Philippines lawyers explained their case especially the Sulu-Ovenbeck 1878 agreement (primal reference) and related information to the court (Section 44 & 83). The same 15 main court judges were sitting at the bench and Malaysian and Indonesian lawyers too were involved in this trial.
      On 23 October 2001, by 14 to 1 vote, the court rejected Philippines request on the ground that there is “no interest of legal nature” (Section 93). (Meaning Sulu/PH claim on Sabah is null and void)

    Attorney Harry Roque is likewise adept at international law and as a matter of fact, is an authority because he is an international lawyer and yet unlike you he sees that there is hope for the Philippines to reclaim Sabah or at the very least open a negotiation with Malaysia on the matter. You started your video with a disclaimer that your take on this will be as a historian and yet towards the tail end of your video you contradicted yourself by going overboard and giving your opinion. History is an empirical science based on records and facts. You sir is doing A LOT MORE than that. You became what is the opposite of being a historian by going over the very thing which makes history a science, ever so subtly ever so slightly but nevertheless a contradiction to the field of history. Only those capable of careful discernment will be able to see through what you are trying to say.
    144 years (1878 to 2022) that our country is unable to benefit from the resources of the northern and eastern Sabah while Malaysia just exploited it to their hearts content and you coming in just like that. Our country DESERVES a share of those resources.
