Well it only have two peaceful scenarios here; one the Malaysian government will annex sabah and the sulu sultan will become sabah's private owner, two the sultan will have that land back to the philippines and its benefits. So before it became an issue of sovereignty Malaysia should consult the Philippine government and bring that issue in far more superior international courts.
What I mean was the heirs of sulu's former sultan who lead the sulu is going to own that land privately without bringing that territory back to philippine government, and the issue wasn't because of territorial claim of Philippine government but the rights of heirs so what ever the decision of heirs about sabah will still be a legal case because of previous claims and court rulings that doesn't involve Philippine government and by Malaysian authorities.

Malaysia should give up Sabah to the Philippines, the real owner to avoid future conflict and may disentigrate ASEAN unity. Take note that the Philippines is now slowly building up its military power. Once the conflict in Mindanao is settled and prosperity will come in, and the PH has no other problems to comfront internally in the near future. Time maybe ripe to fan the burning sentiment of .many Filipinos that are victims of injustices inflicted on them by the British and Malaysians for not returning back Sabah. They could choose to do what they want. In the current arrangement with Malaysia, peninsular Malaysia basically suck the resources of Sabah and just returned somewhere around 50% in the form of services and payments to personnel. If they become a devolved province they can utilize it to their advantage and defense would be the responsibility of the national government.

Sabah belongs to the Sultan Of Sulu who is a citizen of the Philippines. It was the British who annex Sabah to Malaysia in 1962 when it gave Malaysia its independence with out knowing it wasn't theirs to give in the first place. It is hoped that the ruling with regards to the seizure order issued by the two courts would compel the Malaysian Government to recognize its obligation. With the said ruling, it shows that sabah is an integral part of the Sultanate of Sulu territory in the Philippines in which it is more ancient to that of the State of Malaysia which was only created by its British colonizer. The question now is: Is this issue of Sabah not similar to the case of Hongkong which was before held by the British and then later returned to its mother land China?

@Hope Lope Malaysia inherited (or maybe volunteered) to continue the rental payment to the Sultan of Sulu after the British company ceded Sabah to Malaysia. Even the Malaysian government doesn't deny that they are paying annual rent until 2013. In the first place, does that British company have any legal authority to cede a property that they do not own? That is highway robbery by the tenant with the landlord (the Sultan of Sulu) as the victim. He lost his land (Sabah) because his tenant sold his land to someone else (Malaysia).

An annual rent of Sabah commensurate to the present economic condition should be agreed upon by both parties. Malaysia is going to be the tenant while the Philippines will be the landlord.

The $15 billion award is just DAMAGES, there's another part of the arbitrarial ruling: that there was a BREACH OF CONTRACT by Malaysia & that the CONTRACT WAS Voided, so the property being rented should be returned to the owner. KUALA LUMPUR: A Spanish Constitutional Court has dismissed an appeal by a group of individuals claiming to be heirs of the Sultan of Sulu in relation to their compensation of Sabah.
Minister in the Prime Minister's Department (Law and Institutional reform) Datuk Seri Azalina Othman Said said the decision effectively ended the claimants' judicial strategy in Spain.
"The Government has just received official confirmation that the constitutional appeal filed by the claimants has been rejected and that, as a result, the annulment of Dr Gonzalo Stampa's appointment (which was already final and binding) has also been confirmed by the Spanish Constitutional Court.
"On June 29, 2021, the High Court of Justice of Madrid (HCJM) issued a decision which annulled the unlawful judicial appointment of Stampa to act as an arbitrator
"HJCM retroactively invalidated Stampa's appointment and nullified all his actions as a purported arbitrator, including the alleged preliminary award he had rendered in Madrid.
"The claimants complied with HCJM's annulment decision and took steps to appoint a different arbitrator
"As a consequence, they recognised that Stampa was not an arbitrator," she said in a statement today.
She said the Spanish Constitutional Court has rejected the appeal as the claimants had withdrawn their claim to appoint an arbitrator following the annulment decision.
"As a result, they had voluntarily abandoned the proceedings which served as the basis for their constitutional appeal.
"Following the annulment of Stampa's judicial appointment in Spain, he lacked the authority to act as an arbitrator and should have immediately put an end to the purported arbitration proceedings.
"This decision confirms the legal position that Malaysia has asserted since the dispute began," she said.
Azalina said Malaysia has subsequently availed itself of all available legal remedies to invalidate Stampa's two purported awards.
"The Spanish Constitutional Court, therefore, reaffirms Malaysia's position," she said, adding that the recent decision vindicates the government's policy to defend its interest, sovereign immunity and sovereignty at all times.
The District Court of Luxembourg on Jan 23 set aside the attachment order requested by the claimants over the US$14.92 billion arbitration award they won against Malaysia on July 11 last year.
Azalina said the attachment was based on the purported final award and the purported preliminary award issued by the purported arbitrator Stampa on Feb 28, 2022, and May 25, 2020, respectively as well as on the ex parte exequatur order before the Luxembourg Court of Appeal.
She said the court accepted Malaysia's challenge based on the fact that the claimants had, according to the court, voluntarily omitted to reveal their real address.
She said the court considered this omission significant and found that the claimant's conduct impeded the service of documents and the enforcement of the potential judgment to be rendered against them.
A French court last year ordered Malaysia to pay US$14.92 billion to the Sulu sultanate heirs to honour a colonial-era land deal.
Malaysia, which did not participate in the arbitration proceedings, maintained that the process was illegal.
It obtained a stay against the award's enforcement in France, but the ruling remains enforceable outside France under a United Nations treaty on international arbitration.
Last July, two Luxembourg-based subsidiaries of Petronas were seized by court bailiffs as part of the heirs' efforts to enforce the award.
Following this, Petronas said it would contest any claim on its assets by the heirs of a former Southeast Asian sultan, who are seeking US$14.92 billion in compensation

Malaysia as a successor of British North Borneo Company ( BNBC) only paid the sulu hiers a meager amount of 5,300 ringgit annually which this insulting amount not even enough to pay home electric bill and water. It was malaysia who forced the heirs to seek international help and by means of international arbitration this may help them to achieve justice.

@@aseananalytics partial win...is a partial loss.... remember, the operative word is partial. Hence, not their's. because if it is truly their's... no qualification should be necessary.. and since their win is only partial there is legitimacy to the Sultan of Sulu's claim.

Well it only have two peaceful scenarios here; one the Malaysian government will annex sabah and the sulu sultan will become sabah's private owner, two the sultan will have that land back to the philippines and its benefits. So before it became an issue of sovereignty Malaysia should consult the Philippine government and bring that issue in far more superior international courts.

What I mean was the heirs of sulu's former sultan who lead the sulu is going to own that land privately without bringing that territory back to philippine government, and the issue wasn't because of territorial claim of Philippine government but the rights of heirs so what ever the decision of heirs about sabah will still be a legal case because of previous claims and court rulings that doesn't involve Philippine government and by Malaysian authorities.

Malaysia should give up Sabah to the Philippines, the real owner to avoid future conflict and may disentigrate ASEAN unity. Take note that the Philippines is now slowly building up its military power. Once the conflict in Mindanao is settled and prosperity will come in, and the PH has no other problems to comfront internally in the near future. Time maybe ripe to fan the burning sentiment of .many Filipinos that are victims of injustices inflicted on them by the British and Malaysians for not returning back Sabah. They could choose to do what they want. In the current arrangement with Malaysia, peninsular Malaysia basically suck the resources of Sabah and just returned somewhere around 50% in the form of services and payments to personnel. If they become a devolved province they can utilize it to their advantage and defense would be the responsibility of the national government.

In the first place, does that British company have any legal authority to cede a property that they do not own? That is highway robbery by the tenant with the landlord (the Sultan of Sulu) as the victim. He lost his land (Sabah) because his tenant sold his land to someone else (Malaysia).

The missing link is the British company which leased Sabah from the Sultan of Sulu. That missing link is also the entity that ceded Sabah to Malaysia. If you insist that the lease agreement is between the Sultan of Sulu and the British company, then Malaysia has no right holding on to Sabah. If you say that the British company ceded Sabah to Malaysia, then Malaysia is going to inherit whatever obligations/contracts that the British company has with regards to Sabah.
But the real question is, does a private company have legal authority to cede a territory to another country? The answer is no and you know it.

Malaysia is not going to return Sabah to the Philippines. So the best course of action here is perpetual rent by Malaysia of Sabah from the Philippines. An annual rent of Sabah commensurate to the present economic condition should be agreed upon by both parties. Malaysia is going to be the tenant while the Philippines will be the landlord.

@Hope Lope The fact the British Overbeck signed a business CONTRACT with the Sultan is a LEGAL recognition of his control of that land. Deal with it. The $15 billion award is just DAMAGES, there's another part of the arbitrarial ruling: that there was a BREACH OF CONTRACT by Malaysia & that the CONTRACT WAS Voided, so the property being rented should be returned to the owner. That's the crucial part still not being discussed in the Malaysian media

There are 9 principal heirs as per Mcaskie ruling in 1939.So Malaysia has to contact all heirs not the Philippines is owner of Sabah.
Yes they need to contact the hiers of sulatnate of sulu. Sabah is not owned by PH govt. Its under PH territory,ph govt. help the hiers bcoz they asked help for the govt. to claim the ownership of sabah.If the malaysian govt. want to finish it give what is due to the heirs.Then the heirs decision whatever choice if they will give it to PH govt. or keep it as their own. Since the sultanate submitted to the government of the Philippines, they also have to pay taxes to the government

Based on this documentary series. People of Sabah are property of the Sulu Sultanate and Sabah citizen does not have say in the matter of what they want. Also, based on the Philippines passport incident, Philippines are trying to take the Brunei portion of Sabah too.
There could be a debate on current Sultanate legitimate sovereignty since America force them to renounce it in the Carpenter’s agreement.

As an ethnic group, the majority of us are filipino citizens. We can always claim we didnt get out inheritance. 😊.. it doesnt mean if our grandparents left that they would no longer be entitled to their inheritance.
