Fresh out of the dreary times of the Covid-19, to straight resume with a session as momentous as felicitation of Justice P.S. Narasimha, one of our very senior, seasoned, loved, and respected members of the Bar on being elevated to the Hon'ble Apex Court Bench, and Justice Narasimha beginning by confessing that he was waiting to be invited, is everythng that the endeavour called the Friday Group could have ever asked for. It is not only a testament to the gravity and significance with which we are perceived with by all at the the Bar and the Bench, but also a validation to the fact that each day counts, each Friday matters, and each talk, is going forward, with steadiness and sincerity. Justice Narasimha put it so rightly that what to not learn is as important as to know what to learn. The SC Bar being termed as a mini-India for accommodating and welcoming so much regional and intellectual diversity, is so apt. It is so inspiring when he says that this is a place where it is possible that even despite we having come from nowhere, we can always aspire to reach anywhere. In today's times how much significance it holds when he underlines the importance of upholding our independence even while we have our respective ideologies or allegiances, political or otherwise; because nothing is more material than the truth. These are some enriching 30 minutes where life lessons learnt by the great Justice Narasimha himself were encapsulated for our benefit too. Hon'ble Mr Justice PS Narasimha talks so elegantly, eloquently and effectively and one who concedes that he learnt so much in Supreme Court! How I wish he some day rules that it is a national tragedy that Uttar Pradesh which owes for maximum number of pending cases slammed by former UN Secretary General Ban ki Moon as rape and crime capital of India and still has just one Bench and that too so near to Allahabad at Lucknow and nowhere else! Why Judges of Supreme Court never speak on this worst violation of the right to equality as enshrined in Article 14 of the Constitution despite the irrefutable fact that Justice Jaswant Singh Commission having recommended three HC Benches for undivided UP yet 75 years after independence we such just one Bench in Lucknow created way back in 1948? Why only a few peaceful State like Maharashtra which already had multiple HC Benches was given one more in 1985 at Aurangabad and Karnataka also so also in Madhya Pradesh and West Bengal but for UP just one and West UP which owes for maximum number of pending cases we see no Bench and so also in lawless Bihar we see none? Why the 230th report of the Law Commission of India is lying unimplemented even after fourteen years of its being submitted to Centre? That is the real rub! Let the respective jurisdictional high court judges decide which judgement suits their present case and intellectual interpretation of the respective legal provision. Let me know your innovative ideas and opinions.
