The recent judgement by SC on the govs refusal to sworn in as minister is well addressed
The switch over of MLA to rule party ,the speaker is taken to task by SC
In HP the defecting MLAs along with 3 of independent MLAs now need to seek fresh mandate from People.
The role of judiciary as watchdog is on rails.

    Sir
Why it took 4 years to take up the matter related to repeal of Article 370.
Why all the constitutional matters are regularly heard by constitutional bench now?

Baseless presumption that judges are somehow better than elected prime minister or law minister
Glaring nepotism is a matter of shame to the judiciary..
Why do judges want to rule by backdoor?

    • @poonam7572

Because judges are part of adversarial system having India adopted so. And they are meant to act as backdoor checkers on all other constitutional system for the adequate functioning of Democratic Nation.

Very sad to hear Rohington . He could have stopped with speaking on constitutional law. Instead he dabbled on subjects to which he has no expertise or exposure. What does he know of politics? Has he ever stepped into the streets and addressed a common man? Kashmir is an integral part of India, but will have its own laws. Whom did it benefit, except a handful of politicians. On BBC, even those fellows agreed on breach of indian laws and this chap says they are targetted. Good god, is this how he decided cases in court without reading the brief😂😅

Nothing better can be expected from a harebrained nut who opens his gob after switching off his Upper Story or the Upper story is unoccupied. You can't even spell the name of the Justice correctly.
Do you know Justice Nariman gave a dissent note on the decision of the Collegium selecting the panel of judges from Supreme Court in which Justice Akil Qureshi's name was removed as per the desire of Modi Govt?
He is a man of character with a moral compass intact!
You better keep your gob shut!

    • @navaneethrchari
      @navaneethrchari 9 месяцев назад +1

Having practical experience in the subject is the core issue. Living room opinions without anything more was the critical comment. One need not be a supreme court judge to know the law. Such a deception requires rehaul of your esteemed opinion. Many lawyers and professors of constitutional law are better equipped than the judges. Untrained minds cannot traverse beyond borders. Sitting in a room and offering one thoughts is no different

@@rajjakhmola7761 Changing time needs change in approach as well. His own father has said that 370 was a temporary provision and there was no special status ,a few days ago . Now the only question is 'Was the way to remove 370 constitutional?'. If the govt. would have gone the way of getting the consent of legislative assembly or constitution making bench of j&k , but both didn't exist at that time. So whose fault was it that there was so much political crisis and i know u know the answer to that.

    • @NirajPant2

@@navaneethrchari Rohinton F Nariman was a lawyer of some standing before he was directly appointed to the Supreme Court as the Judge.
The issues he talked aren't political science and drawing room talk; he talked about the Constitutionalism.
It is unfortunate that a section of society has so latched itself with a political philosophy and the entity that they have begun to talk like a lobtomised Nuts and you are one of that lot who talks out of his hat.
And you have the cheeks to sermonise and pontificate with upper story switched off!
