- I know it took a long time for investigators to unravel the situation, but it's finally happened. Clay Thom, owner of the ill-famed CNC Motors, was finally arrested and charged with multiple crimes. This is in criminal court, not civil. His bail was set to a massive $8.7M! It's safe to say the prosecutors are not messing around.

Sounds like Clay ripped off a judge or lawyer at some point. $8.7 million is the most I’ve heard for a property crime.

I can tell you right now that the general public has minimal sympathy for Ferrari owners so it is up to enthusiasts like us to recognize the need for and push for consumer protection legislation.
You only have to post 10% in CA. Asset, cash etc. He can go to a bondsman and use a car he ripped someone else off for as collateral.
This was a long time coming. You lead the charge on this fraudulent operation. So glad Clay is now finally in jail for all the horrible things he did to people. So many lives were destroyed by this jerk. Thank you for the great work on exposing him!

I have not seen a video from Dan in a long time. I am glad to see the CNC scandal wrapping up. Never say never because you never know what is going to drop into your lap. I began following you over the coverage you provided on the dark side of car consignments and am game for more if it is something that affected you directly.

Though I didn’t buy my McLaren 570 nor my i8 from CNC, they treated me well as a potential buyer of both those cars. (I ended up buying my i8 from McLaren Walnut Creek and my McLaren from West Coast Auto Gallery in San Diego). They assessed quickly I was a serious buyer and put me behind the wheel of a 570 for a test drive and also let me flog a Lotus Evora that actually had been the reason for my visit. I’m grateful they put me out n the 570 because I was sold at that point. The prices were too high at CNC and I wasn’t ready to buy until the depreciation kicked in. But over all my experience was very good. The salesperson I dealt with was Rex.

I got burned by a Southern California small lot dealer who loaded up his lot with cars from Manheim Auction. He never paid Manheim so they wouldn't release the pink slip. My daughter needed the car for her work but she couldn't drive it because the tags expired. We had to sue Manheim and it took over 2 years to get the title. The DMV investigator says this happens all the time and they don't file charges until the losses are over 10 million dollars. The investigator said that many small lot dealers are doing this and the large name dealers are also collecting the taxes and registration but refusing to turn them in so the buyers have to pay again to get their registration tags.
Somehow that doesn't shock me but it is disappointing to hear
I forsee a day when a gymnasium full of Ferrari luggage is discovered Indiana Jones style and everyone is made whole again!😂

This story is how I actually found your channel. I know a guy who was scammed out of his McLaren by this guy a few years ago. They "sold" his car to another guy and transferred it to the new owner without ever having the title to the car. He ended up getting the car back after a couple years but it was a huge legal and financial nightmare nobody should ever have to go through.

Dan I think you're right, the charges are placeholders. I think more charges will drop. Let's not forget that Fed charges are coming, especially tax evasion. A danger of selling on consignment is that you make the consignment lot your agent. As the seller you can’t withhold the car because your own agent absconded with the money the buyer paid.
Yeah it's all civil court stuff when it falls apart which makes it harder to resolve
@@normalguysupercar yes, this sounded like a case of commingling funds. They should have had an operating account to deposit commissions and pay company bills and a trust account of the sellers money.

In the press release from the California Attorney General's office, they mention there are 4 million dollars in fraud/theft and 4 million in back sales taxes / statutory penalties. So that's 8 million of the bond amount there, just to ensure those amounts are secured. I think this means the bail can't be reduced below that amount as well... and probably has to be in cash.
That also suggests that there's possibly almost $100m in fraudulent sales as that's just for the unpaid taxes

It's a true shame that all this happened in the first place, but a bigger shame would have been the state looking at it and saying "welp, he's bankrupt i guess that's that, sorry everyone!"
Not that him ending up in prison is a GOOD thing, but it's the path he chose to go down so it's on him. At least he's being held accountable.

Civil matters are peculiar. If you eat a $50 meal at a restaurant and leave without paying, you can be arrested for theft of services. However, a renter can beat a landlord out of $thousands in rent and that's only a civil matter. I'm amazed that anyone got pinched in this matter.

Don’t forget there was this little known RUclipsr named Doug who used CNC to source enthusiasts cars for his car videos. When CNC collapsed, Doug had to find a new place to find his RUclips cars so he decided to make his own car auction site. He then sold his auction site and Doug is now a multimillionaire lol!

I had one of my super car consigned at CNC one month before then Dan made his video exposing them. Something was wrongs. I don't know how I know but I went up to the dealership and demanded my car back, made a scene and was not willing to walk out without my car. Even had my keys willing to jump into the car and just ram through the garage. A damaged car is still having a car. Still could be fixed. Missing car can never get it back.

Never put your car up for consignment, never buy a car you feel the need to get out of or your life is over, if you are buying cars and it’s such a hit to your life you made the wrong decision. Always make a smart decision and don’t buy a Ferrari for example.

This is what happens when dealers in slow times start dipping into sales tax account money or using sold car loan pay off proceeds/ amounts to prop up the business instead of paying lenders. Also with dealer DMV bonds being so low, the house of cards doesn't take much to collapse quickly with exotic car values.

I was told Fraser left the company when he disagreed how the finances of the company was being handled. Clay wanted Fraser to invest his fireman retirement income to support the company.

I did business with Clay - we made custom belts for them to give to their clients. I felt the same way. His dad created the company but died of cancer so the boys took over. His legacy is down the drains.@@rickydavis1051

Where do you flee to when you have nothing? Clay is not the kind of professional criminal who knows how to get fake passports, safe houses, new identities etc.

I think he tried to live a lifestyle that he seen his clients live. And he got in over his head . And typically like others before him . Clay robbed Peter to pay Paul . And like others before him it always fails. Time to send old Clay a care package I am thinking a plastic model car perhaps a Ferrari LaFerrari / Bugatti Chiron/ $16.95 @ Target 1:24scale along with some . Climax brand lube and knee pads . To kind of help him out a little and give him suttle reminder . I think that would be a nice parting gift for the guys who lost there 458 or GT3 RS and are just out of that money period .
