    If a citizen breaches law it is a crime, if Parliament breaches law it is an amendment and if the court breaches a law it is an interpretation. The Constitution of India is silent about certain powers of the Parliament, whereby, the Parliament alone can decide on whether a Particular act of a citizen amounts to Unlawful Act. However we do not have a parliamentary or state legislative body to examine such matters on a day today basis and refer the matters to the Courts. The power to decide on " Reasonable Restrictions" remains as a source of power retained and vested in the hands of the legislature to lay down the reasons to apply the law to a citizen to decide upon and to refer the Matter to an appropriate court. There is no Act for Press,vand tte Journalists come under Labour Acts.
    We journalists have the discretion to use self imposed Censorship and most of us understand that the successive Governments could not create such policies that could create Indianness, sense of belonging and a National character. National Security is a subject which is fully vested in the hands of the elected government. India is still at the infancy and has not matured into a nation as it could have been. No Bills are referred to the Constitution Bench to examine the appropriateness. Such a procedure is counterproductive to the democratic system. The courts cannot issue directions to to the Select Committee. Attorney General abd Solicitor Generals if have two different views on the same matter, would the Court take view of the SG?

    SEDITION LAWS and UAPA are used against large number of people, mainly minorities, political opponents etc. More than 95 % of them are found not guilty, innocent and released after a long time in jail. I congratulate Sir Noriman for his valueable speeches.

      Nation is made of people, laws are not to be made to protect land but the people of the land.

      @@trickyabb Same judiciary did not took up the matter of carnage of kasmiri pandits in 1990.also sikhs are not get full justice of 84 carnage..When we talk about right.. duties towards nation also demand same hypes..peoples are sitting in the highways in the name of democratic rights and even red fort on 26th jan outraged...
      There are too much freedom of speech in our country.. Some deterrant must be there..

    There was an illustrious retired Chief Judge of Malaysia who kept on publicly condemning the Police for what he termed as extra judicial killings of suspects. One night a few burglars entered his home. The retired CJ surprised the burglars by waking up. He was tied up with his wife and taken for a joy ride at 3 am and released at a secluded spot by the criminals.
    Why this long story ? Surprisingly after that episode the CJ stayed silent. There are many out there to champion the liberty of criminals but not for the unfortunate victims.

    Arrest concept is british law introduced in 1861 where no examples were framed and it is being misused in spite of fundamental rights came existence by way of constitution

    This law is for criminals, not for innocents. Every criminal has an excuse for doing crime such like backwardness/mental health. Freedom must be for traveling without fear , without repeating mumbai 2008. .Removing such a law is like removing Dowry act.

      The point is their no mechanism to stop misuse the law and the crimes for which sedition and UAPA are being slapped, already has enough crpc and ipc ambit but UAPA and sedition once slapped the process to exonerate is the punishment. This marks the law being misused as a tool to target people. Who is criminal and who is innocent can be deduced after the investigation.

    The law needs to be very precise in this area, not leaving any scope for arbitrariness by the System... "Bringing hatred/contempt", "excite disaffection" might not be very subjective in the light of precedents, but the State is free to say that the alleged act (which itself is created by doctored videos sometimes) fell into the vague definition... The provision needs to be made more precise instead of being thrown away altogether... The definition must focus on specific motivations, intentions and consequences... Where there is no allegiance to militant groups, no connection to any problematic group whatsoever, a mere opinion cannot be seditious... Moreover focus on "Government" ultimately enables the party in power to misuse it... Focus should be the Nation... Just because a law was enacted in the British era, you can't throw them all away saying it's "collonial".... Use logic & foresight !!

    I have a great respect for the lordship and as a young advocate, I look upon you for guidance.
    Sir what you are proposing now (i.e. repealing the sedition law by court) is fine, but why didn't you repeal it during your tenure.
    If not, could you help me if I file a PIL in supreme court. Please answer, if you stand by on your words.

    Justice Narman is not authority to strike off any laws by British colonialism which is alien rules of laws incorporated in constitution to prevent hooliganism if any àrose from Independence declare in 1950.

    Normal Indian has no breathing difficulty. If an Indian has an anti national agenda he should feel chocked... nothing wrong in that. These two draconian law should be eradicated because it's misuse is prevalent, particularly against those who are daring to raise voice against the arbitrary act on the part of the state. It goes without saying that arbitrariness itself denies equal protection guaranteed by the constitution of India under Article 14..

    sedition law brought by british queen which was in indian penal code in 1860.
    This law came since there was revolt in 1857.
    Indians should not feel feeling of independence. To creat more fear in the minds of indians ,it was brought by brtish quuen.whoever by signs or words shows disloyalty against brtish queen or representative,shall be punished with life imprisonment .After independence,queen and representative is deleted where government word existence is continued.

    There is a provision in the Indian constitution, by which government can re- appoint retired judges in the Supreme court. This person thoroughly deserve. The judiciary will be immensely benefited.

    THE INDIAN PENAL CODE
    Section
    [124A. Sedition.-Whoever by words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards, the Government established by law in [India], shall be punished
    with [imprisonment for life], to which fine may be added, or with imprisonment which may extend to
    three years, to which fine may be added, or with fine.
    Explanation 1.-The expression “disaffection” includes disloyalty and all feelings of enmity.
    Explanation 2.-Comments expressing disapprobation of the measures of the Government with a
    view to obtain their alteration by lawful means, without exciting or attempting to excite hatred, contempt or disaffection, do not constitute an offence under this section.

      In Roman law ,the justices are lord ,that concept have greatly infected his mind .

    एक आदर्श समाज के निर्माण के लिए कठोर कानून आवश्यक ही नहीं बल्कि अनिवार्य है।
    अतएव ध्यान रखें महाराज, अत्यधिक छूट कही गले में फांस की तरह न बन जाएँ।
