    Why should law allow any sort of " Adverse Possession" isn't injustice with property owner? It is advisable to judiciary review and make laws so affirmative that no one should loose his right of ownership in any circumstances

      this has become trend in India Tenant does not pay rent and Owner cannot forcefully evict tenants if Owners go legally it takes more than 3 years, Tenants know this is time taking Tenants take benifit of this at the end its mental harrassment to owners and there family members, Court, Lawers
      this is why if people become rich they go out of India, no one invest in india.

    ऐसे केस में सजा का क्या प्रावधान है, कब्जा करने वाले को किस प्रकार की सजा दी जाती है। क्योंकि कब्जा करना भी एक प्रकार का अपराध है, इससे असली मालिक को मानसिक और शरीरिक दोनों तरह से प्रताड़ित होना पड़ता है। ऐसे मामलों में दोषी को ऐसी सजा मिलनी चाहिए कि उसकी सात पिढियाँ भी कब्जा करने के बारे में ना सोचे।

    Adverse possession is mockery of justice.
    If someone has bought property with her or his lifetime savings and allowed it to be used as rent , then with this law nobody can be thrown out even though it don't belongs to them.

    Thanks, लेकिन शीर्षक भृमित है। 1 दिन मे कैसे खाली हो पायेगा, पुलिस कौनसा बगैर court order के हिलेगी? और कोर्ट तो दशक ले लेंगे फैसले मे, वो भी वकीलों पर हजारों/लाखों खर्च करने के बाद।

    It's injustice to justify adverse possession of any period. This law has opened the way for adverse possession. This has created problems in society. Adverse possession should be declared illegal

    Not only settled possession, it must be an open possession where owner must be aware of the possession of tenant and still doesn't object to it... Then only adverse possession applies. Secret possession does not entitle anyone to claim adverse possession even if it is a settled possession of more than 12 years.

    Thanks for giving Tota ram and Puna ram judgement of Hon'ble Supreme Court. I have one problems.
    One gentlemen has sold his plot to a distance from person who has sold same plot to me within 8 months. It is a be_lagaandeeh plot from 1910. And no mutations is required for any be_ lagaan deeh plot by circle officer of area. Here in first stage original owner was living in that plot and after selling in 2001 he was residing in same plot as usual. When I purchased this plot from his relationship, first man asked to give him permission to staying in this half built home which was given honorarium.
    After 8 years first original man died but his son and his family did not vacated and lived as usual and blocked giving any advance upfront called rent ( it's a village and rent is below 500 rupee).
    In 2011 send notice after failing his father commitment to pay rent. Then later his son adjoining the hands with local cheapest quality anti social elements, and trying to abuse continuous ly. Second notice was given but not replied After sending third notice, he says.. That it is his Patterns property
    Case has been filed on court in November 2021 and notice has been issued in October

    There should also be accountability when a Judge knowing well passes a fraudulent order against the facts and merits in a case. FIR should be registered when a Judge deliberately makes a wrong version of cross statements.

    As an NRI family from Punjab need help, is out of the country for way over 12 years and tried to talk to the people who are living in illegal occupied and they threaten with guns for generational property under father/grandfathers(late) name originally written in Urdu farads.

    If anyone can guide me-
    My neighbor in village constructed a small temple on my land while i was in army. The temple built was in residential area and next to my house and it was all intentional as we were not on good terms. Now i got retired and thought to expand my house but found out 80% of the temple is on my property and 20% on his. So now how to acquire my land again.
    I don't know what to do in this situation, any guidelines to start with ...will be appreciated.

    Kanoon toh aisa hi hona chahiye ke jo Malik hai, Jiske Naam Property registered hai( clear registration no jhol jhaal) hai. Jo uss property ka waris hai, jiske naam bills of municipality, electricity aate hai , usse property aur possession mil na hi chahiye.( The municipality and electric company cannot do illegal transfer( jo corruption karte hai usse saja mil ni hi chahiye)
    Nahi toh Kissi Kanoon ki jarurat hi nahi !
    Aise toh Koi bhi kisi ki property mein Guss jayega aur Owner bichara court mein apni property ke liye saalo tak bheekh mangata hi hai.( Current situation toh aisi hi hai)
    Adverse possession ka toh sawaal hi peda nahi hota! Corruption ko badhava Dene wala kaam 12 saal Wale yeh law hai.
    Case toh 12 saal tak kissi ki property PE avaid kabja karne ka hona chaiye.
    If Laws can't protect, its citizens ,what is the need for such obsolute laws like 12 saal!( Iss mein court mein argument ki koi jarurat hi nahi. If the law of land is supreme.
    Koi bhi Kanoon tabhi Tod ta hai jab usse malum hai ke usse saja nahi hogi.
    Ek hi Court ka faisla supreme hona chahiye.( Kitne saal owner has to fight to prove his right) ek court se dusre court cases ko bhejne ka matalab hi hota hai corruption.
    Kanoon ki vyavastha citizen ke rights ko protect karne ke liye ho ni chaiye na ki unhe tang karne ke liye.
    Judgement should be based only on merits morality, intention and circumstances.And not on the mood and fancy of the Judges.
    aaj tak ke Lakho log jinke cases pending hai
    Courto mein jante hi hai court mein kuch kaam hota hi nahi.Bus vakil apni khichdi paka kar khate hai. Ek vakil hazir hai, toh dusra Gul! Kabhi judge leave PE hote hai . Bus Tarik pe tarik chalti rehti hai.
    30- 30 saalo tak case mein kuch hota hi nahi.
    Koi koi csses mein toh original case parties bhi Guzar chuke hote hai aur firbhi cases chalte hi rehte hai!
    Mediation aur compromise ka humesha open hota hai kyu ke iss mein lawyers ko tagdi rakam milti hai! Nuksaan bichara Owner ka hi hota hai.

    Ksbha milne me hi 30-35 years lsgvhste hdi tab tak ksbha lene wala ki desth bhi ho jati hai. Judges ko kewal politics me jyada interest hai aam aadmi jaye bhad me. Aidi court bhi honi chdhiye jo in court k kriya kalaap par nigrani kare. Decifion 1-2 years me j jsna chahiye.

    There is no way you can evict a trespasser in one day.
    That India doesn't exist.
    There is so much harassment and bribery in lawful eviction, that God save everyone from going to court.
    Unless there is legal reform and accountability of judges, lawyers and court staff for inordinate delays, it. is better to avoid court cases 😢😭🤧

    Judge को घर किराए पर दिया था 5 साल पहले
    3 साल तक तो बराबर किराया आता रहा और हर साल rent agreement भी अपडेट होता रहा
    लेकिन उसके बाद ना रेंट एग्रीमेंट भी अपडेट नहीं हुआ और ना किराया आता है judge बात करने को राज़ी नहीं है और ना ख़ाली कर रहा है
    कोठी में मोज कर रहा है
    अब क्या करूँ

    Sir, mera property ki registry mere naam or meri wife k naam se hai.4 saal se, mutation bhi mere naam par hai , or property tax bhi mere hi naam par hai. mera us property par loan bhi chal raha hai , suddenly koi complain karta hai bolta hai yeh uska plot hai. jabki jis buyer se maine kharida tha uske pass property 25 saal se thi with proper registry and mutation . police dabav bana rahi hai ki mai usko khali karoo.
    maine bahut mahnat karke property kharidi thi or family mai ab sab paresan hai ki koi aisa kaise kar sakta hai ki hamarai property ko apni batai. sir please help.

    A piece of land measuring approximately 5100 sq.ft.has been illegally occupied by a person belonging to paswan caste.contacted police station several times but no action.When I approached the occupier at personal level he denied to show documents of land in his favour further the occupier threatened to implicate me in false case of atrocities against harijan.How to get the grabbed land back? What does the "use of reasonable force" mean?In the process of use of reasonable force, if opposed with same strength by the occupier,may lead to injury on both sides then who will be held responsible?

    "8. he may even use reasonable force to keep out a trespasser" is a kind of gundagardi invitation only and court is allowing you to do it keeping the legal ways out of it. Not a good thing at all.

      Renting a property is proof that it is not owned by the renter and therefore, not possessed. Renters should not get their minds fogged by greed.

    Sir aapane bahut acchi tarike se samjhaya hai lekin sir mere grandmother ke naam per ek place tha tha Jo hamen 1 sal pahle pata Chali hai, lekin vah place per hamare padosi rahte hain 25 to 30 year se rah rahe hain .to ab hamen kya karna chahie vahi samajh nahin a Raha hai sir please kya karna hai hamen thoda sa Bata dete to bahut helpful hota

    पूज्यनीय फत्तुलाल जी ने ध्यान भजन सुमिरन के लिए धर्म स्थल हेतु रजिस्टर्ड दानपत्र द्वारा 1994मे भूमि दान दी है।
    भुमि का नामांतरण होकर भुअधिकार पुस्तिका बनी हुई है। रजिस्ट्री में लिखा है कि आज केबाद हमारे वारिसान भाई बन्द का कोई अधिकार नहीं है। इसपर दानकर्ता के वारिसों ने कब्जा कर लिया है और सत्संग बन्द करवा दिया है अतः यह कब्जा हटाने के बाद पुनः धार्मिक कार्य चालू कर ना है । सत्संग करने वालों के पास बाहूबल की कमी है क्या दान की भुमि वापस होती है। प्रार्थना है मार्गदर्शन करने की कृपा करें।जय हो 🙏

    Sir what if a person using agricultural land from last 30-40 year continue without any complaint but after this long time people come with there khatoni and sijra and do measurement of there land with the help of patwari
    Can the person who using that land from last 40 years without any complaint can legally become the land holder of that part? As adverse possession

    Sir i want ur opinion in one case
    At time of my grandma they have given one property on rent with rent of only few rupees, it went for long time because in those days no one need them, but as he was not increasing rent uncle told him that leave the property but he didn't listen
    So we went to court, but he has produced fake witnesses by giving money result came on his side, 2 times we lost the case, now the person who took on rent has died & his kids are not ready to leave that place even we sent them notice, it is actually a shop on road but they are living in that shop & now we need that property because of some financial issues
    Any suggestion in this case

    Sir I had given rs.18933/- to advocate who files my tax last year in December on his asking but tax was not deposited as tax was nil. I asked him about the same he said that he will refund the amount. Till today he has not paid the amount back despite my several what app MSG , he does not pick call plz help me

      Maximum lawyers have thug nature ,nxt time to file tax prefer ca .dont take any action it ll give you more stress leave it but do negative marketing against him like whenever someone ask you how was that lawyer then tell them he is a thug took money but did nt return it .this ll hamper him

    Sir my tenant is a good person doing business in our land but if 12 years passes and if he asked for possession then can we vacate him legally, every 3 year we makes agreement now 9 years passed

      Iska answer to main bhi de sakta hun.. if the tenant is paying Electricity bill or similar other bills (landline/gas) which is not on tenant's name but to the real owner's name then the tenant can't even claim for such possession. So you can sleep peacefully and enjoy your rent :)

    Can anybody expect real and honest justice from the courts..? The advocates as well as judges get bought who can turn the cases against the petitioners ,even if they are in the Right.
