@Daniel Barnett, Barrister what does the law say around having the right to legal representation before appearing infront of a magistrate? Is it a breach of human rights if this request is denied, for example, by the custody officers at the court?
You get charged if its 40 or over, 35 is the roadside one. They only gave me 2 tries to blow in machine, charged with failing to provide specimen, went to court, cps never bothered to show up, they just emailed my solicitor the early morning of my court date that there not pursuing with this case as it'll cost them to fight and they'd probably still lose.

@@alexandrugherghe6729 I don't condone drink driving. How come you got to wait 2 months for your court day? Mine was only approx 2 weeks. I just got a solicitor, just be truthful to your solicitor, there's specific ones for drink driving. The police statement, with how they described how I was while in their custody helped my case. It helped a lot to prove my innocence. I hope you all the best.
No you are not screwed at all. Before your court appearance jack your job in and don't sign on. Having zero income you will not get a fine. After the court case sign on and if you have a wife and four kids you can claim benefits that will probably be better than your wages in your last job. Take it easy and put your feet up for eleven years. After 11 years you can apply for your licence back and it will be clean with no DR10 endorsement.
@@jimdavis5230 You forgot to mention about being able to claim extra disability benefits for being an alcoholic, they will really top up your money plus loads of extras like a free bus pass. Sometimes crime does pay.
Hi I was sitting in my car in Derby after had some drinks,I was sitting in my car eating kebab with my engine on.Police some and arrest me coz I was sitting inside my car for my license for 11 months,my very 1th offence never done nothing bad never had a issue with police before,also I had test and failed coz I had alcohol in my sistem,I have court date on 5th September,I want to ask you what will happen to me ?😭
Unfortunately, even just having the keys on you, standing by the car, you’re “in charge” of the vehicle. Being In it, engine on, in a public place, you’re absolutely “in charge”. I fear you’ll have lost your licence.
There’s one good peace of advice regarding drink driving and that is just don’t do it.

I understood these are offences and not laws therefore on the basis of statute laws any one can choose not to consent and agree to any road side test

Do the police do the eye test, checking for nystagmus as they do in the states? How accurate is it?
