"The feasibility of accepting surrender refers to whether it is practical and safe for the opposing force to take custody of the surrendering persons. Consider the example of enemy soldiers who man an antiaircraft gun and shoot at an enemy aircraft, and who then raise their hands to surrender seconds before a second aircraft attacks their position. In the circumstances, it would not be feasible for the crew of the attacking aircraft to land and accept their surrender. Similarly, a soldier fifty meters from an enemy defensive position in the midst of an infantry assault by their unit could not throw down their weapon and raise their arms (as if to indicate their desire to surrender) and reasonably expect that the defending unit would be able to accept and accomplish their surrender while resisting the ongoing assault " - The legal and practical elements of surrender in international humanitarian law, Geneva Centre for Security Sector Governance.

A very relevant factor is whether there's a history of Russian troops trying to be deceptive about surrendering - not hearing anything about whether that's been a trend? - which certainly reflects on how attacking troops will behave on the spot.
@@xmuzelever hear of Japanese soldiers surrendering to Americans with live grenades? Not saying Russians are doing that but he’s speculating on something like that
@@xmuzel I'm talking about Russian soldiers holding grenades or pistols in their pockets while pretending to surrender - or laying on an assault rifle while pretending to be wounded - then attempting to attack UAF soldiers when they have the opportunity - ie. being deceptive about surrendering. Im saying if that kind of thing has been happening a lot then it would explain UAF troops being very quick to err on the side of caution and shoot "surrendering" Russians if there's anything even slightly suspicious. SPECIFICALLY I was wondering IF there had been a lot of that type of deceptive behaviour. I personally do NOT think there has been that trend and so this unit are committing crimes.

@@Angstbringer18B6000 is the number claimed by Russian officials, so it obviously can't be trusted. Ukraine has not officially disclosed how many prisoners they have taken, so the 1200 is made up.
Correct me if I'm wrong here, but I believe there are provisions for not being obligated to capture enemy POWs if the unit is not capable of safely accepting them. The case of the unit being small, low on ammo and supplies, no available logistics, and being unable to handle their own wounded makes a solid case for them not being in a situation to accept POWs. Not sure how it works out if you initially take them and realize after the fact that you shouldn't have. To preempt the rage comments, I'm not saying anything is right or wrong here, just rules as written. War is hell and sometimes things that "feel wrong" have to happen. A group of 12 soldiers with limited supplies and several wounded cannot be expected to accept 30 POWs while out on a mission. So rules are in place for that.
this sounds more like you are trying to find a way to explain their actions in a positive manner cause you know what they did was bad, nowhere in the statements made where killing alot of POWs to a point where you can say they couldnt safely take them back, also they were embedded with other AFU soldiers, it wasnt just them so the 12 against alot of POWs doesnt work, they just wanted to take no prisoners simple

The medic and whoever spoke to the NYT should have reported the incidents officially. Ukraine does not condone war crimes. Instead, these incidents, whether true or not, will be used by the russians to their advantage.
The Chosen Company commander has already had an interview and cleared everything of this. He is an american. Ryan O'leary is his name. He wants them to investigate so they can move on.
I believe this footage is what they were referring to as the guy who ran to the wrong trench. It's on their page. He ran to the wrong trench and then back to his old position to presumably fight. In their defense, it was chaotic and the gopro footage when he's back at his trench, well... you definitely can't clearly see him surrendering from the chosen position. I'm pretty sure this is what they're referring to... When he ran to their trench his hands were at his waist but they were up... it looked more like an OH SHIT WRONG TRENCH reaction rather than him surrendering and then for him to run off and start fighting back? Definitely not a war crime. The other "mercy kill" I'm not sure that was posted.
I am an American citizen and this is not ok at all. If someone is surrendering, you don’t assassinate them. I don’t know what really happened whose gun was where, what happened earlier in these fights, but it sounds bad. Especially if this guy was truly crawling to them begging for help that is disgusting!!!!!
There is an interview on Garand Thumb ("Combat Vets Explain") where two foreign fighters (one American, one British) tell in no uncertain terms how they usually don't take prisoners, shoot everybody even when they're surrendering and helpless, and even shoot those who appear dead, because you never know. Very good interview btw. So I'm not surprised anymore.

Nah man ima not gonna focus in on this when nobody is focusing on how many times the russians have done this to un wounded prisoners the russians have videoed it and posted stuff like this back to back and I see no westerners focusing on that
The ruzzianz were the first to claim western fighters wouldn't be granted the protections of being a POW. The ruzzianz openly stated they would treat all western fighters as criminals (we all know what that means). Reap what you sow ruzzia
Same things have been happening since 2014 on both sides. But western media preferred to avoid covering Ukrainian war crimes at all cost. There's a reason why pro Ukrainian NPCs believe that Russia randomly bombs schools and malls even after amnesty international reporter that Ukraine was using civilian infrastructure for military purposes in every city they visited
Or, his under resourced unit, low on ammo, having issues carrying their own wounded, couldn’t safely take them, and their lack of resources could have killed them all. There are provisions for situations like this! By all means investigate, but not all is black and white in a conflict. That’s life, and war!
If your friend is doing something wrong and you don't say something he's not your friend Ukrainians or shell-shocked full of anger you need to make sure they can control that anger and not do stuff like this because they have lost friends and family they have no empathy for the enemy and if you still have some empathy you need to pass that on to your friend
I think a big problem here is that the Ukrainian propaganda is constantly dehumanizing the Russians. Just remember how they always refer to them as "orcs". Not saying this is the cause of the problem, there have always been and will always be crimes in wars, but this propaganda is certainly contributing.
there is actually a full almost 1 hour video of that assault ( I am talking about the first you mentioned) with interviews and footage where is clearly seen those 2 getting fragged
Saw videos of operation shovel, and the first instance is definitely not a war crime. It was weird because since it was a pinch, one of the russians ran toward chosen co thinking they were friendlies and when he realized they weren't russians he ran back for his mate weapon so they dropped him. The other 2 russians were in the crater. One was wounded and surrendering, and the other was wiggling. But the guys in the ground couldn't see the guys in the crater, so they lobbed the grenade. It was all pretty quick. Check out the videos.
If you watch drone footage you frequently see attacks on hors de combat soldiers and even wounded men being carried on stretchers. I've seen the latter though *also* with another ending: the grenade missed and the guy who had been on the stretcher sprinted away faster than the guys who had carried him...
You need to understand what an hors de combat soldier actually is. Stretcher bearers do not get protection under Geneva. They are soldiers, free to be targeted until they disarm and surrender. Russian soldiers have a nasty habit of pretending to be injured or dead, only to turn out to be laying on top a live rifle or grenade. The Geneva Convention recognizes that sort of thing can play a role in determining who is or is not hora de combat. Given the situation, the only people getting protection are those who disarm and clearly surrender. This is why you will see some Russian troops completely strip themselves down to their underwear when surrendering. You will also see Ukrainian soldiers processing surrendering troops go out of their way to remove certain items so that the POW is not mistaken for being an active combatant by following units. I've seen soldiers remove packs that has already been searched and tell the POW not to put it back on because it might make them look armed, before telling the POW to keep marching toward the back of the line.
@@tochallengethehorizon6487 Well if you attack a group carrying a wounded soldier on a stretcher that is a warcrime is it not? I remember this and specifically they killed the incapacitated soldier by dropping another grenade on him after he had already been lying on the ground. As for Russians pretending to be injured, I mentioned the sprinting guy on the stretcher (different situation) so yes I'm aware of this, too. Still many times you see them drop grenades on soldiers already crippled from attacks by drones. Also I've heard several reports by Western volunteers where they spoke of taking no prisoners at times (which is not right but still understandable) and murder / torture of POWs. Nontheless of course I'm on the UA side. It just seems wrong to not talk about this reality.
@frankschaeffer8153 It isn't. That's a group of armed or presumably armed soldiers, and open to attack. Geneva used to have specific detsils for what one needed to do to be categorized a stretcher bearer unsuitable to attack, but no armed forces really deploy unarmed and marked stretcher bearers anymore. It's just armed soldiers doing these duties basically.

Allegedly, there was one that happened during one of a youtubers video's, CivDiv. I believe it was from the Finish Medic in the video concerned, which was during the first Kharkiv/Kharkov Counter-Offensive. During the video the camera conveniently cuts out during the war crime then in works again after the carnage had unfolded. Apparently the guy actively policed and deleted comments. Story goes something like this: "The one they call 'Jabrony' executes a Russian officer during a talk under truce, which leads the to the Russian unit, who were bunkered up in a basement of a partially fortified building, fighting to the death and the Foreign Volunteers (UKRAINE) suffer casualties as well . There was an artillery hit at the end of the firefight which is blamed for all casualties, despite drone footage contradicting this by showing a dead Russian Officer on the stairway leading up to the front door before the artillery had hit. Again...... Allegedly.
Hello Preston. Love your videos. I have been a subscriber to your channel from the beginning. We also served together with the 101st at the same time, and were deployed to Afghanistan, during 2010-2011 Deployment. I was with 1BCT, 1/327 inf. Anyways I'm a Ukrainian/American, my parents moved to the US when I was just a baby. After Highschool, 2003-2014, I served in the US Army. After a full out invasion of Ukraine by the Russian forces, in February 2022, and after finding out about the Ukrainian International Legion. Me and two of my good friends, who are also US Army vets, made our way to Ukraine to join the Legion. Anyways, to make a long story short. I served in the 3rd battalion, (3 ОБСпП) of International Legion for Defense of Ukraine, from April 2022, until May 19th 2023, when I got injured at Petropavlika, in Donetsk region. Once again, to make a long story short. Maybe things have changed since I've been there, but in our battalion, there were 3 companies, Alpha, Bravo, and Charlie, aka (Chosen). Alpha and Bravo were all foreigners. Alpha was mostly made out of Americans, Canadians, Brits, and some New Zelanders. Bravo Co, was mostly South American, and few Australians. However Charlie Co, aka Chosen, was mostly made out of Ukrainians and volunteers from the former Soviet Union Republics. You didn't specify what battalion you were talking about in the video, but somewhat knowing how the legion operates, most Americans and English speaking volunteers with previous military experience are mostly serving in the 3rd battalion. Therefore I assumed, this was the third battalion. However, even though hatred towards the enemy is common in the warzone. I honestly don't see that happening. Maybe it's a Russian psyop or whatever. But when I was there our commanders would never allow this to happen. Please understand, I am not trying to sound like it's all roses and peaches over there. No, not at all. This war is brutal and gruesome. Something I never saw during my years in the US Army and my multiple deployments to Iraq and Afghanistan. This war is something completely different. However, because of the help from the West, Ukraine is trying to uphold all of the Geneva convention rules. Therefore it's a little hard to believe. Because honestly, I never witnessed any termination of a wounded or surrendering enemy. Honestly it was completely opposite, in most cases, if we still had to press on, but we had some POW's, we had to designate a few guys to transfer them back to our positions. Plus the fact that Chosen was mostly Ukrainians and volunteers from other former Soviet Republics, makes me think that this article is some sort of psyop or something. Regardless. Always love your videos.

Love how Russian Rusichi called the worst military unit possible on this channel, but chosen are only " facing allegations." At least this Infotrash didn't say faulse allegations.
Unfortunately, if war crimes occurred, accountability must be held, which is unfortunate only in that the volunteers who may have committed these war crimes threw away their lives and their actions (the specific actions resulting in war crimes) will remove them from the battlefield, depriving Ukraine of their legitimate skill sets and added man power.
@@juicingfactor1463 Do you know how to read? Maybe ESL? I ask because if you are literate and not ESL, then you may have noticed the fact that what was declared to be unfortunate was that if war crimes were committed, 'accountability must be held,' and it was further clarified that it was only unfortunate because of certain circumstances. Tell me, would it have made sense to say: "It is unfortunate to the families of the dead orcs that we must hold these American-led UA volunteer soldiers accountable for any war crimes they may have committed against the dead orcs?" The fog of war must be real thick in this conflict. Foreign (US) fighters wearing Ukrainian flags and gear, almost like a Company of mercenaries. Russian PMC's not following rules of armed conflict either. I can see the frustration on the side of this Chosen Company, but they may feel like they don't have to follow the same rules because they aren't Ukrainians. So many moving parts. This is a tough one for sure. If these guys truly weren't following the law they will be hung out to dry, and I can't see the Ukrainian government going to bat for a group of volunteers outside the chain of command.
I don't see the tough bit. If you break the law, you must be willing to carry the consequences. This is not a video game, it's real men asking for help. Neither side may do it.
I can see why this happens, especially when the side you are fighting you has no issues flying drones into blocks of flats , it creates massive amounts of hate.

Maybe you should have named what a specific law actually sounds like before talking about “crime”? There is no law that would force anyone to take a prisoner. There is a clause that leaves everything to the discretion of the soldier, and in fact only the soldier himself can decide for himself whether this was a war crime or not (regarding capture). Only one last case out of three CAN be classified as a crime. And then, even after being captured, in the period of time between the moment of being captured until delivery to the place of detention of prisoners, variations are allowed by law, where the captured person is eliminated, and here again a lot is released at the discretion of the soldiers accompanying the prisoner, since this is the field of battle, not a police car in a peaceful city, only they decide how possible the mission of transporting the prisoner to the place of detention is. Imagine that you are an acrobat, balancing at a height of 50 meters without a safety net and checking every centimeter of your body movement so as not to die, and then some yellow-throated chick from the crowd below shouts “hey hey, you are committing a war crime, you should have taken that butterfly captive, that sat on your balancing pole, you should not have shaken her off!”. The only answer that comes to mind is "STFU". But of course, unambiguous cases of war crimes in the case of prisoners are also possible.

Regardless. Always love your videos.

russians do that. Russians accept thousands of ukrainian surrenders per week and nothing happens to surrendered ukrainians. It would be a warcrime if they didnt
Because this can save lives on both sides. Its not always that people surrender when its obvious they have lost. And keeping the ability to surrender alive as an option saves people from having to engage in the first place because they know there is a better option.
Are you shallow or what? kill their buddies so you must surely die? this is war not some airsoft game. Its called war crime you silly little pig

One army plays by the rules and one army doesn't. Who is most likely to win the war? Iran has declared that if they get drawn into the war, they will not play by the rules.
True
the rules make sure Ukraine can continue receiving western aid. One of their conditions for winning the war
@@clankclankimatank the rules also guarantee they can never win the war, thus sacrificing tons of their people for nothing. do you think that's moral? Russia will never back down or surrender until Russia feels the pain of the war. for a war to end one side needs to lose the will to fight. why would Russia do that if everything is running smooth in Russia? as you said, it's all a money game it has nothing to do with morals. the west did and does a lot worse except they're the ones with the money.
@@clankclankimatank though even if it is proven ( may very well be true ) then the actions of a few cannot and should not decide if UA gets dropped like a hot potatoe, though the manner in what (or if) investigations are carried out in the higher and highest command circles may be a different thing. But lets be honest, the video evidence of russians shooting up civilian cars willy nilly in the first days of the war, Bucha, Irpin and lots of other places did NOT cause the big international outrage it SHOULD have caused, the help was very lacklustre then and the sanctions are still not fully implemented to this day, but you are right, they may just be used as cheap excuses to drop out of the group of countries which sent aid.
@@thingamabob3902 oh I agree, it's just a looming possibility that I hate to see get any fuel
unless there is actual footage or you were there, you really cant say it was a war crime. alot of russians wounded crawl and dont stop and when the medic comes to try to give aid they pull a grenade and try to kill the medic. its why you see sometimes they call to the russian wounded to stop and surrender in a trench if they crawling and if they dont stop crawling they just shoot him.
perfidy is common among russian soldiers.
This happened in the Pacific War, “Japs” would feign surrender or being wounded, then throw or set off a hand grenade. Marines quickly took a no prisoners policy; especially after finding Americans who had been captured that were tortured and killed.

Sorry that it's happening on either side ... It's wrong
Ive heard lots of troops on this war say that during trench fighting you cannot take prisoners, you dont have the capacity to do so.

There are no excuses. If you are going to spread excuses like "oh but their family was killed by the invaders", which isn't even true here since this unit is comprised of foreign volunteers rather than Ukrainians, you are part of the problem.
