Teen Accused of Dumping Baby in Trash Claims Nurse Killed Newborn

    Nineteen-year-old Alexee Trevizo allegedly gave birth in a hospital bathroom and dumped her newborn in the trash in January. Trevizo’s attorney is now blaming Artesia General Hospital staff, claiming a nurse killed the baby by administering a cocktail of drugs, including morphine. The New Mexico teen also filed a notice of intent to sue the hospital for the wrongful death of the newborn but later changed her mind. The Law&Crime Network’s Angenette Levy breaks down the latest development in the case with Jerry Dugan, a former medical malpractice attorney and homicide prosecutor.

    Those nurses and staff there CRIED for that babyyyy! I don't believe this. As a nurse myself, I find this so disturbing and scary. We are so damned if we try to help our patients. This is why there are more nurses leaving the floor. The mistreatment and stress, being overworked. Understaffed and underpaid and now are accused of things we have no control over. This is frightening.

    My husband believes, and I'm starting to believe it too, that lawyers who bring frivolous lawsuits (such as blaming the hospital for something that someone OUTSIDE the hospital actually did) should be disbarred for wasting the courts time.

      I have also always thought there is something criminal about lawyers using word gymnastics to get someone off the hook who's clearly someone who did something heinous that needs disciplined for. Sometimes it seems the lawyers need to be thrown under the jail with the criminal.

      My thoughts exactly. Even if the drugs played a part she still wrapped it in a bag (that was suctioned to the babies face when they went to unwrap it which means it was breathing) and hid it in the garbage. She didn't seek help for the baby or even just in case something could be done. So I say this seldom at this stage of the game but it's pretty clear that she is guilty...I'll leave a sliver of open mind but....yeah.........

      I think she knew she was, but had no clue she was full term. I think she thought the baby was stillborn and very premature. (Many babies are limp and don't cry, plus they gave her morphine) She was trying to hide this "miscarriage", particularly from her mother. This girl is absolutely clueless and much more immature than others her age.

    To even think about how traumatized every one of those nurses/doctors/workers for witnessing such tragedy, but to have her spin this narrative after they do nothing but still care for Alexee after she’s put them through a surge of emotions and adrenaline AND there’s video evidence of them immediately rushing the newborn that SHE disposed of to a trauma unit in the hospital, yet she does this? The audacity of her. My hearts go out to every single hospital worker that night that gave your best efforts to save the precious baby boy’s life that you cared about more than his own mother ever could have or will. So tragic.

    The way she went to the bathroom to give birth was calculated. The way she threw it in the trash, was disturbing and meant to hide it. If she had the baby by accident in the bathroom - a loving and caring mother/person would immediately seek help from nurses and doctors in the hospital. She has no emotion of what she did. Her and her mother should be prosecuted.

    Her mother has never held her accountable for anything she's done wrong. The mom has made excuses and asked for special treatment from the start. She knows what her daughter did, but wants to blame everyone else. I hope that seeing her daughter in prison will open her eyes to what her child did, due to her own enablement.

The way the mom burst out with “I told you” when the doctor and police confronted her about the baby tells me that this girl had been trying to hide the pregnancy and denied it, but the mom knew in her gut she was lying even if her daughter hadn’t ever told her the truth.

    I hope she gets a lengthy sentence not just for getting rid of her baby in the worst way possible, but for the trauma those nurses had to go through seeing that bathroom and finding that baby and especially now for blaming it on the nurses who wanted to do nothing but help they even said they would have taken the baby if she didn't want it no questions asked!!

    I actually felt bad for this girl for a minute cuz I think her mother is nuts and probably the cause of a lot of her problems. However, NOBODY SHOULD HAVE TO TELL U NOT TO PUT A BABY IN THE TRASH! Also, why didn't she call for help? Why didn't she use the bathrooms emergency call button when the baby started coming out? There were SO MANY things she could've done to avoid this tragedy. Alexee also kept referring to her baby as "nothing" as a way to justify her actions. This girl is sick and deserves ZERO mercy, like she showed her own baby.

      I agree. But I believe she was completely terrified to tell her parents she'd gotten pregnant. There's a reason she didn't tell them, and I can't help but think it's because she dreaded her parents knowing, to the point where she went to these lengths. This isn't all Alexee here, but she will be the one who pays the ultimate price. This is far more complicated than it appears.

      She locked the hospital staff out of the washroom. They knocked on the door repeatedly asking if she was alright and she said she was. She then delivered the baby and suffocated him to death with a plastic bag and tried to play it off like nothing happened.

I have a 7 week old and was given Morphine in the hospital once in the third trimester for back pain and the other drug they mention Zofran is literally just an anti nausea med which they prescribe to pregnant women. I was literally taking it almost my entire pregnancy and my baby is perfectly fine. Neither of these meds are harmful to the baby

    Everyone in that hospital seemed like they would have done anything to save that baby, but they never had the chance. So many people would have taken that baby in and loved him, in a heartbeat!     Zofran is safe in pregnancy- it is an anti-emetic, for nausea and vomiting. The sodium chloride is IV solution, given often in labor. As a nurse this infuriates me.

    I seen the ER footage of the nurses standing outside the bathroom door asking her several times if she needed assistance. She refused their help stating that she was trying to deficate and then attempted to clean up afterwards. So her lawyer stating that they just stood around not helping is a complete lie by her lawyer. He should be charged with defamation.
    Her mother is doing her no favors by allowing her daughter to commit murder blatantly and then blaming others for her crime. She knew exactly what she was doing and deserves every year she gets behind bars.
    And any lawyer that looked at the evidence and actually thought for 1 minute that suing the nurse and hospital was the correct response deserves to be disbarred immediately!!!!!!!

We don’t have all the facts yet - but people want to do what you’re doing and condemn her before she’s even had a chance to try to defend herself. Maybe she didn’t know she was preggo. I know that seems unlikely, but there used to be a whole TV show based on women giving birth when they had no idea they were preggo until they gave birth.     Not only was I given Morphine during labor with my son, but I had to take Zofran (one of the other medications this attorney mentioned & is claiming caused the childs death) throughout my pregnancy for severe nausea. The only thing that killed this baby is her!

      It's crazy to me that she, her family and the attorney can't see what a very bad move this is for her. The nurses were so obviously not at fault here. Only she was. She's going to lose big time, and there will be no sympathy for her now whatsoever. She can't claim to be a nice girl who was just ignorant and poorly raised. This is a calculated decision to put the blame on the nurses, and she is obviously fine with that. And I think the judge will be harsher with sentencing as a result.

LOL, the slime ball lawyer probably looked at when the HCG was drawn but didn't take into account that results are not sent to the unit immediately. Besides, ANY patient who presents with a positive HCG test, the unit is notified but not until its run twice to verify. Pregnancy tests are run on all women of childbearing age, when they present in the ED with back or abdominal pain. In the meantime, you have a patient in excruciating pain and screaming, yelling, so what should they do? Ignore it? If it were you, wouldn't you want some pain medication???
      So screw your 'theory' about the patient receiving medication. Nothing this young woman received was harmful to the baby b/c she most likely received the lowest dosage of everything.

      An interesting question would be: Who taught the teen what to do in the event that the baby were born alive? Have the computers and phones been confiscated to see if there are any searches on how to kill a newborn? If this data exists on the mother's device the mother will also face jail time! I am hoping that at some point-after the results of a positive pregnancy test that there was a fetal monitor placed to record a viable heart beat.

    My son didn’t cry after he was born until the cord was cut. If you notice she doesn’t say he wasn’t alive just that he didn’t cry. Also the fact that women get epidurals with pain medication stronger than the amount of morphine she was given makes this defense ridiculous.

When Lexi made the comment "nothing cried" (or whatever disgusting verbiage she used), I wish the male nurse would've told her that babies don't always cry when they're born but that doesn't mean they're not alive. It would've been great to see Lexi & her mom's reactions to that statement. And yes, the "morphine did it" defense is absolutely ridiculous, along with the "Big Mac theory" to explain away her belly.

      When she went to the bathroom she wasn’t hooked up to a drip machine so they had already stopped drug treatment IMO. They didn’t give her permission to poop, she ran there. They tried to check on her several times and had to get a key to get her out.

      @AngelOfTruth We don't know the dosage administered. When I was pregnant I was given a small dose of morphine to try to stop labor. If the dose was not large she should have been more than capable of walking to the bathroom without assistance. The subject was refusing a vaginal exam and so even with a positive test result the staff would not know if they were dealing with a false positive or if she was pregnant how far along she was. It could have been weeks or months. The hospital from evidence presented didn't do anything not in accordance to protocol

    Two weeks before I was induced, I spent a week in the hospital with fluids on my spine a cerebral cortex. Neurosurgeons (4 different ones) tried to do 4 blind spinal taps to reduce the fluid and all were unsuccessful. The pain was horrific and I was essentially hooked up to a Morphine drip to reduce the pain. I was too early in my pregnancy to deliver and the doctors wanted my baby to stay put until his lungs developed more and it was safer to deliver. I was sent home for a week prior to being induced with a prescription of Percocet to help manage the pain. There’s no way a doctor would give a pregnant woman drugs that could ultimately kill an unborn child. If that were the case, I wouldn’t have my amazing 4 year old son! She knew she was pregnant and just didn’t want the responsibility of owning up to being a mother. Her mother knew too. I doubt she was in the dark about it! She needs to take full responsibility for her actions!

    This is absolutely SICKENING! Just when I think this entire story can’t get any more disturbing and infuriating, we meet her lawyer. Lawyer and client are a perfect match, equally sick and twisted. The audacity they have to blame the hospital/nurses is outrageous. Every single one of those nurses showed more emotion, shock, sadness, than both her and her mother combined. Makes me absolutely sick that there are people like this.       I believe at the time they also weren't fully sure how far along she was yet. And, I believe in a video a few months ago, she left to go to the bathroom without anyone knowing and she locked the bathroom door so no one could enter. They kept checking on her, she just wouldn't open the door.

    It was NOT a stillbirth!! According to the coroner, the baby had oxygen in his lungs. Even if she delivered and the baby wasn’t breathing, she didn’t give the staff of the hospital any opportunity to save the child. I can’t say I’m shocked that they’re trying to blame the nurses.     Retired L&D nurse here. All of what the second dude said is true. We give Morphine and Zofran to pregnant women all the time, unless they overdosed her these meds are safe. Most women in the US will get IV fluids during delivery, I'm really not sure how they could be a factor in all this. It's basically water... The baby had air in its lungs and stomach so clearly not a stillbirth. If she was so concerned about the baby why did she wrap it in a garbage bag instead of trying to get help? The only thing I disagree with is the strangulation. The autopsy showed no signs of this, the cause of death was suffocation from being in the trash bag.
    This girl has never been told no and is terrified of her Mom. If that woman was my mother I'd hide a pregnancy too (I wouldn't however, kill my baby).

    I'm not a lawyer, but if I had to guess, I think her best bet would be to show remorse. Right now, she, her family, and lawyer are coming off as quite inhumane. There was air in the lungs, the amount of morphine was minuscule, the baby was wrapped, she lied to the medical staff, her own mum didn't know how far along she was, there is a picture of her pregnant. Show remorse. Apologise. Let people know the real fear you were experiencing that cause you to act in this manner.
