I had a city cop in NC come over with an angry lady because I was flying my drone. They asked if they could fly it. They took pictures and thanked me for sharing my " Awesome toy." The lady stormed off.

Thanks for sharing your thoughts in this video.
I'm a Part 107 pilot in NC, and have passed the NC commercial operator permit test. The test is not difficult once you've studied, and is free. It's actually great that they've gone to the effort to establish an online process to help ensure familiarity with the regulations. Definitely go for it if you're going to fly in NC.
With that said, the test and permit is not the issue in my opinion. At the end of the day, if I can't launch/recover anywhere without first obtaining consent (with the exception of property that I own), it complicates in practice the ability to gather footage (general footage samples for my web site, town reel footage, taking nice shots of a beautiful horizon I'm driving by, etc.) Most private owners (if asked if you can launch/recover your drone from their property) will default to being skeptical of your intentions. Since NC regulates launch/recovery (and not airspace in this case) I'm not sure the supremacy clause applies.
While the regulations overall in NC make a lot of sense, the launch/recovery portion is the key challenge. I really would love to see them modify the launch/recovery regulation to allow Part 107 and NC operator permitted pilots more flexibly to launch/recover. It seems if someone goes through the study prep, registration process, pays the fee to take the exam, and passes with proper knowledge of Part 107 and NC regulations, allowing them to more easily conduct business in the state would be a good thing.

I live in Raleigh and own a Phantom 4 Pro. Now that I have learned of this ridiculous law I'm going to start flying my drone everywhere in the hopes of being arrested. I will be the one to challenge this and expose North Carolina's ridiculous overstepping laws.

As a North Carolina Commercial Operator, I agree with the state permit process...It has very little to do with airspace. It has to do with ensuring pilots have an understanding and comply with state regulations like flying in state parks and over prisons... Too many operators out there think ignorance of drone laws give you a get out of jail free card....Fly over a jail in N C and see what kind of fine you get. Permit or not. Looking at the work that the NCDOT Aviation Division does for the UAS community at large, your commitments are really unfair... Research and development dollars are flowing in.... We lead the industry in many ways... First in medical package delivery for instance, first BVLOS waiver to a N C company.. If out of state pilots don’t want to take 20 minutes to take a free online open book test, then don’t come here to fly. That simple...More opportunities for our pilots to make money... BTW Go ahead and argue with a cop in the street...Never ends well...

As a police officer I can tell you the arresting officer is not going to argue the supremacy clause with you in a field. They are going to tell you that the law is on the books and you will have to argue it with the judge when your court date comes up. Someone will have to get arrested and take it to court than it will change.

Howard Elzey ~ Leo enforce laws of their jurisdiction, that's their job.
City/State laws should be vetted prior to enactment, the job of their council, putting the onus on the public and putting Leo's in an uncomfortable position.

The law only applies to commercial. I don't think there is a NC permit requirement for recreational.

At least it's free to get the NC operators license (for now) and the test is so easy no study is needed if you are 107. Took me 5 min online and you print it out it out instantly.

Born and raised in North Carolina. I can tell you the state has sucked more and more every year for the last 25 years.GREED is a big problem. NC loves to spend on lavish vacations and other useless crap. How do you get more money to waste? You beef up highway patrol and fees. Govern every aspect of a person's life. When a person even minutely steps off of that thin little path, you fine them. That's how.
So many northerners moving down here and I haven't figured out why, yet.

I went to a job interview. It was for UPS to fly delivering medical samples at wake med. The job opening wants a lvl 2 FAA medical cert. part 125 cert! Part 107 and a private pilots license. Really WTF! A guy with 1500 flight hours with drones can only get hired as a visual observer. Really?! The job opening didn’t even mention VO once.

Can you share the paper on this topic that u mentioned? Also have u ever heard of local (city) agencies creating drone laws.

Trying to talk to a cop about the relevance of his city or state law is pointless. That's not his role and he's not a lawyer.
What would be good would be for some advocacy group to sponsor a test case where somebody would go test the law, probably get a summons or arrested and with the support of the advocacy group fight the ticket all the way through the courts.
Hopefully this would result in laws being changed.

Link is no good for field kit . I don't see what the gripe is over the permit. You have to pass a knowledge test which is easier than the 107. Then its one more click to print the free permit. It took longer to cut it out of the paper than to actually get it. I don't see the point of it anyway but its not a big deal. If you argue with an LEO like you are suggesting they are just gonna lock you up for being a jerk and take your things. Then its just a pain to get them back. Yea it shouldn't be that way but it is and LEO's put up with a lot of crap from people all day. They shouldn't have to from drone pilots. Just land and go fly somewhere else. And tell them to have anice day and maybe make an advocate rather than an adversary for you and other pilots.

The problem is NC may have good intentions and a simple process, but other states may not. That's why we have a defined process.

Florida has the most progressive UAV laws. New legislation superceded Orlando ;opened commercial flight. FAA certified is required.
Good example City law being ruled unenforceable By state ~ which is following federal I.e; FAA rule/order.

I didn't listen to the whole video ( honestly, I'd listen more often if you'd limit the banter and just get to the point ), but you should point out up front, that this permit requirement is only for Commercial drone flight. Recreational UASs don't need a permit. While I disagree with the NC law on the commercial, States doe have the authority to require business licenses, don't they.

  • @triprot3465
