I am in desperate need of an update! I've seen many 1st amendment audits, I also work for a law enforcement agency. It bugs the heck out of me when I see lawmen do this. Please tell me there is an update and/or legal actions being taken against them!
Kent accepted a deferred prosecution agreement to stay out of jail. Under this agreement he admitted his guilt and agreed to stay out of trouble for a certain length of time (including returning to the Boone Co Courthouse) in exchange for not being prosecuted. He tells people the charges were dropped but they were not. As he admitted guilt there are no grounds for a lawsuit.

you arent very clever are you... a business card like the one you gave the cop IS NOT a form of ID... for it to be considered press ID you need your full legal name on it, your phone number, your photo and a contact name and number to verify who you are and who you work for even if its your own news agency, there are groups who issue press ID like the IFJ or the IPC so yes press ID does exist you just dont know how to obtain it correctly...

Friend who told you a business card without a photo is the same as an ID. For all we know you printed that card on your inkjet printer. Please provide case law that states all a individual needs is a a business card to prove you are a member of the press.

So he calmly explained to you that you are not allowed to file without court permission. It is clearly listed on the door. So how is the cop rude? He asked you to leave till you got permission to film. You pushed and pushed till you got arrested. I have seem a couple of your videos and you do the same thing.

Every courthouse in the United states is fucking public, there is no such thing as a private courthouse that is part of the usdoj. Prohibition of contraband can only be applicable to the courtroom itself and cannot govern the parts if the building that are administrative. Hence the name "court rules" literally can only apply to the court and its function within the court room. The court rules do not apply until court is in session and the courtroom is defined by the judge and his calling. The court rules are then effectively dismantled when court is adjourned. As a matter of fact I'm pretty sure it's illegal to do this. Access to the clerk is not governed by the court rules.

I think you need to watch the video again, he didn´t barge in in any way, he just walked in like anyone else, and didn´t say anything to anyone, he just stood there calmly and silent they were the ones who approached him yelling. I used to live in Columbia, this is the true nature of the cops there. Plus, that one cop has a full beard. Does he have a shaving profile? When did they get lax on their dress code & personal appearance code?

I was in the Army, I know about the gas mask thing, also some black soldiers are given shaving profiles. But I would think that police chiefs would mandate a shaving profile to his officers in its personal appearance code. I know it’s not mandatory, but most police departments enforce the shaving code. Most of the black guys I remember got shaving profiles, and I don't blame them. The first few weeks of basic they had horrible razor burn and bumps. As if life didn't suck bad enough, lol. I'm currently working on a story related to this courthouse. I found out plenty about this place and much of it stemmed from people seeing this video. You don't know about everything that goes on behind the scenes. Again, the Marshall's immunity is directly tied to the judge. This is the state of Missouri. There are 50 states in this country and they all operate differently.

There is no constitutional right to film in a courthouse. See _Perry Education Association v. Perry Local Educators’ Association, 460_ U.S. 37 (1983).

They contradicted themselves multiple times. The property line is NOT at the bell. It's ten feet past that bell. I used their own county GIS to confirm.

I subscribed, and you should file a federal suit against that circuit court rule. You can't be barred from filming in the lobby of a courthouse, and you certainly can't be arrested for recording on the courthouse steps.

@@CitizenStandpointNews They didn't get a conviction because you pled guilty to the charges and they agreed to do a deferred prosecution. If you break the terms of that agreement they can reinstate the charges and convict you on your confession of guilt.

8:33 “They told me to leave the building, not the property”. This shows that you understood that they were asking you leave the building. When you didn’t leave the first time you were asked to leave the building they had probable cause to arrest you under section 569.140. Trespass in the first degree.
You committed all the elements of the crime.
I don’t think you have any cognizable 42:1983 claims because:
1) court orders/regulations on courthouse photography have held up in federal court. See UNITED STATES v. Gary A. GILENO, 350 F.Supp.3d 910 United States District Court, C.D. California 2018, for example.
2) You were asked to leave because you were in violation of the court rules on videography and you were argumentative in the courthouse when you were asked to follow court policy/regulation...and you continued in a dilatory and belligerent fashion to argue against the enforcement of the policy.
3) You committed trespass by not leaving when instructed to do so by court security officers. Therefore they had probable cause to arrest you. Probable cause to arrest destroys false arrest, malicious prosecution claims and First Amendment claims. To your credit you were arrested peacefully...For that reason I don’t see an excessive force claim either since the video shows a fairly relaxed arrest by all involved parties.
At 4:58 you arguably committed trespass when you said “No” when the officer asked you to step outside. You certainly were asked to leave more than once...even with the threat of arrest when you were inside the building. As I mentioned, you told the other officers outside that you were told to leave the building. That was the “actual communication” mentioned in the statute as a required element of trespass in Missouri.
Even if the officer was somewhat mistaken about the courthouse property north of the bell the officers had probable cause to arrest you for first degree trespass when you refused to leave the building.

I remember you from commenting on some older videos. I also noticed your comments on Schodringer's channel. I hope you guys understand that I don't exactly fit the bill of many of the other auditors. I wished I would have had a camera with me all the times in the past when I witnessed LEO's doing bad things. It would help explain why somebody that used to want to be a cop would choose this path. I've just seen and experienced too many abuses from people that are in a position of trust.

Kent accepted a differed prosecution. That means he had to admit his guilt and agree not to return to the courthouse in exchange for not being prosecuted. There are no grounds for a lawsuit.
