ON PRICE ASSURANCE AND FARM SERVICES ACT, 2020
(3) The quality, grade and standards for pesticide residue, food safety standards, good farming practices and labour and social development standards may also be adopted in the farming agreement.
9. A farming agreement may be linked with insurance or credit instrument under any scheme of the Central Government or the State Government or any financial service provider to ensure risk mitigation and flow of credit to farmer or Sponsor or both.
18. No suit, prosecution or other legal proceeding shall lie against the Central Government, the State Government, the Registration Authority, the Sub-Divisional Authority, the Appellate Authority or any other person for anything which is in good faith done or intended to be done under the provisions of this Act or any rule made thereunder.
19. No civil Court shall have jurisdiction to entertain any suit or proceedings in respect of any dispute which a Sub-Divisional Authority or the Appellate Authority is empowered by or under this Act to decide and no injunction shall be granted by any court or other authority in respect of any action taken or to be taken in pursuance of any power conferred by or under this Act or any rules made thereunder.

1.If the contract farming laws are not compatible/detrimental to the farmers then they need not enter into a contract with companies. 2. What happens if the farmer does not comply with the terms of contract- should the company pay the price as agreed though the product is not as specified by the company? 3. We have to respect the authorities specified and if the farmer is not satisfied then he can go to the courts as per the constitutional rights and no one can stop it. What is the guarantee that the Courts will only favour the Farmers?The authorities as specified in the farm law will have to give a clear judgement based on evidence. If the judgment is patently wrong then they will have the right to go to HC/SC. 🙏

Well explained by Prof. Nageswara Rao. The terms are really vague in the Act. When courts have no jurisdiction, who are going to save the farmers? How much sincerity being exhibited by Beaurocracy is well-known to the public. Who are going to save the farmers from natural calamities? Nature will not spare the fields of Contract farmers. Not only WTO, even UNO cannot stop the aggressive nature of super powers. It is idiotic to bow to WTO.
Ultimately it is about transparent price discovery which should benefit the farmer, whether through established APMC mkt yard or outside the yard.If these new laws can enable it then they should be welcomed. However if there are some technical and legal clauses which seem to create doubts on achieving the overall objective of these laws, then they should be clarified and improved for developing a balanced legal position. No contract should be unconscionable.

ఇవాళ వరి, గోధుమల విషయం లో కూడా జరుగుతుంది ఇదే. ప్రభుత్వం MSP లు ఇచ్చి లక్షల కోట్లు పెట్టి కొని అదంతా వృధా చేస్తుంది. రైతులకి ఇదేం పట్టదు. అటు కొన్నందుకు ప్రజల డబ్బు వృధా, ఇటు పండించిన పంటా పందికొక్కుల పాలు. ఈ పరిస్థితి మార్చటానికేగా కార్పొరేట్లతో tie-up పెట్టుకునే అవకాశం కల్పిస్తుంది ప్రభుత్వం. ఇక ఇది కూడా వద్దు, రైతు కి రేటు దైవాధీనం అన్నట్లు చెయ్యాలని ఈయన కోరికా?
ఇంక గుజరాత్ రైతులతో పెప్సీ వివాదం.. గుజరాత్ లో పెప్సి కంపెనీ నిజంగా రైతుల్ని కోర్ట్ కి ఈడ్చదలుచుకుంటే రైతులు నష్టపోయే వాళ్లు. ఎందుకంటే ఆ కేసులో రైతుల వైపే తప్పు ఉంది. తెలిసి చేసినా, తెలియక చేసినా తప్పు తప్పే. అందుకే అప్పుడు గుజరాత్ ప్రభుత్వం pepsi కంపెనీ తో చర్చలు జరిపి కేసు withdraw చేసుకోమని కోరింది. ఆ కేసులో అహ్మదాబాద్ కమర్షియల్ కోర్ట్ పెప్సి కి అనుకూలం గా తీర్పు కూడా ఇచ్చింది. ఆ కంపెనీ అభివృద్ది చేసి పేటెంట్ పొందిన బంగాళదుంప వెరైటీ ని రైతులు కంపెనీ తో ఒప్పందం లేకుండా పండించకూడదు అని తీర్పు చెప్పింది.

Dear Sir, I salute to your skill on misinterpretation of everything done by Govt in power. 1. You have problem with CAA which gives citizenship to a minority persecuted people from neighborhood. 2. You have problem with the Courts who gave verdict on Ayodhya and Babri demolition...and the list goes on. Now coming to your arguments on Contract farming. 1. You have compliant on using the word 'may' which is used to give freedom to decide terms while entering into agreement. Neither party will be dumb to accept a clause against their interest while entering an agreement. If Govt has tightened the ability to take a decision by a small farmer, you would have cribbed otherwise. 2. You mistake arbitration by RDO and asks why not courts. On the other hand you don't believe the courts that gave verdict on Triple Talaq, NRC, Ayodhya etc. Already courts are overburdened with lots of cases. By adding these Arbitration also to them, will kill small farmer. A Pepsi or Ambani can file a suit and hold the payment for a small farmer until court arbitrates. You know the delay that would take in court. On the other hand he can walk into RDOs office and plead him with his real problem against a Corporate. If RDOs Arbitration is wrong he can go to next level immediately. You have problems with that as well.

ఇంక గుజరాత్ రైతులతో పెప్సీ వివాదం.. గుజరాత్ లో పెప్సి కంపెనీ నిజంగా రైతుల్ని కోర్ట్ కి ఈడ్చదలుచుకుంటే రైతులు నష్టపోయే వాళ్లు. ఎందుకంటే ఆ కేసులో రైతుల వైపే తప్పు ఉంది. తెలిసి చేసినా, తెలియక చేసినా తప్పు తప్పే. అందుకే అప్పుడు గుజరాత్ ప్రభుత్వం pepsi కంపెనీ తో చర్చలు జరిపి కేసు withdraw చేసుకోమని కోరింది. ఆ కేసులో అహ్మదాబాద్ కమర్షియల్ కోర్ట్ పెప్సి కి అనుకూలం గా తీర్పు కూడా ఇచ్చింది. ఆ కంపెనీ అభివృద్ది చేసి పేటెంట్ పొందిన బంగాళదుంప వెరైటీ ని రైతులు కంపెనీ తో ఒప్పందం లేకుండా పండించకూడదు అని తీర్పు చెప్పింది.

కేంద్రప్రభుత్వం 3 రకాల చట్టాలకు సవరణచేసింది.
1️⃣ ఇదివరకూ నిత్యావసర వస్తువుల ధరలు పెరగకుండా ఎప్పటికప్పుడు వాటి నిలువలపై పరిమితులు విధించేది. అంటే ఫలానా సరుకు ఫలానా క్వింటాళ్లు లేదా టన్నులు మాత్రమే నిల్వచేసుకోవాలి. అంతకుమించి నిలువ చేసుకోకూడదు. ఇప్పుడు అటువంటి పరిమితులు పూర్తిగా ఎత్తేశారు.
ఆహా...ఎంత మంచి చట్టం, రైతుకే కదా మంచి జరుగుతోంది అనుకునేరు.... అక్కడికే వస్తున్నా చూడండి...
ఈ బిల్లు ప్రకారం సప్లై చైన్ లో రైతులనుంచి రీటైలర్ వరకూ ఎవరు ఎంతైనా స్టోర్ చేసుకోవచ్చు. నిత్యవసర సరుకుల ధరలు రెట్టింపు అయినపుడు & కూరగాయల ధరలు 50% పెరిగినపుడు మాత్రమే ప్రభుత్వం నిల్వల మీద ఇప్పుడు ఆంక్షలు విదిస్తుంది. అంటే చేతులు కాలాక ఆకులు పట్టుకుంటాం అని బాహాటంగా చెప్పేస్తోంది.
ఈ బిల్లును బాగా అర్థం చేసుకుంటే,
86% చిన్న సన్నకారు రైతులున్న దేశంలో రైతులు తమ పొలంలో పండిన వాటిని సొంతంగా స్టోర్ చేసుకోలేరు. ఎందుకంటే రైతులకు రిలీయన్స్ ఫ్రెష్ లు, హెరిటేజ్ ఫ్రెష్ లు, AC గోడౌన్లు లేవు. కాబట్టి ఎలాగైనా దళారీలకో, కంపెనీలకో ఉత్పత్తి అయిన పంట పాడు అవకుండా తొందరగా అమ్మేస్తారు. ఇక్కడ లాభం పొందేది దళారీలు, కార్పొరేట్ కంపెనీలు మాత్రమే. ఎప్పటిలానే రైతు మోసపోతాడు.
ఎక్కడో ఉన్న గుజరాత్, బాంబే, ఢిల్లీ కంపెనీలు ఆంధ్ర, తెలంగాణ లాంటి రాష్ట్రాల్లో కొనుగోలు చేయడానికి వీలులేదు కాబట్టి ఆ బడా కంపెనీలకోసం రైతులకు మేలు చేస్తున్నట్టు ఇంకో సవరణ చేశారు మన కాషాయ దళం. అదే రెండో చట్టం.....
2️⃣ రైతులు భారతదేశంలో ఎక్కడైనా సరే తమ పంట ఉత్పత్తులు అమ్ముకునే చట్టం ఇది.
ఒక చిన్న, సన్నకారు రైతు నిజంగా తన పంటను వేరే రాష్ట్రానికి వెళ్లి అమ్ముకుంటాడా? పక్క జిల్లాలోని మార్కెట్ యార్డులోనే అమ్ముకోవడానికి ట్రాక్టర్లు, లారీలకు బాడుగలు ఇచ్చుకోలేక నలిగిపోతున్నాడు. తీరా అక్కడికి వెళ్ళాక సరైన ధర లేక కొన్నిసార్లు అక్కడే పడేసి వస్తున్నాడు. కాబట్టి ఇది రైతులు తమ ఉత్పత్తులు అమ్ముకోవడానికి చేసిన చట్టం కాదు.
మధ్య దళారీలు, కార్పొరేట్ కంపెనీలు దేశంలో & ప్రపంచంలో ఎక్కడ డిమాండ్ ఉంటే అక్కడ అమ్ముకోవడానికి ఈ చట్టం ఇది.
ఉదాహరణకు యూరప్ లో టమాటో కిలో 10 డాలర్లు అంటే 750 రూపాయలు సేమ్ టైం భారత్ లో 30 రూపాయలు రేటు ఉన్నప్పుడు, ఎక్కడెక్కడో ఉన్న కార్పొరేట్ కంపెనీలు వచ్చి రైతుల దగ్గర తక్కువ రేటుకు కొని, ఎక్కువ లాభం ఉండే యూరప్ కి అమ్ముకుంటారు కానీ, ఇండియాలో సచ్చినా అమ్మరు.
అది సరే... రైతుకు లాభాలు రాకపోతే కార్పొరేట్స్ కి తన పంటను ఎలా అమ్ముతాడు అనే డౌట్ వస్తోంది కదా... దానికి కూడా మన నాయకులు చట్టం ద్వారా బడాబాబుల ఒక వెసులుబాటు ఇచ్చారు. అదే మూడో చట్టం... కాంట్రాక్ట్ ఫార్మింగ్...

నిల్వలు మీద ఆంక్షలు ఉండద్దు అని పెట్టింది Food processing industries కోసం. వాళ్లు ఒక 1000 కిలోలు స్టాక్ పెట్టుకుంటే మార్కెటింగ్ డిపార్ట్‌మెంట్ వాళ్లు వెళ్లి వాళ్లని లంచాల కోసం వేధిస్తారు. ఇవ్వకుంటే ఏదో వంక పెట్టి వాళ్ల వ్యాపారాన్ని సీజ్ చేస్తారు.
అయినా ఇవాళ రేపు వరి, గోధుమలు అనవసరం గా ఎవడు స్టాక్ పెట్టుకుంటాడు రేట్లు పెంచుకుందామని? మూణ్ణెల్లకి ఒకసారి లక్షల టన్నుల స్టాక్ వస్తుంది మార్కెట్ లోకి.. ఉన్నదే ఏం చెయ్యాలో అర్ధం కావట్లేదు.
పాల బిజినెస్ లో heritage, nestle, britannia, hatsun లాంటి ప్రయివేట్ వ్యాపారులు వందల్లో ఉన్నారు. ఎవడైనా స్టాక్ పెట్టుకుని రేట్లు పెంచుతున్నాడా? లీటర్ పాలు ఏమైనా 1000 రూపాయలు అయిందా? కోళ్ల బిజినెస్ లో ప్రైవేట్ వ్యాపారులు ఉన్నారు. కోడి గుడ్డు ఏమైనా వంద రూపాయలు అయిందా?
2. ఇది ఇంకో పనికిమాలిన ఆలోచన తీరు. ఇవాళ heritage కంపెనీ కి పాలు పోసే రైతు తన బర్రె ని సిటి లో ఉన్న heritage కంపెనీ దగ్గర కి తెచ్చి పాలు పితికి ఇచ్చి వెళ్తున్నాడా? ప్రతి ఊరి నించి కంపెనీ క్యాన్ లలో collect చేసుకోవట్లేదా? రైతులు కూడా కొన్ని సంధర్బాల్లో ఇతర ప్రాంతాలకు వెళ్లి అమ్ముకుంటారు ట్రాన్స్‌పోర్ట్ చార్జీలు పోనూ ఖర్చులు కలిసి వస్తాయి అనుకుంటే. అలా చాలా మంది చిత్తూరు జిల్లా నించి మామిడి రైతులు బెంగుళూరు, చెన్నై లో అమ్ముతుంటారు. జహీరాబాద్ నించి వచ్చి హైదరాబాద్ లో తమ ఉత్పత్తులు అమ్మే రైతులు బోలెడు మంది ఉన్నారు. అలానే హోసురు నించి వందల మంది రైతులు వస్తారు పొద్దున్నే బెంగుళూరు KR market లో వాళ్ల పంట ని wholesale లో అమ్ముకోటానికి.
అయినా లేబర్ దగ్గర నించి MBA, సాఫ్ట్‌వేర్ ఉద్యోగుల వరకు వాళ్లకి ఎక్కడ డబ్బులు ఎక్కువస్తే అక్కడకి వెళ్లి సంపాదించుకుంటే రైతులు వెళ్లలేరా? ఒరిస్సా నించి కూడా వస్తారు ఆంధ్ర లో వ్యవసాయ కూలి పనులకు సీజన్ లో.. ఏదో రైతు ఒక్కడే ఇంట్లోంచి కదల్లేడు అన్నట్లు చెప్తున్నారు సొల్లు.

ఈ చట్టంలో, అన్యాయం జరిగితే court కి వెళ్లే అవకాశం కల్పించలేదని, courts మాత్రమే న్యాయం చెప్పాలని, executive megistrate కి ఇవ్వటం తగదని అనే ఈ నాగేశ్వర్ గారే ఒకవేళ చట్టాన్ని సవరించి courts కే న్యాయంకొరకు వెల్లవచ్చంటే, courts కి వెళితే రైతుకు సత్వరన్యాయం జరగదని, ఓ రైతు తనకు రావలసిన డబ్బులకోసం ఏలకేండ్లు ఎదురుచూసే విధంగా చట్టాన్ని పెట్టారని, అంటారు.

Excellent analysis with reference to the Act and past anti farmer experiences. I don't think Sections 18 & 19 of the Act will withstand the test of law with reference to the provisions or/and spirit of the Constitution in a High Court or the Supreme Court. Centre has offered to amend both the sections it seems. The government should not hesitate to withdraw the acts. Discussion and flexibility are also important even for a government which thinks that there should not exist a different opinion.

@@manjulathag4298 Madam, iam not against BJP or against Congress, I am just trying to understand why this insecurity and why this bill? Any farm-based country's government should help the farmers of that country to stand by themselves by improving the infrastructure (Build storage houses, Transport facilities, Market yards, Quality checks, Impose restrictions on what farmers can produce by various attributes like extent of land, wether and various regional attributes, and who ever sticks to that restrictions help them by giving subsidies, Research on new varieties, etc.)
We have experienced a green revolution, I don't see any private companies being part of that, and neither I saw farmers being soo insecure, I don't see Amule made farmers insecure in Gujarat. but this is happening now, why? Privatizing or corporate partnership is not a solution for everything madam, especially when you are trying the segment which is the backbone for the economy of this country. If we support this then it is as good as privatizing CISF, CRSF, BSF, and other critical defense lines.
Here I can clearly see that the government is trying to shrug off responsibilities instead of taking them up and make lives easy.
Coming to your point of government made promises to amend the bill.. Farmers already lost their trust in that bill.
