It is time to outlaw HOA's!!!!!!
That will never happen. I am not happy with them either but who would take care of the common areas?
@@Omar_Zazzle dude you are dumb how many houses dont have HOAs and common areas aren't a problem the HOA is you paying someone to police your house and tell you what you can and cant do with your house and the prices of houses are outrages now I
Not outlawed, but limit to HOA's power and to prevent power abuse.
No, But an HOA and it's creation should be very limited until the majority of homes are sold. Then voting will take place on key issues. Current HOA is Designed and Created by the Developer and Lawyers Not people living daily in the Community.
@@Omar_Zazzle go back to old school and don't have common areas.
Absolutely insane HOA's can foreclose on your home for $500 fine.
Even if the home is completely paid off!!!!!
Link? None.
@@7531monkeythis common and widely known, now $500 might be a stretch, BUT they will foreclose on your home after a couple thousand in fines.
You don't need a link, this is totally true and has happened in our community. Plenty of first hand accounts of this happening. You can't ask for a link and then say none in the same breath. Especially on something that's actually true. The name monkey is right.
The bill passed and now HOA's can't foreclose on a home unless its more than $1000. Also the maximum amount of violation can't more more than $100 per violation and can't exceed more than $1000. Which really eliminates liens and foreclosures.
Never buy in an hoa
I’d buy a tiny home before I even buy an HOA home
I read that wrong I thought you meant something else I thought you meant
@ZEEZombino The problem is there are a lot of incentives for new construction to be in an HOA from a builder's perspective, so chances are that tiny home you want to buy is also in an HOA. If you want a home not in an HOA they tend to either be rural homes (because they were not built in large development projects), or very old homes, which tend to be traditional size (not tiny homes).
Lmao this isnt 2010
Thats not the case in 2024 😂@jofujino
I did some work for a guy who bought a small tract of land, a developer bought all the land around him, then formed an HOA, the guy tried to refuse the HOA forming, but as developer owned a majority of land involved he was forced into the HOA...the developer never started building the subdivision, so the guy is the only house for several miles and he gets fines all the time from the HOA.
This was in Florida by the way.
DO NOT BUY IN A HOA HUGE MISTAKE YOU'RE PAYING FOR PEOPLE TO POLICE YOU

HOAs need to be VOLUNTARY. Freedom of association needs to be upheld. I should not be required to bend the knee to an unaccountable hyper-local extra-Constitutional government just for the privilege of owning a home.
If you're living in a land-leased park, the HOA is required to represent you in regards to issues with the park owner. Why should you get the benefits without having to pay for them like everyone else?
@orion3706 if you're in a land lease, you aren't an owner and I'm not talking about you.
@DoubleplusUngoodthinkful you own the home but not the land. But I was referring to the park owner, which can be a huge corporation who raises lot rents, forcing people to sell their homes and move, if they can find a buyer. The hoa represents the homeowners in relationship with the park owner.
You choose to buy into an HOA neighborhood. Since you made that choice you are obligated to follow the rules of that are set forth. You should read the neighborhood Rules and Regulations before buying , if you don’t like it ,don’t buy the house!

HOA can levy your bank account for unpaid fines and fees. They also can garnish your wages and put a lein on your home. Worse… They can foreclose on your home. People need to understand that before they purchase a home in a HOA.
I don’t care about HOA’s. If an HOA can harass and abuse you to foreclose on your home then sell it to the Boards Attorney for $1 you deserve to go to prison.
This is what needs to be outlawed. A lien yes but to have right to foreclose on your home is criminal
In Florida, an HOA cannot foreclose on a home for a $1 fine or debt. Read the state statutes before making that kind of asinine comment.

I passed up a nice house on 8 acres with a nice view in Prescott, AZ. It was in an HOA, and the realtor said there was no way to avoid or escape from it. No thanks---
Some HOA are only due the road and like$50 a year. Was it for that?
HOA started around 20 years ago and cities and counties allowed HOA to exist as a way of taking the burden of taking care of these from the cities and counties and putting the responsibility on the HOA's But now 20 some years later these same HOA's are out of control. My advice to anyone looking to buy real estate is to NOT BUY a condo or in a HOA because you can not control what happens or how much they can charge you. and if you do buy in these areas don't blame anyone but yourself when things go wrong.
I refused to sign an HOA agreement when we moved in but that didn’t matter because Pasco County took over the HOA’s punitive measures here in New Port Richey, FL. We feel we’re prisoners.
My HOA was founded in 1977.
I conpletely agree with you! We loved the HOA we lived in. There weren't cars parked all over the streets so no one could get through. The houses were well taken care of and kept the property values high. We voted in, and out, who was on the board, along with a management company, and it was great. In Florida, I bought a place with an HOA, and many of us were upset when they were voted out. The 4 wheelers racing down our streets and drag racing, etc. was too much so we moved.
HOA’s have been around formerly for over 100 years in the US. The basic concept likely goes back to Ancient Rome. Even older is the practice of people who know virtually nothing about something acting like they do and even having strong opinions about those things.
@@MrElwoodCaudillI have no idea how that could even happen, but an HOA is much better than an over active municipality. In fact, one of the benefits of an HOA is that it can offer protection against a crazy municipality.
In Florida board members may be sued personally. Many people are not aware of this means to check those who act outside the confines of their elected capacity.
Then no one competent will volunteer to be on the HOA boards
@@coastalhillbilly3419 right how absolutely horrible, why would anyone take on that kind of risk!

I'm already required by law to pay property taxes. No way am I going to pay an HOA fee to have additional rules imposed on me. My home is paid off, that means I own it. If I had to pay HOA fees, and I didn't, and they can foreclose on my home, then I don't really OWN it do I??? Not to mention, you want to have your car up on blocks or leave your trash can out? Great! I could care less. Just stay off my property. The LOWER my property value the LESS taxes I have to pay!!
My home is paid off too. However, don't pay your annual property tax bill and see who else "owns" it.
@@robertburroughs8962 Sure, your right, don't pay taxes and the government will own it. That's NOT optional. Moving to a home with an HOA IS optional. If I want to paint my house pink polka dot and have a 7 color fence, and work on my car in my driveway I don't need someone waa waa-ing about it just because they are on a power trip.

People will abuse the power you give to them. That's human nature. A good functioning society need to strike a balance between what is good and what is bad regulations.
HOAs are good, but they should not be able to foreclose on a property for non-payment of small amounts. Also, the process for foreclosure needs to require some sort of in person interaction.
How about telling us exactly what the law does, rather than just posting some talking heads.

They did tell what the bill does. It is a weak bill, thar is the issue.
Give up your rights and move into a commune HOA why just why ?
Good luck finding any new homes which don't require membership.
We built a home in early 2000 and had an HOA. Those were the days. It was a gated community, tennis courts, pool, cabana, stocked lake. Our HOA fees were less than $400 a year!! It was definitely needed. A family with 10 kids continued to have parties after the pool was closed and would throw the pool furniture in the pool and break the pool water system. Some people decided to paint their houses bright purple and flouresent pink!! It helped A LOT then. This stuff is too far.
@marlysmithsonian5746 so basically, you like them because they keep your neighbors from doing things which are perfectly legal, but that you don't like.

Just don't buy any home
That is an HOA .
tell your agent to show you only the home none HOA .
That's a lot harder to do now. Most new developments force HOAs
A lot of places that you wouldn’t think are HOA, have inactive ones. My neighborhoods streets are not maintained by the govt. so we have and HOA that only has a full meeting once a decade & their only job is to discuss fundraising & maintenance for the private roads
Now the crapy neighbors will let their house run down
cute, my moss covered house with the tired looking deck is 90 years old and the roof dont leak, My co workers lil mega mansion in a hyper tuned HOA, 3 month old house, roof leaks like a stuck pig. so much for that HOA quality home.
If they don't violate local or federal law there should never be a fine. HOA are just a way for city's to not have to use tax dollars todo what they are supposed to do. You can dissolve an HOA with a vote. It is very easy.
I have lived in non neighborhoods and now live in HOA home. I like living with a HOA because our streets are free of RVS and boats , large commercial vehicles staring me in the face each time I am outside my home. If you do not like the HOA rules , don’t purchase a home in them.
They should ban HOAs and legalize tarring and feathering of bad HOA board members (And more). Also a reminder that Spectrum and other garbage ISPs cozied up to HOAs to force residents to pay for outdated cable internet/tv to increase their profits, regardless of whether you use it or not.
Im paying enough bills for my house. I dont need more bills for an HOA fine.
I dont live in, nor have i ever lived in, an HOA, but whenever i drive theough one, im certainly jealous of how clean and tidy all the landscaping looks. I have neighbors that park about 6-8 vehicles in their yard, ruining the swale and making everything look run down. Other neighbors who disrespect noise ordinance at sometimes all hours of the day. HOA's are really tempting to me because i want to be proud of my neighborhood, but i also dont want someone telling me what color my house can be or qhen to move my trash can.
Couldn’t agree more! We must live in the same neighborhood. Numerous cars parked on the grass, garbage cans left out for days, yards never mowed. It’s depressing to walk through my neighborhood. I do believe HOA rules need to be regulated though.. some are out of control. There is one HOA neighborhood nearby where the homeowner can’t park in their driveway, they must park in their garage. Rules like that give HOA’s a bad name.. in addition to the escalating monthly cost.
Rules are needed but the biggest gripes are transparency of where the money is going. Some fees are just excessive and HOAs are no strangers to crooks
Screw HOA's and CONFORMITY!
I wouldn't live in a house where people tell me what to do
Somehow state intervention always makes things more expensive.
Some HOA board members goes on power trips and fine people they dont like, ridiculous amounts for the smallest thing. Also, how is it legal for HOA to be able to sell somebody else home. Its ridiculous.
outlaw them altogether!! It's one thing when the homeowners actually get together and make the decisions. Most of the time it works. but the MINUTE you give the management over to a 'management' company.. then the fines come.. and the management companies are all about fines. how else will they make more money?? They get a percentage of the fines. sometimes all of it. My HOA was great until they did this. I sold and moved within a year. And bought a house that is not in an HOA and will never be in one. The city I live in has enough rules to be just about as bad as an HOA. Maybe they need to look at that next.
HOAs need to be illegal
Our HOA told a neighbor their pool equipment was never approved. The Equipment CAME With the Pool when they bought it SEVENTEEN YEARS AGO! ABSURD! They were going to make them move it.
My HOA won’t tell me when they do their inspections. I said “so if I mow my lawn every single Friday, and you take pictures every single Thursday- I’ll always get violations, but if I mow my lawn on Wednesdays I never get violations. I don’t think you’re rolling dice before you go take pictures of the neighborhood, so there’s must be a plan. There’s no reason not to disclose that.”
Our governor seems to enact all of these petty laws in hopes of diverting our attention from the real issues at hand - skyrocketing home owner and auto insurance rates as well as affordable housing.
I don't know why people would give up your freedoms to the neighborhood power hungry karen....
An HOA is a Developer or Builder created Association Before the residents buy or majority of residents live in a community. There are Very Limited options in some areas (Florida). Current HOA is a Seriously flawed design
@@jbranche8024 they should disband it once they finish selling all the houses they built there.
its funny how every comment ive ever seen in a video about HOAs is saying to never buy a house with one, yet people continue doing it because of the value it adds
I will be in the minority, but my HOA was the only thing that stop my neighbor's dogs from barking at 3am. Local government wouldn't do anything so I just reported them to the HOA every two weeks.
And yes I talked with the neighbors about his dogs and received any ear full about "minding my own business".
This is the problem with living in a non-HOA community such as mine. Neighbors don’t respect neighbors.. it’s a “I’ll do what I want world”. So my neighborhood has multiple cars parked in the grass, yards not mowed, trash piled up alongside of the house etc etc. I do agree that HOA’s need to be regulated and ease up on some of the rules which can be ridiculous.. in addition, the escalating costs of some HOA’s make living in one almost impossible.
Nothing will change!
Never buy a house in a HOA community…code enforcement does a pretty good job at keeping homeowners in check..☑️☑️☑️

In Jacksonville, FL the city has an ordinance where you must keep your grass mowed. if someone reports it, the City will come out, mow the lawn and charge the homeowner an arm and a leg for it. It works well here.

My condo board blocked cash sales on my unit and there were 3 people on the board but they never included the 3rd person - they declined 5 hispanic buyers and i lost over $9k in purchase price, taxes and maintenence on it. I finally got a litigation attorney to send a threatening letter and was finally able to get it sold. The attorney said its a waste of money to take it to court for it would cost me more in the long run. I would never live in a community where you have less power or control ! I would never buy in a HOA. Or any place that you have to pay condo fees
I couldn't live with the heat in FL but it's like they just get it in FL. More rights for innocent citizens than criminals, protect children from molestors, property owners have the rights - not squatters, less rights for the HOA.
Good. Another upgrade to HOA would be for part of the fees to be invested and profits given to residents. That's a stronger model.
I enjoy living in a nice neighborhood. But I also think is ridiculous that HOAs can foreclose on people's homes. I also think about older people and the HOA telling them they have to pressure wash the roof, the driveway, change the mailbox, etc, etc, etc. When you pay off your home on retirement, your only income is your retirement, you don't have the ability to do some of this things yourself. And someone could take your home away because you can't afford to pay someone to pressure wash. That's actually pretty terrible. I also think that if you bought your home for a price your taxes should be based on that price. Because your home could also be taken away if you can't afford your property taxes.
I feel like HOA’s are everywhere!!
just curious what else is written in this bill?!?
I hope other states adopt this because I will never move into an HOA

You move into a HOA and agree to the rules and then complain about the rules... you can't make this stuff up
Here's the issue first responder vehicles and tow trucks are legally labeled under Florida state law as an emergency vehicle and Not commercial,
therefore HOAs never had the right to ban them to begin with.
The issue is some hoas believe they are above state and federal law because it's private property , they can do what they want.
I do believe there are simply too many laws on the book that people don't remember them all.
All this new law does is reinforce an existing one
@Kibatsume1 that may be the case with this law but people complain about everything in an HOA..
HOA's are just a way to grift money from homeowners!

HOA really means Headache Own Associates 😅
"That might discourage some from wanting to get involved"
Ok, whats the problem?
Part of the new rules allows parking anywhere on your property, including your front lawn. Can't wait for that. NOT!
Now in Florida they have something worse. CDDs another property tax. Once sold as just for a few years to pay for development of the area. It never ended 😂, just like tolls. So you pay HOAs, CDDs, property tax, and property insurance. All fees that always go up and up. DeSantis approved all rate hikes. So all this companies plus all utility companies are living their best lives. And Floridians are paying 2x - 3x the cost of just a couple of years ago.
As a Floridian, you are absolutely correct.
When you start helping to pay my mortgage, then you can start telling me what to do with my property.
I will never EVER EEEEEVER live in an HOA. Thank god for my land and my freedom.

I hope my world view never gets so small that I worry about someone else’s grass being cut.
Not a fan of more legislation. We have enough laws. In fact too many. When you buy a property and it has an HOA, it is up to you to review its policy. If you have an issue you can sue the HOA in a civil court. I have zero interest in some rando telling me how to manage my property. We wanted to buy a house. It was a HOA home and we didn’t even consider it because it was. It was a beautiful neighborhood beautiful home and we probably would’ve fit in nicely, but I didn’t want anybody telling me. I couldn’t put a flag cover over my mailbox, even though it wasn’t at the time, the spelling out of some of the rules were very vague so it just depended on the times and the person interpreting them so we just thought ahead and thought hell no so we just settle for less and more so we don’t have to worry about “the neighborhood
