Saw some patients who presented as MH or substance affected, & had serious medical issue as the cause. Saddest was a beautiful 14 yo girl, many decades ago. Was a good kid. Acted like she'd used PCP. Psychiatrist really listened to extended family. All drug screens were negative. MD had seen ONE case, in 25 years, of chicken pox virus getting into brain. Lumbar puncture ("spinal tap") provided sample of cerebrospinal fluid. Chicken pox (varicella) virus found. Sadly, no cure & condition is always fatal. I will NEVER forget that girl or her family, or the MD. Family finally had an answer.
That is not the court's job at a criminal hearing. It requires a petition to the court for such matters as medical/neuro or mental health eval. Mom needs to file if she is concerned. Call the judge as a witness if she wants. Call the jail staff if she wants. I have been down this road with my now ex-husband. He had a right to fight such a petition at a hearing for such matters but not in another court on any other matter.

Even before the availability of acyclovir, fatality rates from varicella encephalitis was only 15-25%. Chicken pox infections in children did occasionally take this form before the general use of vaccination for the disease. If I recall correctly, about 60% of those who recovered did so with return to normal function while the remainder of the survivors were left with some form of cognitive deficit. Varicella does sometimes reactivate in adults usually in the form of shingles but in immunocompromised patients such as those having undergone organ transplant it may appear as encephalitis. This is the only cohort whose mortality rate is 100% if memory serves.

25:41 as someone who used to evaluate people with mental health issues, obviously not evaluating him, but since he previously seemed functional and had a job that required training, my questions would be 1) does he have a mental health history and is off meds 2) does he possibly have a previously undiagnosed mental health issue that has worsened in severity for some reason, 2) is this a change of mental status due to possibly a head injury or tbi 3) is he possibly having a later in life psychotic break. Is being a jerk possible? Yes but the biggest thing to me is his affect and he's completely disengaged.

The "IRS" thing sounds like the common scam of "we accidentally over-paid you by cheque, and need you to send back the difference by wire / gift cards". The cheque is invalid, but it's drawn on a hard-to-validate account and takes a couple of weeks to bounce. At which point the bank yanks back the amount from the person who cashed the cheque.
Having listened to that segment again, what strikes me is that the court official says that she confirmed with the IRS that the refund was real. It makes a big difference how she did that. If she did due diligence and found the real contact information for the IRS, it would seem to be the IRS that screwed up. (That might be based on the guy filing fraudulent information, of course.) If she used the same contact info that the guy was using, she would just be reaching the same scammers that he was.
@@kathym8223 The Canada Revenue Agency gives one the option of getting one's refund by cheque or by direct deposit. They encourage the latter, and the former takes longer. There might be a limit on the amount they're willing to send by paper cheque, but I don't know if that's the case.
@jpolowin0 I believe the check is legitimate and from the IRS BUT filed fraudulently by a scammer. Normally the scammers ask you to submit a pic, ss card AND your bank info. They probably had multiple interactions with him hence explains why he alleges he contacted them by Facebook and texts. Those two forms of communication DOESN'T exist with the IRS. I know that firsthand. So the scammer most likely presented themselves as the IRS and said we need to pay out money but you need to file first. Please provide your info. They then used his legitimate info. Provided him with the Facebook and text info as a means for him to follow-up. The money then gets sent to him. There are scammers that specialized in those PPP loans that as seen on local news did this. Some have even been famous people. Eventually the IRS started cracking down and investigated.Thousands of those loans were fraudulently filed. Scammers were originally having the money sent to themselves but during the crack down it was traced and they were getting caught. I believe they started getting "mules" like this guy. The money was taken by child support before the scammers got a chance to finish the scam of telling him there's an error in the amount. Then proceed to tell him to "pay" back the majority of it by untraceable means. Basically an elaborate scam but a scam nonetheless. He most likely isn't the scammer but is the victim of his own naivety. All he saw was dollar signs and stupidly fell for it. Smh
He is under no obligation to assist this woman in her investigation, and he should provide her with nothing. Investigating tax fraud is not within the scope of her job description. If he had any counsel at all this case would be over. The sixty-day adjournment is based on nothing more than what may, might, or probably will happen in the future. Future crime is outside the jurisdiction of the court as much as tax fraud investigations are outside the prevue of counsel for the state child support disbursement office.

The dude with the IRS thing was definitely being roped in to some sort of scam... not sure what went wrong or if the actual scam has yet to take place but there's no way he was video chatting with the IRS on Facebook and texting them in order to get a $35k (a full year's pay for a lot of people) check out of nowhere. There's just no way.

He was told that it is a lone. Scam would have been done by IRS refund and then scammers asking him to repay lone to them instead. If IRS would not find it then they would get 35K. Simples.

Dealing with the IRS ~SUCKS!! I was in charge of a small business for 27 years and I didn't do anything illegal, but didn't follow every detail because I didn't know. I was the ONLY person who dealt with the concerns and the last time I called with a concern/question so I could do things properly the response was. . . .IRS man "you haven't convinced me you're the proper person to talk to" - end of discussion!! Many times I would send 3 or 4 copies of the same things to resolve an issue. . .🤦♀️!
I do tax returns and last year a sweet 85 year old lady who just had a small pension and social security got her refund held up because the IRS wanted to verify her identity. She had no cell phone or Internet or email so I had her come into my office to do it using my cell phone and the agent shot us down after 30 seconds, telling me I couldn't assist her in any way, so she had to get a ride to travel 50 miles to the nearest IRS office to prove she is the same person she's been for 85 years.
60 years ago, after my friends Dad died, the government declared that she and her 2 brothers, all under 12 did not exist. Birth certificates, school records, doctors records including hospital birth records and bills, notorized statements from neighbors, family and friends and they still said they did not exist. They refused to give them social security, finally the Mom got them escorted into the Social Security office with police and boxes filled with copies of everything already submitted and told the THING giving her a hard time, "Here are the children who do not exist. I cannot take care of them since you have cut me off and I can't even get my husbands life insurance payments because you refuse to give me the proper paperwork. Now they are your problem.". Meanwhile the cop was laughing his head off, finally the woman decided they did exist when her Supervisor was looking at the pile of paperwork with a look that said, "Are you insane"?

Either not guilty by reason of insanity or to do his jail time in a mental health facility which would be better than a jail. Looks like he’s just given up on life. Poor mom to have to watch him spiral down the drain in what should be her Golden Years. My mother is going through the same thing with my brother. Albeit he is not doing a mental schtick, but he refuses to straighten his life up and is in and out of prison; has never successfully completed parole nor have any desire to be self-sufficient and sober. And my mother thinks she can save him every time, obviously doing more harm than good.
And remember, the COs (Corrections Officers) have to deal with these individuals when they go off screen. They don't have the luxury of hitting mute or asking them to leave! I think the defendant that only nods is going through some sort of mental health issue. Anger giving way to depression, sitting in jail will do that to an individual. My husband was a CO (Corrections Officer) for 30+ years, he's seen it all.
Maybe he sustained a head wound or had a mini stroke that changed his brain chemistry? Or a prolonged period of stress in his life led to mental illness?

"Sovereign citizen" is a misnomer, and it's presumptuous of you to infer what these men and women may believe or not believe. The problem, respectfully, is that you don't know what you're saying. When you mention the word "statute," you are unwittingly admitting to the operation of trust law. Valid trust law is akin to statutory law is akin to public law. Everything is trusts. There are several trusts in operation in every single matter brought before the Bar in one of their Temple-bound courts for processing financial instruments. They are making money off of court cases, which is a polite way of putting it. It is incumbent upon any man or woman, if they truly be men and women of good conscience, to object to such mala fide proceedings when and where such opportunity should arise. I realize people have to pay bills. I realize people need clearing mechanisms for trade and transport, like "licenses." I realize men and women must put food on the table. But, at the end of the day, all of it revolves around "trusts" which are then broken up into Estates [States] having one of more funds for trade in setting off debt to be salvaged by corporations. That's the system [Roman system] in a nutshell. It has nothing to do with high-minded principles of _law_ but about making money from thin air and commercial control through such legal perversions as "enclosure."

It's been a long time since I felt this much pity for a poor defendant. It's easy to say he deserved it, but damn, I think he realized before leaving that it was probably a scam. When you're texting the IRS to find out if it's legit, he knows. And it never occurred to him until the court asked its questions.

At the end of this video she claims that she spoke to T.J. Reed & he gave her permission to go back in the house. Spoiler alert: that was a blatant lie since she never spoke to T.J. The guy saying he was talking to the IRS through FB got scammed. He needs help to protect himself from Identity Theft. Wow, this is a weird circumstance.
My theory: scammers used his info to file for the Employee Retention Tax Credit (ERTC). They either set the refund to direct deposit into their own account, or have the check mailed to their address. They didn't count on the refund being seized. The guy is going to have a whole lot worse than DFCS to deal with, when the IRS catches up to him.

100% this they got him to prove his identity then scammers used that and submitted his taxes saying that he had the max dependents max charitable donations and would have had him send 90% to them saying that it was 35k instead of 3.5k.. super common

I have always been amazed that we walk the same streets as other people, but live in completely different worlds. This phenomenon is not new. This kind of chaos and insanity (can't think of a better word right now) exists in every society. I am just grateful that it isn't my life. What I mean by that is that we watch from a distance and we can walk away. But it is these people's reality every single day, for whatever reason. It will never change. It's just more obvious now.
Zoom hearings have empowered defendants to act like they are talking to their buddies in a bar. The minute a Judge recognizes a belligerent or obnoxious defendant, he or she needs to immediate adjourn the hearing to a later date and demand the defendant appear in person.

Sounds like a scammer. They send a check and then ask for part back. Because they over paid. He sends the difference back and the check eventually comes back fake. But now he has sent them all his id and information. The mistake on the scammers part is the check went to a government account.
For the guy with the $35K IRS check, if the IRS later finds that this check was issued in error the they will go after him to get the money back. Court and DCFS shouldn’t be taking this up at all.
The Judge didn’t, he made a sixty day continuance in hopes that at that time there will be some resolution of the check issue and he can then know if he needs to rule on continued child support from the defendant. This poor guy appears to be too simple to even know what’s going on and he didn’t understand at all what “she”(which I assume is his wife) had done in that regard. If his wife knew the money she got was based on a fraudulent tax return then I would suppose the IRS may come after her as well. I feel quite sorry for him, he looks to have done what he could to verify the check but apart from that he is clueless. Any IRS agent who talks to him is bound to know he didn’t intentionally set out to defraud and that does make a difference to them in how they proceed.

The ex-wife’s name wasn’t on the check. She didn’t cash it. The money was appropriated by the state to pay his back child support. Not her problem. But I don’t blame the judge for holding off in the disposition of the case. I doubt it will change anything. The IRS will go after the guy and garnish his wages if the check was made in error. No different than if he had received the check, cashed it and spent the money. He’ll be responsible for paying back any amounts paid to him in error.

There likely is some form of community or charitable resources she might access. I wonder how extensive the repairs are to make that home safe for habitation? As well, surely there must be someone who could assist her into a new living situation and maybe even a local church might help her with relocating her possessions. Does she, in truth, own the property? Is there equity in it insofar as the lot itself if it were sold? If there are recoverable resources in the building itself, she might be able to allow someone to do that and recover some funds from that. There are a million questions here but someone needs to help her sort it out. This is too sad.
They are charging her with trespass so that would imply that actual title to the property is no longer in her hands so she needs help to recover her possessions. Surely, as I said, there must be some charitable entity or local Church who could help her. This is horrible and she needs emergent help to get into another living situation and to deal with her obviously very ill daughter.

If you have seen the show hoarders there have been many cases like that on the show, folks own their homes which are then condemned and the city closes it off. Sad cases, these ppl still own the property but can’t access it. She should definitely look into selling the property as is.

I have a feeling the guy in the DCF case talked to someone with a very heavy Indian accent. Banks will clear the funds, then 7-14 days later come back saying it was opened under a bad account, and reverse the funds. It's a pretty known scam.
I think this country is going to need a great deal of help in dealing with the mental health crisis our government is encouraging, including encouraging drug and criminal behaviors.

Simply having a mental health issue is not an automatic excuse to commit crimes. The vast majority of mentally-ill people are not violent or criminal, and can tell the difference between right and wrong. This is why the bar for proving a lack of criminal responsibility is so high. Simply having a diagnosed mental illness isn't enough, you have to be so impaired that you are totally incapable of knowing right from wrong, which very few people qualify as.

The "IRS" thing sounds like the common scam of "we accidentally over-paid you by cheque, and need you to send back the difference by wire / gift cards". The cheque is invalid, but it's drawn on a hard-to-validate account and takes a couple of weeks to bounce. At which point the bank yanks back the amount from the person who cashed the cheque.
Which will be the state of Kansas.
Having listened to that segment again, what strikes me is that the court official says that she confirmed with the IRS that the refund was real. It makes a big difference how she did that. If she did due diligence and found the real contact information for the IRS, it would seem to be the IRS that screwed up. (That might be based on the guy filing fraudulent information, of course.) If she used the same contact info that the guy was using, she would just be reaching the same scammers that he was.
The IRS sending a paper check rather than reaching out to set up an electronic transfer seems a bit off to me. Even TN is set up to handle EFT. 😂
@@kathym8223 The Canada Revenue Agency gives one the option of getting one's refund by cheque or by direct deposit. They encourage the latter, and the former takes longer. There might be a limit on the amount they're willing to send by paper cheque, but I don't know if that's the case.
@jpolowin0 I believe the check is legitimate and from the IRS BUT filed fraudulently by a scammer. Normally the scammers ask you to submit a pic, ss card AND your bank info. They probably had multiple interactions with him hence explains why he alleges he contacted them by Facebook and texts. Those two forms of communication DOESN'T exist with the IRS. I know that firsthand. So the scammer most likely presented themselves as the IRS and said we need to pay out money but you need to file first. Please provide your info. They then used his legitimate info. Provided him with the Facebook and text info as a means for him to follow-up. The money then gets sent to him. There are scammers that specialized in those PPP loans that as seen on local news did this. Some have even been famous people. Eventually the IRS started cracking down and investigated.Thousands of those loans were fraudulently filed. Scammers were originally having the money sent to themselves but during the crack down it was traced and they were getting caught. I believe they started getting "mules" like this guy. The money was taken by child support before the scammers got a chance to finish the scam of telling him there's an error in the amount. Then proceed to tell him to "pay" back the majority of it by untraceable means. Basically an elaborate scam but a scam nonetheless. He most likely isn't the scammer but is the victim of his own naivety. All he saw was dollar signs and stupidly fell for it. Smh

He is under no obligation to assist this woman in her investigation, and he should provide her with nothing. Investigating tax fraud is not within the scope of her job description. If he had any counsel at all this case would be over. The sixty-day adjournment is based on nothing more than what may, might, or probably will happen in the future. Future crime is outside the jurisdiction of the court as much as tax fraud investigations are outside the prevue of counsel for the state child support disbursement office.

The dude with the IRS thing was definitely being roped in to some sort of scam... not sure what went wrong or if the actual scam has yet to take place but there's no way he was video chatting with the IRS on Facebook and texting them in order to get a $35k (a full year's pay for a lot of people) check out of nowhere. Dealing with the IRS ~SUCKS!! I was in charge of a small business for 27 years and I didn't do anything illegal, but didn't follow every detail because I didn't know. I was the ONLY person who dealt with the concerns and the last time I called with a concern/question so I could do things properly the response was. . . .IRS man "you haven't convinced me you're the proper person to talk to" - end of discussion!! Many times I would send 3 or 4 copies of the same things to resolve an issue. . .🤦♀️!

I do tax returns and last year a sweet 85 year old lady who just had a small pension and social security got her refund held up because the IRS wanted to verify her identity. She had no cell phone or Internet or email so I had her come into my office to do it using my cell phone and the agent shot us down after 30 seconds, telling me I couldn't assist her in any way, so she had to get a ride to travel 50 miles to the nearest IRS office to prove she is the same person she's been for 85 years.
60 years ago, after my friends Dad died, the government declared that she and her 2 brothers, all under 12 did not exist. Birth certificates, school records, doctors records including hospital birth records and bills, notorized statements from neighbors, family and friends and they still said they did not exist. They refused to give them social security, finally the Mom got them escorted into the Social Security office with police and boxes filled with copies of everything already submitted and told the THING giving her a hard time, "Here are the children who do not exist. I cannot take care of them since you have cut me off and I can't even get my husbands life insurance payments because you refuse to give me the proper paperwork. Now they are your problem.". Meanwhile the cop was laughing his head off, finally the woman decided they did exist when her Supervisor was looking at the pile of paperwork with a look that said, "Are you insane"?

Either not guilty by reason of insanity or to do his jail time in a mental health facility which would be better than a jail. Looks like he’s just given up on life. Poor mom to have to watch him spiral down the drain in what should be her Golden Years. My mother is going through the same thing with my brother. Albeit he is not doing a mental schtick, but he refuses to straighten his life up and is in and out of prison; has never successfully completed parole nor have any desire to be self-sufficient and sober. I think the defendant that only nods is going through some sort of mental health issue. Anger giving way to depression, sitting in jail will do that to an individual. My husband was a CO (Corrections Officer) for 30+ years, he's seen it all.
Maybe he sustained a head wound or had a mini stroke that changed his brain chemistry? Or a prolonged period of stress in his life led to mental illness?

When you mention the word "statute," you are unwittingly admitting to the operation of trust law. Valid trust law is akin to statutory law is akin to public law. Everything is trusts. There are several trusts in operation in every single matter brought before the Bar in one of their Temple-bound courts for processing financial instruments. They are making money off of court cases, which is a polite way of putting it. It is incumbent upon any man or woman, if they truly be men and women of good conscience, to object to such mala fide proceedings when and where such opportunity should arise. I realize people have to pay bills. I realize people need clearing mechanisms for trade and transport, like "licenses." I realize men and women must put food on the table. But, at the end of the day, all of it revolves around "trusts" which are then broken up into Estates [States] having one of more funds for trade in setting off debt to be salvaged by corporations. That's the system [Roman system] in a nutshell. It has nothing to do with high-minded principles of _law_ but about making money from thin air and commercial control through such legal perversions as "enclosure."

It's been a long time since I felt this much pity for a poor defendant. It's easy to say he deserved it, but damn, I think he realized before leaving that it was probably a scam. My theory: scammers used his info to file for the Employee Retention Tax Credit (ERTC). They either set the refund to direct deposit into their own account, or have the check mailed to their address. They didn't count on the refund being seized. The guy is going to have a whole lot worse than DFCS to deal with, when the IRS catches up to him.

I have always been amazed that we walk the same streets as other people, but live in completely different worlds. This phenomenon is not new. This kind of chaos and insanity (can't think of a better word right now) exists in every society. I am just grateful that it isn't my life. What I mean by that is that we watch from a distance and we can walk away. But it is these people's reality every single day, for whatever reason. It will never change. It's just more obvious now.

Sounds like a scammer. They send a check and then ask for part back. Because they over paid. He sends the difference back and the check eventually comes back fake. But now he has sent them all his id and information. The mistake on the scammers part is the check went to a government account.

For the guy with the $35K IRS check, if the IRS later finds that this check was issued in error the they will go after him to get the money back. Court and DCFS shouldn’t be taking this up at all.
The Judge didn’t, he made a sixty day continuance in hopes that at that time there will be some resolution of the check issue and he can then know if he needs to rule on continued child support from the defendant. This poor guy appears to be too simple to even know what’s going on and he didn’t understand at all what “she”(which I assume is his wife) had done in that regard. If his wife knew the money she got was based on a fraudulent tax return then I would suppose the IRS may come after her as well. I feel quite sorry for him, he looks to have done what he could to verify the check but apart from that he is clueless. Any IRS agent who talks to him is bound to know he didn’t intentionally set out to defraud and that does make a difference to them in how they proceed.
@@jill7759 I don’t feel sorry for him at all. He knew he wasn’t making enough money to get back the amount of that check. He is libel for it if the check even if the check was issued in error. The ex-wife’s name wasn’t on the check. She didn’t cash it. The money was appropriated by the state to pay his back child support. Not her problem.
But I don’t blame the judge for holding off in the disposition of the case. I doubt it will change anything. The IRS will go after the guy and garnish his wages if the check was made in error.

There likely is some form of community or charitable resources she might access. I wonder how extensive the repairs are to make that home safe for habitation? As well, surely there must be someone who could assist her into a new living situation and maybe even a local church might help her with relocating her possessions. Does she, in truth, own the property? Is there equity in it insofar as the lot itself if it were sold? If there are recoverable resources in the building itself, she might be able to allow someone to do that and recover some funds from that. There are a million questions here but someone needs to help her sort it out. This is too sad.
They are charging her with trespass so that would imply that actual title to the property is no longer in her hands so she needs help to recover her possessions. Surely, as I said, there must be some charitable entity or local Church who could help her. This is horrible and she needs emergent help to get into another living situation and to deal with her obviously very ill daughter.
@@jill7759she may still have title but it could be the home is inhabitable. The city may have safety concerns and therefore condemned it, as such she cannot be there. If you have seen the show hoarders there have been many cases like that on the show, folks own their homes which are then condemned and the city closes it off. Sad cases, these ppl still own the property but can’t access it. She should definitely look into selling the property as is.

I have a feeling the guy in the DCF case talked to someone with a very heavy Indian accent. Banks will clear the funds, then 7-14 days later come back saying it was opened under a bad account, and reverse the funds. It's a pretty known scam.

I think this country is going to need a great deal of help in dealing with the mental health crisis our government is encouraging, including encouraging drug and criminal behaviors.

I can't imagine the mom in the child support 35,000 has any responsibility to return that money. The department sent it to her. She has been denied 35,000 in support and was probably jubilant lol. I'd ignore those calls too.

Thank you, Mike because I don't understand first of all, like you said, his account is taken care of. And it's none of her business or the court's business, why he got the money? He checked it out, he got the check. It was sent to his wife or asked whatever she is, and it's legitimate. It's not like IRS when they're there and said Hey, give me my money back mistake. They need a back off and leave it alone and leave him alone. It isn't right. And that DCF attorney needs to mind your own business because the account is paid in full.
I have jury duty next week in Decatur, Ga. I would gladly do it for a trial with one of these crazy guys.

She said they had to send to mom in 2 days in the system, but it never said the check cleared! My son got one and weeks later was charged in fraud of bad check since it came from a crazy fraud scheme
How the hell do you have so many of these people from Kansas?? I was raised in Kansas and can ensure you we are NOT all this crazy... You go out to the small towns (with bad schools) and you start getting more of the Sov Cit/Libertarian types.
It is sad that our courts and jails are being used in this way. Mental health issues shouldn’t be treated as crimes.
Simply having a mental health issue is not an automatic excuse to commit crimes. The vast majority of mentally-ill people are not violent or criminal, and can tell the difference between right and wrong. This is why the bar for proving a lack of criminal responsibility is so high. Simply having a diagnosed mental illness isn't enough, you have to be so impaired that you are totally incapable of knowing right from wrong, which very few people qualify as.
Better we allow them to remain on the streets attacking and harassing others right?
