Well, there is one difference. She supposedly has more training on how to safely handle her own weapon than another that she randomly encounters. I will say that there are some weapons that unless you are trained on, you should not handle. One of the first rules of gun safety is "If you don't know how to safe it, don't touch it". And in this case, she clearly violated that rule.
Cops were the ones who tried to convince everyone that "Glocks just go off in the holster" for at least 10 years before they finally figured out that it will go off if their finger is inside the trigger guard when holstering. The average uniformed cop is not a good gun handler. Ponytail cops are even worse.

This is precisely why it's a bad idea to inform an officer that you are armed when pulled over. Under the law they can choose to disarm you, and then someone whose competence you have no way to know will be handling your firearm. And, despite what a lot of people think, the vast majority of officers do not have much expertise with firearms. They train to the lowest standard required by their state or department with just their duty weapons, and in many cases may have no other experience at all.

I have been traffic stopped on 3 occasions while carrying concealed. These were routine stops. Even though not required, I gave my CCW permit to the officer with my drivers license, and they simply asked me for the location of the weapon, and I told them. No request was made for custody of the weapon. Really stupid policy.
That agency is not classifying the incident properly, it is an officer involved negligent shooting, not “accidental”. This is what happens when inexperienced people handle firearms. As a LEO, I have never disarmed a licensed carrier for “officer safety” because guns don’t discharge by themselves. I don’t see LEOs disarming other LEOs they’ve stopped for traffic violations so why disarm a concealed carrier?

As a former state corrections officer, we had only 2 days of gun use, and that was it. No gun safety. Then, when I joined the Tactical Support Unit (SWAT), we would train once a month, but that didn't always mean weapons training. Physical training was done instead. Regular officers were armed and, with little training, took inmates to other prisons around the state on daily, weekly, or monthly transfers. The average time a police officer in the academy spends on weapons training is 71 hours. Less than 2 full weeks. The average police academy is about 5 months. The corrections officer academy I was in was 7 weeks. Fortunately, my federal law enforcement officer father had taught me how to use weapons for self-defense and hunting. Plus, former military. This whole scenario is scary.

I have seen officers tell people to unload their firearms in front of them while they are at the traffic stop. Administrative handling of a firearm should not be done in your car. Especially during a traffic stop. This is a recipe for abject disaster. Just because the person is engaging in their rights doesn't mean they're a criminal or that they should do anything differently than anyone else. Write the citation and hand it to them. It's being said and it's being said all the time that when you're pulled over you're not under arrest. You most certainly are under arrest and the Supreme Court said that in 1961. If you are on the side of the road because a police officer told you to sit on the side of the road and you're not free to go, that is by law and arrest. Your behavior has been arrested. If they choose to detain you further that's a different story. But it doesn't go your free to travel then they detain you, then you're put under arrest. The definition of an arrest is anytime your behavior has been interrupted. You can't change the definition of the word arrest through legalese. The officer in this case had no business telling the person that they're going to remove the firearm from them. That was even stupider than having the the person disarm themselves. Police officers are not known as being anything like a Firearms expert. Believe me I've trained police officers. Their understanding of the mechanics of a firearm is frequently less than nothing! It is becoming completely clear that not only should you not tell the officer your arms, he shouldn't be asking if you're armed. It is none of his business. Write the citation from which you hold them over for unless you see that they have somebody restrained in the back of their car or some other such obvious issue. Write the citation or tell them to be more careful whatever it is you need to tell them and end the arrest.

Removing the holster? I hope the mouthpiece was mistaken. Removing the sidearm is one thing but removing both simultaneously is ignorance and negligence at its highest level.
Just imagine if he's been removing the gun himself, and accidentally shot the officer. I wonder what charges he would be facing?

"Officers encounter a lot more people with guns..." That is a completely unjustified assumption. Officers are being TOLD that someone has a firearm more often, because they are now legally justified. There is no reason to believe that the actual number of people carrying changed significantly before and after the law went into effect.
So the memo is basically letting them know what they should already before even going out into the field as a policy officer
Even in a memo they get it wrong and they are teaching them that. RAS, reasonable is the first word which is important.
The only words you need to hear are "accidental" and "shooting." No other context matters, this person can never have a firearm ever again.
They had no right to remove it.

This is what Black people speak of when we talking about there being a set of rules, regulations and laws for Black people and another set of rules, regulations and laws for white people. I have seen officers tell people to unload their firearms in front of them while they are at the traffic stop. Administrative handling of a firearm should not be done in your car. Especially during a traffic stop. This is a recipe for abject disaster. Just because the person is engaging in their rights doesn't mean they're a criminal or that they should do anything differently than anyone else. Write the citation and hand it to them. It's being said and it's being said all the time that when you're pulled over you're not under arrest. You most certainly are under arrest and the Supreme Court said that in 1961. If you are on the side of the road because a police officer told you to sit on the side of the road and you're not free to go, that is by law and arrest. Your behavior has been arrested. If they choose to detain you further that's a different story. But it doesn't go your free to travel then they detain you, then you're put under arrest. The definition of an arrest is anytime your behavior has been interrupted. You can't change the definition of the word arrest through legalese. The officer in this case had no business telling the person that they're going to remove the firearm from them. That was even stupider than having the the person disarm themselves. Police officers are not known as being anything like a Firearms expert. Believe me I've trained police officers. Their understanding of the mechanics of a firearm is frequently less than nothing!
It is becoming completely clear that not only should you not tell the officer your arms, he shouldn't be asking if you're armed. It is none of his business. Write the citation from which you hold them over for unless you see that they have somebody restrained in the back of their car or some other such obvious issue. Write the citation or tell them to be more careful whatever it is you need to tell them and end the arrest.
