  • I'm sure you've heard of cyber attacks, but have you ever thought about taking 'persons unknown' to court?
When HWL Ebsworth faced a massive cyber attack with 3.5 terabytes of sensitive data stolen and a ransom demand of about $AUD7.1 million, they chose a bold legal approach over payment.
Instead of meeting the hackers' demands, HWL attempted to negotiate through the dark web to confirm the possession of files. After refusing to pay the ransom, which resulted in some documents being leaked online, HWL successfully obtained an interim injunction to prevent further distribution of the stolen data.
They communicated this injunction to the hackers using the hackers' own communication methods. Ultimately, HWLE secured a permanent injunction, effectively stopping not just the hackers but also any third parties from spreading the information further. This case illustrates a proactive legal strategy for dealing with cyber threats, focusing on containment and prevention without compromising on ransom demands.
