    Information about how to become a successful real estate lawyer by Attorney Steve Vondran, the business and real estate lawyer. This video talks about the types of cases real estate lawyers might handle, whether it is from setting up a new business, (incorporation or LLC, or partnership) and setting up independent contractor agreements, policies and procedures, and the like.
    This video on tips to becoming a real estate attorney also discusses getting a hi-score on your LSAT, doing internships, getting a real estate broker's license, and other tips to help you practice law as a real estate lawyer.
    Other topics such as financial elder abuse, breach of fiduciary duty, real estate arbitration, eminent domain, zoning, and land use are also discussed.
    Hope you enjoy the video. I love practicing real estate and business law and hope you will enjoy it too. The nice thing about real estate law is NOT EVERY LAWYER out of law school wants to go on to become a real estate attorney (many law school students want to do criminal law from my experience). There are only so many of those cases to g around based on the number of lawyers around. So focusing on real estate law could be a great niche for a new lawyer to consider.
    Granted, the real estate market is not sizzling hot right now, but look around, there is property everywhere you look and real estate law issues will never go away.

    I just recently graduated with my Bachelor's in Criminal Justice from University of Central Florida, but my senior year during my very last semester, I took an elective course in Real Estate basics (my mother is a Realtor and owns numerous properties) and I fell in love with RE. Shortly after, I wanted to take it up a notch to a Real Estate Lawyer. I always had an interest in law, just wasn't sure which kind of law to practice. Any pointers or tips you can give? Any books you recommend or certain classes to look for? Anything you know that can make me more competitive? I have been reading real estate law books and looking into general business knowledge as well, considering criminal law is my stronger suit at this point but I want to make the transition over. I also have been studying for the LSAT exam scheduled for December and have a 3.3 college GPA (not the sharpest, I know, but I seen 2.9's get into decent schools with good LSAT scores). Thank you so much for sharing this video!! It gave me a great view of what you guys do!

      Hi Wally, you ask a lot of great questions. My advice, its general:
      1. Never let your GPA dictate who you are or what you can do. The classroom is very different from the real world. And there is an old saying "the A students end up working for the C students." That being said, you should always try to get the best grades possible, but that is not the defining measuring stick from my perspective.
      2. Criminal justice and real estate, to me, are very different and you are likely looking at two very different worlds. Criminal Justice may take you more into the courthouse, while real estate is more about properties, (commercial, residential, retail, etc.). Its about transactions. Deal closings and that sort of thing. You have to know what it is you really enjoy doing. Do you want to try to improve the criminal justice system, and help people in that area, or do you like deals, commissions, licensing, zoning, flipping, and those types of things? This really involves taking some time to really get to know yourself. We are always learning about ourselves, and we are always changing. So this is the fun part, but also the challenging part. You choose how you want to spend your hours on the big rock.
      3. As for real estate law, I have always found it to be a great area of law because there are so many different types of real estate professionals. From property managers, to loan officers, to escrow agents, and with residential real estate agents, commercial property brokers, zoning and land use issues, environmental law, building brokerages, real estate accusations, ethics issues, I could go on and on and on. Real estate financing is a great area as well. So as you may be able to tell, even if you make the decision that you want to be a real estate lawyer, you will find that there are 50 different directions you can take within the profession itself. This is what we call niches. So many things to choose, the same I suppose would be true of criminal justice, but I don't know the ins and outs of that area.
      4. Do well on the LSAT if you are going to do it. Take your time to really try to master that. It could impact which schools you get into. But then again, schools do not define you. If you go to a lower tier law school like I did (Whittier Law School - which I loved), then you try to be the best alumni ever, and I can tell you I am doing quite well and very pleased with what Whittier has afforded me. But like everything else, my philosophy is you go for the gold, and if you fall short you are still doing pretty well. Life and career is what you make of it. Labels (like schools and GPA are just measuring sticks some people use to classify and categorize you). Make your own labels and be awesome regardless of undergrad majors, GPA's, etc. You can always be the person you want to be.
      5. As far as books to read. I like the web, videos, podcasts. Check out BiggerPockets and Inman real estate. Miller and Starr is the real estate law bible. Three good sources I like.
      Best of luck, just remember to always go for it in whatever you decide to do. Put yourself "all in" to your work, your relationships, and have PASSION for what you do. Without passion its hard to do anything worthwhile.

    I'm 26 years old rn and I am seriously considering finishing school in order to become a RE lawyer , I am in my first year as a realtor and I'm a community assistant manager for a real estate investment company/property management company , I love this business

    Hey Steve, cool video.
    I just graduated law school and passed the FL bar last year. I got my first job doing civil litigation defense. I’m looking to make a switch to real estate law. Any advice on how to enter into the field as a new attorney? Thanks.

      What I did was get my real estate broker license. In CA they had some exemptions for Attorneys that made it easier to get in. From there, I started incorporating real estate brokers, then, that lead to broker defense of accusations and many other things they would call me for. I think blogs and videos are crucial (along with being educated on the issues). Hanging out with real estate people is key as well. SV

    Hey Steve, I live am a recently licensed attorney in Ohio and I am considering starting my own practice initially primarily focused on Real Estate Law (I spent the last 3 years as a Title Abstract/Landman). I was curious if you had any insights into possible resources that I could read/view that would help me get a greater grasp on the law and issues I would encounter.

    There are real estate consultants that assist parties in real estate transactions and development. However, to advise a person or company on legal matters, a person would need to have a license to practice law in the state they are practicing in. Knowing the laws is always good, but to be able to advise a person or entity as to the legalities of a transaction, or to represent them in a real estate arbitration, normally a law license would be required.     Can you be a real estate broker and real estate lawyer at the same time?

      raul chacon Hi Raul, yes there are lawyers that also act as brokers. There are some ethical rules that can apply for example, you cannot be a broker and try to solicit clients for your law firm for example.

    Hey Steve, great video. I need some advice to get started on my career path. I’ve always wanted to be a lawyer and I just finished with my associates degree in criminal justice. I now know I want to pursue Real Estate but I’m not sure where to begin. Should I continue to earn my bachelors in criminal justice so I can go to law school or start over?

      We like to call it "practicing law" because we are always practicing to get better each year. Once a person passes the bar exam, they can choose what field they want to practice in, so really, you can start on your first day. As I like to saw, law takes a few years to learn (law school) but a lifetime to master. Thanks for the great question! Steve

    Steve, I'm a licensed attorney in Washington state. I just came across your video and wanted to ask you about a lateral move from my criminal/personal injury practice of 11 years to real estate. What suggestions do you have for someone looking to make a move (I have my real estate broker's license here in Washington state)?

      Good question Nathan. First thing in my opinion would be to get involved with other brokers and agents. Go to the association meetings, conventions, etc. Get to know your local area agents. Also, I used to buy the BRE mailing lists that have all the agents on it, and I used to send monthly mailers advertising my real estate related services. I then got into blogging and video heavily. Focused on issues like 1. how not to lose your license 2. reporting criminal convictions, 3. what to do if you are being audited or forced to respond to a complaint, 4. what if you are involved in a real estate accusation. What grounds are there for bringing an accusation, what are the burdens of proof, etc. Then I got into commission disputes, ethical complaints, etc. The topics are endless. Zoning was always a part of my practice as well, and you can network with commercial real estate brokers to get your name out their. Their clients may need zoning and entitlement work. Once you get in on these levels, you might see what I saw (being that I also constantly blog about general litigation topics and my Clients know I litigate in both state and federal courts), then you end up getting some arbitration and/or litigation cases. Throw in TILA and RESPA and you are off and running. It just takes time to get the mix going. 1031 exchanges might also be an area to throw in . At any rate, those are my general comments. You just have to get into the mix and let everybody know what you do. Having a youtube video channel has also been important. A lot of work, but fun work for me. Hope that helps. Best of luck!

    Can a realtor get sued for copyright in using someones music for a real estate video on Instagram?

      Hi Luis, we cannot give legal advice online. Generally speaking you need to get permission to use someone else's music in your videos or you can risk being sued. There is one main exception, and that is if there is a "fair use" of the copyrighted content. However, this is not always best to rely on as a defense but doing non-commercial videos on instagram might qualify depending on how much of the song is used and how its used and other factors. I plan to do a video on fair use in the near future to help on this important topic.

      Great question Luis, generally speaking you always want to make sure you buy a license or use your own music to avoid potential copyright infringement lawsuits and legal demand letters. This is not legal advice but anything that is copyrighted and used commercially online can lead to legal issues.

    I am trying to figure out what advantage you have as a real estate "lawyer" vs. just knowing the real estate and business laws inside and out.... if its to charge people for consultation, if you have a brokers license, and can demonstrate thru references and knowledge you know how things are done, cant you simply act as a consultant assisting someone in self-arbitration?
