Joey Merlino revealed that during his imprisonment, he shared a cell with alleged terrorists. He was placed in an extremely high-security environment, where conversations and calls were monitored. He further recalled his transition after being released nearly 12 years later in 2011 and feeling behind with technological advancements such as mobile phones. In 2016, Merlino was again arrested, this time for being one of 46 individuals put under trial for a variety of charges connected to the Racketeer Influenced and Corrupt Organizations Act (RICO). They included one count of racketeering, one count of fraud, and two counts of illegal gambling. Prosecutors believed Merlino had ties with the Genovese Mafia and was part of a medical fraud scheme. Merlino, however, described these charges as "all bull****" and stated that he couldn't present crucial tape evidence at his trial, which led to a hung jury and eventually his plea of guilty on a single charge related to illegal betting.
