My primary number 1 criteria when I was looking at houses where nearly ALL houses are in an HOA (Palm Beach County, FL) - was no HOA. Under no circumstances will I ever again live under HOA rule.
Thoae ppl worked hard to earn a place that is private... no one can just walk up and do what they want no matter how innocent... what if that was ur ppl.. or u dont have respect for the matriarch/patriarch of your line?
the reason they bought a house in a private community is because they didn't want any tom dick or Harry at their shit. if that piece of property the two kids claimed was owned by the county.. cool fish there.... but not up in people yards or boat docks... simple has some respect and go ask the ppl if you can fish there... i do it all the time with my kids... some ppl say sure...others say no and we go about our day...

I guess I depends on where you live. I live in a Home Owners Association neighborhood. No one really gives a fuck. The cops roll by every now and then and tell you to get your basketball hoop out of the road, but that's about it. The only time the HOA meets is if the city is threatening to raise the taxes again or to warn people that excess crime like B&E's are going on. Or the local teenage vandals are out again, busting the tail lights or windows of cars. Oh yea another thing they like to do is go around knocking mailboxes over. So there's that but I'm living here 33 years now and never heard a peep from the HOA about my property. I'm a paralyzed veteran. So, I can't mow the lawn, the pine trees have taken over my property and you can barely see my house. I have a good neighbor, so he cuts my grass whenever he cuts his own. I have an old handicap van that hasn't been washed in a decade. The thing is, everyone knows me and my situation. My house is called the "Addams Family House". Anyway what are HOA's for? Think about it. In my opinion just for the community's safety. Everyone in my neighborhood has an easement ten feet from the curb in towards their house. We are responsible for cutting the grass on it, but it's pretty much public property. Anyone can walk on it. But when people go on their evening walks, they walk in the road. Why? Because they have respect. that's all these old timers are asking for. A little respect for a person of any age goes a long way. That old lady seemed like a bitch. Maybe she was just tired of having strangers getting up in her shit. The old man seemed like he would have been willing to talk. I'll bet if you put your fucking cameras down and talked like two decent humans to each other you might have persuaded him to let you do a little fishing back there. At least he would know who you were.

My brother’s hoa told him to buy a $400 tree and plant it in his front yard since he lives close to the entrance to the subdivision. I know it’s subjective by hoa SUCKS
in all states its illegal to trespass - and that dude on the dock was. The guy with the camera was not until he crossed that clump of trees on his right.
@@JoseGomez-vr6lh You seem to have a common fundamental misunderstanding of navigable waterways, and property. "you can't own the water" is a trope, and a half truth at best. Even on an navigable waterway - which that is not - you can own to the high tide mark, and you can 100% still get a permit to build a legitimate private dock, which you also own - even though you cannot in the case of a navigable waterway tell boaters to go away because they're "close to your dock". You can pull up ON A BOAT and fish the dock pilings and theres not a damn thing the dock owner can do - but if you set foot on that dock, you are trespassing. The second you set foot on land above the high water mark - you could be tresspassing, and you're NO LONGER on the water. Navigable waterways are a defined thing, and it's not every bit of water over land. when it rains ... can I stand in puddles in your yard and tell you to fuck off? You don't own the water! You can 100% own a property, and build a pond - and you own the land underneath the water because it's not navigable per the actual definition. That lake COULD be owned by the HOA, and it might or might not be - but for the sake of argument - lets say it IS a navigable waterway ... you have to put a boat in from a location where there is public access, and if you can float your boat to where you are - you're fine. Fish from your boat against that guys dock - 100% legal. You cannot fish from land and cry about "navigable waterways" because that's not how any of that works. If a navigable waterway intrudes or crosses through private property, you can be ON THE WATER below the high tide mark, and you're fine! But if you have to drag your boat through shallows where you can't float (I'm talking kayak here) - and that part you're now in is enclosed in private property - it's NO LONGER navigable, and you're trespassing. I looked up that lake, and the properties on the GIS map on the tax assessors site, and that most certainly IS his dock. That one guy standing on the dock trespassed on at least 2 other properties on his way TO that dock. There IS a public access point to that lake where they came from, but the park doesn't extend through those peoples back yard. There are SOME places, where 10 feet from the bank is public property - but that's not the case here. He is not "squatting" so he can claim "adverse ownership" with that dock. Matter of fact - you can probably look up the permit for that dock - and if he has no permit, go ahead and report him to the county, they'll come inspect, look at permits issued, and if it's not in order, they can make him take that dock down - but that still doesn't mean you can walk through his yard to fish that lake...

Hunting laws are even MORE confusing - that shit'll make your head spin ... Now - if these dudes put in a jon boat right there at that public access, they would have PROBABLY been A-OK fishing those dock pilings from the boat, and if the homeowners had something to say about it, and a vid was made - I'd be on their side 100% - and I AM on the fishermens side ... but they were wrong in this case, and graciously accepted it. Jack Kramer agreed we get it here in Canada too . I’m in my 60 ies if fish and every year more harassment just like you getting . I don’t think I would have used their dock though .
Everybody thinks they own the water. Boaters are just as bad. I never take my boats out or fish on high volume days. 5AM on a Monday morning suits me just fine. There are very few casuals and belligerent drunks that way.

I've had one issue in over 50 years of fishing with people telling me I couldn't fish a spot I was 100% legal to fish. Most of these videos are young kids breaking rules and hoping to get likes/subs by posting videos on YT.
@@zachburskey8868 Agreed, you should not trespass on people's private property. There are lots of places that have private shoreline that you can fish if you are on the water and have legal access. That sucks for bank fisherman, but Jon Boats and Fishing kayaks are cheap and are much better for fishing anyway. Bank fishing sucks. All the good spots are overfished, and at best a 50-50 shot even when fishing is good, because fish move around with slight condition changes throughout the day, and become wise to bait and similar presentations even during spawn when it is reaction strike.
I was fishing on a Lake that was next to a golf course & was threatened with my life by an old fart with his nine iron while his son & wife stood by watching. Then he said that he was calling the police, I said "Great, I'll get a ticket for trespassing & You'll get handcuffed for threatening to murder me with your golf club...BRING IT ON!!" I left directly & have not returned. That was 15 years ago.
These kids might be okay, but the ones who come after them may be slob fishermen who don't obey the laws and leave litter all over the place- or worse.

I was a bylaw officer/supervisor for our local municipality for 12 years and although we didn't deal with fishing or property-related issues - I ran into people like these everyday in other matters. People who just make things up and say anything they want out of sheer ignorance and stupidity. Seniors were most often the worst. And when they're retired...they have all day to stand and argue pointlessly. I commend both these youngsters for staying calm, cool and collected and attempting to logically deal with the confrontation. Fishing's a great pastime (I used to ice fish in my younger days)...fresh air, sunshine...relaxing and fun. Great way to stay outta trouble. Unfortunately you run into a few Karens and other naive idiots who just can't help but demonstrate their ignorance.
The Homeowners Association can't fine you for nothing all the can do is ask you nicely to do something. And all HOA board members are are stuck up rich a$$holes.
There's times when Realtors and title companies do not tell buyers unknowing themselves or out and out hide the fact. HOA's can range in any combination of affordable and lenient, to expensive and assholes. HOA's are formed by the developer and usually turned over to the home owners after a certain percentage of the properties are sold, all rules dictated by State regulations. When buying any property in or outside of a HOA, do your homework, interview neighbors, review property history, at the title company and planning and permits departments. Don't buy in and be a jerk, because you didn't check it out, or say that you didn't know if was a HOA.
We have an HOA but don't pay anything for it. I live right outside of a major military installation. Nobody really gives a shit. People are constantly moving from one post to another or getting out. I don't think anyone is on it. The police run a neighborhood watch through here every now and then. Especially in the summer when the teenage vandals have nothing better to do and go around fucking shit up.

I have property on the water, a canal that leads to the ocean. I have always let kids fish on my property! In fact whenever I run into teens looking for a place to fish i direct them to my property which is right next to a state park closed to them unless they pay a large fee. This is very petty of this man , he wants to feel he is better than others. And to control these kids while they are on public property at that!!!! Maybe they will give up fishing and will have nothing better to do but to burglarize the mans house.
Your last sentence hit it right on the head. How many people do these homeowners see walking that thin strip of land behind their house? What's the crime rate in that area? How many B&E's have been committed in that neighborhood? How do these homeowners know you're not casing the joint? Try and see it from the homeowners point of view.

Know your rights. As licensed fishermen, I would've informed both these individuals that it is illegal in all 50 states to harass licensed fishermen and hunters. If that truly is a county/public lake, then you're the one who is actually paying extra to upkeep it -- not those two people's HOA. The only thing they're doing is paying county taxes, just like you (or your parents) are. Your fishing license is extra money to help maintain properties like that. In the meantime, unless that lake/pond offers the best fishing in the state, I just simply wouldn't go there. Seriously, who needs the grief/confrontation (right or wrong)? I go fishing for fun/recreation, not to get it heated debates with cranky, uninformed locals.
The whole point was the kid in red was on their private dock!!! They were right for saying he was on private property, the rest of the video is just pointless because they had a right to fish everywhere but where the guy in red was standing.
I go to the public lakes on a kayak(which makes all the difference) & avoid these kind of situations. I didn't always but with age comes wisdom. Meaning, I've made some monster mistakes & try very hard not to repeat them.
He probably never even called the police, just thought it'd scare you off. Some older people are just hateful & want things done THEIR way. We lived on a private lake for 20+ years & if 2 young/ teenagers came to the door, knocked & ask to fish off our dock, we'd say yes,just don't leave trash behind. My husband died recently, was 70 years old, I'm late 60's, I don't want to be like some elderly people, I try to be understanding & remember when I was young. I have grown grandchildren & I'd rather they be outside doing something than inside on the computer, a phone stuck in their face, or strung out on drugs. You seem like nice, mannerly young men, stay that way & keep fishing or doing Anything outside..
I used to fish for saltwater alongside a bridge, and the guy in one of the condos along the side of the road kept threatening to call the cops on my buddies and I. When he finally DID show up, we asked the cop how many feet we were from the center of the roadway. By State law, we were on state land. We weren't being disruptive, or damaging anything, so the cops backed us up.
Seems like a good kid but he most likely has this problem because his mom didn't make him sit up straight as a child & if he reads this he will come to her defense and say he has a genetic spinal issue scoliosis ect .

Here's the thing about lake community's, if the lake is built in a flood zone or the lake has a water source that runs in and out of it, it will need a levee. What looks like to me is exactly what you guys where standing on. A levee needs to be maintained and cost to do so. So if the community doesnt want to pay for it then it has to come out of taxpayers money. If taxpayers are paying for it then a portion of that lake has to have public access.
Rule one: Do not allow them one iota of control! When they say " come over here " don't! Follow me I want... No! Put them on the defensive. Who are you. Do you have id. And never stop fishing! "we're gonna get two more signs and put them up there." if any signs are placed by a city/county there will be stickers on the back of the sign indicating the city's/county's name and the statute code number. otherwise, it is like you said, anyone can put up a sign. also, if it is a public lake, there has to be a public access point. most likely, this is why the county maintained ownership of the strip of land.

It funny I was just fishing yesterday I had a farmer come up to me and a friend tell us your fishing on private property. I looked at him and said to him politely show we're on the geogle map does your farm run to. Then he goes on telling me fish and game gonna find me for fishing on his property I told him go head we got are fishing license. There were other people there telling him you don't own the leveee. I told him i worked for the county for 5 years and you cannot put up private property sign on county owned or access road that illegal.
I totally get that your on public land and your just fishing, but you have to remember that your an ambassador for everyone who fishes, please be respectful while dealing with people. Your 100% right and I’m glad you came prepared to deal with people like this but you gotta take the high ground!

If it blocks your access to the lake, I believe you have the right to cross it since it's on public property. They may even be required to remove the dock since it block assess. Talk to the DNR about it.
Some of these older people should be out there fishing with the young guys and try and remember what it is like to be young. Instead of being nosy, interfering old killjoys.
Not sure what state you're in, but many states have specific laws against harassment of fishermen and hunters. Y'all might want to google that law and, if it exists in your state, keep a copy of it in your backpack.

The only lakes that are illegal to fish on are legally owned bodies of water by either someone who dug it on their property or if it was man made by a company, such as Arrowhead Lake in north GA. Bringing up allatoona was a real test for their knowledge btw, allatoona is owned and ran by the Army Corp., a national organization, all county/city owned lakes (and national) are public unless marked by licensed officials. Y’all had every right to fish off of the land in that location.

First off your buddy was behind houses on a dock and not on the property you were talking about being county property. That means at least he was trespassing and likely you were when you rushed to his defense. Secondly if there is a HOA that covers access to the lake and stocks the fish then it is indeed private property regardless of who owns the lot. I'm sure you are correct that the county does own at least part of the land however they still would have to follow HOA rules regarding the lake. Honestly if you do not own it, or it is labeled specifically public access don't go there because while you think you may have a right to be there you may actually have no legal right to be there or at least fish there at all.
A HOA has no authority over a public lake. If the county owns the lake then people have a right to be on it. It doesn't have to be labeled public access.

The HOA could actually own the lake and it's contents regardless of who owns the bordering property. It sounds as if that is the case and they are indeed trespassing when they fish.

It depends on the local and state laws regarding riparian rights, if it's a man made lake or waterway or naturally occurring. The shore line is probably an easement up to a certain number of feet but may not include docks or other fixtures depending upon where it is and local laws.
Don't ever go onto someone else's dock and fish when you don't have permission. The kid in red shirt was obviously trespassing. The county property was fine though.

Without doing more research it is tough to say who is actually right here from a legal standpoint. I will say this, just because the county (or some other local government) owns a property this does not automatically mean the general public has a right to use it for recreational purposes. The older couple might be correct, especially if there is a formal agreement with the HOA.
If fishing is not permitted by the local government, then the local government should be the ones to put up NO FISHING, or NO TRESPASSING signs, not the HOA members.
Teens fish in the Bayou behind our house all the time when my Children were younger..I enjoy hearing kids laughing having a great time.. Life is TOO SHORT.. Its a Liability for the HOA if non residents fish a HOA owned/ maintained Lake. The property owners probably signed legal papers not making the HOA responsible should anything happen with the lake when purchasing their property. Just go to a normal lake and fish with no worries.

I guess I depends on where you live. I live in a Home Owners Association neighborhood. No one really gives a fuck. The cops roll by every now and then and tell you to get your basketball hoop out of the road, but that's about it. The only time the HOA meets is if the city is threatening to raise the taxes again or to warn people that excess crime like B&E's are going on. Or the local teenage vandals are out again, busting the tail lights or windows of cars. Oh yea another thing they like to do is go around knocking mailboxes over. So there's that but I'm living here 33 years now and never heard a peep from the HOA about my property.
I'm a paralyzed veteran. So, I can't mow the lawn, the pine trees have taken over my property and you can barely see my house. I have a good neighbor, so he cuts my grass whenever he cuts his own. I have an old handicap van that hasn't been washed in a decade. The thing is, everyone knows me and my situation. My house is called the "Addams Family House".
Anyway what are HOA's for? Think about it. In my opinion just for the community's safety. Everyone in my neighborhood has an easement ten feet from the curb in towards their house. We are responsible for cutting the grass on it, but it's pretty much public property. Anyone can walk on it. But when people go on their evening walks, they walk in the road. Why? Because they have respect. that's all these old timers are asking for. A little respect for a person of any age goes a long way. That old lady seemed like a bitch. Maybe she was just tired of having strangers getting up in her shit. The old man seemed like he would have been willing to talk. I'll bet if you put your fucking cameras down and talked like two decent humans to each other you might have persuaded him to let you do a little fishing back there. At least he would know who you were.

Even on an navigable waterway - which that is not - you can own to the high tide mark, and you can 100% still get a permit to build a legitimate private dock, which you also own - even though you cannot in the case of a navigable waterway tell boaters to go away because they're "close to your dock". You can pull up ON A BOAT and fish the dock pilings and theres not a damn thing the dock owner can do - but if you set foot on that dock, you are trespassing. The second you set foot on land above the high water mark - you could be tresspassing, and you're NO LONGER on the water.
Navigable waterways are a defined thing, and it's not every bit of water over land. when it rains ... can I stand in puddles in your yard and tell you to fuck off? You don't own the water! You can 100% own a property, and build a pond - and you own the land underneath the water because it's not navigable per the actual definition. That lake COULD be owned by the HOA, and it might or might not be - but for the sake of argument - lets say it IS a navigable waterway ... you have to put a boat in from a location where there is public access, and if you can float your boat to where you are - you're fine. Fish from your boat against that guys dock - 100% legal. You cannot fish from land and cry about "navigable waterways" because that's not how any of that works. If a navigable waterway intrudes or crosses through private property, you can be ON THE WATER below the high tide mark, and you're fine! But if you have to drag your boat through shallows where you can't float (I'm talking kayak here) - and that part you're now in is enclosed in private property - it's NO LONGER navigable, and you're trespassing.
I looked up that lake, and the properties on the GIS map on the tax assessors site, and that most certainly IS his dock. That one guy standing on the dock trespassed on at least 2 other properties on his way TO that dock. There IS a public access point to that lake where they came from, but the park doesn't extend through those peoples back yard. There are SOME places, where 10 feet from the bank is public property - but that's not the case here.
He is not "squatting" so he can claim "adverse ownership" with that dock. Matter of fact - you can probably look up the permit for that dock - and if he has no permit, go ahead and report him to the county, they'll come inspect, look at permits issued, and if it's not in order, they can make him take that dock down - but that still doesn't mean you can walk through his yard to fish that lake...

I've had one issue in over 50 years of fishing with people telling me I couldn't fish a spot I was 100% legal to fish. Most of these videos are young kids breaking rules and hoping to get likes/subs by posting videos on YT.

That sucks for bank fisherman, but Jon Boats and Fishing kayaks are cheap and are much better for fishing anyway. Bank fishing sucks. All the good spots are overfished, and at best a 50-50 shot even when fishing is good, because fish move around with slight condition changes throughout the day, and become wise to bait and similar presentations even during spawn when it is reaction strike.
I was fishing on a Lake that was next to a golf course & was threatened with my life by an old fart with his nine iron while his son & wife stood by watching. Then he said that he was calling the police, I said "Great, I'll get a ticket for trespassing & You'll get handcuffed for threatening to murder me with your golf club...BRING IT ON!!" I left directly & have not returned. That was 15 years ago.
I just retired and I can say I would NEVER stop kids from fishing! what the hell is wrong with people! They should have been thrown in the LAKE!

I was a bylaw officer/supervisor for our local municipality for 12 years and although we didn't deal with fishing or property-related issues - I ran into people like these everyday in other matters. People who just make things up and say anything they want out of sheer ignorance and stupidity. Seniors were most often the worst. And when they're retired...they have all day to stand and argue pointlessly. I commend both these youngsters for staying calm, cool and collected and attempting to logically deal with the confrontation. Fishing's a great pastime (I used to ice fish in my younger days)...fresh air, sunshine...relaxing and fun. Great way to stay outta trouble. Unfortunately you run into a few Karens and other naive idiots who just can't help but demonstrate their ignorance.

There's times when Realtors and title companies do not tell buyers unknowing themselves or out and out hide the fact. HOA's can range in any combination of affordable and lenient, to expensive and assholes. HOA's are formed by the developer and usually turned over to the home owners after a certain percentage of the properties are sold, all rules dictated by State regulations. When buying any property in or outside of a HOA, do your homework, interview neighbors, review property history, at the title company and planning and permits departments. Don't buy in and be a jerk, because you didn't check it out, or say that you didn't know if was a HOA.
We have an HOA but don't pay anything for it. I live right outside of a major military installation. Nobody really gives a shit. People are constantly moving from one post to another or getting out. I don't think anyone is on it. The police run a neighborhood watch through here every now and then. Especially in the summer when the teenage vandals have nothing better to do and go around fucking shit up.

I have property on the water, a canal that leads to the ocean. I have always let kids fish on my property! In fact whenever I run into teens looking for a place to fish i direct them to my property which is right next to a state park closed to them unless they pay a large fee. This is very petty of this man , he wants to feel he is better than others. And to control these kids while they are on public property at that!!!! Maybe they will give up fishing and will have nothing better to do but to burglarize the mans house.
Your last sentence hit it right on the head. How many people do these homeowners see walking that thin strip of land behind their house? What's the crime rate in that area? How many B&E's have been committed in that neighborhood? How do these homeowners know you're not casing the joint? Try and see it from the homeowners point of view.

Know your rights. As licensed fishermen, I would've informed both these individuals that it is illegal in all 50 states to harass licensed fishermen and hunters. If that truly is a county/public lake, then you're the one who is actually paying extra to upkeep it -- not those two people's HOA. The only thing they're doing is paying county taxes, just like you (or your parents) are. Your fishing license is extra money to help maintain properties like that.
In the meantime, unless that lake/pond offers the best fishing in the state, I just simply wouldn't go there. Seriously, who needs the grief/confrontation (right or wrong)? I go fishing for fun/recreation, not to get it heated debates with cranky, uninformed locals.

I go to the public lakes on a kayak(which makes all the difference) & avoid these kind of situations. I didn't always but with age comes wisdom. Meaning, I've made some monster mistakes & try very hard not to repeat them.
Should also contact DFG so they can issue citations for harassing while fishing. They may learn when the $$$$ dries up and they have nothing.

I used to fish for saltwater alongside a bridge, and the guy in one of the condos along the side of the road kept threatening to call the cops on my buddies and I. When he finally DID show up, we asked the cop how many feet we were from the center of the roadway. By State law, we were on state land. We weren't being disruptive, or damaging anything, so the cops backed us up.

Here's the thing about lake community's, if the lake is built in a flood zone or the lake has a water source that runs in and out of it, it will need a levee. What looks like to me is exactly what you guys where standing on. A levee needs to be maintained and cost to do so. So if the community doesnt want to pay for it then it has to come out of taxpayers money. If taxpayers are paying for it then a portion of that lake has to have public access.
Rule one: Do not allow them one iota of control! When they say " come over here " don't! Follow me I want... No! Put them on the defensive. Who are you. Do you have id. And never stop fishing! Asking for a badge and where they live is always good too. Call the cops first too especially if they hinder your progress or make any aggressive move or threat.
The friend in the red shirt was clearly on a private dock that had stairs going directly to those peoples house lol. Most of the time I’m on the side of the fisherman but have some common sense dude. I don’t think they would have giving you any trouble if he wasn’t on their dock.

It funny I was just fishing yesterday I had a farmer come up to me and a friend tell us your fishing on private property. I looked at him and said to him politely show we're on the geogle map does your farm run to. Then he goes on telling me fish and game gonna find me for fishing on his property I told him go head we got are fishing license. There were other people there telling him you don't own the leveee. I told him i worked for the county for 5 years and you cannot put up private property sign on county owned or access road that illegal.

If it blocks your access to the lake, I believe you have the right to cross it since it's on public property. They may even be required to remove the dock since it block assess. Talk to the DNR about it.

The only lakes that are illegal to fish on are legally owned bodies of water by either someone who dug it on their property or if it was man made by a company, such as Arrowhead Lake in north GA. Bringing up allatoona was a real test for their knowledge btw, allatoona is owned and ran by the Army Corp., a national organization, all county/city owned lakes (and national) are public unless marked by licensed officials. Y’all had every right to fish off of the land in that location.

First off your buddy was behind houses on a dock and not on the property you were talking about being county property. That means at least he was trespassing and likely you were when you rushed to his defense. Secondly if there is a HOA that covers access to the lake and stocks the fish then it is indeed private property regardless of who owns the lot. I'm sure you are correct that the county does own at least part of the land however they still would have to follow HOA rules regarding the lake. Honestly if you do not own it, or it is labeled specifically public access don't go there because while you think you may have a right to be there you may actually have no legal right to be there or at least fish there at all.
A HOA has no authority over a public lake. If the county owns the lake then people have a right to be on it. It doesn't have to be labeled public access.

It depends on the local and state laws regarding riparian rights, if it's a man made lake or waterway or naturally occurring. The shore line is probably an easement up to a certain number of feet but may not include docks or other fixtures depending upon where it is and local laws.

Without doing more research it is tough to say who is actually right here from a legal standpoint. I will say this, just because the county (or some other local government) owns a property this does not automatically mean the general public has a right to use it for recreational purposes. The older couple might be correct, especially if there is a formal agreement with the HOA.
If fishing is not permitted by the local government, then the local government should be the ones to put up NO FISHING, or NO TRESPASSING signs, not the HOA members.

Its a Liability for the HOA if non residents fish a HOA owned/ maintained Lake. The property owners probably signed legal papers not making the HOA responsible should anything happen with the lake when purchasing their property. Just go to a normal lake and fish with no worries.
