      i know alot of people that age that look good . todays 63 is like 53 because of modern medicine , modern comforts , and all we know about nutrition and supplements .

    I'm a building manager we have 300 units we gave residents 1 week to come to the office and get the new stickers because life happens and you can't expect your residents to drop everything because you an the board decided to implement new stickers you have to give them some kind of grace period aslo the building manager does control when the tow company comes if they say otherwise they are lying

      What are you talking about they gave notice. And he had no real reason to miss it he had the stupid sticker in hand and still didn’t do it. They could’ve carried him in a carriage to his car with the sticker and he would’ve decided to go inside and do something else anyway.
      Tow companies have spotters too. Management only controls when they themselves get complaints or see someone parking and call the company themselves. They don’t control spotters

      I agree 3 days, especially for older people, is not enough notice. I also think the guy got away with showing fake evidence to support his claim that he was given ample time.
      America is so weird! If he had a previous sticker on then why doesn't the tow company see that and still see he is obviously a resident that hasn't had time yet to go get it.

The very day they had that meeting they should have personally walk around to the apartments and given the residents their stickers, giving each person at minimum 24 hrs to proceed to put the sticker on the car. I can't help but be annoyed that these people are running a senior building doing this

    WHAT? The defendant says that the plaintiff's car was the only one towed, and they knew that he had only just picked up his sticker, so when the manager called the tow company he knew it was the plaintiff's car that was going to be towed. Seems a little underhanded to me, there should be a much longer period between notification and action, because they only gave him a few hours notice, which is simply unfair...

      Many tow companies spot themselves. He had plenty of time 🙄this isnt having a deadline to build a working shuttle craft for space in 5 minutes. It’s walking over and slapping a sticker on your car.

      @@elvickRULES his car may have been further away then we may think . maybe its a really large parking lot and the elderly man was not feeling well until a few hours after his medication kicked in . tenants should always get at least 24 hours notice before any changes occur in a building , especially if they are elderly tenants . he repeatedly told the judge they informed him that the tow truck would not be there until the evening hours which is reasonable to assume starts at 6 pm . he was misinformed by the building as to the towing time so he should have won .

It was unprofessional of them and I'm sure an inconvenience for the tenant, however they gave it to him several hours before the tow and he just chose not to put it on 🙄 he screwed up and that's on him. He definitely deserved to lose.

    I'm kind or for the plaintiff, he was told towing would go into effect in the evening, not afternoon. 2:30 is considered the afternoon. However, once he picked up the sticker around 9 that morning he should've put it in the car then.

      I can relate to his line of thinking. We don't know how far out his car was parked. If he had planned on going out before evening, he thought he had time. We don't always do everything straightaway, post haste, and immediately.

    I agree with JM on the verdict, but the Senior Home management was probably clumsy on conveying this, and it was petty to tow the car on the same day he got the sticker. After the residents' meeting, they should have supplemented it by given a written notice about when a new sticker would come into affect and warning residents that the car would be towed on that day if they don't get the sticker put on. Because obviously not every resident attends meetings.
    The key here is that he was given the new sticker and warned that the car would be towed later that day. It's short notice, but legally the defendant has no blame here.
    I live in a condo rental and any time the building needs to do maintenance or require that our cars are moved out of the garage, I get the email notice from my property manager, a written notice that is slipped under my door, and also the notice is clearly posted in the building lobby and in the parking garage. Therefore there's no room for error.

    If I heard the word "towed", I would've run to the car once I got the ticket. Take his meds before? Was he dying? He was lazy and tried to get compensated for it.

    I live in a senior complex. We get a monthly newsletter to our door that says don't park here and there. IF someone IS parked there, the office calls them and tells them to move it or they are going to tow it. To me, that means, get your rear out there and move it cuz next time management looks, if it's still there, they will call the tow truck not you again.

    An affidavit should not be admissable. Because people lie out their mouth as well as on paper. Lastly, this judge thinks people should do what she would have done. Always says this doesnt make sense. Well everyone thinks different.

    They should have sent a written notice to all units, many people do not go to meetings or allow grace period for tows. Bummer, $172 for tow, ouch!

    I think a building should give at least 24 hours, up to 48 -- but 5 hours, not adequate notice. He's probably paying over $10,000 a year to live there - just, give 24 hours notice, bare minimum. 24 hours.

    lol people siding with the lazy plaintiff. There was notice posted. Could they have sent a letter? Sure. But he wouldn’t have done anything with it either since he had the sticker and didn’t do anything with it. 🙄 Some people just don’t help themselves. They just float through life as things happen to them. He could’ve prevented this doing what 99.9% of people would’ve done after being given the sticker. Go put it on the car.

    I don’t feel bad for last min people. I agree they didn’t come in the “evening” but a complex has no control when contracted jobs will be done. There’s always a general sense and people should be prepared in advanced. Don’t use the old card as an excuse either esp when the plaintiff is intelligent and coherent

      if they had no control over what time the tow guy got there then they should have given 24 hours notice to all the tenants and not 5 hours notice to elderly people . this verdict was nonsense . the building failed to give reasonable notice which is usually at least 24 hours and this judge should know that .

    Honestly if it was THAT urgent that they put the stickers on & THAT important that it gets done by a certain date & time, the apt complex should have spent $5-$10 on copy paper, printed the new notice (they could have EASILY made 2 if not 4 notice’s on one sheet of paper 4 = 1/4 section of paper), printed a statement “effective 9/15 we are switching tow company’s & you will need to update your sticker. Please stop by the office by 9/14 to avoid any problems with parking. Office hours are 8a-5p. Thanks Management”. Then went and tape or staple to each door. It’s quick & easy & everyone is notified.

    The tow paperwork said the 15th and he got the sticker on the 16th. I am wondering if it had been towed already before he got sticker? If he would have went out right away we would have known.

    They had a contract with the tow company. The company put it on there schedule and would get to it when they got to the parking lot at whatever time. The elderly apartments didn't call the tow truck on him so it is what it is.

    at the end harvey says if u violate policy then u get towed , but i say that proper reasonable notice was not given , which a notice of at least 24 hours would have been reasonable . these are elderly tenants that dont move super fast and u cannot give them 4 hours notice to get a new sticker race to their car before the tow guy gets there . its very unprofessional on the part of the building .

    The owner should've mailed a letter to each apartment with a date & a timeline that the policy would go into affect. The calls were a great idea as follow up. However, a timeline to have stickers applied to automobiles is necessary. That way it's clear without any doubt.

      This case was in 2017. As of this moment in 2023 Judge Milian is only 61. She would have been 55 in 2017 and the defendant was 63 so she was actually 8 years younger at the time.

    I feel bad for the plaintiff. I would have put it on right then (and snapped a pic) if they were saying it would take effect later that day. At the same time as saying that : WHAT kind of management company changes the passes and enforce it on the same day . THey should really give a whole month for that kind of thing. If I was running the management company I would even go so far as to post a red reminder flyer on their car saying it would have been towed etc etc. to give people enough warning. (I am somewhat suspicious about the defendants answer to the question of "anyone else get towed" and the answer of "not to my knowledge" um. thats not a NO. I wouldn't be surprised if he is getting a kickback from the towing company.

    umm...usually tow truck companies stop at 5PM, unless they have a contract with the city or police. Evening suddenly turned into night by the plaintiff. They gave him a week...apparently he doesn't read notices in the lobby or elevator.

    Some people have to do things at the same time every day. (OCD) This chap seems like he may be one of them and it is really important to him that he performs his routine at the same time and in the same order every day. No reason at all that he couldn't have gone down and put that sticker on after he had completed what he needed to do though, he had plenty of time before his car was towed.

      I think the "rudeness" is literally part of price for free hotel, airfare, and show paying the debt owed. I wouldn't be surprised if producers prep them about it bc for this and the other court shows over the past 25 years both sides complain "the judge didn't give me a chance to explain everything".
