  • The letter of the law and the spirit of the law can often be two different things. And perhaps there is no better example of that than this 1998 NFL week 11 game between the Jacksonville Jaguars and Tampa Bay Buccaneers, where a fan was arrested outside of Alltel Stadium for selling his ticket for three cents above what Jacksonville law allowed. This is the story behind the game between the 1998 Jaguars and 1998 Buccaneers, and what has to be the dumbest ticketing controversy in Jags history

      It clearly was. No reason you'd set the ticket price at $XX.72 if you weren't trying to take advantage of the law.

    To be fair 3 cents in 1998. Is like 15 cents today. At least in the gasoline economy.

    Poorly considered and/or badly worded laws are a huge problem. A culture in which government agents can entrap innocent people and then decide whether to punish them is deeply toxic. The concept of "the spirit of the law" is more often used to justify things that legislators could not legitimately codify.

    Even though there were a lot of fans here in Tampa for these clubs' 1st meeting in '95, it didn't sell out in time for WFLA-TV to air it for its Tampa Bay audience.

    As a capitalist, I never understood scalping laws. If it's a hot ticket, I am WILLING to pay whatever I can to get it. I'm guessing it's just the government wanting their cut of your profit. That's why it's all legal now with sites like EBAY, where everything goes to the highest bidder so your profits can be tracked

      It's not about the money. Before StubHub and the like was a face to face transaction outside the stadium. Security doesn't want people not attending the event at the stadium. It's an anti loitering law. There's no government conspiracy. It's just security getting rid of a hassle.

    The ticket scalper came all the way up from Largo to Jacksonville to attempt sell a ticket for 28 cents more? That makes this story even more dumb because Largo is (without traffic, of course) a little over 4 hours away from Jacksonville. Crazy.

    Well THIS is NOT a SURPRISE CONSIDERING that the Jacksonville Jaguars and the Tampa Bay Buccaneers COMBINED are WORSE than a 39.6 and AREN'T EVEN WORTH 3 cents. They would BOTH be WAY BETTER OFF just SPIKING the football into the ground on EVERY single OFFENSIVE play!!!!!!

    I've never understood why ticket scalping was illegal or even frowned upon in the first place.
    It you buy a ticket, you should have the right to go the game, sell it, set it on fire or whatever you want.

      It's not about the tickets, it's basically an anti loitering law. They don't want people without tickets just hanging around doing what people who hang out outside stadiums without tickets do.

    I respectfully disagree. The Jets were a good team too. Jacksonville went 4-3 the rest of the season and had to settle for the 3 seed. The Jets got the 2 seed and easily beat the Jags in the playoffs. I do acknowledge the Jags had a great stretch from 1996 to 1999. Great act of philanthropy by the gentleman who was arrested

    And I thought I had a bad case with the law. I was once sued over a bill that had been paid but still got stuck with over $100 in court costs? I was injured on my job and want to the ER. Since this was in 92 my bill was $97. I give it to my boss who didn't pay it for almost a year. After getting a Court summons I called him and he told me he had paid. I called the court house and they confirmed it had been paid, so I did nothing more. Almost a year later I got another summons that I owed over $100. I called and they told me even though it was paid in full, I was responsible for court costs plus a year's worth of interest and late fees.
    Amazing how jacked up the law can get.

    I love how people are bashing and trashing Florida when 1.) This was strictly a Jacksonville thing and 2.) Florida right now is one of the VERY few places worldwide actually fighting against global tyranny (and getting bashed and trashed for that too).

    Oh my gosh...oh my gosh...I cannot believe what I just listened too. This is beyond the most unreal story you have ever reported on. Great job telling this story but this gores beyond all logic in every way. $34.72 to $35.00.....arrested for 3 pennies over Jacksonville law, just unreal. If only he had asked for $34.97. Definitely a "3 Penny Opera" :)

    This is so stupid! How can ticket scalping be illegal? If two consenting parties, adults of course, decide to mutually engage in a transaction that they both agree is worth it for both sides despite what the original face value of the ticket is, how is that illegal or an arrestable offense?
    If the person selling the tickets is legally in possession of those tickets and decides that he would now prefer to resell his tickets because the game is sold out and scarcity and “demand” for these tickets has caused the secondary market value to skyrocket, why can’t he resell his tickets for any price that he chooses as long as he and the potential buyer are in mutual agreement? The team already made their money for selling the tickets at the face value they wanted. Who are the cops or the team or anyone to say that someone can’t resell anything they’ve ever purchased as long as it’s a transaction between two concerting adults and if they both agree on price for item, it’s no one else’s business to get in the middle of that. Such bullshit!!! So much for freedom in America. That’s just flat out tyranny!!! Oh well, at least the kids got some tickets for another game sometime in the future.

      First of all, if you're that outraged over ticket scalping I'm not sure I want to see your rant about masks and vaccine passports and cancel culture 😲 Secondly, given that everybody knows scalping is illegal, anybody who actually does it right out in the open in front of the stadium on game day kinda deserves to be arrested. It's like people don't realize this sort of thing can be done behind closed doors, in a more private location.

      @@D0ugh.B0y For a long time it was a free trade argument by the stadium owners and team owners. Teams have to lock in ticket prices for the whole year. Scalpers can set the prices game by game depending on supply and demand. The teams argument was, well, if scalpers can do that why can't we? By forcing teams to lock in prices for the season the NFL is restricting trade and creating an unfair market. The old timey workaround was to sell a jersey or whatever and offer the tickets as a "free gift".

      @@ahoneyman thank you for a well expressed educated answer unlike from others. That makes a lot of sense. I thought the same thing about teams not adjusting the prices per game after I wrote this but I assumed that possibly it was because most tickets would’ve been a part of a “season ticket” package and you don’t always know which games will be great match ups. Well, some you would up front but it changes as the season goes on which I figure a flat price up front guarantees the teams a certain amount of revenue and on the back end just let the scalpers make money. As it is, a lot of those scalppers like anyone else who lives in the area, has money stolen from them by way of taxes for stadium subsidies. So you might as well let them make some of their money back to since a lot of them don’t even go to games. But yeah, thanks for the well thought out answer. I appreciate it.
