    A few notes, as a security guard myself
    I'm surprised he was armed, and question if he is supposed to. While armed security exists, obviously it's more expensive and I'd be surprised they pay the extra for armed security of an abandoned park. He was also way more aggressive than needed, which might be a red flag along with being armed. I'm sure these guys would leave if asked politely, as most people do. No need to flash a gun at them. And while the threat of calling the police is valid, he unlikely did. Not worth wasting the polices time, and your own, by calling them. I only call the police when absolutely necessary. Always hate to see an aggressive security guard who takes his job too seriously. Makes the rest of us look bad.

    For future reference, a security guard has absolutely no authority to search you or your belongings. You have no responsibility to open your backpacks for him. The only way he could legally search you, is if he had called the police and they were there. Even then, the police would need probable cause, or a warrant, to search you and your belongings. F that rent-a-cop. Keep up the awesome vids guys.

    • @scottcol23
      @scottcol23 2 года назад +61

      well you are right about most of that EXCEPT that the police could have searched them. They were clearly trespassing in a marked keep out/private property area. The police would have had to detain them, and part of that is searching you for weapons. Thus the probable cause for search. BUT Paul Blart there was in the wrong for sure. He is not a cop. probably wants to be one. BUT with that little display he will likely never get that chance. LOL Also the police would have been on the guards side. They would have fist bumped him and said good work.

    • @knurlgnar24
      @knurlgnar24 2 года назад +31

      The police would have absolutely searched them for burglary tools and weapons as a matter of duty to the law. That said the security guard had no ability to do anything other than talk to them unless they overtly threatened property or persons. They handled the situation properly: Just walk away.

    • @porkrind
      @porkrind 2 года назад +95

      Legally speaking, the guard was in the wrong. That said, if a dude is pointing a gun at you and making demands, its generally better to have your rights slightly trampled than to be dead. In this case, sending the video to the property management company with date and time will resolve the matter. They don't want the liability of a rogue guard murdering some random teens.

If we caught someone going in. they were photographed and told they would get arrested if they came back. That was it. There is motion detection in a few areas that have assets that are either dangerous or have some sort of value. There are/were trail cams on some of the poles too that can give off notifications of activity. Its neat seeing how nature has started to reclaim the property. It has that "end of the world" apocalypse vibe. very creepy at night. Spent many nights out there and would hear tapping and what sounded like laughter or grunts. probably just homeless people reproducing, but still creepy.

    I’m a huge roller coaster enthusiast, your original video on this park got me hooked on the channel. I never visited, but it sounds like it was a great park. So fun fact, that green coaster “The Jester” had been relocated from another Six Flags owned property, Fiesta Texas, a few years prior to Katrina. The pink paint peeking through the green is the paint from the other park. To this day one coaster from this park still operates. It was known as Batman: The Ride here. Now it operates under the name Goliath and is located at Fiesta Texas. Happy to say it runs very well. It was relocated after Katrina, the only reason they could save it is that the majority of the ride is pretty elevated from the ground. The National Roller Coaster Museum has some original signs from this park and had the neon restored, it was really cool to see! They also have a park map they didn’t restore, aside from the backlight. Sad seeing the water damage, even sadder seeing all the vandalism this park has dealt with. Thank you for exploring it again, I’ve wondered if it looks any worse. I hope they rebuild the park, it really looks like it was a fun place to visit.

      Louisiana §20. RS 14:20 Justifiable homicide - A. A homicide is justifiable:
      (4)(a) When committed by a person lawfully inside a dwelling, a place of business, or a motor vehicle as defined in R.S. 32:1(40) against a person who is attempting to make an unlawful entry into the dwelling, place of business, or motor vehicle, or who has made an unlawful entry into the dwelling, place of business, or motor vehicle, and the person committing the homicide reasonably believes that the use of deadly force is necessary to prevent the entry or to compel the intruder to leave the dwelling, place of business, or motor vehicle.
      In New Orleans, armed security officers must submit to an additional background conducted by the NOPD and receive a Special Officers Commission from the department’s Special Officers Division. What may not be well known, is that this commission gives the security officer Deputized Arrest Powers while they are on duty and at their place of assignment or patrol beat. It gives them powers to detain and arrest anyone they witness committing a felony or misdemeanor crime, as well as anyone that a credible witness points out to them that has committed a felony or misdemeanor crime. The security officer may detain, handcuff, and conduct a pat down of the individual for weapons. The only limitation is that the security officer cannot conduct a “search incident to arrest” of the individual’s pockets or belongings. The security officer is then required to contact the NOPD, who takes over the investigation at that point and can request that the security officer assist in any way.

      "...and the person committing the homicide reasonably believes that the use of deadly force is necessary to prevent the entry or to compel the intruder to leave the dwelling, place of business, etc..." - This means in the event that this man happens to fire his weapon after drawing it, without speaking a single word beforehand in order to compel the two to leave, it would be hard to justify that as a means of defense. He may be able to claim he thought whatever equipment they had were weapons, but that's a different matter, as it doesn't have anything to do with what you stated

      TTILE: Peace Offices
      Special Officers-A class of individuals who, because of their job duties, must carry a weapon and/or have powers of arrests or detention (i.e. security guards). They are empowered by the Superintendent of Police as “special officer permits” which denote the authority, rights and limitations on the credentials.
      2006 Louisiana Laws - RS 40:1379.1 - Special officers; powers and duties; concealed handgun permit
      §1379.1. Special officers; powers and duties; concealed handgun permit
      A. The superintendent of state police shall be authorized to issue at his discretion a special officer's commission from the division of state police. Any person who receives a special officer's commission must display need for statewide police power and power to arrest, be bonded, and adhere to all restrictive stipulations as set forth in the special officer's commission.
      B. The special officer, when performing those tasks requiring a special officer's commission, shall have the same powers and duties as a peace officer; provided, however, that when not performing these tasks directly related to the special officer's commission, he shall be regarded as a private citizen and his commission shall not be in effect.
      TITLE: SEARCH AND SEIZURE
      Investigatory Stop-The temporary involuntary detention and questioning of a person and/or vehicle and its occupants to investigate potential criminal conduct. To conduct an investigatory stop, the officer must have reasonable suspicion that the individual or vehicle occupant has engaged, is engaging, or is about to engage in criminal conduct.
      Pat-down/frisk-An external examination of the outer garments of an individual for the purpose of ensuring the individual does not possess any weapons. A pat down may only be performed when it is based on an officer’s reasonable suspicion that the person is armed and dangerous and must be limited to what is necessary to detect weapons
      Plain-feel doctrine (aka plain-touch doctrine)-An officer may seize an object while conducting a legal pat-down if its nature as contraband is immediately apparent during a touching permitted by a stop and frisk.
