The producers confirmed this flashback is told from Alison's point of view...pretty amusing to see how ali had a completely weird view of toby from reality
I couldn't take this seriously because of his attitute.. he was very different back in season 1.. this is so Season 3 Toby..

The main thing to know is: Toby's wearing a do-rag. OK? He’s in prison, wearing a do-rag and not wearing a shirt and also he's wearing a do-rag. When you watch a show, you’ll wonder who the writers are aiming at with certain things. Toby marching around shirtless all the time is for young straight girls in the audience. Who, pray tell, is meant to benefit from Toby Cavanaugh in a do-rag? The answer is: humanity. This one's for the people. Folks are folks and each and everyone of us deserves this
