- Zachary Kwak pleaded guilty to one count of first-degree assault, one count of second-degree assault and an added count of criminal attempt to commit assault in the rocky-throwing case that led to Alexa Bartell's death. FOX31's Vicente Arenas listened to the victim's family outside of court.

No. If they get out after 20 years, they'll hit the streets institutionalized, and will quickly commit another crime to be returned to prison because they will not be able to exist in the real world. The recidivism rate is so high because prison is the only place those people can have food to eat, a clean place to live that isn't roach infested, get medical care and dental care, and only have to perform some menial labor any 7th grader could perform. Going in young means they will quickly become homosexuals either pitching or catching depending on how big and strong they are.

These men went to a parking lot and picked out landscaping rocks they felt where just right to do damage or to kill some one. These rocks where not just in there vehicle or laying on the ground. They took them to the place the threw them. This was premeditated murder.

I know, there's so many factors. Destruction of normal family life from so many areas.
The food they were raised on likely didn't help. I was raised in mostly home grown farm raised food in the 50s. It's possible in these times that generations can grow up without every seeing a vegetable they picked from their own garden.
I truly feel sorry for people who missed out on many things I was blessed with being raised by my no nonsense grandma on the farm.
But in the end people are responsible for their choices. I just can't fathom how throwing rocks through people's windshields can begin to be a thing any human could think about more than half a second before getting repulsed. Then to carry it out, demonic.

The sad thing is no matter how much time they get. What sort of immature nutjobs throw rocks at cars?! This happens often too. In 2017 a young man in Michigan was killed by a rock thrown from an overpass by four teenagers. Terrible brats.
Judging by the act, you can immediately tell they were teenagers.
They should never have offered him a plea. He got away with murder, not because of a slick lawyer or legal loopholes, but because of lazy dumbass prosecutors. And people see these cases and get ideas. “They say that crazy guy will serve no less than 20 years, but I bet he only does around ten years or less. So if I do something similar AND EVEN IF they catch me, it’s still worth it.”
agree with your point, but he still doing 20 years min, which is likely the low end of a manslaughter or 2nd degree murder conviction. like you said, a lot of people get 10 yrs for a homicide conviction.
@@IGNANT4LIFE20 years is almost unheard-of for manslaughter and rare even for 2nd-degree murder. This Kwak guy intentionally murdered a total stranger for laughs. He is a danger to society and the idea for a long prison sentence is to protect us from him more than to punish him.

This happened to a family from Ohio several years ago! A school teacher traveling with her family when three guys threw rocks from an overpass on the highway and struck her in the skull!! It left a beautiful wife mom and friend terribly handicapped mentally and physically!! Very sad incident!! I think her husband eventually took his own life as he knew he had lost the love of his life!! Don’t judge, put yourself in his place!! This family didn’t ask or deserve any of this!!😓🙏

Plea deals often make sense even if they don't yield maximum sentence. "Bird in the hand." Guaranteed 20 year minimum in this case, nothing to sneeze at. Anything can happen in a trial, can have mistrials or outright acquittals. Can also use plea deals to extract testimony against the higher priority perps. Finally, victims' families often want to avoid trials, they are long and very stressful, bring up lots of bad memories.
I believe they could of pleaded to 30 years. 20 in this case is too few.

Kwak was there when the rock was tossed. He knows exactly who threw the rock. He will be the prosecutions' star witness against the other two. Kind of surprised he agreed to 20 years when he could have bargained for less time knowing the true villain. From what I heard about the deal, he did not acquiesce to throwing the rock.
And sorry, the prosecution cannot PROVE the intent to kill or any of the other rock throwing events. It's not what you know or believe, it's what can be proved. It cannot be proven that the group intended to kill. That's the way the law works.
