I'm sorry, this is too sketchy! It is too unsafe to go back and "try" and get that van! One, it's most likely stripped! Two, someone may hide something inside, when you two try to bring in back over the boarder, then you'll end up in jail in Mexico, three, it's going to cost you more than it's worth! Sorry to hear about your confusion and uncertainty. Unfortunately, both the Embassy is correct and your lawyer is correct. The situation of getting you car confiscated due to not having a TIP is confiscation of the vehicle with little to no recourse. Like I said earlier, you did the right thing in getting an Attorney. The Embassy was correct in saying that %90 don’t get their vehicle back because they don’t get a lawyer and the vehicle is forfeited or the fine is so high the individual can’t pay it. So even though that call was ambiguous, he was correct. Your lawyer is also correct that he can get it back for you by paying fines and expenses if it is clean so to speak. The issue is going to be the amount of the fine and legal fees. Once again, if you need someone to give you some clarity, I am always available to help, just reach out. I hate that you’re going through this, but breaking the law in Mexico is a big deal and once you get caught, it can be difficult or impossible to resolve. The van was used illegally because you didn’t have a TIP, which will make it much harder to get back. For everyone else, don’t enter Mexico without a TIP (unless you will 100% be in the free zone) a clear title (no liens) and Mexican car insurance. US insurance is useless here. Keep the faith that they will cut you a break, but understand they don’t have to.

Mexico is as corrupt as the day is long. They stole your vehicle and are using their corrupt “laws” to do it. Stay clear of Mexico unless you’re flying in to go to a resort.
From what I read about the embassy there, they only handle cases of stolen vehicles if the vehicle was stolen in the states and taken to Mexico. It sounds like the embassy guy has probably heard about these types of situations but doesn’t get involved and doesn’t want to get involved.
I have been thinking about how could you possibly have gone all the way to Cancun without a temporary import permit on your van, as around the border it isn't necessary for such permit, but as soon as you drive a few miles towards south you would find a custom post where they would tell you you cannot go south without the permit. After thinking about it, I believe I know the cause. You drove on the coastal road, famously known for being dangerous, cartel territory, and that is why there was no customs inspection post at that road. Mexican customs must have decided it was too dangerous to keep guards/inspectors there. That made it possible for you to drive all the way to Cancun, and you were lucky that nothing bad happened. When you decided to take the inland road there were posts set up to check all cars, and...
Now it all makes sense. So basically they took a route they should not have, possibly to avoid tolls or fees, and ended up getting their van confiscated for breaking the law by not getting a TIP (Temporary Import Permit) before entering the country. Got it!

It definitely sounds like you're in the middle of a shakedown. If I recall correctly, I believe RUclipsrs @FnAVanLife found themselves in a similar situation during their trip traveling through South America sometime during the pandemic, and they were just told to turn around, go get the proper permit, and come back. You have full coverage in the States. Did you purchase Insurance when you went into Mexico? Your van got confiscated because you didn’t pay the $50 to get a TIP? Crazy. The fact that 90% don’t get their vehicle back is criminal. They are thieves. Sorry you had to go through this. Sharing your story will help others who are thinking about going to Mexico.
You know that you need the permits to get into Mexico if you don't do that they will take your car away simple and rude that's The law, no, don't come with those little things, I'm going to Mexico, get your permit and leave you alone. I've been there many times in Mexico and that never happened to me because I got my permit.

Why would you be embarrased? Don't be. If you drove to the US with MX plates illegally where would you and your vehicle be? They are home and free to travel, you'd be in jail. The least of your worries would be your vehicle. Every country has laws. They have taken accountability for their lack of knowledge and are taking steps to get their van back. This city in MX did nothing wrong but follow their laws which are readily available not hidden, not enforced selectively. The feelings they have towards their experience is emotionally charged as it should be. Don't be embarrassed for your country for this specific situation
It may be time to notify the vehicle lien holder. I know you all may not want to because you are in violation of the contract terms by taking the vehicle outside the US. Plus your US auto insurance does not cover you outside the US and I believe you all stated in the comment that you don't have Mexican auto insurance. I also recommend you all contact a US attorney because Mexico may not be able to legally take a vehicle that the drivers do not own. If you had applied for a TIP (Temporary Import Permit) you would not have been allowed to bring the vehicle into the country because you don't own it, therefore you would not have had the title to register it. You all broke the law by bringing a vehicle into Mexico without a TIP, and you've had this vehicle in their country since December 2023 without a TIP. This may be the reason they confiscated your van and are refusing to return it. They are more than likely thinking you all think you can outsmart them because they know already you don't own the van. They are probably just waiting for the lien holder to take the necessary steps to have to van returned to the US and are showing you all that you can't outsmart them. But contact a US attorney and the lien holder. It's already bad but continuing to wait will probably only make things worse. The worst that can happen is you lose the van. You all can "work" to get another one. Best of luck!

I was in a similar situation in Nigeria with the US embassy. I too experienced difficulty getting in touch with anyone at the embassy. That was back in 2012. They really don’t know Tenaj and Tino. They don’t nor do they want to get involved. Months later, I learned about other Americans in varies countries who looked to the embassy for intervention/information/help to no avail. The Mexican licensed lawyer appears to be more knowledgeable with the laws of Aduna. I say go with the lawyer because there’s movement and knowledge there than with the embassy telling you what typically happens without rationale. Why didn’t it work for others in your situation? Did they work with a lawyer? Ya know?
@@TenajTino why are you waiting so long to notify the lien holder and insurance company? Since the van is technically the lien holder’s and not yours, they might have…well, they WOULD have more pull to get the vehicle back since it’s technically their property. They would want the van or the money still owed on it. Yes, you did the wrong thing by not having a TIP to enter Mexico with the van, however the rightful owner may have better success. I’m sure the longer you wait, the higher the storage cost is racking up on the van. All the best!

Also, I think people are wanting you to give up hope on getting the van out of pure intentions but also out of being triggered by previous traumas where they experienced being let down from being hopeful. The lawyer said as long as you didn’t break the law with the vehicle… but you did break the law because you didn’t get a Temporary Importation Permit to allow you to drive through Mexico & that’s illegal… so does that count towards the van being used for something illegal?

@@TenajTino Please withdraw and cease the broadcasting of all calls, even on the membership page, unless you have written permission. I work in a legal capacity for embassies and government orgs (I am a surveillance contractor part time for government orgs so knowing the law is part of my role); if it is discovered that you're broadcasting calls from officials, even unnamed ones or even in part, this gets you in an even bigger mess. Very unwise and not the way to resolve anything. It's only the way to attract fines and legal issues on top of the van problem.

The secret squirrel sh*t is because government agents, even ones doing regular tedious jobs, often become targets when they give bad news. Many end up stalked and hurt or threatened. Sad but true. Even in the UK, many officials in certain advisory roles have to hold back their full identities. Even the emergency service call handlers here do not give full names because they are dealing with people who are at their most volatile when under stress. Things are different in each country and circumstance.
You reached out to the embassy and someone responded but would not provide their full name? They have very strict guidelines for accountability. They will always provide you with a full name and contact info. Also a case number. Again, very sketch.
Absolutely, and they should not be broadcasting his calls either! It's a good thing he withheld his data or that too might be all over the internet. Some unwise decisions are being made in putting calls out for all to hear.
The point is they’re doing the things that need to be done to retrieve it. It’s not right if Mexico keeps moving the bar to make it impossible to do so. We’ve all made mistakes. Have you ever gotten a ticket? How would you feel if they kept changing the requirements of what you needed to do to satisfy the ticket.
They haven't contacted the lien holder because they are in violation of the contract. You can only take a vehicle out of the country if you hold a clear title, and the only way they can get a clear title is by paying the vehicle off, which they probably can't afford to do considering they are asking for donations. Even if they don't get the van back, they will still owe the lien holder. Plus their US auto insurance does not cover them outside the US and I believe I read in another post that they did not get Mexican insurance. They should contact a US attorney because I don't know if Mexico can legally keep a car that is owned by someone else, which is probably a bank or credit union. It's all a mess. SMH

I was truly hoping that after your trip to Mexico, taking all the paperwork you would get some good news. The guy from the Embassy sounds very sketchy. Would you be able to contact the embassy here in the states to see if that is actually a number for the embassy in Mexico? The embassy sound a little shiesty so you should let your lawyer talk to them. And don't give them, the Mexican Embassy anymore info and or money unless your lawyer is on the phone with you.
Also whenever you talk to someone let them know you are recording their voice and comment for legal purposes. So that way you will always have their voice and whatever they said on recording just like they do us when we call places. But I definitely would not talk to nobody in Mexico without the presence of my lawyer. And never give up original paperwork never give up your original copies. But always be sure to get a copy of anything they said or wrote down or had you sign. SHAME!!!!
Your embassy guy is running interference. He is managing expectations of himself and the embassy. You have a fourth option which is to bid at the auction to purchase your van. Most likely you will win that bid.

@@RaphaelNationYep. Mexico also considers it an " abandoned vehicle " if it isn't recovered in 45 days from the confiscation. They will also add an abandonedment fee. I've seen people who had to pay more than their vehicle was worth to get it back. That fee is assessed from a percentage of the perceived value of the vehicle.

Listening to your story it sounds like your attorney is involved in swindling money from you guys as well. With no intentions of helping you. The deal breaker is hospitals 😮 I had to take my aunt and you can’t leave the sick you have to stay with them the whole time or pay a babysitting service . Maybe in a big city you can actually leave and let the nurses care for an injured person but very expensive if you can find one ? The hospital and doctor office never took blood pressure or temp ? I think that the guy from the embassy was telling you that there IS a loophole. That is why he didn't give you a last name and sounded vague. (Also because you might be hanging him out to dry here, to some degree. 😎) But that may mean that you have to STOP posting videos about this for a while and if you do get the van back never make a video about how you did that. Talk to as many people as possible who did get their van back but don't post anything about it. Don't give in too much to your feelings of confusion and powerlessness. No. It wasn't stolen. It was confiscated for not having a required permit. They should report it as confiscated to their insurance company and their lienholder. Nothing good can come from not being open, honest, and upfront. Having worked in insurance for 28 years, I can say this with certainty.
I would suggest you share NOTHING just quietly get your van back and once you leave the country then tell your story. speaking bad about any country other then your own takes you into a sticky political zone that doesn't fair well for immigrants. Any good lawyer will tell you stay silent until you leave the country, if you ain't talking about how wonderful a country is say nothing until you leave.
Who is advising you? Everything in Mexico is done with a lawyer. The information from police, to your lawyer and relayed to you. The penalty or process to get your temporary import documents. Again everything given to your Mexican lawyer, in Spanish,wo anyone standing by, standing over the discussion. Your lawyer will be able to get the information, regular logical sentences that are standard in the United States are the same in Mexico, exactly the same. Where will our vehicle be stored? What is the fee? We need a receipt. Will you contact us? Or our lawyer. What is the regular infraction fee ? From your videos is as if you didn't leave them with a local point of contact and you may have abandoned your vehicle or they may assume that. The consulate is certainly not where you would turn for not having documents, straight forward questions, like ooops what do we do to fix this?? Ooops my Spanish isn't good enough, my knowledge of the law is not good enough, who does my lawyer need to speak with, do they have a phone number? Do they keep office hours? What is the address our lawyer will contact them ASAP. You don't ( ever, never) ask a non Mexican to fix a problem in Mexico. You never ever ever get frustrated or upset at police or other officials for not speaking English, French, German, Dutch, Russian or Chinese.. business in Mexico is conducted in Spanish using Mexican slang and common phrases that are unique to Mexico. I have traveled these roads many times. And experienced problems, and all were resolved. All the cartel boogie man stuff is not productive, using toll roads during the day and speaking w Mexican authorities before you have any issues. There is no such thing as a free zone. The only free zone is Baja Norte and once you cross from Norte to Sur you need temp import docs w proof of payment. When you take the ferry it should be in your possession. I feel bad about your situation and you should immediately reach out to a lawyer who works near where your van is located. And you can call the delegate or state President and explain the situation and that you are Americans and need help, again all those calls will happen in Spanish by someone who knows the players involved. Example, in your videos never heard the name of the police precinct or police chiefs name.. there are laws in Mexico for illegal importing a vehicle and solutions. Mexico has 130 million people. The unemployment rate is 2.84% the economy is on fire.. consulate will not even know where to start about a van taken after an importation violation..

Hey, I would advise not to publicise calls at all. This in itself can get you in a whole lot of trouble unless the person with whom you are on the call has given permission in writing. I know you want to make interesting videos but broadcasting segments of phone calls against permission could lead to an even bigger mess. It doesn't matter where you put those calls; even in a membership group, it is not right to do it and you can find there are legal ramifications from this, even months later. Would any of us like our calls, which we believe to be between ourselves and the other party, to be broadcast on the internet? When recording officials' phone calls, you could be on the wrong side of the law in broadcasting or giving transcripts.

Sorry to hear about your confusion and uncertainty. Unfortunately, both the Embassy is correct and your lawyer is correct. The situation of getting you car confiscated due to not having a TIP is confiscation of the vehicle with little to no recourse. Like I said earlier, you did the right thing in getting an Attorney. The Embassy was correct in saying that %90 don’t get their vehicle back because they don’t get a lawyer and the vehicle is forfeited or the fine is so high the individual can’t pay it. So even though that call was ambiguous, he was correct. Your lawyer is also correct that he can get it back for you by paying fines and expenses if it is clean so to speak. The issue is going to be the amount of the fine and legal fees.

I hate that you’re going through this, but breaking the law in Mexico is a big deal and once you get caught, it can be difficult or impossible to resolve.
The van was used illegally because you didn’t have a TIP, which will make it much harder to get back. For everyone else, don’t enter Mexico without a TIP (unless you will 100% be in the free zone) a clear title (no liens) and Mexican car insurance. US insurance is useless here. Keep the faith that they will cut you a break, but understand they don’t have to.

From what I read about the embassy there, they only handle cases of stolen vehicles if the vehicle was stolen in the states and taken to Mexico. It sounds like the embassy guy has probably heard about these types of situations but doesn’t get involved and doesn’t want to get involved.

I have been thinking about how could you possibly have gone all the way to Cancun without a temporary import permit on your van, as around the border it isn't necessary for such permit, but as soon as you drive a few miles towards south you would find a custom post where they would tell you you cannot go south without the permit. After thinking about it, I believe I know the cause.
You drove on the coastal road, famously known for being dangerous, cartel territory, and that is why there was no customs inspection post at that road. Mexican customs must have decided it was too dangerous to keep guards/inspectors there. That made it possible for you to drive all the way to Cancun, and you were lucky that nothing bad happened.
When you decided to take the inland road there were posts set up to check all cars, and...
Now it all makes sense. So basically they took a route they should not have, possibly to avoid tolls or fees, and ended up getting their van confiscated for breaking the law by not getting a TIP (Temporary Import Permit) before entering the country. Got it!

If I recall correctly, I believe RUclipsrs @FnAVanLife found themselves in a similar situation during their trip traveling through South America sometime during the pandemic, and they were just told to turn around, go get the proper permit, and come back. Why would you be embarrased? Don't be. If you drove to the US with MX plates illegally where would you and your vehicle be? They are home and free to travel, you'd be in jail. The least of your worries would be your vehicle.
Every country has laws. They have taken accountability for their lack of knowledge and are taking steps to get their van back.
This city in MX did nothing wrong but follow their laws which are readily available not hidden, not enforced selectively.

It may be time to notify the vehicle lien holder. I know you all may not want to because you are in violation of the contract terms by taking the vehicle outside the US. Plus your US auto insurance does not cover you outside the US and I believe you all stated in the comment that you don't have Mexican auto insurance.
I also recommend you all contact a US attorney because Mexico may not be able to legally take a vehicle that the drivers do not own. If you had applied for a TIP (Temporary Import Permit) you would not have been allowed to bring the vehicle into the country because you don't own it, therefore you would not have had the title to register it.
You all broke the law by bringing a vehicle into Mexico without a TIP, and you've had this vehicle in their country since December 2023 without a TIP. This may be the reason they confiscated your van and are refusing to return it. They are more than likely thinking you all think you can outsmart them because they know already you don't own the van. They are probably just waiting for the lien holder to take the necessary steps to have to van returned to the US and are showing you all that you can't outsmart them. But contact a US attorney and the lien holder. It's already bad but continuing to wait will probably only make things worse. The worst that can happen is you lose the van. You all can "work" to get another one. Best of luck!

I was in a similar situation in Nigeria with the US embassy. I too experienced difficulty getting in touch with anyone at the embassy. That was back in 2012. They really don’t know Tenaj and Tino. They don’t nor do they want to get involved. Months later, I learned about other Americans in varies countries who looked to the embassy for intervention/information/help to no avail.
The Mexican licensed lawyer appears to be more knowledgeable with the laws of Aduna. I say go with the lawyer because there’s movement and knowledge there than with the embassy telling you what typically happens without rationale. Why didn’t it work for others in your situation? Did they work with a lawyer? Ya know?

Since the van is technically the lien holder’s and not yours, they might have…well, they WOULD have more pull to get the vehicle back since it’s technically their property. They would want the van or the money still owed on it. Yes, you did the wrong thing by not having a TIP to enter Mexico with the van, however the rightful owner may have better success. I’m sure the longer you wait, the higher the storage cost is racking up on the van. All the best!

The lawyer said as long as you didn’t break the law with the vehicle… but you did break the law because you didn’t get a Temporary Importation Permit to allow you to drive through Mexico & that’s illegal… so does that count towards the van being used for something illegal?

I work in a legal capacity for embassies and government orgs (I am a surveillance contractor part time for government orgs so knowing the law is part of my role); if it is discovered that you're broadcasting calls from officials, even unnamed ones or even in part, this gets you in an even bigger mess. Very unwise and not the way to resolve anything. It's only the way to attract fines and legal issues on top of the van problem.

The secret squirrel sh*t is because government agents, even ones doing regular tedious jobs, often become targets when they give bad news. Many end up stalked and hurt or threatened. Sad but true. Even in the UK, many officials in certain advisory roles have to hold back their full identities. Even the emergency service call handlers here do not give full names because they are dealing with people who are at their most volatile when under stress.

They haven't contacted the lien holder because they are in violation of the contract. You can only take a vehicle out of the country if you hold a clear title, and the only way they can get a clear title is by paying the vehicle off, which they probably can't afford to do considering they are asking for donations. Even if they don't get the van back, they will still owe the lien holder. Plus their US auto insurance does not cover them outside the US and I believe I read in another post that they did not get Mexican insurance. They should contact a US attorney because I don't know if Mexico can legally keep a car that is owned by someone else, which is probably a bank or credit union. It's all a mess. SMH

The embassy sound a little shiesty so you should let your lawyer talk to them. And don't give them, the Mexican Embassy anymore info and or money unless your lawyer is on the phone with you.

Also whenever you talk to someone let them know you are recording their voice and comment for legal purposes. So that way you will always have their voice and whatever they said on recording just like they do us when we call places. But I definitely would not talk to nobody in Mexico without the presence of my lawyer. And never give up original paperwork never give up your original copies. But always be sure to get a copy of anything they said or wrote down or had you sign.

Your embassy guy is running interference. He is managing expectations of himself and the embassy. You have a fourth option which is to bid at the auction to purchase your van. Most likely you will win that bid.

@@RaphaelNationYep. Mexico also considers it an " abandoned vehicle " if it isn't recovered in 45 days from the confiscation. They will also add an abandonedment fee. I've seen people who had to pay more than their vehicle was worth to get it back. That fee is assessed from a percentage of the perceived value of the vehicle.
This is what we heard as well. Except the 45 days part.

Listening to your story it sounds like your attorney is involved in swindling money from you guys as well. With no intentions of helping you. The deal breaker is hospitals 😮 I had to take my aunt and you can’t leave the sick you have to stay with them the whole time or pay a babysitting service . Maybe in a big city you can actually leave and let the nurses care for an injured person but very expensive if you can find one ? The hospital and doctor office never took blood pressure or temp ? USA has half a million surgeons Mexico 2,400 hundred so if you need a surgeon your waiting and many die . Best of luck 🍀🍀

No. It wasn't stolen. It was confiscated for not having a required permit. They should report it as confiscated to their insurance company and their lienholder. Nothing good can come from not being open, honest, and upfront. Having worked in insurance for 28 years, I can say this with certainty.

Who is advising you? Everything in Mexico is done with a lawyer. The information from police, to your lawyer and relayed to you. The penalty or process to get your temporary import documents. Again everything given to your Mexican lawyer, in Spanish,wo anyone standing by, standing over the discussion. Your lawyer will be able to get the information, regular logical sentences that are standard in the United States are the same in Mexico, exactly the same. Where will our vehicle be stored? What is the fee? We need a receipt. Will you contact us? Or our lawyer. What is the regular infraction fee ? From your videos is as if you didn't leave them with a local point of contact and you may have abandoned your vehicle or they may assume that. The consulate is certainly not where you would turn for not having documents, straight forward questions, like ooops what do we do to fix this?? Ooops my Spanish isn't good enough, my knowledge of the law is not good enough, who does my lawyer need to speak with, do they have a phone number? Do they keep office hours? What is the address our lawyer will contact them ASAP. You don't ( ever, never) ask a non Mexican to fix a problem in Mexico. You never ever ever get frustrated or upset at police or other officials for not speaking English, French, German, Dutch, Russian or Chinese.. business in Mexico is conducted in Spanish using Mexican slang and common phrases that are unique to Mexico. I have traveled these roads many times. And experienced problems, and all were resolved. All the cartel boogie man stuff is not productive, using toll roads during the day and speaking w Mexican authorities before you have any issues. There is no such thing as a free zone. The only free zone is Baja Norte and once you cross from Norte to Sur you need temp import docs w proof of payment. When you take the ferry it should be in your possession. I feel bad about your situation and you should immediately reach out to a lawyer who works near where your van is located. And you can call the delegate or state President and explain the situation and that you are Americans and need help, again all those calls will happen in Spanish by someone who knows the players involved. Example, in your videos never heard the name of the police precinct or police chiefs name.. there are laws in Mexico for illegal importing a vehicle and solutions.
Mexico has 130 million people. The unemployment rate is 2.84% the economy is on fire.. consulate will not even know where to start about a van taken after an importation violation..

Hey, I would advise not to publicise calls at all. This in itself can get you in a whole lot of trouble unless the person with whom you are on the call has given permission in writing. I know you want to make interesting videos but broadcasting segments of phone calls against permission could lead to an even bigger mess. It doesn't matter where you put those calls; even in a membership group, it is not right to do it and you can find there are legal ramifications from this, even months later. Would any of us like our calls, which we believe to be between ourselves and the other party, to be broadcast on the internet?
When recording officials' phone calls, you could be on the wrong side of the law in broadcasting or giving transcripts.

At first I felt for you guys losing your van but now I am getting upset when I see that you are making anyone here believe that the confiscation of your van is unfair and unlawful and it is Mexico the one to blame as we all know Mexico to be “shady” and “corrupt” right? First you are wrong. In every video we stated we were wrong and made a mistake by not getting the TIP. We’re not smearing your country. Mexico was being smeared many years before we made these videos. We also made 20 videos about how great Mexico is also. Please go through all our videos and comments before making an untrue statement. We always admitted it was our fault. It’s the process in which it was taken and how to get it back is what is at question. You cannot find any comment of my wife and I bashing Mexico.
