Court documents reveal new details about arrests of two farmers in Lancaster, York Counties

  • It's been three weeks since two central Pennsylvania men were arrested and taken to prison.
    Ethan Wentworth of Airville, York County and Rusty Herr of Christiana, Lancaster County have sat in their respective county prisons since April 10 and 11.
    Herr and Wentworth run NoBull Solutions, LLC., a breeding company that helps dairy farms with the reproductive management of cattle.
    Brook Duer, a staff attorney with the Penn State Center for Agricultural and Shale Law, has been following the case closely. He says a lot of people in the agricultural industry are familiar with Wentworth and Herr, due to previous complaints against them, claiming they were practicing veterinary care without a license.

It doesn't give medicine out, it doesn't even do ivf which is also offered by other companies that don't employ a vet(when are they going to be arrested🤷) they are a ultrasound scanning service so you can have early detection of pregnancy. They aren't part of the vet community, they don't need a lisence and are not accountable to the regulatory board for vets, so when the vets put in a complaint that you are doing something that isn't allowed because you aren't one of them and take it to court to tell you off and fine you do you really think that turning up is required, NO because YOU ARE NOT A VET AND THEY HAVE NO LEGAL SAY OVER YOU. The case should of been thrown out the second the judge saw that the vetenarian board had no legal jurisdiction over those men. 🤦

    Someone didn’t like them using ultrasound, and came up with false accusations. That person had a buddy on the vet licensing board, and were able to push it through. Using ultrasound on cattle to determine if a cow is pregnant is not “practicing veterinary medicine”. It’s literally just preg checking a cow, except with technology instead of your arm in the cow.

      Exactly. Artificial insemination has been performed by dairy farmers and cattle ranchers for centuries. Checking for pregnancy for a cow does not make you a vet🤦‍♂️🤷‍♂️.

    This is surreal. Vets don't like not getting paid to do ultrasounds on cows? Farmers should be allowed to do as they wish- provided they are not abusing animals or putting the public at risk.

    What an idiot. There was NO criminal case. While it's true that a criminal case can be initiated by the actions in a civil case, that never happened here. The judge in a civil court simply ordered the incarceration of two people without any criminal case whatsoever.

    Did they ever actually receive any court orders, warnings or documents?' Were they ever made aware of what was going on? Did the "records seal" include them as well? Did the process servers "accidentally serve, mail or deliver the papers to the wrong addresses?

      @@richh5824 China's land ownership gets a lot of attention, but as far as the actual amount, it's tiny. Most of the foreign-owned land is Canadian (about a third of all foreign-owned farmland). After that, it's Netherlands, Italy, France and Germany which collectively own 29% of all foreign-held land. China's stake is less than 1%.
      Bill Gates is another story. He's the biggest private farmland owner in the USA and his stake keeps growing. I'm equally concerned with giant corporate agriculture colluding with the federal government to bankrupt and drive out small farmers so their land could be gathered up on the cheap, thus centralizing control. It gives the big ag businesses even more market share, and it allows the federal government to more easily centralize its control over our food supply.

    The complaint was likely filed by a state or national veterinary association trying to claim that as something that falls under their license. Similar disputes have occurred between other licensed health care professionals to protect their areas of specialties and income. If the complaint was that they were doing ultrasound on other people's cows, maybe they should just rent a portable ultrasound to their customers by the day or hour so they ultrasound their own cows. I didn't hear that any of their customers had a complaint.

    Ultrasound is not a medical intervention. It is barely different than using a stethoscope. We used to tell our students that ultrasound is the stethoscope of the future....it is now the stethoscope of the present. It astounds me that this is even a case. Shame on that judge for acting with ignorance.

    The State Board of Veterinary medicine doesn’t make law. There should have first been a trial to even determine if what the men were doing could be considered “practicing veterinary medicine”. Using a sonogram machine with no drugs involved just to see if a cow is pregnant can arguably be contested as NOT practicing veterinary medicine. Are they going to decide next that a Farrier is practicing veterinary medicine when they trim someone’s horse’s hooves? This should have been a civil suit, not a criminal case. There’s no law that I’m aware of that specifically says non-licensed persons can’t use a sonogram device on a cow. What law they broke first has to be determined.

    Animal husbandry has been practiced for thousands of years. It has never been regulated veterinary care. Nothing they are doing requires medical training. The state board of Veterinariary regulation has no authority over unregulated activities like animal husbandry. Government overreach.

    The veterinary community says doing ultrasound is unlicensed pracitce of veterinary medicine, but farmers themselves are allowed to do it. Go figure.
    The entity involved has no.authority to have anyone arrested or incarcerated; moreover, it's a civil, not criminal matter.

    as law enforcement constantly tells suspects, "if you have nothing to hide, why not cooperate?" there is no logical reason for the government to have this sealed. people's names who are being investigated are always in the news.
    how does a regulatory board have power over an individual who is not a member of that board?
    an agency has no legal authority to have someone incarcerated. they should have the local/state prosecutor bring charges against the person(s), had a trial for the adjudication of the defendants, innocent or guilty, before being thrown into prison for non-violent (probably misdemeanors) crimes.
    definitely an abuse of governmental authority.

    Why should they? The veterinary board has no jurisdiction over these farmers. Ridiculous, they’re not veterinarians.
    Checking to see if your cattle are bred …. Not practicing veterinary medicine.

    Veterinarians brought the complaints because they were losing money because of the Defendants' business. Their fellow veterinarians on the Licensing Board backed them up. Wentworth and Herr should have fought the "guild" in Court vigorously back in 2010.

    If doing ultrasound to see if the insemination took so you don’t waste the semen trying to fertilize a pregnant cow is practicing veterinary medicine then taking the cow’s temperature with a thermometer to see if it’s sick would be too?

    Simple question: Are non-registered individuals subject to the regulations of the agency that enforces the regulations upon their registered members?
    For example: Does the board of realtors have regulatory power over everyone who assists in selling real estate?

    They needed to claim their American Constitutional right the right to be heard and know why they’re being arrested…. Before they went quietly they should have demanded their rights.And the right to a trial by jury as a citizen of the United States…..

    That still Does Not call for PRISON. You go to Jail, not Prison for Contemt of Court. The People of the State of Pennsylvania should have a Grand Jury Indict the Judge and Arresting Officers to send them to Prison for 30 Days for Illegal Imprisonment. The Judge should lose his/her right to ever practice law and the Officers should lose their right to ever Own or Carry a Firearm which would cause them to lose their jobs and have to change careers. Come on Pennsylvania, Do what is right.
