Roman trials were evidence based, though high stakes trials were definitely colored by concepts of family honor. As far as domestic violence, in the Republic fathers had the right to murder offspring. On the other hand divorce was very easy.
Very amusing to hear people think it's the rule of law that prevents violence, and not the social pressure and fear of punishment behind the law that actually keeps society ticking along. Funnier still is the shock at such cruelty. All the while admitting that they watch true crime stuff. People never stopped being brutal, they just got better at pretending they aren't!
