    Just some points I want to clarify that keep cropping up in the comments.
    The charge is section 5 - disorderly behaviour - of the Public Order Act 1986.
    Secondly, I’m fully aware of Harvey v DPP 2011 the case law surrounding swearing at an officer. I wrote about it in 2016 here:

    What people don’t seem to understand is that presenting case law at a magistrates' court would be like showing a dog a card trick. Magistrates are not legally trained and the clerk would show little interest. It would be a matter for appeal, not conviction. In any event, it is using a sledgehammer to crack a nut, which I will explain in the next video.
    To those who say, why did go with them, you should have refused to speak to them and not opened the door. Clearly you are Freemen of the land or just idiots. When the police turn up with a battering ram and an order of the court to force entry, do you honestly think I’m going to let them fragment my door, knowing full well I would be unable to sue them for replacement of it afterwards. The police are immune from suit when acting upon a search warrant issued by the court, as are HMCTS. They were going to force me to court and I was not going to subject my family to having the door smashed in by these brainless thugs. The idea that you can talk the police into going away in such circumstances is infantile, and clearly those denouncing me have never found themselves in such circumstances and have no idea what they are talking about.
    Thank you to everyone else who has offered to support me in my defence. It’s not necessary as self representation is the best thing and a solicitor would likely harm my defence as they invariably refuse to act on full instruction. There are human rights issues that can be brought up as part of my defence that I know a criminal defence solicitor wouldn’t have a clue about. But I really appreciate the support.

      I’d use the video footage to prove that in court. He can’t be that much of a victim or be that offended if he so confidently comes to your house to harass you. He’s clearly abusing his power to win a dispute between the two of you which should be a personal matter. But the corrupt sack of shit is using his job against you. I bet when his partner leaves him for someone else he’ll get their new lover arrested too.

      Honestly it's sickening. I was reading an article about a volunteer worker in Syria being shot trying to save a small child from an IED and of course they were trying to claim they were a 'hero' and so on. But then I hear about this Officer, in Britain of all places, having to hear a swear word and I began to sob uncontrollably. You just can't imagine something so heinous could happen, in Britain of all places too.

      @Steve Gee I realize that, but to try to impress on the idiot politicians who created the law (and who can undo it) and the police who slavishly enforce it, you can legitimately make claims beyond the potential of distress and claim actual distress. When the politicians start getting arrested and the police have to start arresting each other, they might begin to see the shortcomings of their laws.

      @@jdlambert8 it honestly doesn't matter. it's the police who're enforcing these laws and laws that simply don't exist or laws that they're misrepresenting or interoperating anyway since they're not legally trained on what they're trying to enforce. If section 5 is revoked, the police will just have a quick scan of the law they probably overheard in a court or friendly solicitor, and make assumptions about how it supposed to be used, and pass that on to their other police mates as a word of mouth law that they'll then use to enforce to their own needs.

      And the second one was an off duty police officer riding home on his motor bike and ran over a kid running across the road to join his family in the restaurant on the otherside. The family saw the accident, the father ran out of the restaurant towards the kid and the accident and the off duty cop shot and killed the father because the cop felt threatened by the father running to his son.

    I used to believe that the Police had a difficult job to do and it was due to the amount of abuse they get why they are so aggressive with some people, UNTIL I had the pleasure of dealing with them after I got a new car that attracted police attention on a daily basis, they would have me pulled over for no legitimate reason and then say the car smells of cannabis so they can search it and me, even though I had a drug swab that proved I didn't use drugs, I'm a builder and I finally got arrested for an offensive weapons charge after a Stanley blade was in the tools on my back seat, not in a case or holster. £600 fine and a conviction that reads possession of Firearms and offensive weapons ALL ABOUT THE OLD STANLEY KNIFE BLADE IN MY TOOL BAG??

      @@edward3320 If you check on the vest of every attending officer you can see their taser guns, they also have response units that are armed with assault rifles and sidearms, so the threat and danger is there.
      As law and order declines in the UK we will soon see more police carry firearms to assert their control.
      I think the new chest cameras and other technology is a game changer for police encounters and will help keep those that would be liberal with the truth a little bit more honest.

    It's videos like this that help make me form my opinion that the police only claim underfunding and cutbacks as an easy excuse for not carrying out their duties properly. They simply have an agenda of their own and it's not the protection of the public.

    I'm currently 'under investigation' for malicious communications due to the fact a bent "CID" officer would not return my property. He thought it would be easier to have me arrested for an offence of his choosing as an alternative to return my property from an incident years earlier. The police forcein the UK is so bent, twisted and corrupt but the general public don't usually witness it.

      I have them follow me around all the time, yet on there phones in the car, on Facebook, while I slave my ass off paying their wages. But when I phoned them for an assault on me in front of a camera, apprently they lost the evidence so nothing could be done. It's absolutely ballshit.

      @@mattbeardsworth3201 I have got most of my original property back. They smashed up my expensive computer though unfortunately. That was seized from an offensive weapons charge which I accepted I was in the wrong and I received a fair punishment in court. It was what happened after that case ended which is the worrying part. The officer in charge had a hump for me and was upset about the sentence I received. He doesn't understand that judges are the ones that give the sentences. I was in contact with Crimebodge regarding a civil claim against them for the damage to my computer which is ongoing.
      When the offensive weapons case was over, the officer in charge (CID) would just not return my stuff. He would point blank refuse and I couldn't do anything because I was niave at the time and had bad solicitors. I had seized phones, computers, laptops, hard drives, USB sticks, dash-camera, worth over £1,000. It was bankrupting me. They needed NONE of these things to investigate the offense. I called the officer in charge and let him know I was recording the conversation before I took legal action to reclaim my belongings. He laughed and swore down the phone but then was worried that I had the phone call recording, so initiated this mallicious comms case against me to seized more phones, computers etc which they did and still have. He had his CID buddies arrest me by saying I started to call his personal home and mobile numbers making strange noises, etc. There is no evidence and never has been and never will be because it's completely false allegation. How would anybody get the private number of a senior officer?!
      I am still under investigation for this since August 2017. There is no time limit so they will just prolong it forever. These legal-aid solicitors don't help you at all but sadly I can't afford a proper solicitor.

They claim they're underfunded, aren't attending burglaries, refusing to attend the scene at motorcycle thefts etc, yet can spare all these men and man hours for that?     The use of a law designed to prevent victims of sexual abuse from being cross examined by their abusers is completely inappropriate and wrong-headed in this case. When the police wonder why most people no longer respect them and the judiciary, they need to remember the thousands of incidents like this.

      This will open their case to an appeal though, so if he is found guilty he can appeal the case to a higher court and thus have a better chance in being heard by a different judge

      @@disappointmentinc3522 The appeal process takes the case to a more senior judge (and you can appeal their finding to an even higher court, all the way to the Supreme Court if appeal is allowed). I think we have a great judiciary in this country and they control the power of the government as much as they enforce the law. I think this judge won't have legitimate grounds to find guilty, and if they do the decision will certainly be overturned on appeal.

    Sorry. I don’t know your first name, I am a solicitor, save for your thoughts on the value of my brethren. I can tell you that I go out of my way to fight for my clients. So much so, I have been held in contempt, spent six hours in a cell, made to apologise, then had my clients conviction and my contempt finding erased upon appeal.
    Yes, when being represented by a duty solicitor at a court, you will get the newly qualified on their LPC looking to gain court time. However, you do not have to accept that person to represent you. Had you known that, you could have (subject to whether your court is busy or not), have spoken to any solicitor there at the time, thereby obtaining the services of a more worldly representative. They may have been able to (if time allowed) represent you, or got someone with experience to the court who would have been able to stand in their place.
    For the Judge to have allowed the use of Sct.36 is a clear breach of Article 6 HRA. There was no following of the protocols that must be used if the Court is to consider the use of Sct 32, 33, 35 or in your case, Sct. 36. Save for certain MAJOR crime, if the Police are going to be considered, “vulnerable, intimidated or mentally defective (MHA 1983)”, then God help us all. The snowflakes have infiltrated the Institution of masculine autem masculinity! I believe the Court May have used Sct. 34 on you, however, the test as required in this instance under Sct.36 simply could not have been met under any circumstances pro. the charge you appeared under. By doing so, the DJ opened the Court to an appeal or a charge under Article 6 of the HRA. By setting this precedent and I use this term following extensive searching of LawTel and Westlaw to see where a Judge has banned a defence in person from cross examining a person under the charge where an indictment could result in a sentence not exceeding 12 months, excluding any indecency .........before and there is none. This Judge May have stepped on the third rail in law.
    May I suggest you PM me to discuss further, or, accept my referring you to The Equalities and Human Rights Commission? The latter can give you the name of an advocate who, subject to your status, be able to start the ball rolling. I often work with an eminent Barrister in this field, however, one cannot take cases direct from clients who have not come through the former line of approach. I would direct you towards the EHRC as their contact network is far more extensive for this type of case.

      @@jukeboxhero1649 Criminal lawyers are not paid very well - they have the very lucrative option of going for high-paying commercial law, but they take a pay-cut to work in criminal instead (which requires really good grades so it's not just anyone who can make this decision). Criminal lawyers should never be seen that way unless they are incompetent, but that reflects on the individual(s) in question. Honestly mate, they're definitely not enemies of the people and they spend most of their time criticising the law and the governments that produce it

    I worked with an ex-cop recently through an office temp job I did. He stated he used to like slapping people about he arrested and getting away with it back in the late 80's (UK) when nobody had camera phones.     You should write to the Lord Chief Justice and complain about your treatment before the magistrate. He rules that the judge was wrong about Tommy Robinson, in that Tommy was ripped off the streets and before the judge and not given ample time to prepare a defense.
    Also you should complain about not being able to interview officer delicate snow flake. I thought that being able to face your accuser is a basic tenant of the justice system.
    In this case it would appear that you were denied time to prepare a defense. And also isnt it law that the prosecution have to supply the defense all of the evidence that they have before them and are going to use ?
    You sound like you have a good case for appeal.

      I used Tommys example because he was whisked off the street and before the courts without being allowed ample to time to consult with lawyers and plan a defense. Very similar as to what happened here.

    The Police have admit that many crimes, actual crimes, go un investigated due to lack or recourse, whoever runs this department should be relieved of his position and sent off to be a traffic warden... what on earth were they all thinking?

    A court judge has ruled that swearing at police is not a crime because officers hear foul language “too frequently” to be offended. Overturning Denzel Cassius Harvey's conviction, Mr Justice Bean said officers were so regularly on the receiving end of the "rather commonplace" expletives that it was unlikely to cause them "harassment, alarm or distress". In other words it goes with the job. Mr Harvey appealed against his conviction after he was fined £50 for bombarding police with foul language when they attempted to search him for drugs.

    What a surprise it's Derbyshire Police. I was once arrested by these scumbags for battering my girlfriend, when I told them that my girlfriend was at work and had been all morning they threw me on the ground in front of bystanders, literally ripped the shirt off my back while one copper started shit talking me "come on then big man" etc. Eventually when we got to St Mary's wharf and it turned out the guy they were after had a sleeve tattoo whereas I have none, I just happened to match his description and drive a similar car. But the police weren't done there, oh no. After realising their mistake they decided to do me for "resisting arrest and/or impeding an officer in the line of duty" obviously I was found guilty for that because police are never in the wrong and don't make mistakes. Who knew that asking why I was being arrested counts as impeding a police officer?

    It's time the public turned on these Muppets called the police ...I had a solicitor at court that tried his best to get me to admit to something I hadn't done even offering me to take a lesser offence he was as bad as the police eventually I gave in... but at that very moment my girl friend who was with me said no no Stephen you didn't do anything wrong . At that moment I snapped back at the solicitor and said yes she's right no I'm not pleading guilty for something I didn't do as a result one of the people accusing me didn't turn up at court and it got thrown out but the police completely fabricated lies they have No shame cowards maggots hiding in the uniform that contains a backbone

      Hey Micky Cheats! Not everyone though, sadly. Im grateful that I could come here and have better life (not that is that awful in Poland...). Some people just think they are privileged and everything is for free. There are people like me who came here and put their roots down but there are some who just came and use the system. Unfortunately open borders never was and never will be a good thing. I like to some point Australian way of getting new members - only skilled ones..... It's a shame really that majority of immigrants are not even able to communicate in English... Why would you "invite" those kind who don't even care to put minimum effort and learn language...... Shame really.

    My house got burgled both of the kids who did it were caught, they have CCTV evidence of the break in, DNA evidence eye witnesses and they were caught in the act....it's not even going to court and your going to court for saying no shit to a policeman and the cops wonder why kids drop kick them in the street? They have lost the respect of the public, Best of luck, they are doing this to you because of your channel and your brilliant expose of their tactics, it's nothing to do with what you said.

      in case u haven't already figured it out, the police are the mafia. The police run crime as business, profiting mostly from drugs and rape gangs, employing criminals to front them.
      Like any criminal gang, it is vital that the police suppress any individuals that try to audit them - else if left, groups, then a culture may grow to actually monitor police activity which would expose who they really are.

    i would let them bash the door down for saying 'no shit' to a police officer. record it all, then take it to the news channel and ask the public if they believe the police should pay for a new door + a little extra for your time. what you're dealing with here is a situation where a gang just wants to prove a point because they feel powerless and weak.

    That a battering ram was brought to break your door down tells anyone seeing this exactly why they came for you and how they wanted you in the system, (you disobeyed). This is hows its done to break someone down. Of note in these cash strapped times for the police, (according to BBC reports), a van and 3 to 4 cops turn up, (cost?) because you swore in front of a cop and were not cowed by them.

Most police officers will have had worse said to them on multiple occasions. For the incident to have caused this level of response, there must have been something more to trigger it.

      @@tricky778 I know that police officers are human and thus there is the potential for abuses of power due to grudges. Generally there is a trigger for that abuse however. What I am finding unusual is the concept that the actions here are the result of a grudge founded only on one incident of saying "no shit" to him by a member of the public he did not otherwise know.
      Sure it's possible, it just seems unlikely.

      Anyone call flooding would be arrested for harassment or stalking. Wave at someone they claim it's stalking police will take as such. First in is believed bullies now use anti stalking legislation to claim fear, alarm and distress is being caused to them. I'd bet that 60 percent of stalking and harassment allegations are actually by a bully who needs to have a "defence" or some narcissist.

    I saw two policemen got ragged in London last week. Nobody came to their aid. Years ago they would have got help but the idiots have managed to alienate those who would have helped. Well done. What on earth have they recruited to the police service ?

    Unfortunately this doesn't surprise me one bit. I was once arrested by Derbyshire police for affray (I peacefully stopped a guy pounding another guys face) and was cs sprayed. A wpc stamped on my thumb and broke it. I was cuffed and put into the back of a police car when a PC opened the door and decided to punch me in the jaw even though I wasn't causing any problems. It was caught on CCTV. I made a formal complaint. The investigating officer came to my house with said CCTV on vhs (2005ish) and just as it was about to show him punch me it went blank. The investigating officer was genuinely concerned and made it clear that he believed me as this same officer had a similar complaint made against him just 10 minutes before he assaulted me. Unfortunately nothing came of it and was prosecuted for affray and put on a curfew with an ankle tag although they never came and fitted the tag. Very strange and I can only assume the investigating officer got involved as my solicitor said he's never known them to not fit an ankle tag. I've never trusted the police since.

      @@mattbeardsworth3201 I never heard back from the police. The investigating officer told me that there was nothing he could do without the CCTV footage or witnesses. The only witnesses were the friends of the guy (a local bully) that I prevented assaulting a weaker guy. They hated me because I was perceived to be "tougher" than them. We all live on the same estate. I still remember the assaulting officers name and have searched for him on Facebook but no luck unfortunately. The investigating officer did assure me he would do his best to get this guy out of the police force as soon as he have concrete evidence against him

He was remanded and I was released. The tag was supposed to be fitted shortly after my conviction but they never turned up. Very strange. The only evidence was the CCTV footage and witnesses that would never have supported me. We still have bad feelings to this day

    I lost all respect for the police years ago when a clear cut case of assault against my mum by a friend of a copper was given a not guilty verdict. Physical proof and witnesses were not enough, apparently him stating he was acting in the public interest by trying to pull my mum out of her car while stopped on a dual carriageway was enough.
    Unfortunately I have no doubt you'll be convicted as the system is corrupt on so many levels.
    I hope I'm wrong.
