I have a question regarding Doris Tate’s question, saying she is being sued for something from 2014, so if it’s past statute of limitations, and the creditor sues, the consumer can counter sue? I’m asking because my cousin had something like this happened to her and her husband, where someone had sued her and now they’re garnishing wages. I don’t know who sued her or how old the debt was but it is supposedly past statute of limitations and now their wages are being garnished, can my cousin and her husband go back and counter sue or is it too late because they allowed their wages to be garnished?
It’s going to be impossible to analyze your family situation without digging into the actual court file, and only then if it were a Florida case. Other states are different. Your family members should probably contact a lawyer in whatever state they live in, If they are experiencing wage garagement right now.
I am currently wanting/needing to purchase/rent a new home. Brickwall I hit looks like this: I am currrently in a hotel due to inability to continue paying the rent which was twice our previous mortgage on the house we sold to avoid forclosure due to covid 19 in 2021. Right after moving I lost my job due to covid which is why we had to resort to a hotel. Long story longer I have recently discovered I am an identity theft victim from equifax data breach t mobile data breach and several others. MY CREDIT SCORE IS MY BRICKWALL. Any advice is better than none!! HELP!!

I think they went after my bank account already but I had no money just a couple of dollars but I guess it is related to that judgement. any advice? no money for attorney, just started a new job.

Without a local attorney, you're probably going to lose a LOT MORE money when they garnish your wages. Definitely talk to a lawyer even if you don't think you can afford one. Business debt is going to have a different set of rules than consumer debt. We only handle consumer debt and recommend you speak to the lawyer who’s advising you on business matters. (If you have a business you should already have a lawyer for this )
Proved I didn't owe my so-called balance to Chase proved to the collection agency that I didn't owe it.the dispute Department won't speak to me and now Chase Bank is switching banks to Barclays in Delaware and their Delaware paperwork stated that if I owe a balance to Chase that I will still owe the balance to the new bank can't call them because they need the credit card number haven't had the credit card for 4 years haven't used it so am I going to have to go through new collection agencies once Chase switches to Barclays Bank of Delaware in September comment much appreciate

For identity theft go to www.identitytheft.gov/ and follow those steps right away.

Every state has its own laws about service of process. Definitely do your own research on that to make sure that you’re doing the right thing

If it’s business debt consumer laws don’t apply no matter who’s name it’s in. You need a business lawyer to help you.

"Proved it" to whom? Did a judge enter an order saying you didn't owe it?
