    Hey everyone, I just want to say sorry in advance that this weeks video isn’t “super fun” I just really wanted to bring this up. The more and more people steal my likeness to sell products the more I worry about the validity of the products. So please be safe online, there are so many scams out there!! Love you all to bits 🫶🏻

      Temu likely didn’t even know about it. They have thousands of sellers and I doubt they are verifying each photo. The people who stole it are likely random sellers with no connection to the brand department that is trying to work with her

      @@ashleys885 Temu is still slave-labor city though. They know exactly what they're doing because they do NOT care. The only thing they worry about is publicity.
      It does not matter if the departments are connected to the sellers. It does not matter if the people in the PR department are nice. It does not matter if those people will fix Mia's issue.
      What matters is they are ripping you off and exploiting the underprivileged. Always.

    And... patent agent here 🙋‍♀️ there are several requirements for a patent, you cannot get a patent on a person, face, look, name, etc. So the fact they require a patent to take action tells you a lot

      @@jennymichelle81 well you could get a design patent, but depending on what you are trying to get patented it might be hard to get, since you still need to prove novelty, non-obviousness, etc. Those tend to apply for art. In her case, I think since it is her picture that was stolen, she would not be protected by a patent.

      Temu being consistent and meeting my expectations in regards to customer service is not super surprising. Sucks but like be fr. People defending these companies somehow still surprised me. Like, these sites do not care about people and the prices are suspicious. I don't understand the loyalty.

    Channel 4 in the UK recently released a report about Temu- falsifying safety marks, selling weapons, stealing IPs and using high/illegal levels of toxic substances in their products. I'm so sorry they did this to you, Mia. Gross behaviour from a horrible company.

      I thought that just in every other frame she looked like she was in the middle of talking (bc she was lol). So you would've immediately known that the picture as stolen from a video and not actually a picture that she posed for. Like that's the only picture that looks like it could be actually MEANT to be a picture.

    7:33 the sad and scary thing about this part is that people can use AI to make a video of you talking with YOUR voice, and make you say whatever they want without your consent nor acknowledgement..

      True. That's why I don't like to donate to any charity unless I'm 100% sure it's going to the right place, and not into a scammer's wallet. There are some really outrageous scammers out there who are making fortunes for themselves at the expense of people in real need (Ukraine, etc).

    They (can’t remember if it’s Temu or Shein) literally took Cassy Ho’s (Popflex) video of one of her products and replaced her head with someone else’s head. It was a video of her in her hose. They not only stole her product design but also her body and house.

    with Temu, Shein, and even Tiktok shop, videos like this are so important (for young consumers especially i think) to remember that you can’t trust everything you see sold on the internet and to be wary of what gets purchased from where

      And older consumers. Probably not Shein so much, but there are tons of scammy ads on Facebook that I see older people fall for all the time. I always assume all the ads I see are fake until I do some deep diving. I'm pretty savvy and I almost fell for a fake QVC website once. It was pretty impressive. (Just off a little. I think it was the font.)

      To be fair…there are a lot of youtubers who use other peoples content Snippets of what is on the other persons channel) to make their own videos and use images of other people as screen shots on their channel….(you tubers in general, that is) …are they stealing?

Using a snippet of someone's content that is pertinent to the subject matter in your video is fair use and not stealing. Taking a screenshot from someone and putting it on your website to sell a product is actual stealing. Not only did they use her photo to make money off of her, but they used to try and make whatever they are selling look more credible.

I can’t even imagine how weird and uncomfortable it would be to have your likeness stolen in this level. I’ve had fake socials pretending to be me and that’s weird as hell to me so THIS is just disgusting..

      Another thing that might help is they’re being sued for downloading spyware with the app.. the owners owned a company that did the same previously.
      They’re not making money off of their products, but off of the information they’re selling.

      I'm getting so many spam emails and calls from numbers all around the world with the same robotic voice speaking Chinese I think. I still use Shein sometimes, but Temu is so so sooooo much worse

    Computer scientist here. They can easily apply a detection model (even one person can easily write and train it) and flag all the posts that have suspicious photos and filter them out. So if they are not doing that, they don't want to do that.

    So, they were telling you about their counterfits goods policy. A patent would be used if you owned the company that invented something and temu had a fake of the item. Stolen media (photos, videos, etc) is a copyright violation and that's legally a different thing. In the US it would be handled with a DMCA takedown notice, and then if they fail to comply, one could then sue the company.

      But sadly they are based in China. Back in the day China and Korea would both be able to use your image freely if you posted it publicly. Especially if it was their product but even if not, if you were someone well liked they would put your face on any promotional imagery. Idk if it has changed over there officially but I'm guessing not.

      @@court.rosejj Temu is still located in China, so Chinese law apply for them. It’s not legally how it works, but that’s how they see it.
      Temu and Shein are both being investigated in Europe, quite honesty I hope they both will be banned all together.

    What’s even more frustrating is you said you might be able to get it taken down from your business email but those poor other people that work in small business wouldn’t be able to from their regular email

      Her logic didn't make sense unfortunately. Her trying to get them to take down the picture with an anonymous email address is like a random person asking to have a picture taken down.
      You can't just ask a company to remove a picture because you don't like it.
      She *has* to prove that she's indeed Mia and that it's her face/picture. Otherwise you could just email random companies and have them take down pictures of models you don't like.

    I watched a video once and that creator had her photo stolen. She contacted the business that stole it and let them know that she charged $ X for her photos. They had no choice but to pay her and told her that is was an expensive mistake.
    Maybe you could try something like that.

      I think the company would actually have to care. I don't think Temu cares. Their "workaround" is "other people sell on our platform, we can't monitor everyone so you would have to contact any/all individuals who used your image without permission." It's disgusting!

      I think the bigger issue is that no one takes responsibility for 3rd party sellers on their platforms and no one makes them or protects consumers. Caveat emptor. And the government turns an eye away from the giants like Amazon who was not punished for selling $60 Chinese toilet paper during the pandemic, yet went after smaller companies and individuals who did the same. These platforms are poorly regulated, if at all, and literally have no consequences for the platforms who sponsor independent sellers who spam, or steal/ sell your information, or sell products with little or no resemblance to what people purchase.

    Thank you Mia! This is valuable educational information. I am a Canadian Senior that can not afford to be scammed in anyway. Be it quality, price or identity (financial or otherwise). I do watch as many of your video's as is relevant to my demographic and value your opinion and advice. You walk me through all the in's and out's of purchasing from Canada and there really is not enough quality content out there from a reliable source and Canadian perspective. If there is I have not found it, and would gladly go if you recommend some. I find your test video's valuable as they are real life, easily digestible as in you explain in detail without using acronyms that baffle or tech lingo that dissolves into incoherent nonsense. Love the light hearted attitude and humorous banter with your Mom. For all these reasons it is important for all your viewers and loyal followers to know that any endorsement of any product or service come straight from you right here on this channel.💖🤩

    I used to work in the legal department at Adobe. We always had to have a signed model release for commercial use. Since Temu is a Chinese company that uses slave labour and counterfeit products though, I doubt they would react to a cease and desist letter which is the common next step. Everyone needs to boycott Temu. I fell for their crap once. Never again. Live and learn

      I get why there's a debate about the possible TikTok ban, but sites like Temu need to be outright banned. While Amazon is scummy, too, they're also easier for the US judicial system to reach and punish when they hurt consumers. Temu being from overseas means consumer protection regulations from here don't matter to them. When Amazon was alerted to sellers on their site selling literal thorium-laced products, Amazon was beholden to the NRC and our consumer protection laws and took them down. But how well does China listen to the IAEA? That's how dangerous it can get shopping from companies that don't care what they sell so long as they get their bread.
      By the way, regarding the thorium-laced products: Avoid anything that says 'ionizing' and 'negative ion'. Also, 'quantum energy', 'scalar energy', and 'EMF protection'. The Thought Emporium posted about this stuff a few years back. Stay safe, don't get skin cancer from a bracelet.

    I absolutely hate this for you or any other artist. This happened to me about 20 years ago, when scrapbooking was very popular. I was in a private group along with other artists. Of the rules of the group was “no stealing.“ Come to find out, someone took my exact project that I shared, and had it published and was paid a significant amount of money. I left the industry because of that. It broke my heart. I absolutely hate this for you. I hope there is some sort of way, You can make some good out of this. I’m sending you love and comfort.

    Well to be fair if some random person asks to take it down I think it makes sense they decline the request cause it's not the person, so imagine you have rights to use the image but some random person asks to take it down and temu is like sure no problem! that woldn't be okay for the seller, so I think it makes sense that you as the actual person getting stolen should be the one to complain and if they take it down it might be for that reason not necessarily because u are famous and they want to work with u. However yes most likely they would give you more attention because of who you are.

    So frustrating! However it would make the most sense to request a removal from the person themselves, like instead of as a random person because if you really think about it, anyone could just wanna remove something just because they don't like a certain person or something random like that. But if it's coming from the person they stole from, it would make more sense to ask for a removal. Anyway, Temu needs to really just stop.... and the other brands. Stealing designs is so common (I'm a fashion designer and I fear that happening someday) and it's really sad! We gotta put a stop to this!!

      The difference is that you can sue them in the US. You cannot sue Temu. They will simply not respond.

Also AI is so advanced it's showing people saying things from videos they have posted that the person never said. Just something I thought I'd mention.     I know so many people who buy from Temu all the time. I purchased a couple things from SHEIN back in the day because I was broke, but when everything finally arrived I realized that even if it is crazy cheap, it’s still not worth it because it’s all GARBAGE! I immediately stopped buying from them, but understood the mindset behind others doing so.
    With Temu, I scrolled through and realized it was all the same so I wasn’t even tempted.
    All the people I know who still buy from them are struggling with money and I can’t stress enough that that’s VALID, but I’ve recently come to the conclusion that being short on cash should be a reason to NOT buy from them. If I only have a certain amount to spend on something, I’d personally rather it be a good quality product that won’t break the first time I use it.
    $5 for a pizza cutter that lasts a couple years is a GOOD DEAL. $5 for a DISPOSABLE pizza cutter that cuts A SINGLE pizza then turns into garbage is a RIPOFF! And that’s not to even mention the product itself potentially poisoning you and your family, contributing to LITERAL slavery, destroying the planet, killing wildlife, etc, etc, etc. With all those caveats, they would have to pay ME to use their shady products!
    I feel like if more people looked at these awful companies and their awful products through that lens, they’d realize they’re just willingly being scammed.

    I remember watching Dr. Oz & he was livid that all kinds of adds were using his likeness to push products! He warned his audience that none of the products were endorsed by him & that they were using his likeness without permission (so if he couldn’t get them to stop, good luck 😡)

    I am glad a lot more people are catching on to things like this because back in 2018, no one knew that these scams were even a thing. And companies like Temu took advantage of that! They hoped that we were dumb enough to not know any better, so raising awareness about this is the best way to go, aside from suing if you can!! And then idea that I need a PATENT, on my own face, is absolutely insane, and seems like a scare tactic to me.

    This is from a US law that applies to the theft of your image by Temu. It is from Elvis Presley's estate: "Estate attorney C. Barry Ward said rulings supported the contention that celebrities have an exclusive right, through copyright laws, to control and profit from the commercial use of their name and image during their lifetime." So when you figure out the date your image went up, you can charge a fee for every unit sold after that date.

    To be honest no matter if it is a Company or privat persons... there are so many people who are stealing images from others....I got scammed very badly recently and even more bad things happened. Guys be very cautious no matter if it is something you want to buy or people who want to get to know you through the internet.
