The War of 1812 is a draw no matter how many Canadians or Brits disagree. Just read the Treaty that ended the war. No land or territory was gained by either side, and the Americans burned down Canada's capital as well. It's probably the most easily defined draw you could find. No territory lost, no territory gained, and both sides got a bit of what they wanted in the end.
Victory or defeat is based on the goals of the war. The US's goal was to take Canada, the UK and Canada's goal was to not be taken over. Only one of those goals were achieved. Therefore, Canada won.

If for example russia were to give back / lose all ukrainian territory they currently occupy and then the war ends, no one besides russia would call it a draw (and even then they would prolly call it a victory somehow).

Looking at it, on the battlefield it was a draw. Yes britain burned DC, but they failed to take baltimore (their main goal) and left. The US likewise did the same with burning York. The US achieved 3 of its 4 goals, including the primary one. Ending impressment and the blockade of France, weakening indigenous power allowing for westward expansion, and confirming national sovereignty via a 'second war of independence, but failing to gain any territory. I can't really see how it's an American loss, unless you believe the only thing that matters in war is territorial gains. A lot of people seem to believe that the main war aim of the US was to conquer Canada when that's just not supported by the information we have about the war. Of course the reason they achieved their primary goal was that impressment and the blockade weren't important after napoleon was defeated, so it's tough to say that the US 'won' that.
