    When I had jury duty with the district court last year (population in the district is almost definitely larger than this one), I was one of about 55 people pulled for consideration for a civil trial. There were almost 1000 people called in that day. The other 945 got dismissed after lunch because the criminal case they were marked for ended up taking a plea agreement over lunch. I have no idea what case that even was. So to my inexperienced mind doesn't feel like 1,800 people is a wild amount for something like this.

    I find this whole thing just such a stretch the entire justice system is a game of social psychology and moving venues won't solve that

      This. I don't know how well you will respond to it, EDB. It's angering and frustrating and not quite murder of a child (not the fetus), but it is definitely heavy on the crimes against a kid.

    I grew up in Boise. It was and still is very conservative. Also Ada county just gave Daybell the death penalty.. soooo

    If I were JJ, I’d move it to one of the closer counties. Every county has similar levels of pre-judgement and media interest, but my deciding factor is the post-trial pressure that might be put on the jury. If you move it Nez Pierce, you are close enough for convenience and you remove some of the key factors like neighbor pressure, local knowledge of the house and law enforcement personnel. But compared to Nez Pierce, there’s no advantage to ADA in terms of pre-taint percentages.

      Ada is 10x bigger by population with slightly more diversity and is urban by Idaho standards. Nez Perce is similar to Latah. Rural people seem to be a bit more trigger happy when it comes to the DP and have higher trust in police.

      There is an argument to be made for how excited the people are about this trial and how much information has been spread in the area. If you happened to be in the area, would you happen to hear about it by chance? Would you care more than other areas?

      ​@@1nWaterBurning I would honestly say No. No matter where you go in Idaho, you're going to find people who feel closely connected to this case, bc alot of them attended U of I. I would say Especially in Boise. The Vandal alum is huge here. And info sharing has been spread universally throughout.
      But I do think neighbor pressure (or fear of retaliation or rejection after the trial is over) is definitely going to be a bigger factor in Moscow, simply bc it's a smaller town and the likelihood of running into someone you know or recognize is greater. But really you could go to any county outside of Moscow to reduce that potential issue. It'll likely be Ada though if the judge does agree to it.

      I read local news for both this case and KR on a regular basis. I assume thousands are doing the same throughout the US. The stats guy had so many assumptions that I have to wonder whether the data is skewed despite his testimony. Also don't trust a person who keeps asserting that we trust the "simple math" when we are dealing with a subject that involves both human nature and global access to local news - which is all he examined since he didn't analyze sources with pay walls.

    Ever since the Read Trail, I can't help but wonder how much things would have changed with a change of venue. The jurors literally feel unsafe in that case! So while I feel 300 miles is a little wild, I do think they need to move it to another county closer to the trial.

      You make a valid point about the Read trial. It was def an example of jurors feeling unsafe and pressured from the family, friends and police staring down the jurors. It even seems that one of the police was stalking jurors and got one of them removed with no evidence etc

    Emily! Replay crew member here. I am what I like to call a "recovering attorney" turned horticulturist - but used to practice criminal defense - including murder specifically. My hubby is a high up managing public defender in our state and regularly has high profile cases including murder. So we are both very familiar with making venue motions.
    Just wanted to note that at 47:25 you're discussing the reality of people who want to see the story and follow it, being likely to do so on the internet regardless of residency. For the purposes of the defense argument right at this juncture, (presuming I'm reading it correctly based on our lawyering experience) this area is more centered upon the average local media consumer that is NOT intentionally following this story or looking for information on this case. RATHER, it is regarding the likelihood of inadvertent exposure simply by participating in local news consumption for those who regularly participate on a generic level.

    I just dont understand why they didn't send out Jurry questionnaires and see what came back. Of it was flooded with people who knew too much or were impartial then widened the net or move it. This process has taken up so much time and it might not even be fruitful, because honestly those numbers aren't a huge difference it's all very close.

Just curious because Ann Taylor sounded like she was speaking SO slowly almost like she wasn’t talking to PhD’s but was speaking to a toddler. I hadn’t noticed this in prior hearings with her but it was just getting on my last nerve today.

    My high school in Alaska goes to the Jazz festival every other year. I also have friends that live in a Idaho that i graduated with. I think the impact on the jury pool will be just as bad locally as another county.

    Observing EBD's response to Eldeman highlights how emotions can distort information. She was so affected by his initial attitude that she overlooked the fact that he was discussing probabilities, not claiming that more information in a case always leads to a stronger belief in guilt.

    Last week, I read local coverage from Boston while reading up on the latest in KR's case. I live almost 1,100 miles Southwest of Boston. I suspect that a deep dive into the a priori assumptions hidden in all this data would tear apart its credibility, though I am admittedly biased in believing that you should actually try to form a jury before relocating.

    Replay crew. As a social science researcher I LOVED this. I know it's not your thing EDB, but what we do is real and important and backed by science. Dr. Dahir's testimony is addressing a lot of the critiques you had of the previous testimony. And double barreled means that Two questions have been rolled into one sentence, and that is bad methodology because the respondent is a only allowed to answer the two questions as one. An example would be "Yes or no, do you think kids should learn both civics AND science in school?"

    I was wondering... (I hope this isn't a silly question...) Rather than moving the trial to a different county, could they get the jurors from a different county and move them to Moscow for the trial, sequester them somewhere during the week, allowing them to go home on the weekends... would that be easier and less expensive? I know it would be an imposition on the jurors, especially if they had children... but, idk, I'd like to hear your thoughts about that.

    I dont think this guy knows what he is talking about. The more knowledge someone has about a case they think the defendant is guilty. Um Sir, let me introduce you to Karen Read. Most of us watching this have a vast knowledge of that case and KNOW she is innocent. That statement was ludicrous. The more Ann Taylor speaks the more I dislike her.

    I seriously doubt that the venue gets changed. I’m in the Philippines and a lot of people here know about the case. In order to get an impartial jury the trial needs to be moved to another Galaxy altogether.

    We don't have a jury system where I'm from, but I have always found it odd that the ideal "jury" is a completely uninformed jury consisting only of people who don't even watch the news. Rarely do we ever otherwise want an uninformed person making important decisions.

      It's a jury of peers. People "like" the individual on trial, rather than a "chosen few" empowered with the fate of people's lives. Power to the people. Our government works for us, not the other way around.

      ​@@JanetSmith900 But if all people who watch the news and stay informed about what happens in their area are considered poor choices for jury duty due to possible bias - then it's not really your peers, it's a very specific kind of person isn't it? I guess I just don't quite understand how that selection doesn't cause major demographic issues that also lead to bias? For example, I would expect the demographic that won't watch the news (at least where I am located) to be less inclined to listen to expert witnesses + science based evidence and more likely to just decide on "feelings".

    I live 10 minutes outside of Moscow ,Id. Boise is fine with me, expensive, yes, but one less appeal. Daybells were tried there. Didn't work out for them. The only reason for trial in July 2025, because of it being a college small town, and no accommodations for media , etc. Personally, a stronger judge would be great.

    I wish we knew what instructions - if any - were given to the survey correspondents before being asked to share what they know about the case. Do they know that the goal of the question is to figure out much they know? If not, I can see a lot of people assuming that the surveyors wouldn't want to hear a 2-minute explanation of everything they've learned, "what the media reported" is much easier and shorter to say.
    I know that if I was asked the question without understanding that goal, I'd probably say everything I could think of without really trying to wrack my memory. But if the goal is full knowledge, I would try much harder to remember as many details as I could.

    These experts (I’m halfway through the second) explain thoroughly why I’m happy to live in a country that
    1. does not publicize anything about a suspect beyond ‘this person has been arrested/is charged with/is standing trial for this crime, and
    2. does not have jury trials.
    The average person on the street (me included) has almost no idea about anything related to law, law enforcement, or trial law.
    Let people who know the law and how it’s supposed to work judge whether the facts of the case prove someone’s guilt. Without the inherent bias of extensive media coverage, and the inability to counter their bias because they have to learn a new trade (law/jury) at the same time. Remove all possible political affiliations too. Law should have nothing to do with politics; don’t elect your judges. Same problem as with juries: the lay person has no idea who would be a good judge. And political affiliation should not influence outcomes of trials of law.
    When that’s done to the best of our abilities, there will still be plenty of bias left that judges will have to counter. Miscarriages of justice will still happen. But at least we’ve tried everything we can to hopefully prevent it.

    I always have a feeling that Ann Taylor starts off strong but then becomes too confrontational the longer her argument goes on. In this case it felt a bit like she was trying to have her cake and eat it too with the constitutional argument. Their own polling data shows similar or same levels of bias regardless of what county they go to and it didn't sit well with me that she tried to tell the judge not to consider other counties that they hadn't polled. In my thought process, the judge has to protect Kohberger's constitutional right to a fair trial above all else and if he decides that Laytah County is prejudiced against Kohberger, then surely all of the other counties which showed similar levels of prejudice are out as well?

    When the truth doesn’t help your client, blame the people reporting the truth about your client because the truth doesn’t work in his favor? The truth being reported doesn’t allow for you to spin and manipulate? Ann saying this, on the record, isn’t for the judge. Spin, spin, spin….

    I fundamentally don’t trust an expert who has theoretically reviewed an immense amount of local coverage but still can’t pronounce Moscow right.
    I live in the area and all my news comes from RUclips and there aren’t any Lawfluencers locally covering it except Andrea Burkhart 🤷🏻‍♀️ so almost none of my case coverage comes from anyone close to me. Theee experts sound so behind the tech.

    It feels offensive for the victims' families to break this down to such a granular level... Like he's more of a victim than they were. I understand due process but it feels a bit indulgent? :/

    For me, he whole argument of he can't have a fair trial here because people know too much is, I don't know. With this logic, no trial could ever be held where the crime happened, especially if it's a small town. And them having this hearing will make people (and therefore potential jurors) talk and know even more, anywhere in Idaho. And people in Boise who didn't pay much attention to the case before may do so know because they have heard the trial may move there 🤔

    2:27:41 Not sure what you're using but on Windows, could you turn on your Night Light mode and bump it up to reduce the eyeball/brain fry? Could you have it turned on for your screen but it appear without Night Light mode showing in the stream for viewers who prefer it au naturel b&w contrasty glory? (I'm kinda suspecting you can't, but I'll bet my shiny dollar that most of us won't mind and will actually appreciate it if you turned on Night Light mode cranked up to yellow as fuck, as I almost always have my laptop set to lol).
    Sensory processing and sensitivity is a bitch, but thank the digital heavens for dark mode becoming a normal thing now. Now I just need a cure for misophonia lol.

    If i ended up on this jury id find it hard not to hold it against Ann Taylor alone to have to miss out on 4 months of work. She may need to seriously consider how many people are gonna be upset with her for putting on a trial.That's going to take four months. I'm sorry, but that is absolutely ridiculous. That she cannot defend him in a trial shorter than four months. If that's truly the case, then we definitely need to expect some mess and shadiness, because there's just no way.

      You do know most of that time is actually for the prosecution’s case and their rebuttal right? The timeline is that long because they are trying FOUR murders with tons of evidence and witnesses. I believe this timeline includes the penalty phase as well (if found guilty) as it is a death penalty case. It has nothing to do with Ann Taylor. I don’t understand why you would think that it’s her fault??
      Also everyone has the right to a fair trial which means they are entitled to a defense. It’s literally in our constitution. Do we really want to automatically start sending people to prison without a fair trial because Crystal doesn’t want to do jury duty?
