Re Kohberger case. Having been in the same situation as the parents of the victims of this case (not as a parent but as a sibling however) I have to say, it shocks me that the parents are given so much cache - despite them feeling they are being ignored. This seems to be an American thing. Where I come from no one gets to talk with abandon about a case yet to be determined. Let alone before a jury has been chosen. It's frustrating, but you have to trust in your judicial system (unless you're in Massachussets). I will miss Judge Judge...I think he is a very fair judge....and I'll miss saying Judge Judge.
While I really do feel for the victims' families, and victims of crimes more generally, it makes sense that the defendant's rights have to always be a priority. For the very simple reason of what if they're innocent? In any criminal case, I think people need to remember that defendants are presumed to be innocent - the idea isn't that a murderer has more rights. The idea is that a *presumably innocent* person is being accused of murder, and so their rights need to be protected
As harsh as it may seem, it is not the responsibility of the court system to help heal the community or, again it may seem cold but it is not beholden to the families of the victims. Yes, it is terrible and we all feel for the families and the community as a whole but we have to understand the court's role. The court has a responsibility to find justice fairly and impartially. If we allow emotions to rule the court and its decisions then the system fails and justice is replaced by vengeance.
Absolutely agree. I myself find it easy to compartmentalize and discuss things like autopsies and quantities of blood and see how the disconnect from emotions help ensure justice and preserve rights of the defendant (and ultimately make sure convictions happen because of facts and evidence, not cuz this guy was hated or that girl is annoying), and prevent vigilantes and revenge/retaliation. I can understand how it feels cold and callous and shoves victims to the side, which yeah it does. So things we can do to help that I'm all for and all the attention on "true crime" and our justice system and lawtube I think it's good and gives voices to the victims as we hear and tell their stories and demand changes. I enjoy watching trials because I want to hear the evidence for myself (the drama is always an added bonus but others don't tend to get the scandal off it without much explanation), and I like to challenge my critical thinking and consider the truth of the matter. I don't "enjoy" true crime for the gruesome details but to remember the victims and see justice being served

Part of my recent learning has been all about not panicking and attempting to over-explain, and then panicking about the explaining and then trying to fix it, and then explain why I needed to fix it because I didn't quite mean that, and then panicking about explaining the explaining of the fixing that I needed to do to fix the over-explaining.
I honestly feel courts streaming the proceedings, and not allowing media to record in the courtroom is the most appropriate. It does serve to prevent prejudicial or even predatory filiming, helps protect family members and any victims in the gallery, and ensures a more accurate record.

@@alexisw28586 The accuracy is ensured by having full public access even to people outside of the jurisdiction, that is not kept behind paywalls such as cable TV, nor requiring someone to view it with potentially biased commentary. Correct the jury is not permitted to watch trail coverage, but a - there are many things pretrial that potential jurors can and perhaps have seen. Ideally they wont have but we do not live in an ideal world. Additionally prejudice is not just limited to the jury alone, but also to the general public. The presumption is innocence, and not just for the jury.

I saw the Daybell trial and it was handled very well and tastefully. The autopsy pictures were only seen by the jury and the litigants. Judge Boyce did very well. I would expect the Koberger case will be handled well. I watched the case with the Its a crime channel run by a Canadian gal. Liberal Boise handed Chad six death sentences. In my case government overreach upsets me and Karen kept bitterly asserting that it was a great big cover up. After the Birchmore murder broke it seems Karen may be telling the truth. Some of the officers in Read are involved in the Birchmore coverup.
It was a cover-up. The trial defense at her trial really laid it all out. Everything is in their favor: The evidence, the witnesses, etc. The investigation into the family whose property he was found on was not done. They were allowed to redo the flooring on their basement and sell their house, making it inaccessible as evidence. They were allowed to "rehome" their dog, and had the records impounded, when John's body had bite marks on them. I encourage you to go watch the trial testimony. There's so many details that don't add up. Among them, the prosecutor was sending the most vile, disgusting texts and sharing sensitive details about Karen Read while he was supposed to be conducting an impartial investigation.
I’m local here in Boise and was lucky enough to be able to attend most of the Daybell trial in person. I agree that Judge Boyce handled things really well. Whatever Judge does get assigned this case, I hope they consult with Judge Boyce to get some tips for how he handled a high profile trial. Especially they do move it to the Ada County Courthouse. I think you already knew this, but yes, even in the courtroom, those of us in the gallery did not see the autopsy photos. The attorney’s at their tables had their computer screens flipped around too so that people behind them in the gallery couldn’t see. Also, during a recess, the judge had us move seats so that we were all cozy and squished together on one side of the courtroom. The side away from the jury. Just to make sure that there was no chance anyone in the gallery could see anything on a jury computer screen. And also I’m guessing so that nobody in the gallery would be a distraction to the jury during that time. Judge Boyce was really concerned with that in general. He always blocked off the court pews next to the jury. And on the off chance that the courtroom wasn’t full, he always made everyone sit in the opposite side of the room from the jury. And if we all wouldn’t fit there, he start filling up the side with the jury, but always starting with the back row first.

KM just doesn't know when to stop. The judge keeps delightfully shading her in her rulings so I am here for it but my goodness KM should stop now. She only has herself to blame for this case being dismissed with prejudice. She should take the loss with dignity and learn from it so she doesn't make the same mistake the next time. I understand the family's frustration also. I also tend to fall back to we need the system to work for the worst possible defendant so that we can have faith that it will work the same way for the wrongfully accused. I think a lot of people tend to forget this.
Did Kerri get her law degree at University of the Fire-Chicken? We’d get writing samples from grads of University of Phoenix for our grad program- they were almost universally rejected. No discernible thesis, grammar issues, incorrect or missing citations, incomplete or undetectable research , no use of primary sources, incorrect formatting and page requirements . They had no idea what was required. And- they whined a lot about the application process. Good grief!
I 100% understand where the family is coming from. However, you have to presume the defendant is innocent and imagine an innocent person, being threatened with execution by the State, knowing that the people around him believe him to be guilty and are willing to sentence him to not only remove his liberty, but his life. These rules are just cuz the system doesn't care about victims (tho in many cases this is true and a Problem) but to limit State power and prevent innocent people from being deprived of their basic rights based on public sentiment

For the Kohberger case: It's my understanding now that it wasn't the change of venue that was the difficult decision for the judge, but he must have already known that he would pass on the case.
I hope the victims family in the BK case have a better Victim advocate than my family does. My brother in law was killed and the VA has done nothing to help! They don't even talk to us! The person is apparently out on bail now and our family is just finding out. It's so frustrating.
I have had struggles in other areas with the VA, and have found that they will respond if you call your Senator and get them involved. Truly - if you haven’t done that yet, it can be effective. They get busy quickly when a Senator says, “so why haven’t you taken care of this vet?” Good luck and many blessings as you go forward. ❤
I am still watching, but regarding the local authority ability to provide security? They simply don't, I'd wager. The population of Moscow ID is likely going to triple or quadruple if the trial is held there. They probably don't have enough freezer space in the restaurants to FEED the number of people who will descend on that little town.
At this point I am actually worried about KM's mental health. She didn't seem well the day the trial ended and she has spiraled so much. It's like she's in a manic state of hyperfocusing on trying to change the Judge's...(or really anyone's) mind about the case. I wonder if she is even eating and sleeping and who she has for support. Her 52 page motion to reverse was just her way of notifying the defendant's of her intent to appeal. That's all. It's possible she goes on a Brady list which could prevent her from working as a prosecutor. She is also facing bar discipline for her role in permitting false testimony (the evidence tech and the deputy). She could lose her license. Her lapse in judgement is monumental.
I don't think Judge Somner can let the motion stand in waiting for a response from Baldwin's team. The State is already too close to the hook for malicious prosecution, if Baldwin wanted to go there, and every filing after the dismissal date will only continue to exacerbate the issue.

I'm here for the Idaho update. Been watching the Young Thug trial. Perhaps Judge Judge has seen the criticism of many other judges around the country, like Glanville in GA and the one in Karen Read case and decided he didn't need all that heat. Just a theory. At this point, I've lost much faith in our judicial system. Courts seem so biased towards the prosecution, that seems to be the same in all these cases I've been watching.
In regards to Idaho, in the two Daybell trials which were relocated to my county (Ada) the judge followed both cases. I'm not sure if that was his choice or someone else's. Latah is a much smaller county than the two counties that were involved in Daybell.
Agree completely about wanting more free press. That's why I watch multiple RUclips channels with different ways of doing things and questioning things. Some have similar focus, but in different ways adding different things to the conversation. MSN just doesn't do that.
My Mom always told me: “if you treat every task in life like it’s the most important to get correct, when the truly important things eventually do come along, you will have the good practices already in place to handle it”. I have kept this practice up as much as possible and it has made some truly horrible and stressful situations so much easier to handle. Had Kari treated every case before her with the upmost care and followed all the rules and double checked everything including her own work - the most important case of her lifetime that truly mattered to her wouldn’t have been so royally fluffed and tossed on a rule technicality 🤷🏻♀️ Hard lessons to learn - if and when you actually learn them (and it sounds like she has learned nothing tbh)
I remember this case. A federal district court dismissed a case with prejudice. The Appeals Court overturned the conviction. I haven't read it, so I don't know how on point it is. That’s like what Judge Boyce did in Boise for Chad Daybell’s trial. He used his judge RUclips feed to broadcast. The first few days of trial, the audio was garbage. But then, over the first weekend, they did something about it, and after that the audio was perfect.
"Even without a finding a presumed prejudice, venue in this case must be changed "for the convenience of parties and witnesses, and in the interest of justice." I.C.R. 21(b)... I brought this up in some channels before this decisions was finally made and people could not understand the point I was trying to make. There you have it peoples! The state already knew that the case was going to be moved. The defense faciliated their goal. The unwillingness of the state to bring expert witnesses to prove otherwise, imo, indicated that. My 2 cents.

I understand the family's frustration also. I also tend to fall back to we need the system to work for the worst possible defendant so that we can have faith that it will work the same way for the wrongfully accused. I think a lot of people tend to forget this.
Did Kerri get her law degree at University of the Fire-Chicken? We’d get writing samples from grads of University of Phoenix for our grad program- they were almost universally rejected. No discernible thesis, grammar issues, incorrect or missing citations, incomplete or undetectable research , no use of primary sources, incorrect formatting and page requirements . They had no idea what was required. And- they whined a lot about the application process. Good grief!
My mom was considering finishing her degree there, but things changed and she was unable to return to school at that time.

I 100% understand where the family is coming from. However, you have to presume the defendant is innocent and imagine an innocent person, being threatened with execution by the State, knowing that the people around him believe him to be guilty and are willing to sentence him to not only remove his liberty, but his life. These rules are just cuz the system doesn't care about victims (tho in many cases this is true and a Problem) but to limit State power and prevent innocent people from being deprived of their basic rights based on public sentiment

@EDB Why doesn't the Kohberger court just do what Federal courts do and bus/fly in jurors from other jurisdictions?
They don't have room/staff/security or facilities for all the people who would be filtering into the town.
Moscow can't afford that. Federal courts have access to unlimited funds.
It’s going to be a 3 month trial. Would you want to live away from your family in a hotel with no access to your phone or a TV for 3 months?
For the Kohberger case: It's my understanding now that it wasn't the change of venue that was the difficult decision for the judge, but he must have already known that he would pass on the case.
I hope the victims family in the BK case have a better Victim advocate than my family does. My brother in law was killed and the VA has done nothing to help! They don't even talk to us! The person is apparently out on bail now and our family is just finding out. It's so frustrating.

I have had struggles in other areas with the VA, and have found that they will respond if you call your Senator and get them involved. Truly - if you haven’t done that yet, it can be effective. They get busy quickly when a Senator says, “so why haven’t you taken care of this vet?” Good luck and many blessings as you go forward. ❤

I am still watching, but regarding the local authority ability to provide security? They simply don't, I'd wager. The population of Moscow ID is likely going to triple or quadruple if the trial is held there. They probably don't have enough freezer space in the restaurants to FEED the number of people who will descend on that little town.

At this point I am actually worried about KM's mental health. She didn't seem well the day the trial ended and she has spiraled so much. It's like she's in a manic state of hyperfocusing on trying to change the Judge's...(or really anyone's) mind about the case. I wonder if she is even eating and sleeping and who she has for support. The state really needs to cut her off from any further legal actions.

Keri took the bait and highhandedly denied it's existence. the judge second guessed the denials and allowed a hearing on the denials

Her 52 page motion to reverse was just her way of notifying the defendant's of her intent to appeal. That's all. You think she's going to leave it to the appellate judges to look all that stuff up??😂😂😂 Omg. Puts the defendants on notice that this is what they're going to have to argue in the appeal. It's all cut and paste anyway. Unless she's got some whiz bang legal app to do all the hard stuff for her.
@@fedfraud.protection.servic2557 you are not appreciating the fact that the dismissal can't be appealed. She got caught as bad as a prosecutor can be caught. It's possible she goes on a Brady list which could prevent her from working as a prosecutor. She is also facing bar discipline for her role in permitting false testimony (the evidence tech and the deputy). She could lose her license. Her lapse in judgement is monumental.

I don't think Judge Somner can let the motion stand in waiting for a response from Baldwin's team. The State is already too close to the hook for malicious prosecution, if Baldwin wanted to go there, and every filing after the dismissal date will only continue to exacerbate the issue.

I agree with the comments ppl are making about Kari, I too have wondered also if she is in a mental break of some sort right now, even watching her the last day of trial she just kept saying over and over “ do these rounds look the same as to what was found on the set of Rust?” Then she kept bringing up HGR’s trial about being convicted, she could not see what everyone else was seeing, it was extremely offsetting to watch her. And clearly she has not moved on!

I'm here for the Idaho update. Been watching the Young Thug trial. Perhaps Judge Judge has seen the criticism of many other judges around the country, like Glanville in GA and the one in Karen Read case and decided he didn't need all that heat. Just a theory. At this point, I've lost much faith in our judicial system. Courts seem so biased towards the prosecution, that seems to be the same in all these cases I've been watching.
In regards to Idaho, in the two Daybell trials which were relocated to my county (Ada) the judge followed both cases. I'm not sure if that was his choice or someone else's. Latah is a much smaller county than the two counties that were involved in Daybell.

Agree completely about wanting more free press. That's why I watch multiple RUclips channels with different ways of doing things and questioning things. Some have similar focus, but in different ways adding different things to the conversation. MSN just doesn't do that.
My Mom always told me: “if you treat every task in life like it’s the most important to get correct, when the truly important things eventually do come along, you will have the good practices already in place to handle it”.
I have kept this practice up as much as possible and it has made some truly horrible and stressful situations so much easier to handle.
Had Kari treated every case before her with the upmost care and followed all the rules and double checked everything including her own work - the most important case of her lifetime that truly mattered to her wouldn’t have been so royally fluffed and tossed on a rule technicality 🤷🏻♀️

That’s like what Judge Boyce did in Boise for Chad Daybell’s trial. He used his judge RUclips feed to broadcast. The first few days of trial, the audio was garbage. But then, over the first weekend, they did something about it, and after that the audio was perfect.
"Even without a finding a presumed prejudice, venue in this case must be changed "for the convenience of parties and witnesses, and in the interest of justice." I.C.R. 21(b)... I brought this up in some channels before this decisions was finally made and people could not understand the point I was trying to make. There you have it peoples! The state already knew that the case was going to be moved. The defense faciliated their goal. The unwillingness of the state to bring expert witnesses to prove otherwise, imo, indicated that. My 2 cents.
