It's such a pain in the behind to go through this process for the AI stuff. I had a look a while ago and really wasn't sure that I wanted to bother with it at all - and I haven't. I guess there might be good sales if only the truly committed do this and the pool of released images stays 'relatively' small....

Good question, you only need one release. The "property" is the artwork in its entirety, irrespective of what it depicts; but if the person(s) in the photo was based on a real person then you'll need a model release for each of the individuals depicted in said photo.

Thank you. I appreciate this video is 11 months ago but I think this has changed. Just so I am 100% clear on this, if I generate an image using Midjourney V6 and it is a close-up portrait of a 'fictional' person's face, facing 'camera' then I would need a signed model release. However, I don't know the 'person' so it would be impossible to get a signed model release. So therefore avoid showing a recognisable face in case it strongly resembles a real living person and you could get sued? Is that correct? I've seen lots of images on Adobe generative AI where a 'person' is facing camera but these images must be without a signed model release? I'd love to know your thoughts on this. To me the risk is the AI face could resemble a living human and you could get sued for damages.

Hey there! I'm not a legal expert or anything, but I can share some general info. So, AI-generated images can be a bit tricky when it comes to copyright stuff. If the person who made the image with AI can show it's unique and creative, they might be able to claim copyright, but it really depends on where they are and the situation.
Even if there's no copyright, selling someone else's AI image without asking could lead to problems, like legal fights or bad rep. Plus, it might go against the rules of websites or platforms you're using. It's always better to ask the creator for permission or chat with a legal pro if you're unsure.
People have successfully copyrighted AI generated content. Search google for "kris kashtanova copyright" and you'll see an article by the verge talking about how she successfully copyrighted AI content in the U.S.
Just remember I'm not giving legal advice here, and you should reach out to a legal expert for real advice.

so much effort and then you will earn in 12 months 195 dollars, while hundreds people have downloaded it already...All the money are in pocket of someone else. People are really ok with this ? it's real robbery but nobody cares. I have many good pictures where the people are but I don't have any chance to put them anywhere because I will not do this. And if I would press myself, then after all this crazy effort with each single one picture - they will pay me the cents. . I am curious where this will have the end... Soon I will need the permission also from the cats and dogs and then I really don't know what and how I will publish as photographer. World today is trying to kill everything, also photography. To make a picture is more and more stress and fear than a joy like in old times. The world is just going to be crazy and very complicated and nobody cares. Nobody even noticed. :) But thanks for tutorial. To be honest I still didn't understand the point (that theatre behind this) but obviously I am the only one who is tired. I miss the old world where we should live in normal freedom , today is all just slavery with one million rules and responsibilities , then people are tired, of course they are. Model... omg. Before models where only in the studios or working with agencies for money but today is a model everyone and everywhere, the world is suddenly full of models :) I can't make a step without models.

Thank you for taking the time to share your perspective. I understand your concerns and frustrations, and I appreciate your honesty. So, let me address your points:
It's true that the financial return from selling generative AI portraits or any other digital assets might not seem substantial at first. However, like with many things, it often starts small and can grow over time with consistency, quality, and a good understanding of the market needs.
The rules about sharing images with people in them can indeed be complex due to privacy concerns. However, these rules are in place to protect individual's rights.
Your concerns about the increasing difficulty in sharing photos, even humorously suggesting needing permissions from animals, highlights how complex these processes can become. As technology evolves, the rules and systems are also evolving. This is often done with the aim of balancing creativity, freedom, and respect for rights.
I empathize with your sentiment about the loss of joy in photography due to increasing complexities. It's essential to remember, though, that every era has its challenges. As we adapt to new systems and processes, we find new ways to enjoy our passions.
Nostalgia for simpler times is understandable. However, these modern platforms also offer opportunities to reach a global audience, something that was harder in the past.
I hear your point about the increasing use of everyday people as models. It's a change brought by the democratization of photography. Everyone can share their perspective now, which can indeed feel overwhelming but also enriches our visual landscape.
I'm glad you found the tutorial useful, even if some parts were unclear.
I appreciate your engagement and your critique. It's conversations like these that help us all grow and adapt to the evolving world of photography and digital art.

@@rohaneh Thank you for your reaction.
The photographers are giving their beautiful high quality work almost for free. In other profession all is so expensive but here I see it's not the balance between the quality of one picture and all the effort spending with it and the price that agencies are giving to artists. I don't know how much time you spend with one generated picture, but with normal camera - you will need to prepare all for the shoot, lights, artefacts, models, whatever, a lot of things, then you have to open Photoshop, prepare picture before publishing, then upload it with all the documents and then 10 cents after all. And in January PAP back in level 1. Great.
Good picture in high quality has to have some value, for sure not 10 cents :( If this is a price for your work - then your work is worthless (in financial aspect).
Each picture needs to have own documents, the child in the middle of nowhere, in Africa... his name, email of his father (who even can't read), address, witness, omg. It's not normal. I think this all theatre is because of some possibility that someone can complain. They could make ONE agreement with each contributor where the contributor with his signature will take all responsibility for HIS/HER pictures and that's all.
Don't think that needing of permissions from animals is some kind of humor :) Imagine that today the child can decide if she/he wants to be man or woman :) In this light nothing is really funny here anymore.
Sometimes I feel we are not ready for any progress in way of technologies. For example social media today - youtube channels etc. How terrible impact all these has on our children :( Empty battery on phone means almost death sentence ;) We can't find the Zoo without Google Maps :) New generation is hardly damaged by social media and nobody cares, but some face visible somewhere is the biggest issue ever. Something went wrong here.
I understand all this "fashion" in human rights. But. I feel like it's going to be too much. It's starting to be not balanced anymore. We are changing human rights for all the possible freedom we ever had, our grandfathers were fighting for, giving their lives. What was photography about ? To keep authenticity for new generations. To keep reality from exact moment forever. To show emotions, feelings, in authentical way. And today ? All is moderate. All is acting. All is planned. Then for what we need photographers today. Just let's make all what we need by AI. We can generate what we want. We can generate whole our reality. Is it not real ? Not truth ? Who cares.
Enjoying my life and my passions is going to be more and more difficult. I liked to drive a car, a lot. In winter with hand-break to slide on snow in big opened areas. Today I can't do it, no hand-break in my car ;) and tomorrow I will be not able to drive at all. I will be sitting in my car, like in the bus. Finish. Soon we will be monkeys again. With all that progress we are not ready for.
I really understand you and your comment. Only for me it's like it's too much. It's going to the slavery again. And people in western world are complicate all for no reason. We don't have any big problems, we have a lot of everything. But once some big drama will happen, we will not think anymore if we want to be still men or women tomorrow ;)
Of course, critique, conversations, discussions, different opinion - all these is very important, it can keep us grow up. Once other opinion will be killed by authorities - it will be end of the progress. And I think this has already started.
I just don't like that money, photographers have from the agencies, I feel sorry for all that effort. You need money everywhere and not 10 cents. Everything so incredible expensive. Except of stock photography.
