      I don't think he was pandering at all. I also think they should've continued the trial, but claiming he is pandering is wild. He went to case law for guidance, which said they searched 4 days for the defendant, then finally continued. Simpson did what he felt was right.
      Also, I'm pretty sure I heard him say that transport had taken bloom back before his lawyer got to speak with him. So he wasn't advised of his right to be there or the potential consequences of not being there.

    Wow the lowest of the low to attack a nurse while he is trying to give him medical care. If he was so unwell as the lawyer describes he should have been desperate and grateful to have health care worker pay attention to him. It shows though that he could not control himself around someone else vulnerable in close proximity with him.. that he could hut. Gross.

    Agree with you, Mike. Also, you're in the middle of the prosecution closing argument. What is affected if the defendant isn't there to see or hear it? He can look at tape or transcripts....and HIS LAWYER IS THERE? WTH?

    • @vanessamw1140
      @vanessamw1140 Месяц назад +1

      Well, in this particular case it could've biased the jury against Bloom since judge Simpson abruptly stopped arguments and sent the jury out (especially since he did so in a stern voice and was obviously agitated about something). Then if the jury came back to see Bloom was gone, regardless of whether or not Simpson told them not to assume anything, they would still likely assume that Bloom was the reason for the pause and was sent away.
      Also, it sounded to me like transport had taken bloom back before his lawyer for the chance to talk to him. So he wasn't advised of his right to be there or the consequences of not being there

    • @jamesmclarey1075
      @jamesmclarey1075 Месяц назад +1

      @@vanessamw1140 My feeling on that is that Judge Simpson (and all judges with any trial experience) have had this sort of thing happen and he knows what to say to jurors and how to say it. He's not going to have a trial and then blow it or give one side or the other reason to appeal him.

  • @Lindon_Martingale
    @Lindon_Martingale Месяц назад +5

    As I understand the case law cited, the problem was that transport already took him back to the jail without talking with Mr. Bernstein. Therefore, if Bloom waived his right to appear, he wouldn't have been advised on the dangers of not appearing. It's because of his own jackassery, but it's not an everyday occurrence. So I get where Judge Simpson is trying to find comfort in an area with very little guidance.

    I strongly suspect Judge Simpson may have never had this happen before. He probably wanted to continue it out of an abundance of caution. However I've never heard of a Jury trial being continued like this for a week, Mike is absolutely right that you now risk Jurors not showing up. That seems pretty unusual.
    The Judge should have immediately resumed the trial after the break where Mr. Bloom had an opportunity to speak with his attorney. Whether Bloom took the opportunity is up to him.

    I would have voted not guilty. I’m not convinced beyond a reasonable doubt. Knowing they had another angle of footage & it wasn’t provided, whether it would have been a clearer view of alleged crime or not, that gave me more questions that they did not get the answers out of their witnesses nor exhibits. But jurors are dumb af lately. And most prosecutors are soulless. Also they have a lot of criminals that ARE guilty. We just need honest & fair prosecutors to put on a legitimate case with out cheating. If a person is guilty, then cheating is not needed. Not saying this prosecutor does any of those things, I’m just speaking from my observations over the last couple of years. Thank God for criminal defense attorneys, because we wouldn’t have any rights left… anyone from any walk of life could find themselves going through the court system whether u broke actually broke the law or not. Nobody is exempt from prosecution..

    So, I'm right at the beginning of the first witness statement (btw thanks Mike for the Mr. Allen-stop 😊) and I'll be taking bets with myself ref how long it will take untill Bloom starts with his facial cringing, hand "movements" and finally firing poor Bernstein because he is not having the stage for himself and doing the talking, respectively his lawyer doesn't say exactly what he wants him to say. Imho it won't last long.
    What he did was truly awful and disgusting. When he was sitting on isolation there was a good reason for that.
    They need to give him medical attention and he even uses such a moment for his evil doings. The question imho is whether he planned that in advance.

    • @gast4215
      @gast4215 Месяц назад

      Added: well, this didn't escalate as quickly as I thought... 😅
      But at the end I don't think that the prosecution made their case. Even those officers standing directly besides the victim did not see the "door-slamming". Although I can imagine Bloom doing all kind of things, I don't see this as a crime proven without a reasonable doubt.

      I've taken to watching the show, 60 Days In. Average citizens volunteer to spend time in jail to observe and learn, then report back to the sheriff about where issues are. That way, it not an inmate worried about snitching or an undercover CO who might try to cover for some bad COs.
      Some of the stuff they show is kinda infuriating. At least, as the show presents it, the COs will outright ignore medical issues. One participant had been an army medic. One guy was balled up on the floor in severe pain and the medic did a quick exam and suspected appendicitis. It took forever for someone to actually pull the guy out. But he wasn't gone long before he was put back after having been given some Tylenol or something.
      In another season, one guy hit the emergency button in his room and never got a response. He had to use the distress signal for the camera crew to come get him to have his issues addressed. At the end, after his feedback, that was looked into and if was found that some of the cells were even missing their buttons. By the same token, it showed at least one guy repeatedly hitting the button to shout at the female CO who responded that he loves her.
      Same season, dude was kinda exhausted and swung around to look at a sound he heard and smacked his face into the metal stairs. He was taken to medical. One CO wanted to send him back when he wasn't actively bleeding anymore. Medical actually looked at him briefly and said to keep him because he might need stitches. In the end, he waited in medical for about 8 hours before they glued him and sent him back.
      You see the abuse of the "medical" excuse all the time in body cam videos. You know they don't need to be seen especially when they end up refusing to be seen, but the cops are required to call for it anyway because of the few people who weren't crying wolf. It would not surprise me at all if Bloom were crying wolf. I'm not sure that he planned to hurt anyone in advance, but he's an extremely violent person and I imagine that it's probably common for staff to have a violent encounter with him.

    I know the defense is trying to discredit the victim's testimony, but doctors tend to describe what they think a patient is telling them. The medical report is written by a doctor and not the patient, nor does the patient read and sign the report as true and accurate. Also, the victim's testimony that his hand was on the cuff when the defendant pulled back is helpful to the defendant in backing up that there was no intent. I'm not finished watching yet so I haven't decided guilt or not.

    Bloom is a narcissist who thinks that no laws should apply to him whilst the world should revolve around him.
    He is a P.O.S who has no problems throwing tantrums and attacking anyone who tells him no or doesn’t give him what he wants, when he wants.
    He is also a huge attention seeker who loves dragging everything out for as long as possible, just to keep everyone focused on him.
    He always tries to control the situation he is in because he wants to make sure everyone understands how special he is.
    He has wasted time, resources and costs with endless arrests and then the constant messing around until things finally get to court.
    In my opinion, he should be jailed for a long time, both to protect the public and teach him a lesson. He took up everybody’s time so, he should have his time taken. I also think he should be made to work the entire time he’s locked up, with all the money going to victims, the police and the courts, for all the resources he wasted. He should also be told that for everyday he throws a tantrum and refuses to work, he cannot be released until he has worked those days.

      He was accused of sodomy and some assault and battery charges against a former gf/roommate along with their other male roommate (or common friend?) . The female that accused him had her own prior convictions, was in jail around the time he was initially locked up- on unrelated things, while incarcerated herself she testified against him at his trial, and she has a heavy drug addiction. In other words, not the most trustworthy or reliable individual 🫨
      bloom was extremely adamant that he was being set up by the female and that other male and denied the allegations from the start.
      This is what's from my memory and it fascinated me back then when it happened but to see how far things have gone and to see him still pop up like this and how much the court despises him beyond what is reasonable is ,at the least , EFFING STRANGE! it's bizarre and there's not much we can deduce one way or another unfortunately.

      @@jamesmclarey1075 This dude has been in prison for violent felony after violent felony since the 1980s, Simpson is bending over backwards screwing over Michigan taxpayers for what? This isn't a guy that will ever change or be a contributing member to society, Simpson chose the worst option at the expense of the Michigan taxpayers and those poor jury members that wasted their day and have to come back for this POS cuz Simpson has a soft spot for him for some reason...
      I'd have more respect for Simpson bending over backwards to help someone that actually took responsibility and had some remorse instead of for Bloom being a professional victim POS that has never shown remorse for his career violent criminal actions...ever.

      @@jamesmclarey1075 The thing is, Bloom's antics are funny in court and on video, but dude is a career violent criminal dating back 40-50 years and has spent most of his life behind bars. He's never shown remorse, will never change, why bend over backwards at the expense of Michigan taxpayers and the poor jury members that had their entire day ruined, and have to come back again? I'd rather see judges have a willingness to help people that are remorseful and show a will to change than some POS professional victim like Bloom.
      Simpson really angered me, he better make up for it on the 30th and stop showing this clown leniency for being a complete jerk in court.
      This is akin to Brady being a superstar in every game but the Super Bowl, and throws 10 interceptions and 0 TD's.
