My father and his brother bought a property which is 1800 square feet, Frontside plot of 1800 which is 825 square feet was bought by father and rear plot of 810 sq ft was bought by his brother. The problem is the way to the rear plot which is 165 sq ft, in our document it was mentioned as the way was left by my father but the area of the path was not included in our 825 sq ft plot because if it was included it should have been 990 sq ft. It looks like even in my father's brother's document it was mentioned as the way was left by him. So I am not sure whose way is that (165sq ft) because my father's brother has maintaining a large neem tree there which is just 4 feet away from my building so I am afraid that if it causes some harm in future who will be responsible for it. And the point to note is that my father's brother is maintaining that neem tree in a way that it won't cause any harm to their building and cutting down the branches going his side every now and then. When i ask to cut the branches that is coming my side , he is procastinating and at the end he is not doing it. Please let me know what legal steps i can take
in dominant and servient heritages owners are different if thy are with blood relationship likewise father and son ?is consider as different owner .or if father is dominant and married daughter is servient owner is this valid ?
