    This is a pretty legally dubious argument you’ve got here. I agree adobe terms and MS recall is at least a few shade of shitty….. but still….. rage farming much?

Agreement says "you give us a perpetual royalty-free unlimited license to do anything with your content" and you think "they can do anything with your content but you may not have the legal right to make that assignment" is "legally dubious?"     This is why I I use Linux and open source software exclusively. I quit using Windows after 2000. Been using Linux ever since.

    I stopped using Adobe Photoshop when they went to subscription-based SaaS (Software as a Service) and switched to Corel Paintshop and Corel Painter. There's always GIMP if necessary.
    For video editing, I use VSDC Free Video Editor.
    I'm sticking with Windows 10 Pro and have Win 11 blocked from being installed using the local group policy editor, so nothing after 22H2 can be shoved onto my computer.

      @@KratostheThird You have to go into the Local Group Policy editor. Wish I could send a screenshot here of what to pick, though I'll try to walk you through it.
      Always, back up your computer first...just in case.
      In the search box on the bottom left of your desktop, type in "local group policy" -- the top item will have "related: local group policy editor", so click on that. It should open up a window called the Local Group Policy Editor.
      On the left side, you will see a folder tree with two main groups: Computer Configuration at the top, and in that section you will see that the last folder is called "Administrative Templates". Expand that and at the bottom of the list you will see "All Settings". You will need to click on that. It will open a long list in the right pane, and you will need to scroll down to "Select the target Feature Update version" by double-clicking it. That will open a pop-up box titled, "Select the target Feature Update Version" in it's upper left corner. On the left side you will see three "radio buttons" -- click on "Enabled". You can add a comment in the box to the right of it with "This is to stop Windows 11 from installing." (quotation marks not required).
      Next, you will need to move down to the "Options" section, and in the 2nd (bottom) box, type in "22H2" (no quotation marks). Then click on "Apply" and "Okay".
      Close out of all that and then reboot your computer.
      The next time you go to Settings -> Update & Security, at the top under the big words, "Windows Update", you should see in red,
      * Some settings are managed by your organization
      Then you're all set! Nothing past version 22H2 will get installed on your computer.
      Hope this helps. :)

    That's the last straw. After nearly a decade of being an Adobe subscriber, I'm calling it quits. I don't care if they 100% walk back everything in this TOS, I'm so sick of their shit. I already use the Affinity suite but was holding on to Adobe for a few select features, but those features aren't worth it anymore.

      If you try to protest their cramming in features that put you at risk by pirating the thing that puts you at risk, *you're still at risk*.
      (And signaled that you think their work is valuable enough to use, but not to pay for. There are times where piracy is in fact the moral and practical answer to a situation. This is not one of them. )

    I'll have to remove Acrobat from my work computer since all of the files we handle daily have PII and HIPPA-covered data all over them. I wonder if there is a case to be made from HIPPA or GDPR regulations that could put Adobe and Micro$oft in legal jeopardy for pushing these ToS and software changes to their user base?

      Adobe is so big and powerful compared to their alternative that most of the other big players are doing the same AI nonsense and no one is going to raise a stink. The only way that will ever happen is if someone gets GOVERNMENT DOCUMENTS over to our russian or Chinese friends due to the backdoor imposed on us through these disingenuous bad faith actions by these companies. The buck stops when the GOVERNMENT themselves get a door knock warning them that they've been "gotted

    A few people have said they have to accept the new terms in order to access the page to cancel their Adobe subscription. There is also a cancellation fee.

      I _read_ that you can downgrade to a lower/the lowest plan, THEN cancel without the fee. No clue if this works; I left Adobe when they started RENTING software.

      Just make a virtual machine for say Windows XP, and install Adobe CS (whatever Version, like CS4) and use this one. The master collection of CS4 includes Premier Pro. Of course do NOT CONNECT this Windows XP to the internet. The older Version of Adobe use the outdated older terms of service.

    The IP holders should band together in a class action lawsuit against Adobe for pirating the material. That should change their tune.
    Anyone accepting one or more images does not have more rights than those who watch a movie or listen to music. As a regular person I cannot sublicense any material which I have bougth, the same can be said about those who accept image editing jobs.
    Considering that the entertainment industry tend to go after thoses who download movies or songs, I can say that the same arguments can be used against Adobe. I don't wanna know how big a fine they would have to pay if they lost in a court.

    A.I. is just a good reason to push this. Software as a service or even "service as a service" has been pushed for more than a decade. When has a John Deere tractor stopped being your property and became a "perpetual lease", banning you from repairing it. Same goes for Roku TVs and some car models. We have became just an appendage of the corporate machine.

      I was an avid Adobe user in the 2000’s. Today you couldn’t pay me to subscribe to any of their products. They charge far too much money, and all of their programs are bloated.

    I will gladly watch Adobe/Microsoft make their product so bad that even normal people try out Linux. Gaming is great even on Nvidia, most people even those like me that used it heavily don't use 80% of what Photoshop can do, and Davinci resolve runs natively on Linux...
    My only concern is, the Pluton "cloud" chips in the copilot devices. How will they react to a Linux install? Can Linux even be installed with those security chips? Will they phone home and exfiltrate data or brick your new Linux install?

    I opened my adobe file the other day and found that if you want AI to interpret that ebook etc, it's free but you have to sign up with the proviso that you allow them to send that document to their cloud. I believe the 'chat with RTX' is a better alternative for those who want privacy.

    I completely understand this. I am a 3D and VFX artist and I recently graduated from a university. At the university, I was also under an internship where I have signed NDA documents. Those NDA documents are the reason why there are things that I legally can not show in my portfolio yet. I am actively searching for other alternatives. I know there is Affinity. I need an alternative for Substance Painter if I am going to completely jump the Adobe ship.

      My experience in 3D/VFX is very limited. But can't you do what's needed in Blender, at least with add-ons? (And yes, Affinity can replace Photoshop/Illustrator/InDesign)

      @@LV4EVR I'm not sure. I have never been a blender user. Most of the stuff used at the studio that I worked through was Maya with Arnold rendering, Substance Painter for texturing, and Houdini for some VFX. The thing I like about Substance is the ability to create textures and save them almost as presets, that way, you aren't saving pre-made color, normal, bump, specular, etc. maps. You just have one file which is made in Substance Sampler and then you use it to apply and paint onto your model. From there, it is exported to Maya. It is a workflow/pipeline thing.

    It'll be interesting to see if (A), Adobe makes an "enterprise" version of their software available to multiple-seat subscribers, without this spyware language in the TOS, or, alternatively, (B) every producer, editor, color grader, etc. in the world switches to DaVinci Resolve. Let's hope that Blackmagic Design does not stupidly follow Adobe's example, as I suspect they could sell A LOT of licenses for their excellent editing suite right about now.

    Getting louis rossman flashbacks where this is just an outright morally justified case of piracy.
    I already hooked my dad up with a cracked copy of a version of Photoshop that runs correctly on his PC, the newest ones were way to laggy for him (Somewhere in 2020 they made it inefficient). He used to be a creative cloud subscriber, he probably paid enough trough that to have paid the original price if it had still been boxed software. And the updates harm him so he doesn't need to pay for updates. In my opinion that was morally completely fine to then cancel the subscription and have him be able to use the version he likes. And now this kind of TOS BS he will luckily not be subjected to.

It bribes our so-called representatives to gain its own human rights at the expense of ours. People are too greedy, people are too lazy, people want "instant gratification'" all lies crafted to keep us questioning each other instead of looking up.

    I do all my professional work for clients with small apps made by small companies or community opensource programs. My clients are very happy, very desirable results etc.. No AI.
    Remember Adobe's top priority as a public listed company is to make as much money from it's users to give to ti's shareholders. It's legally obliged to do so.

    I just contacted them via chat to cancel. I had 4 months left on my contract and wanted to disable auto renew. I was asked why i ws to cancel, told them i was sick of SAAS and their AI, they gave me 3 months free, so now i just have to cancel before renewal in November.

      And I love using Kdenlive to produce AMv's!

      @@jedipadawan7023 I used to use a video editing program purely for fun, back in the early days of RUclips when it wasn't entirely corporate.
      I've also tinkered with stuff like Wolfenstein 3D and DOOM. I've made my own maps for those games.
      Fun with gaming 20 years ago was having a bunch of nerds bring a bunch of Xbox and PS2 consoles together, to play Halo or some other multiplayer game on a LAN connection.
      Sad that this generation will never experience the stuff we loved as kids and teenagers.

      @@KratostheThird Well, we have to be careful there. I remember my parents going on about the 'good old days' to my irritation. I do think Linux brings a lot of the sense of the old days; of being in control and having choice. Having said that, I remember being wowed by 'Manic Miner!'
      An aside: I did my first AMV in the UK on a piece of Windows software, I forget the name, something 'Magik' which I paid $100 for. It was slow, had limited effects, would ONLY input MP4 files properly and even then I had to compensate for audio lag - every other format load equaled CRASH. And this when MP4 was VERY heavy on the single core machines of the time. So editing was SLOW. And the software crashed literally every ten minutes. I did install the patch, which did not fix any of the bugs but introduced a few more so I had to roll back.
      I come to Indonesia, get into Linux and install Kdenlive. All the functionality that was missing on my paid for Window app was there plus effects and it handled every video format known to man and Kdenlive worked!!! For free.

      The "year of the Linux desktop" was meant in that Linux would take over being #1 and knock Windows out of that spot. It was coined by sites like CNET. Linux on the desktop happened decades ago. If you add up all the Chromebooks, self-installed desktops, and laptops Linux runs on these days, it's about 9% of the desktop install base. I've seen a serious uptick in newbs joining the subreddits, forums other sites that I frequent that are focused on Linux. Who knows who is trying it but it's not a niche OS anymore.

      Desktop Linux, not including Chromebooks, has increased from 1% worldwide to 4% worldwide in just 18 months. That's going some. Linux desktop use in the USA now runs at 12%. And this is set to increase, I speak from experience, because people cannot afford the new hardware for the latest versions of Windows. So I am installing Linux (MX Linux KDE for a number of reasons) on old laptops as people prioritise paying for housing and education fees and do not have disposable income.
      That was BEFORE Recall and Adobe's insanity.
      Microsoft is too embedded in critical fields such as big business, healthcare, insurance, oil, etc, etc Like COBOL the world is stuck with Windows legacy and so Windows will always be with us and likely remain dominant.
      But I can see Linux going mainstream in the consumer market and with start ups (I am 100% Linux for my microbusiness) and overtaking expensive, 'walled garden' Mac. If Linux becomes mainstream I would call that the year of the Linux desktop.

      @@jedipadawan7023 I have several Linux hosts including a regularly used desktop as well as an M2 Max Macbook. I've been using Linux so long that Arch (and it's derivatives are easy for me. It's not a brag, it's just that I've been a Linux user since '95. I've been an "anything but windows" user since 1998. :D

      The difference there though is that it's very easy to avoid putting your work on social media. I don't need to upload my art to Twitter in the process of making it, but I *would* need to shuffle it through Windows and my graphics software of choice. Placing these sorts of clauses into software that is essential to a lot of people's workflow makes it unavoidable and thus illegal to use.
      Not that social media websites thinking all your data is free real estate for AI training is great, either, but it's at least avoidable.

      I didn't even think about this, this is just running there business into the ground what idiots. I had to use adobe once for photoshop, and they tried charging me 100$ for canceling because there was no monthly subscription plans at that time. I was able to get out of it by switching my plan then canceling since it was a "New plan" I was able to cancel with no fee but still Adobe are flat out evil!

    But if Adobe uses materials they don't have permission to use for AI training, because you uploaded them to their platform in violation of the license agreement, it's still Adobe violating copyright if they use those materials. And while methods to prove that certain data was used for AI training may not have been fully developed yet, I believe they will be at some point. Dangerous game, that's what they're playing.

    If you use DaVinci Resolve there is no such infringement issues. DaVinci Resolve and the Affinity suite does not use AI. Those and open source, free software is not using AI.

      @@LV4EVR Doing a check, it does seem Affinity will run under WINE especially via bottles. not the Adobe has a real aversion to open source and vowed to NEVER port Photoshop et al to Linux so I am hoping Affinity will.
      Also, people should contribute to development of open source apps such as Krita and GIMP though not that Krita is more 'blank canvas' and GIMP image manipulation.
      Note that I run a private tuition business in Indonesia that requires all sorts of content priduction - worksheets, videos, audio recordings, images, file format translation...I do not use any kind of software 'to the max' but the range of apps I have to use is insane! I am 100% Linux and no problems.

    Even if you 100% own the rights to what you're working on, Adobe is in legally murky water. One aspect of contract law (as I understand it) is that both sides must have concessions to the other. You conceed rights to your work and they conceed what to you? The right to continue to use their product that you already paid for (and thus have an existing contract)?
    Corporations have been guilty of these bait-and-switch tactics for years, of course, but our legal system is completely incompetent.

      Linux is an OS. It's no replacement for Adobe or Microsoft (or any other commercial) applications. Therein lies the problem... for many of those applications, no suitable replacements exist (on Linux or anywhere else).

    Microsoft and Adobe are what's making it legally dubious to use their products. Maybe the investors, if we want to point at the power they exert when they say they'll pull funding if these companies don't add these features. But without a doubt, the vast majority of the actual users of Microsoft and Adobe products were not asking to have their work be examined or reused or repurposed without notification or without more specific clarification on the use case.
    But yes, given the kind of work I do for my job, Adobe and Recall are a *huge* issue for compliance with regards to PII. No idea what the higherups are going to do about that. While I'd be perfectly fine if that meant us switching to Linux desktops, Linux servers, and using Affinity instead of Adobe for design work, I do not anticipate Corporate being willing to do so.

    I've been using WPS office for 2 years as a free alternative to MS. Besides their constant nagging for a paid subscription which I refuse to do, along with the updates came AI, constant pressure to backup to their cloud, a cloud icon in the taskbar which cannot be removed, and now they don't even allow document editing without signing in. I can see their intention to steal documents has/will become reality. MS even allows free usage if u use their cloud storage.

    I used Photoshop before it even had that name. Pixelmator is always improving and has benefit of application-scripting for smart-production/live-automations. Interface remains troublesome, but I use more and more.
    PS was a growing collection of Knowles bros graphic routines contracted around input hardware called Barnyscan, but it had 32-bit color depth and feathered selections… subsumed into a corporate monster : a creature with thousands of stomachs and no-brains.

I'm sure they said they can hide behind the user agreement. Which is going to get them in the end. Either by the loss of customers, and/or by legal action. What these companies are doing is just stupid. It drove me to do most of my creative work off line. I make sure to only have pieces of what I'm doing online.

    Wow. I really appreciate this heads-up. However, there is a lesser point that I am unsure of.
    Adobe can claim whatever they want. They can claim intellectual property rights of whatever their software is accessing, but if the user is not authorized to transfer or sub-license it, it doesn't just happen because Adobe says they want it.
    I am basing this on my familiarity with the stock photo industry terms. I have bought royalty-free perpetual use stock photos for decades. Most of those vendors do not actually guarantee that they have the right to license the photos. They rely on the photographers word (unless I pay a premium for the extra due diligence and/or insurance).
    Suppose I am doing work-for-hire and use a stock photo. Even if their software could detect the license of the photo, Adobe can't unilaterally change it. They could prevent me from doing the work, but I don't think they will. I don't think they will sue me for it.
    I think it's just an overly broad reach to grab as much IP rights as possible going forward. That's definitely something to understand and keep an eye on.

      I'm pretty sure the problem is that if you are sharing with Adobe and you signed a contract that prohibits you from doing so, the party you are contracting with that owns the IP can sue you if it is discovered you were sharing their IP, even if it was to Abobe.

    Yup - Adobe already has the ability to uninstall older versions of Photoshop for instance.....I know because I had an old version of Photoshop that, when it was running while the laptop was online, would suddenly uninstall itself (because it was a pirated version). Happened several times until I learned to shut the internet off while running PS.
    So now it's the end run, they'll be able to erase images that you created with the help of their software?
    I never felt like a pirate, because none of my images earned money or were part of commercial activity....but now...who knows?

    Im not sure how this works but I suppose you have to be using Adobe cloud for file storage for this whole thing for them to work. In any case these corporations should be kicked in the balls. MS, Google, Adobe, Apple... All these should be reigned in. The stuff these guys are pulling on the customer is ridiculous.

    interesting take and thanks for sharing your insights. As you said, many are jumping on the wagon right now, as all think there is a free lunch, especially on the developer side. As creator I feel betrayed.
    Two months ago, a company that works as a social media/creator platform with an stock library element, notified me, that the will use all my photos on their database to train their AI, or even license it out to third parties, no matter whether the photos have been marked as marketable or not from my side. You can withdraw your library and leave. Their willingness to compensate you for the usage of your content was and still is Zero... As creators, we our customers should fight back. I would be happy to help Developers to train their AI, but with the content I define as appropriate (to make sure is does comply) and I do get a fair compensation.

    Oh yeah, Louis Rossman made a video about it and M$ has made it very clear about it, too.
    And let's say people use 11 LTSC it has no TPM great, right? Well... They require you to log in to an M$ account. They just find ways to screw with people one way or another.
    Regardless of all that, the masses will still use Windows. I've gotten used to Linux Mint so I don't mind Linux now.

      Only reason I’m still on Windows at this point is because I built my PC desktop myself and there are some games I play on Steam. Once that falls through I’m switching over to Linux.
      I’m ignoring Windows 11 entirely because it’s the worst OS Microsoft has come up with in their entire existence.
