Sibal only talks about constituent assembly of jk which was not there at the time of abrogation of 370. It is morally binding on all that irrespective of assembly, the integrity of all and loyalty to the nation is of paramount importance. No amount of technical arguments is sufficient to over ride this fact. If this is understood then the whole issue of abrogation of 370 is over within minutes. The SC is morally more bound by this than technicalities.

Art 370 should not have been there in the first place.. and after the constituent assembly was done away with, 370 should have been deemed to be automatically void from that day itself.
How can any annexed state be allowed to enjoy even any limited sovereignty within the sovereignty of a country?Wouldn’t it make the very word sovereignty meaningless?
Extra special status in the border states neighboring the hostile neighbor countries will always create an everlasting impression that this region is a disputed territory ready to be annexed, occupied by them at any time. Ex pm nehru would have been extra careful to this make this crystal clear to abolish this temporary article in a limited time frame. I doubt there would have been this much loss of territory in ladakh region in indo china wars, nor future indo pak wars if this article 370 was abolished in 1957 itself.

Gone are the days when we used to watch logical arguments either in a court or media etc. Now not only senior advocates but the so called senior media personnel as well all talk rubbish(don't want to name any body many names )they think and firmly believe that if they catch and follow a line of thought or explanation(vichar dhara)all others should just go by it as they have superior intellect and wisdom and experience(which is an absolute untruth).If in my egoistic wisdom and intellect and proudness and arrogance I feel and imagine that I am always right there is no harm in that but expecting others to fall in line with my thoughts is utter foolishness.
It is understood that as per provisions of 370 the President of India can abrogate it on the recommendations of the Constituent Assembly which since 1957 is not in existence. However, had the founding fathers of the Indian Constitution stated that in case, the Constituent Assembly is not in existence then the recommendationsof the J&K State Legislative Assembly would be needed for the abrogation. Since such a proviso is non there in the act the Government's decision to abrograte 370 based on an executive order of the President duly passed by both houses of Parliament seems constitutional. Please throw some light of this issue.
At the time of abrogation of 370, the state assembly was suspended since president's rule had been imposed following BJP's withdrawal from its coation govt with PDP of Ms Mufti. So the powers state assembly rested with the state's governor, who accented to the abrogation. No issue there at all.
A national boundary state bordering hostile neighbor countries having these kinds of extra special status creates an ever lasting impression in the minds of the hostile neighboring countries bordering that national boundary. This is against the constitution's preamble objectives. The Indian judiciary branch can't anticipate the hostile Neighbor countries aggresive next moves. Atleast they can amend their constitution book to remove the hostile Neighbors impression to some extent. Judiciary and Kapil sibal should read out the preamble objectives once again louder - standing like for the national anthem on next week Monday.
I mean the judiciary can simply endorse what best the legislature had done with the constitutional amendments to secure the national boundary by removing prejudice, perceptions in the minds of hostile neighbor countries.
I think it's other way round, sibal is just unable to counter temporary provision vs implicit permanence baked in 370(c) via constituent assembly clause. Judges should say that 370(c) is contradictory in nature and has been poorly framed and should have been scrapped long back or Article 21 should have been amended to make it in sync with Article 21 talking about the same. Problem is judiciary doesn't wants to accept they have let this lacuna fester and it was there incompetence
Nobody ever feared that the Supreme Court would overturn legislative action on 370 and 35A. A head-on confrontation between the the two is almost unthinkable,

How can any annexed state be allowed to enjoy even any limited sovereignty within the sovereignty of a country?Wouldn’t it make the very word sovereignty meaningless?
Extra special status in the border states neighboring the hostile neighbor countries will always create an everlasting impression that this region is a disputed territory ready to be annexed, occupied by them at any time. Ex pm nehru would have been extra careful to this make this crystal clear to abolish this temporary article in a limited time frame. I doubt there would have been this much loss of territory in ladakh region in indo china wars, nor future indo pak wars if this article 370 was abolished in 1957 itself.

It is understood that as per provisions of 370 the President of India can abrogate it on the recommendations of the Constituent Assembly which since 1957 is not in existence. However, had the founding fathers of the Indian Constitution stated that in case, the Constituent Assembly is not in existence then the recommendationsof the J&K State Legislative Assembly would be needed for the abrogation.
Since such a proviso is non there in the act the Government's decision to abrograte 370 based on an executive order of the President duly passed by both houses of Parliament seems constitutional. Please throw some light of this issue.
At the time of abrogation of 370, the state assembly was suspended since president's rule had been imposed following BJP's withdrawal from its coation govt with PDP of Ms Mufti. So the powers state assembly rested with the state's governor, who accented to the abrogation. No issue there at all.
A national boundary state bordering hostile neighbor countries having these kinds of extra special status creates an ever lasting impression in the minds of the hostile neighboring countries bordering that national boundary. This is against the constitution's preamble objectives. The Indian judiciary branch can't anticipate the hostile Neighbor countries aggresive next moves. Atleast they can amend their constitution book to remove the hostile Neighbors impression to some extent. Judiciary and Kapil sibal should read out the preamble objectives once again louder - standing like for the national anthem on next week Monday.
I mean the judiciary can simply endorse what best the legislature had done with the constitutional amendments to secure the national boundary by removing prejudice, perceptions in the minds of hostile neighbor countries.

I think it's other way round, sibal is just unable to counter temporary provision vs implicit permanence baked in 370(c) via constituent assembly clause.
Judges should say that 370(c) is contradictory in nature and has been poorly framed and should have been scrapped long back or Article 21 should have been amended to make it in sync with Article 21 talking about the same.
Problem is judiciary doesn't wants to accept they have let this lacuna fester and it was there incompetence
