    I'm glad to see that more courts are handing down harsh sentences for DUI deaths. This is long overdue.

      left out partying which often is with alcohol. Porn many men watch with drugs. All are not available in prison unless the correction officers like you, trust you and you bribe them. You can have all in prison but if you are hated and have limited funds well than good luck.

    This really pisses me off, the county, state, and judicial system repeatedly failed, and they are just as responsible for these three deaths as him. Yes, he murdered them by drinking and driving, personally I think the death penalty should be considered for DWI/DUI, and he had many chances to stop. He didn't, and now he destroyed a family.

      About 25 or so years ago there was a guy in Oklahoma who had 7 DWI's over 15 or so years but never faced serious jail time. That is until he hit a van head on, killing a mom, two children and their aunt. Takes a lot of carnage to see justice done.

      Most states require DUI drivers to have an interlock ignition upon a second conviction or due to really high BAC or causing serious injuries & death but that won't stop them driving another vehicle without an interlock, usually a vehicle belonging to a friend or family. In my opinion, DUI drivers should not be allowed to drive after 2ed conviction or for extreme circumstances for at least 10 years if not life. Unfortunately, the justice system is broken. There are DUI drivers who killed and injured six or more people at once not only avoid time in prison but allowed to continue driving. DUI laws need to become federal across the nation with mandatory incarceration and license suspensions, and as well no reduced charges above BAC .08.

      @@zforeversleeping thing is that does not meet the usual deifation of first degree murder some states will allow second degree murder for repeat DUI defendants who end up killing someone, but to be first degree murder unless the person dies during the commission of certain felonies generally the person have to have WANTED that person to die. Drunk driving while a VERY poor decision is not a case where someone plans to kill anyone, so without that intention drunk driving fails to meet the requirements for attempted murder. That is the same reason that when DUI with death IS charged as murder instead of mansaughter it is charged as second degree murder because while the act is VERY reckless the drunk did not INTEND to kill anyone which is a key element ( something that must be proven in most first-degree murder cases

      Probably because their judgement is impaired and they’re worried about having to get back to their car in the morning. Again not a justification, but I can see why it’s hard to not make the choice to drunk drive in this situation, especially when the possibility of hurting someone isn’t the absolute first thing in the driver’s mind.

    I've had 7 DUIs. I've been sober almost 4 years. I'm thankful the only thing I ever hurt was my dad's mailbox. Alcohol sucks!

    One DUI = loss of license for one year; second DUI = prison for one year, no early release; third DUI = 20 years, no early release; fourth DUI = life, no parole.

    Bailey's mother Misty has been through so much she's always in my prayers. What a strong woman I'm glad there's some justice.     Is there no way for the prior judges to be sued? This man should never have been out and about after FIVE previous DUI convictions! At the third DUI, the book should have been thrown at him, with license revoked for 10 years after release. I mean, what is this? Five DUIs and now you wipe out an entire family on your sixth. The courts need to suffer some sort of accountability too, here.

      They should have a registry at places that sell alcohol so when alcoholics with multiple DUIs go to buy alcohol their I.D. gets flagged and they aren't allowed to make a purchase. Banned from alcohol, and driving.

    1st DUI: Permanent loss of license
    2nd DUI: 10 years in prison
    3rd DUI: Life in prison

    5 FIVE convictions and he is not in jail? You judges waited until he killed 3 THREE people before you sentenced him to jail!!!!! The deaths of these 3 innocent people makes you judges just as guilty as the drunk driver. You need to reevaluate how you can think you are a competent judge when your the blame he was able to drink and drive over and over again. The whole judicial system needs to be completely overhauled.

    We need a federal law if it’s possible to address habitual drivers, driving under influence. Maybe a 3 strikes, banned from driving for life? I don’t know if it would create more problems, but I think being convicted of 1 dui is enough of a wake up call. 2nd dui should be significant punishment. But allowing someone to stay on the road offense after offense is guaranteeing an innocent person is going to eventually die.

    Wow, 5 times (now 6, that killed 3 people)!! He never learned to stay home and drink?? Has he ever heard of Uber or a taxi cab?? What the hell is wrong with people?? I can't understand why they even let him get away with it so long and now, 3 people had to die, for them to get him to stop permanently!! Maybe, now, they can make it a capital offense (a death penalty sentence). Maybe THAT will get people to finally quit drunk driving!!!

    Condolences to the family. This is a very delicate subject. There will be no end to this. It’s a horrible choice to drink and then get behind the wheel. I’m guilty and just thankful I never injured or killed anyone. I go so far as setting up ramps at my tires, disconnecting the battery cable, it’s funny because the neighbors know when I’m about to get frog eyed! However, this will not stop. Having a drivers license just means you’re legally allowed to be on the road. This affects everyone and every class of people. People get stripped away from this planet and it’s not fair. 99% of the time it’s outstanding members of society that get killed from this. Very rarely are child predators or rapists getting taken out. We can only hope that it will get better with people making the right decisions in regards to drinking and driving. When you separate from your loved ones, hug them a bit longer; because you never know when they will never be seen again. Please to the families involved that lost loved ones, accept my condolences if you ever read this. This will be hard and miserable for you. Stay strong and take care as best as you can.

The third dui should've gotten him five years. The fourth seven years, and the fifth should've been ten. If you kill someone, you forfeit your own life.

    His apology means nothing. He had five previous DUIs. He had a suspended license. And that still didn’t stop him. And guaranteed he wasn’t caught every time he drove drunk. Five times he stood in a courtroom knowing full well he could’ve killed someone on any one of those occasions, and yet he continue to do it! How many times did he leave his home with his keys in his hand knowing full well he was going to drink later but took his car anyway? How many times did he sit on a barstool with his first drink to his lips knowing full well he was going to get behind the wheel of a car when he was done? And yet he still took the drink. Every single time he got drunk and behind the wheel of a car he started out sober and made the decision to drink knowing he was going to drive home. For a person like him it’s too late to try and make the decision to not drink and drive once he’s drunk. Because he knows himself, and he knows that he’ll get behind the wheel every single time and yet he still orders a drink. Even if he tells himself beforehand that he won’t drink and drive this time, that he’ll call for a ride he knows he won’t. You have to make the decision to not drink and drive before you ever take the first drink, before you ever get in your car to leave the house. This man knew his habits, he knew his routine. If he really didn’t want to drink and drive he wouldn’t take his car in the first place. I was hit by a drunk driver and it changed my life forever. I’ve had surgery seven times and I have at least two more to go. I’ve had hundreds of procedures, hundreds of injections, tons of physical therapy. I’ve had to give up a job that I worked very hard for and that I loved. I’m in pain every single day of my life and that only gets worse over time. Because it’s degenerative now. Drinking and driving is so selfish. The death and injuries are so preventable. The only person that put this man where he is is himself. It’s not even the fault of the alcohol. Because he’s the one that chose to drink it in the first place.

    First DUI means you get 1 year in prison... 2nd DUI means 4 years and lifetime of no driving , any death from DUI means 10 years minimum and lifetime in prison maximum.

    Some years ago our dear neighbor, a retired grandma...whose hobby was to collect bottles and cans and then donate the money to charity, was hit by a drunken driver and killed, as she was walking in the Bronx.. Guy hit her SO hard that her body went one way, her left leg went another. They pulled this POS from behind the wheel and he slurred, "He just came outta nowhere.." Moreover, it turned out he was a decorated NYPD detective who 'helped take a lotta bad guys off the streets.." Bravo, copper!!! Except he also took out my neighbor, a kindly old European lady loved by her family and community, who never did a bad thing in her life. I know he served some time for this, but was also protected by his fellow officers, who may have urged him to get into alcohol counseling, which of course he never did. Pathetic. Drunk cops are routinely shielded from consequences of driving while intoxicated. And, by brother officers...

    I realize i'm a little late to the party but After watching this I would have to say that he should not have been back on the road at all ever again after the 2nd DUI, I feel like I'm being very generous to give him 2 chances such as that after the 2nd DUI he should have. Never been allowed to drive on the road again. My condolences to the family And friends and to whoever else might have been involved.

    There are FAR MORE courts that are NOT handing down harsh sentences. The system is completely broken, arbitrary, not accountable and unjust depending on which state you live in. No one involved in the lack of oversight or the judicial system is accountable--unless, it's one of their people. Then mysteriously and suddenly the system "works". Woe be to us.

    so his 6th DUI he is finally held accountable because 3 people died. it is funny because a lot of people do not consider an unborn child a human being until someone kills the mother. the brother asked for leniency because alcoholism runs in the family meaning that the family has no control nor do they teach the younger ones the dangers of alcohol growing up. the family is reckless and does not understand what he did.
    this is exactly what I talk about with alcohol being the most dangerous drug in America. It is celebrated, and encouraged, overly advertised, promoted at sporting events, any gathering, in the best of times and the worst of times and everything in between. but god forbid we hold people accountable from the get go to make the point of how dangerous and serious alcohol is. a person has to have 6 DUI's and kill 3 people in order to take him off the streets. thankfully I stopped drinking 5 years ago by chance simply because I did not want a beer at a baseball game and it has snowballed. I used to drink and drive and thankfully I didn't harm myself or anyone else or anyone's property. Uber and Lyft have been around for 15+ years and still people think it is the best idea to drive themselves after they have had too much to drink. and if you don't know what else to do call the cops for an escort home, I am sure they would rather give you a ride rather than potentially have to deal with a situation like the Kennedy's and McKnight's have had to deal with and will for the rest of their lives.

    if the American courts would jail drunk drivers as they do in the UK they wouldn't have to get to this point, this moron had FIVE previous DUIs and was still drinking and driving, in the UK he would have been in jail and on a special programme to get him sober and make him fully aware of his actions and their outcomes, America won't take DUI serious until some innocent persons are killed, they shut the stable door after the horse has bolted,

      This guy had to have served jail time to have that many DUIs. Generaly jail is mandatory on the 3rd one. If someone is killed they are charged with negligent homecide in addition to DUI. If someone is sleeping in their car in a parking lot but are found to be drunk they are charged with DUI. So it could be that his other DUIs did not involve him being caught while driving.

    I think after your third DUI the government should have some kinda program where they provide you a person that can drive you around. That way you don’t drive drunk anymore and you can still get around cause the government supplies you a sober driver.
