It’s much more difficult to prove intent and what things like that statement actually mean than people think. They can’t NOT hand out a penalty. City’s position is: they made the PSR checks and were above board, and they are now having to fight an incorrect assumption about their activities pieced together by NDA sealed documents and private emails that they will claim have been given improper context. That may be more difficult to do, especially facing top lawyers, than people realize. For instance they could the “usual” email was a more casual document with sarcastic comments - they never actually state that “the usual” is some sort of rule breaking scheme. Did the alleged “backhands” even make a difference in them clearing PSR? If they cleared it by 50m in a given year, and the revenue sources were approved, then how do you prove a 1.75 fee for various appearances had the malicious intent of getting them past PSR illegally? If they would make PSR anyway, then the very important aspect of motive becomes tricky. And yes, people need to be careful. Not pundits and RUclips creators per se. But if anyone associated with the PL has become casual enough to throw out things like “115FC” references … counter suits could have legs. So much trickier than people realize. And if they are being quiet and methodical in their approach… then good. That’s what they should do.
The issue is not solely the arrangement with man.city. It is the way in which the payments have been instituted to curb possible losses by the club for having to pay Mancini and other players in bonuses on a whole. The individual situation with Mancini is just an EXAMPLE of the bypass mechanism City used in order to pay from their own pocket rather than the Clubs revenue Which is where the money should have come from. This means that to 50mil is a false value entirely which is FRAUD. As i said, the individual situation with Mancini is problem not because of the deal itself but the source where the money came from, which is NOT the clubs pocket but the owners directly. The agreement for the 4 day training INCLUDES the bonuses Mancini should have received via club profit. The club has to prove that Mancini was paid with Club earnings for his bonus achievements and I would assume this goes for several players in the team. Now on it’s own 4mil over 3 years isn’t much but consider you have 10 outfield players with the same clause and you get how bad it could be entirely in terms of the actual spending offset for the fraud accusations.

Also, the idea behind the charges are to punish City for masked payment structures so fines are generally the first thing that come to mind with prison time being the next obvious punishment. All that should really matter is, if Mancini did the work he was paid for, for a completely unrelated club outside of UEFA competition, absolutely nothing to do with the PL. If he did there was no reason to put that on City's accounts that I can see. Other than some 'technicality' argument, FFP hadn't even been written when the contract was made(circumventing rules before they'd seen them?) and furthermore even if that hadn't have been the case £1.5m a year wouldn't have made a dent on FFP, a pointless risk that could have been achieved by including an easily achievable bonus(the PL cant dictate salaries or bonuses and not should it ever). It was no secret that Sheikh Mansour was the chairman of Al Jazira, if he wanted Mancini to do some consultancy work, that's up to both parties, separate from City, UEFA and the PL's business. So if i am understanding this correctly, Man city moved funds around in the 'usual way', (which could mean from man city's kitty to the holding company to the point of payment or in gold coins via treasure hunt, its a vague statement with no clarifications) and the funds ended up at another of the Shieks businesses to pay someone for their 4 days of work a year at this other company. This was all done with Man City letterhead and emails leaving a very traceable paper trail? Either they are completely incompetent (highly unlikely considering the sheer size of the club and funds moving through it) or they are incredibly assured that they have not broken any rules as they found loopholes or skirted the rules exactly as they needed to to get things done. This will come down to the minutia of the prem rules, which seem to be highly fallable considering all the clubs getting off from their investigations.
TBH after seeing Leicester city managing to find a loophole in their case against the premier League. Then avoid any points deduction or any fines whatsoever. Mancini was at City from 2009-2013 FFP didn't cease to exist til 2012 so this is why it's probably not gonna make it to court against City it's irrelevant evidence.
Before anyone argues with mattos point. He is correct for the PL FFP regs(2013/14 season) and the UEFA FFP regs were introduced for the 2011/12 season. The date of that Mancini document is December 2009. There was an official meeting at UEFA in September 2009 where the concept was approved only. The FFP regs had not been written up, ratified/presented before European Parliament until June 2010. We are also talking about £1.5m a year here, this was not a large amount and could have easily and legally been paid via bonuses. The motive is important and the one they are suggesting makes no sense whatsoever, it's not even valid.

City’s position is: they made the PSR checks and were above board, and they are now having to fight an incorrect assumption about their activities pieced together by NDA sealed documents and private emails that they will claim have been given improper context.
That may be more difficult to do, especially facing top lawyers, than people realize. For instance they could the “usual” email was a more casual document with sarcastic comments - they never actually state that “the usual” is some sort of rule breaking scheme.
Did the alleged “backhands” even make a difference in them clearing PSR? If they cleared it by 50m in a given year, and the revenue sources were approved, then how do you prove a 1.75 fee for various appearances had the malicious intent of getting them past PSR illegally? If they would make PSR anyway, then the very important aspect of motive becomes tricky.
And yes, people need to be careful. Not pundits and RUclips creators per se. But if anyone associated with the PL has become casual enough to throw out things like “115FC” references … counter suits could have legs.
So much trickier than people realize. And if they are being quiet and methodical in their approach… then good. That’s what they should do.

This means that to 50mil is a false value entirely which is FRAUD. As i said, the individual situation with Mancini is problem not because of the deal itself but the source where the money came from, which is NOT the clubs pocket but the owners directly. The agreement for the 4 day training INCLUDES the bonuses Mancini should have received via club profit. The club has to prove that Mancini was paid with Club earnings for his bonus achievements and I would assume this goes for several players in the team. Now on it’s own 4mil over 3 years isn’t much but consider you have 10 outfield players with the same clause and you get how bad it could be entirely in terms of the actual spending offset for the fraud accusations.

Mancini was at City from 2009-2013 FFP didn't cease to exist til 2012 so this is why it's probably not gonna make it to court against City it's irrelevant evidence.

The date of that Mancini document is December 2009. There was an official meeting at UEFA in September 2009 where the concept was approved only. The FFP regs had not been written up, ratified/presented before European Parliament until June 2010. We are also talking about £1.5m a year here, this was not a large amount and could have easily and legally been paid via bonuses. The motive is important and the one they are suggesting makes no sense whatsoever, it's not even valid.

The EPL is bigger than the club. If they are guilty MC then they have affected not only every club in the EPL but also clubs in the lower leagues and around Europe. They need to be stripped of all trophies and titles if that’s the case. Arsenal could be going for 3 league titles in a row if MC had of been dealt with earlier and won extra cash.
