My guy you’re explaining AB 5 wrong! There is no way a service man hired to do the AC was considered your employee. Thats number 2 of the three tests to determine an employee. I.e. The worker is performing work tasks that are outside the usual course of the company’s business activities. If anything it sounds like you were doing /filing something wrong which caused the audit and now you are mad that you’re caught. Just hire a really good CPA to take care of all accounting in the future and you will be golden
whether you're a full time employee or not isn't dependent on things like salary or onboarding. it's hours worked. at the end of the day, if you're in over a certain amount of hours, you're considered FT. this is the same case in Texas. the whole thing about them being chased for contractor payments is weird. it's likely they handled the finances poorly, and they paid the ac guy or plumber as income as opposed to a business expense. a simple invoice or receipt works

The DMV did that with renewal of my Drivers license. Where I had money in the bank, the DMV didn’t pull the money and now it was my fault for a dishonored check. They mailed me a new DL despite “not paying.” They sent me a letter THREE MONTHS LATER about the dishonored check. Did not instruct me what to do. I had to pay the dishonored check and pay a new dl. The letter did not disclose that I have to surrender my license. Now they wanted to put a point on my drivers record. Took like 2 months to resolve
If your business can't be sustainable when you fairly compensate your workers, then it shouldn't exist. People arguing otherwise are scumbags. Are there probably unintended consequences or things that need to be adjusted about the law? Probably. But it generally makes sense and there's a reason worker's unions support it. Corporations have taken advantage of contract work to not compensate people fairly (just to help their bottom line and not even pay taxes on it). Not sure why so many people defend these multi-billion dollar corporations. We'd be better off without them. California will be fine.
If contract work is the norm, then the legislators should make laws to protect contract workers and regulate contract work (like in some European countries), but not by defining “employees” arbitrarily.

Theres people who live in cali who are using retail websites like home depot and amazon by selling directly off those sites while telling customers its from their stores with prices marked up and those profits are being given to a different company in another country who dont pay any taxes on that gain then the money is all gone in the us govts eyes. The account owners are then taking that money through “gifts” under 10 k transactions monthly to not have the money audited or flagged as income.. somehow they’re also able to take the sells theyve made online and use that money exchanged as some kind of a non profit business and get tax refunds and all from the govt.. if that aint messed up enough to ya then what if these people were state representatives and the people who are running these types of small business scams also.. when u find out that some of these auditors have salaries of 60-100k but have properties and assets worth millions it kind of makes you wonder but legalities wont let any questions be answered ..
