  • After a fourth grader with autism was arrested last week in the principal's office of his Florida grade school, his mother says her son "didn't know what was going on" when he was thrown in jail. John Benjamin Haygood, 10, was handcuffed and taken from Okeechobee Achievement Academy by two uniformed cops as his stunned mom recorded video of the entire scene on April 12. In the video, her boy kept asking his mom, Luanne, what was going on. #InsideEdition

    When I went to school in the special class for children with autism, the teachers never called the cops when one of the children grew angry. They often called their parents to come and help calm down him/her. THIS was totally unneccesary, and scary for someone with autism. It can be traumatic.

      Hows the kid gonna learn if you dont discipline him with some sort of punishment. Yes it was probably traumatic, and now he will think twice before doing it again.

      Pluto : A kid with autism can't read social cues and often feel uncomfortable with being touched by strangers. You need to approach them in a different way than other kids. Arresting a kid won't do much good even if the kid doesn't have special needs.

      I don't have autism and I had meltdowns as a child, police were never called. Instead I was locked in a tiny room for the rest of the day. The fact that they put handcuffs on a child is disgusting nevermind the fact that he is autistic. I am sickened by the actions of that school

      Yes, very heartbreaking. The mom was right there. Just let her take her son home. He has been traumatized enough. People with autism have no control over their stims and when they meltdown. Police seriously need training or need specialist on the force that can be called in these situations.

    I have an autistic 16yr old step son. he has moderate case. he hit his teacher once and even hit his mother in the face while on abilify meds which caused his outbusts. What the kid did was wrong but still they should be better trained with a better environment.

    Sounds like a kid in my school. Instead he just got suspended for 3 days and the police talked to him about. Nothing happened about being restrained in handcuffs and alone in jail for hours. Thank goodness I don’t live near there.

And when the police came he had NO idea what was going on. I repeat NO idea. so that meant the kid just made a threat he didn’t actually mean and the teacher did not do their job by not asking him if he means it or not. Or they’re lying about all the accusations.

Guarantee he was cursing and raising hell, disrupting other students, throwing a fit to the point he had to be restrained…assistant tried to restrain him, got attacked, got fed up it’s happened so many times, and pressed charges.

      because he autistic and was getting treated differently by that teacher, the teacher traumatized my bother, he pinned my bother down several times and hurting him ofc he's going to say this stuff because this was effecting him and it hurt, it was slef defense plus he autistic he process things different on top of that they arrested at 10 years old for two days at a real jail, he is forever traumatized from this experience, he still hasn't been able to go to a public school to this day

    I have heard much of autism in my school. When they feel attacked(also just a little bit) They come out with very big words and that should they have known.       You couldn’t be more wrong. I love it when people try to sound educated on a topic they know literally nothing about. Autism is such a HUGE spectrum that it’s a case by case basis. Signs of Autism can range from hand clapping (closely associated with the more non verbal side of the spectrum) to only lacking essential social skills. Your response is comedic because you want to sound so uneducated on a topic you wanted to come across as you were well informed on😂

      Last Fall (around October sometime) was when he hit the teacher. His mom pulled him out to be homeschooled. In April (recently) he needed to come back for standardized testing and that's when he was arrested.

      By the way, here for instance we have a particularly telling example of the family’s social media, taken directly from the elder brother’s public account. On which the mother, Luanne Haygood, has also even posted and made acknowledgements. Also very accessible. She has also voiced her extreme pride in this son.

      In case you don't know who Daniel Carver is, he is a white nationalist and former Grand Dragon of the Ku Klux Klan. Real nice family ties. White supremacy. A trait associated with numerous instances of what is called homegrown terrorism. What an influence for a mentally ill child with aggressive and violent tendencies, right? The kid is also undeniably a product of his environment, regardless of any developmental disability.

    I am the mother of a bullied kid. My son became suicidal at 10 years old, yet the only rhetoric I heard from the school was:"everything is fine. He is the only one that has a problem, nobody else complains". I live in a country that does not allow homeschooling so I had no choice but to fight against the school and the system by keeping my child at home. I spent a lot of money to hire lawyers and luckily the child protection also intervened. It took that much to convince the school that my son was victim of bulling. I don't think this is normal.

      Thanks a lot of the message. In few weeks my son turns 15. He has grown up, still struggles with few things but he has become a confident young man with a lot of interests. We changed countries though, to get him away from everything and he had a fresh start.

    A lot of these comments agree with the officers and say the kid can change etc. It could have and might have been an unsafe environment for spectators but he can't. My brother has high-functioning too. You don't know exactly what happened in that classroom or whether the paraprofessional didn't embellish details. Was his IEP followed? Was he provoked into acting that way? Did another kid do something to him? He was in fourth grade. The paraprofessional should not have pressed charges. If she didn't agree with the treatment, she should have called a meeting.

      The fact is the boy, John Benjamin Haygood, had exhibited 55 aggressive and excessively violent incidents at his school alone (not counting the fire his own brother reports in his social media that he set at the family’s home), among which was a premeditated stabbing of another disabled classmate, repeatedly breaking bones with the steel toed boots his mother so thoughtfully bought him, and certainly not the least of which the TWICE HE THREATENED TO RETURN IN THE FUTURE WITH A GUN AND SHOOT PEOPLE DEAD. Altogether that amounted to 5 felony charges. In addition he was raised in a household that harbored white supremacist ideologies, a developing child being a product of his environment regardless of a developmental disability. There is more information available at your fingertips in the form of additional articles, interviews, police, court, and arrest records as well as the family member's own social media from the more than a year since this took place.
      Directly from the report of the initial court appearance citing the Assistant State Attorney :
      "When talking about the incident that led to John Benjamin’s arrest, Mr. Albright said he has been able to document 55 incidents committed by the boy while in the Okeechobee school system. “That’s only physical aggression against the other children or faculty,” he noted. Some of the documented incidents include kicking, biting, spitting and punching. The prosecutor then offered a few specific incidents.
      • On one occasion, the boy kicked a male coach in the groin.
      • The boy punched another student in the face.
      • The boy stabbed another student with a pencil after he had just sharpened it and the pencil went through the other child’s jacket and punctured the skin.
      • The boy intentionally stomped on a female teacher’s foot while wearing steel-toed boots and broke three of her toes. “Then, when she returned to work, he stomped on her same toes and said she deserved it,” said Mr. Albright.
      • On two different occasions John Benjamin told teachers he was going to come back with a gun and kill them."
      Making a determination on the basis of a developmental disability is not at the discretion of the officers, John Benjamin Haygood being as subject to the law as anyone else. The exception being that it is the role of the court to take into account any impact of a disability or disorder, which of course it did. Those other developmentally disabled classmates, as well as those individuals that advocate and intervene on their behalf, who had been victimized by John Benjamin Haygood all have the undeniable rights to press charges in the interests of their safety and well-being. Something that is being too easily dismissed and contributed to by misrepresenting the facts as if they only involved a single incident with one teacher, or rather one para-professional.
      Ultimately the court, as is its role, took his disorders, which behaviors strongly indicate include an oppositional defiant disorder and or a conduct disorder as well as ASD and ADHD, into account and adjudicated him as incompetent. Which provides safeguards that prevent his future access to any firearms, as well as the court assuring there is provision of additional intervention and oversight at his current placement at the Mountaineers School of Autism in West Palm Beach. These safeguards further not requiring any conviction, incarceration in juvenile detention, or any punitive measures. Most importantly preventing a repeat or mirror of circumstances that contributed to the 17 shooting fatalities in relatively nearby Parkland involving Nikolas Cruz, as well instances where others had likewise made good on their threats. Those who had unfortunately not been barred from access to firearms despite histories and circumstances that in hindsight clearly indicated the action was warranted. Those like Adam Lanza, and even James Egan Holmes and Devin Patrick Kelley.

      What they did was enforce a warrant that mommy was well aware of and admitted to in her interview. Wisely they didn't allow mom to get under their skin and get into a power struggle making matters worse.
      The police report as well as the principal make it clear also, as well as Luanne Heygood"s own interview. Faced with the arrest she staid she thought the warrant was no longer outstanding and charges dropped. Though of course, no legal action had taken place and she'd received no notification of this. She just assumed it. Why? Possibly because the nut doesn't fall far from the tree. Before she started recording she went to the principals office confirmed it was still an opened warrant then starting recording. Funny how that works, that you only see what happens in the video after she turns the camera on. The complete interview of Luanne Haygood is on RUclips, as well as articles that interview the principal. and there is a pdf of the police report for John Benjamin Haygood online that all attest to this. If she' been smarter she'd have checked with the principal before returning to the scene of the crimes. The victims of the kids agression have rights to their safety at school too.
      I've already posted a quotes of the 55 incidents of violence to other students and staff, 2 threats of returning to the school with a gun and 5 felony charges straight from the court proceedings.

      if you find charges related to this child, which the mother claims were caused by one of his meltdowns, he has multiple counts of assault against teachers and students, was reported to have said he'd bring a gun to school and kill everyone, and stomped on his teachers toes, breaking three of them. Upon her return to school, he stomped on the same toes and said "she deserved it". He stabbed at other students with pencils and the mother, on top of this, knew there were charges and an arrest warrant for her son. Instead of taking him to the authorities and working it out, she allowed him to be arrested and handled in this manner. Additionally, the court offered he go to a counseling and therapy program and the charges would be dropped. His mother declined this. They were dropped anyways due to him being unfit to stand a trial in his over 60 documented incidents of violence between 2013 and 2016, involving other special needs children. His mother is an enabler and was looking for attention with this case, which ultimately led to him being further traumatized by police and government. Simply because a child is autistic does not mean they should be allowed to endanger people in this manner, including themselves. This child needs counseling, therapy and help. Obviously, either that school is not a good fit for him or his mother is allowing and enabling his behaviors at home, which will make him act in this manner at school.

    This may indicate that he knew that his actions were wrong. The problem that some SST kids have is that their behavior is very bad for emotional or disability reasons but most of the students do know right from wrong.

Where two brothers under the age of ten famously stood accused of murder of a younger child in the “Kevin case”, decided only by a police interrogator with no parents or representatives present. No given right to a trial. Removed to foster care, where because they were only tried in the court of public opinion, never were taken in and ultimately returned to their family anyway. Twenty years of being treated as child murderers later, the the case is reexamined and it arises they were likely innocent, or nowhere near the murder, and exonerated,citing by extreme the tremendous flaws in the Swedish legal system regarding children.

      There seems to be further misconception as to a recognition of the diagnosis of ASD. In fact, even after John Benjamin Haygood had been released from his few hours of custody to his mother, there was still no permanent clinical determination of ASD at that time that had been made. Luanne Haygood even commenting/ blaming everyone but herself in her social media account and subsequent interviews that John Benjamin Haygood’s Social Security benefits had been temporarily terminated, because she and her son failed to attend a scheduled determination hearing. The school likewise at the time recognizing him as having an undetermined mental illness / developmental disability on record, and on that file a post it note stating only that “The mother says he has autism” because a permanent diagnosis had yet to be clinically determined. Likewise to expect the officers to have specifically known he had ASD based on the information that could be confirmed would not be reasonable, and further would have made absolutely no difference in enforcing the warrant to take him into custody. Though even at the subsequent hearings a definitive answer was not forthcoming to the court for the record. It requiring the judge ordering that any confirmation that the boy was indeed autistic that it needed to be presented.
      According to reports of the hearing:
      “The prosecutor also asked Judge Jerald Bryant to require defense attorney Stephanie Langer to present documentation stating her client has been diagnosed as being autistic. At this point, the defense has only filed paperwork with the court stating Haygood has “mental disabilities.” The prosecutor also argued that, without those records: “How can I litigate my case?” Judge Bryant then ruled if the defense has records indicating Haygood has been diagnosed as being autistic, the defense must make them available to the state.”

Anyone with a bit of knowledge about education (even mainstream education) knows this won't teach him anything, just traumatize him. It was months after his outburst, and the reasons for his arrest weren't even stated until it was all over. This is not discipline, it's torture.
      PS: Also this vid doesn't mention him attacking a child, where did you get this from?

      @@quinncreel6091 if you find charges related to this child, which the mother claims were caused by one of his meltdowns, he has multiple counts of assault against teachers and students, was reported to have said he'd bring a gun to school and kill everyone, and stomped on his teachers toes, breaking three of them. Upon her return to school, he stomped on the same toes and said "she deserved it". He stabbed at other students with pencils and the mother, on top of this, knew there were charges and an arrest warrant for her son. Instead of taking him to the authorities and working it out, she allowed him to be arrested and handled in this manner. Additionally, the court offered he go to a counseling and therapy program and the charges would be dropped. His mother declined this. They were dropped anyways due to him being unfit to stand a trial in his over 60 documented incidents of violence between 2013 and 2016, involving other special needs children. His mother is an enabler and was looking for attention with this case, which ultimately led to him being further traumatized by police and government. Simply because a child is autistic does not mean they should be allowed to endanger people in this manner, including themselves. This child needs counseling, therapy and help. Obviously, either that school is not a good fit for him or his mother is allowing and enabling his behaviors at home, which will make him act in this manner at school. His mother was given a chance to get him necessary help to improve his behavior, even given options by the court. She should be facing the brunt of this for neglecting her sons special needs and allowing this to continue happening for years.

      A symptom of his ASD or possibly in light of his household harboring white supremacist ideologies, just his reaction to a black sheriff's deputy? A child regardless of a developmental disability being a product of their environment.
      There's a lot more to this case than this two year old article pridominently citing the mother of an accused felon took note of, much of which I have already posted in a comment. Not the least of which the boy twice threatened to return to his school with a gun and shoot people dead. His school only a 2 hours drive at most from Parkland, where Nikolas Cruz fatally shot 17 and injured just as many.
      Here for instance we have a particularly telling example of the family’s social media, taken directly from the elder brother’s public account. On which the mother, Luanne Haygood, has also even posted and made acknowledgements. Also very accessible. She has also voiced her extreme pride in this son.
      In his complete and unedited quote directly from his social media he says:
      "Avery Haygood September 20, 2016 ·
      I was fortunate enough at work today and able to pay for and serve Mr. Daniel carver and his family! Too bad I was to concentrated on my first impression (which I I did ) to ask for an autograph. Oh well. It still will always be a day Ill remember!"
      In case you don't know who Daniel Carver is, he is a white nationalist and former Grand Dragon of the Ku Klux Klan. Real nice family ties. White supremacy. What an influence for a mentally ill child with aggressive and violent tendencies huh? The kid is also undeniably a product of his environment, regardless of any developmental disability.

    I read more about the story and this child has gone to juvenile detention multiple times and was expelled from the school where this took place and he had to go to court for this. Meanwhile a kid in my school drop kicks a teacher and is not even sent to the principals office.

      educate urself
      but we can have sensory issues and stuff like that, some of us can get extra agitated and maybe he felt threatened even if there was no threat, in his mind there was and he felt like he had to defend himself,.

    I'm autistic and as a child I was taken into police custody like this and it was honestly one of the most traumatizing things I've been through. I really hope the substitute teacher will be investigated because when a child lashes out like this, it's typically because they're being abused by the teacher. I had this happen to me too and I lashed out in the same way. It's so sad how you can see the fear in his eyes, no child should have to ever go through this. He was 10 years old. When will people learn?
