The accused is not having any role in the criminalconspiracy/ activity, rather the accused is falsely implicated by the police in the false case and also the accused in question was trapped by main accused for his achieving malafide motives, can that Co-accused who is shown as VICTIM can get discharged from the Honourable court under Section 227 in The Code Of Criminal Procedure , I will be obliged to you if you could answer my query Regards Gaurav Jain
First of all I am extremely sorry for replying late, Actually today I saw your query.. Is you just that co accused can be discharged or not,, it depends on evidence on record,, If arguments and facts put up before Court and believes that the accused is no involvement in the case then he or she can be discharged
@@laweasyclasses thank you very much Sir for replying, we have filed all the relevant documents that are given in the chargesheet itself , the arguments have been heard by Honourable Judge Mam for the discharge of the concerned accused, now the Prosecutor is yet to argue next
