I am not sure who you spoke with, but unfortunately we are not able to assist with every case and whomever you spoke with during the initial free consultation would have discussed the factors as to why we weren’t able to assist you at this time. If your claim is denied I would encourage you to contact the attorney you spoke with to see what your options would be at that time.

I contacted your firm and sent my denial letter up but I have a question. Could I get unemployment since my STD got denied and now have no income coming in and bills are due. I heard an appeal process can take months which would hurt me financially

Despite the denial of STD benefits, if you have not been terminated by your employer then I am not sure if you would be eligible for unemployment - you would need to make inquiry to the proper department with respect to unemployment. If your employer has terminated you then you can certainly go through the means to apply to see if you are eligible. That being said, if you are pursing the STD benefits please be aware of two things that could impact your claim if your benefits are approved and you receive unemployment: (1) For unemployment you are generally indicating you are ready, willing and able to work, which is in conflict with pursuing disability benefits and some disability carriers will use that against you to deny a claim; (2) if your STD is approved, any money you received from unemployment would be offset by the disability carrier - so they will subtract what you received from unemployment from what they owe you. The majority of the time the second outcome is what happens, but it is important to note the issues of the first situation. Ultimately, you will need to contact your local unemployment office to determine eligibility/application, etc. I have been advised by various people that in light of the COVID pandemic the normal rules of unemployment have changed. So - it doesn’t hurt to try and is worth the call. I hope this helps.
